which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, and title 39, United States Code, to provide the United States Postal Service the authority to mail alcoholic beverages, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2667BC66FC864CE5924B9AD1DB843653"><section section-type="section-one" id="H5B658115FBF148B8BCB319D358B21C49"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Postal Service Shipping Equity Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H1F48E3990A934F8281AC73CE07726220"><enum>2.</enum><header>Shipping of alcoholic beverages</header><subsection id="H4787ED8F26D64AA48490DBA4B8829BC5"><enum>(a)</enum><header>Mailability</header><paragraph id="H16F803E1B9B94383B7EF56D7A1600732"><enum>(1)</enum><header>Nonmailable articles</header><text>Section 1716(f) of title 18, United States Code, is amended by striking <quote>mails</quote> and inserting <quote>mails, except to the extent that the mailing is allowable under section 3001(p) of title 39</quote>.</text></paragraph><paragraph id="H7845114C8DC848149125AE968DE822AC"><enum>(2)</enum><header>Alcoholic beverages</header><text>Section 1154(a) of title 18, United States Code, is amended by inserting <quote>or, with respect to the mailing of alcoholic beverages to the extent allowed under section 3001(p) of title 39</quote> after <quote>mechanical purposes</quote>.</text></paragraph></subsection><subsection id="H98055E657A5040D1978FC560DA662D06"><enum>(b)</enum><header>Regulations</header><text>Section 3001 of title 39, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H60191FDBBB5242C2959267D7EE6DDC14"><subsection id="HE5D0257C210B41B4937B2101C875588B"><enum>(p)</enum><header>Shipping of alcoholic beverages</header><paragraph id="H1E1D3A7BDEFE416280F3D9A168791F50"><enum>(1)</enum><header>In general</header><text>Alcoholic beverages shall be considered mailable if mailed—</text><subparagraph id="HF3DDF14E5C8448A5B1CDFE14016530BE"><enum>(A)</enum><text>by a covered entity in accordance with applicable regulations under paragraph (2); and</text></subparagraph><subparagraph id="H011E574C859947CAB29D0C7B3106CA36"><enum>(B)</enum><text display-inline="yes-display-inline">in accordance with the delivery requirements otherwise applicable to a privately carried shipment of an alcoholic beverage in the State, territory, or district of the United States where the addressee or duly authorized agent takes delivery.</text></subparagraph></paragraph><paragraph id="HC8C006CD701042059A95A9B71C98FE1B"><enum>(2)</enum><header>Regulations</header><text>The Postal Service shall prescribe such regulations as may be necessary to carry out this subsection, including regulations providing that—</text><subparagraph id="HABB59D05BDF9461095CB7FB5D471A606"><enum>(A)</enum><text>the mailing shall be by a means established by the Postal Service to ensure direct delivery to the addressee or a duly authorized agent at a postal facility;</text></subparagraph><subparagraph id="H8934D074CCB44F44AC57CF17916DDCC7"><enum>(B)</enum><text>the addressee (and any duly authorized agent) shall be an individual at least 21 years of age, and shall present a valid, government-issued photo identification at the time of delivery;</text></subparagraph><subparagraph id="H4FA7159FA08949EFBA528F48D7FDDA1D"><enum>(C)</enum><text>the alcoholic beverage may not be for resale or other commercial purpose; and</text></subparagraph><subparagraph id="H76A2828D5CF04D7AAF79828E90B10092"><enum>(D)</enum><text>the covered entity involved shall—</text><clause id="H2BAB058229AC4807B6282D04AF49191A"><enum>(i)</enum><text>certify in writing to the satisfaction of the Postal Service, through a registration process administered by the Postal Service, that the mailing is not in violation of any provision of this subsection or regulation prescribed under this subsection; and</text></clause><clause id="H9E9979EF688D45B79D83CBE31C71C24D"><enum>(ii)</enum><text>provide any other information or affirmation that the Postal Service may require, including with respect to the prepayment of State alcoholic beverage taxes.