<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1673</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210518">May 18, 2021</action-date><action-desc><sponsor name-id="S411">Mr. Marshall</sponsor> (for himself and <cosponsor name-id="S398">Mr. Cramer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To preserve access to Federal land, control fires, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H38A74312CF204C86BE44C907AA47DFA7"><section section-type="section-one" id="H79D6084B65844BC781593E2BC36ED9F9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>30 × 30 Termination Act</short-title></quote>.</text></section><section id="idFBDFD32F869C4851A3E3BB53CCCC5B39"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id0C10CBF221234155BC2E3BB6578B9EC8"><enum>(1)</enum><header>Federal land</header><subparagraph id="id52396D3D968142E5BD0B19BF868F9294"><enum>(A)</enum><header>In general</header><text>The term <term>Federal land</term> means—</text><clause id="id75E8925BA6AC432FB05A525A50883615"><enum>(i)</enum><text>National Forest System land;</text></clause><clause id="id1A9BEB8A977D4FC8BC297B1B6C6289C5"><enum>(ii)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)); </text></clause><clause id="id5FE35BD284AB416183F2FE1749AE71BC"><enum>(iii)</enum><text>the outer Continental Shelf (as defined in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>)); and</text></clause><clause id="id80AA7F1DD64E4B9CAE1ED244E764C105"><enum>(iv)</enum><text>Federal land within the Exclusive Economic Zone of the United States, as established by Presidential Proclamation 5030, dated March 10, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref> note). </text></clause></subparagraph><subparagraph id="id4BE61BE1BA5A4D71B7FC4920A2087FA4"><enum>(B)</enum><header>Inclusion</header><text>The term <term>Federal land</term> includes land described in clauses (i) through (iv) of subparagraph (A) for which the rights to the surface estate or subsurface estate are owned by a non-Federal entity.</text></subparagraph></paragraph><paragraph id="idA8ADE176A42F48D7BB83426DDCDF9F62"><enum>(2)</enum><header>Multiple use</header><text>The term <term>multiple use</term> has the meaning given the term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text></paragraph><paragraph id="id579BFC2F48CF448481F423F9ACC2E219" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Principal or major use</header><text>The term <term>principal or major use</term> includes domestic livestock grazing, mineral exploration and production, rights-of-way, timber production, commercial fishing, recreational fishing, hunting, camping, hiking, mountain biking, horseback riding, whitewater rafting, and off-highway vehicle use, and other outdoor recreation. </text></paragraph></section><section id="H2E3D7EBBE27E4D74AA1A9A81FF541950"><enum>3.</enum><header>Revocation of Executive Order relating to Conserving Our Nation's Lands and Waters</header><subsection id="HA64C9E33C83845F3BF8E8EC39054C50D"><enum>(a)</enum><header>In general</header><text>Section 216 of Executive Order 14008 (86 Fed. Reg. 7627; relating to tackling the climate crisis at home and abroad (February 1, 2021)) shall have no force or effect. </text></subsection><subsection id="H07C406922F70429C8D7D4A611E0A8408"><enum>(b)</enum><header>Limitation on funds</header><text>No Federal funds may be used to implement, administer, enforce, or carry out any report or program substantially similar to the report or program required under section 216 of the Executive Order described in subsection (a).</text></subsection></section><section id="HDFBF29889AE044B1A29923733540322A"><enum>4.</enum><header>No net loss of non-Federal land</header><text display-inline="no-display-inline">No Federal funds may be used to acquire non-Federal land within a State or county in which 15 percent or more of the land is managed by a Federal agency, unless the Federal agency proposing the acquisition disposes of an equal amount of Federal land within the State or county in which the non-Federal land is located to ensure no net loss of non-Federal land and taxable acreage during the fiscal year in which the proposed acquisition occurs and subsequent fiscal years as a result of the proposed acquisition.</text></section><section id="HEAEA39DC367D421E98FD8667CEEAF850"><enum>5.</enum><header>No net loss of multiple use</header><text display-inline="no-display-inline">No Federal funds may be used to implement, administer, enforce, or carry out any action on Federal land that results in a net loss of multiple use or any principal or major use within a State, unless the action has been authorized by an Act of Congress.</text></section><section id="id9A547174106945F29C7CB944EFBC6EB7"><enum>6.</enum><header>State and congressional approval required prior to the Federal acquisition of more than 160 acres of non-Federal land</header><text display-inline="no-display-inline">No Federal funds may be used by the head of a Federal agency to acquire more than 160 acres of non-Federal land unless—</text><paragraph id="id39E5D80018D248AEBB483EE8CA2A7B80"><enum>(1)</enum><text display-inline="yes-display-inline">the head of the Federal agency has received from the State in which the non-Federal land is located written notice that the State has enacted legislation approving the proposed acquisition; and </text></paragraph><paragraph id="idff44ad41d086434683519d362b338870"><enum>(2)</enum><text>the proposed acquisition has been authorized by an Act of Congress.</text></paragraph></section><section id="H42049BF491004245B9166DEF27F91BF6"><enum>7.</enum><header>Prohibition on withdrawal</header><text display-inline="no-display-inline">The President may not withdraw any Federal land from forms of entry, appropriation, or disposal under the public land laws, location, entry, and patent under the mining laws, or disposition under laws pertaining to mineral and geothermal leasing or mineral materials unless the withdrawal has been authorized by an Act of Congress.</text></section><section id="H104498D3ED6F48A88DD90B4A4133D6AC"><enum>8.</enum><header>Limitations on declarations of national monuments</header><text display-inline="no-display-inline">Section 320301 of title 54, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE55BAFB5848942EA8561015002F990BD"><subsection id="H76A18F06DE4346A082DC1F7F8192F759"><enum>(e)</enum><header>Limitations on declarations</header><text>A declaration under this section shall not apply to a State or county in which 15 percent or more of the land is managed by a Federal agency.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