</text></clause></subparagraph></paragraph><paragraph id="H7D53A752E6FE40ED940FB2B2B2AF73C0"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection—</text><subparagraph id="H581C40C90DCC4713BEED80EC1560C536"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>alcoholic beverage</term> has the meaning given the term in section 203 of the Federal Alcohol Administration Act (<external-xref legal-doc="usc" parsable-cite="usc/27/214">27 U.S.C. 214</external-xref>); and</text></subparagraph><subparagraph id="HB10039AD54DE48578B5E1C88303BCD37"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>covered entity</term> means an entity (including a winery, brewery, or beverage distilled spirits plant, or other wholesaler, distributer, importer, or retailer of alcoholic beverages) that has registered with, obtained a permit from, or obtained approval of a notice or an application from, the Secretary of the Treasury pursuant to—</text><clause id="H4F0C0B7DCDD6419DA207F6B20364EB0A"><enum>(i)</enum><text display-inline="yes-display-inline">the Federal Alcohol Administration Act (<external-xref legal-doc="usc" parsable-cite="usc/27/201">27 U.S.C. 201</external-xref> et seq.); or</text></clause><clause id="HE3ADB48A74FD4479BC1221339881CF9E"><enum>(ii)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/51">chapter 51</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/5001">26 U.S.C. 5001</external-xref> et seq.).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HA976DE0625784DEDA36C62BDC8841E9D"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the earlier of—</text><paragraph commented="no" display-inline="no-display-inline" id="H8D32640B980441EC8D9CE2B8FA388614"><enum>(1)</enum><text>the date on which the United States Postal Service prescribes regulations under section 3001(p) of title 39, United States Code, as added by this section; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H39BCEFFC64444FFD8002847648BD0369"><enum>(2)</enum><text>the date that is 2 years after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H9AADAEC1C54F46909C040941851E32C9"><enum>(d)</enum><header>Relation to State, local, and Tribal laws</header><paragraph id="idF4301B6FB550487DAF26EAF93785B9DD"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="idE4F3B45005FF42E588CB0D970D9AE79B"><enum>(A)</enum><text>the term <term>alcoholic beverage</term> has the meaning given the term in section 203 of the Federal Alcohol Administration Act (<external-xref legal-doc="usc" parsable-cite="usc/27/214">27 U.S.C. 214</external-xref>);</text></subparagraph><subparagraph id="idF1E3209AEC274341B531730C5EF0C0BB"><enum>(B)</enum><text>the term <term>Postal Service</term> means the United States Postal Service; and</text></subparagraph><subparagraph id="id0A217A3535A2415D843FDC82DA947050"><enum>(C)</enum><text>the term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, and any other territory or possession of the United States.</text></subparagraph></paragraph><paragraph id="idDE8E9878A1934A0BBFCAB203107EEFE3"><enum>(2)</enum><header>No preemption of State, local, or Tribal laws prohibiting deliveries, shipments, or sales</header><text display-inline="yes-display-inline">Nothing in this section, the amendments made by this section, or any regulation promulgated under this section or the amendments made by this section, shall be construed to preempt, supersede, or otherwise limit or restrict any State, local, or Tribal law that prohibits or regulates the delivery, shipment, or sale of alcoholic beverages.</text></paragraph><paragraph id="H1F139B7B6AD34C8D9FBD4B2507B9E14B"><enum>(3)</enum><header>Liability of Postal Service</header><subparagraph id="id404E6C4339494FE7B7EA8B8779AFF3EB"><enum>(A)</enum><header>Cause of action</header><text display-inline="yes-display-inline">A State, local, or Tribal government may bring a civil action against the Postal Service in an appropriate district court of the United States for a violation of a law of the State, locality, or Indian Tribe, respectively, regarding the sale, mailing, transportation, or importation of alcoholic beverages.</text></subparagraph><subparagraph id="idEE1EA1E95DA543E89A5BA6185A6B8DB3"><enum>(B)</enum><header>Liability</header><text display-inline="yes-display-inline">In an action brought under subparagraph (A), the Postal Service—</text><clause id="id2593837F20C64264B7A2627828207E11"><enum>(i)</enum><text display-inline="yes-display-inline">except as provided in clause (ii), shall be liable in the same manner and to the same extent as a private individual under like circumstances; and</text></clause><clause id="idB1107D05261E460FB3AF476969479BA8"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be liable for—</text><subclause id="idA280298C39EB4CDB8BD0232C91214D1E"><enum>(I)</enum><text display-inline="yes-display-inline">interest prior to judgment; or</text></subclause><subclause id="id966A065E1A3147BF880550FD5FD4CF63"><enum>(II)</enum><text display-inline="yes-display-inline">punitive damages.</text></subclause></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
