Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the National Fab Lab Network, a nonprofit organization consisting of a national network of local digital fabrication facilities providing universal access to advanced manufacturing tools for workforce development, STEM education, developing inventions, creating businesses, producing personalized products, mitigating risks, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H417F8A4C764A41D6B49A177D7DF1DCD8"><section section-type="section-one" id="H9BB9D63B80064ECF9C57884E14CDAB35"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Fab Lab Network Act of 2021</short-title></quote>.</text></section><section id="H6D54BD68457443619521149D3C58AE2F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H9DE497BF1DCA464AA59F21B44EBC0755"><enum>(1)</enum><text>Scientific discoveries and technical innovations are critical to the economic and national security of the United States.</text></paragraph><paragraph id="H406C1EB2D00C4807960088D35007A438"><enum>(2)</enum><text>Maintaining the leadership of the United States in science, technology, engineering, and mathematics will require a diverse population with the skills, interest, and access to tools required to advance these fields.</text></paragraph><paragraph id="H7542E3A810674562A22D87C2CD9E801C"><enum>(3)</enum><text>Just as earlier digital revolutions in communications and computation provided individuals with the internet and personal computers, a digital revolution in fabrication will allow anyone to make almost anything, anywhere.</text></paragraph><paragraph id="H6471FA912BE543249626DF172A85AD71"><enum>(4)</enum><text>These creations include elements of a typical household basket of goods (furnishings, apparel, food production equipment, shelter, transportation, education and communication, recreation, and other goods and services), personal technology, means for personal expression, the production of digital fabrication machinery, community design, and manufacturing capability.</text></paragraph><paragraph id="H8662A9E76E0A45B9B65BC72EE96C4A4A"><enum>(5)</enum><text>The Center for Bits and Atoms of the Massachusetts Institute of Technology (CBA) has contributed significantly to the advancement of these goals through its work in creating and advancing digital fabrication facilities, or <quote>fab labs</quote> in the United States and abroad.</text></paragraph><paragraph id="H116B64611ED6487BA96CA85ED43DC1FE"><enum>(6)</enum><text>Such digital fabrication facilities may include MakerSpaces, Hackerspaces, and other creative spaces that use digital fabrication as a platform for education, innovation, entrepreneurship, personal expression, public access, and social impact.</text></paragraph><paragraph id="HE2D5B8F7E3AF43F3B9C1439121CCFA23"><enum>(7)</enum><text display-inline="yes-display-inline">Such digital fabrication facilities provide a model for a new kind of national laboratory that operates as a network, linking local facilities for advanced manufacturing, providing universal access, cultivating new literacies, and empowering communities.</text></paragraph><paragraph id="HBDF84132C4294D5FA62E1FE22CB7A14E"><enum>(8)</enum><text>The nonprofit Fab Foundation was established to support the growth of the international network of digital fabrication facilities, to amplify the educational, entrepreneurial, and social impacts of digital fabrication facilities, and to support the development of regional capacity building organizations to broaden impact as well as address local, regional, and global challenges through the use of digital fabrication technologies.</text></paragraph><paragraph id="H0666A1AFF4F5485DAE0575F01CA42D2E"><enum>(9)</enum><text>A coordinated array of national public-private partnerships will be the most effective way to accelerate the provision of universal access to this infrastructure for workforce development, science, technology, engineering, and mathematics education, developing inventions, creating businesses, producing personalized products, and mitigating risks.</text></paragraph></section><section id="HA0862A08F7824A24A9A5E27BBAB3AA46"><enum>3.</enum><header>Definition of fab lab</header><text display-inline="no-display-inline">In this Act, the term <term>fab lab</term> means a facility that—</text><paragraph display-inline="no-display-inline" id="HD3052C74A119419B969EEF941D6BF43B"><enum>(1)</enum><text>contains the range of capabilities required to create form and function from digital designs, including—</text><subparagraph id="H2E1488E016F144779F8BF7EAA4311B50"><enum>(A)</enum><text>computer-controlled machines for additive and subtractive fabrication processes;</text></subparagraph><subparagraph id="H14211388DE584743A59F854591BFA589"><enum>(B)</enum><text>tools and components for manufacturing and programming electronic circuits;</text></subparagraph><subparagraph id="H1E966B14A1DC408A89759379B1D23A80"><enum>(C)</enum><text>materials and methods for short-run production; and</text></subparagraph><subparagraph id="H4457EA5D0EE849C3B636C4D8AE0EC498"><enum>(D)</enum><text>workflows for three-dimensional design and digitization; and</text></subparagraph></paragraph><paragraph id="H687F7F2E937B4CF8B8D893B67855CFB5"><enum>(2)</enum><text>is committed to supporting education, innovation, entrepreneurship, personal expression, self-sufficiency, and social impact for its community through digital fabrication.</text></paragraph></section><section id="H62C46241805C4E5F9504F5C6D2C46A8F"><enum>4.</enum><header>Establishment</header><text display-inline="no-display-inline">There is hereby established a nonprofit corporation to be known as the <quote>National Fab Lab Network</quote> (in this Act referred to as the <quote>corporation</quote>), which shall not be an agency or establishment of the United States Government. The corporation shall be subject to the provisions of this Act, and, to the extent consistent with this Act, to the District of Columbia Nonprofit Corporation Act (D.C. Code, section 29–501 et seq.).</text></section><section id="HD3623A5A2EF847F59C2477AFA304C7D9"><enum>5.</enum><header>Goals and activities</header><subsection id="H7DC75618771E47428ACAD13C14C3D565"><enum>(a)</enum><header>Goals</header><text display-inline="yes-display-inline">The goals of the corporation are as follows:</text><paragraph id="HC0F7BA65628E40BA99BE7EBFD685D858"><enum>(1)</enum><text>To provide universal access to digital fabrication.</text></paragraph><paragraph id="idFFD02744C2D641FE997C98D61AD04940"><enum>(2)</enum><text>To foster current and future fab labs.</text></paragraph><paragraph id="HB182C488C75F42BD8FBD8E3309678B59"><enum>(3)</enum><text>To create a national network of connected local fab labs to empower individuals and communities in the United States.</text></paragraph><paragraph id="HAFF92222C84046E99A825A5F5134DEB2"><enum>(4)</enum><text>To foster the use of distributed digital fabrication tools—</text><subparagraph id="H7DFC2248712D44E1B4B4EDA1E1D1D797"><enum>(A)</enum><text>to promote science, technology, engineering and math skills;</text></subparagraph><subparagraph id="HC94DD3B0E17549E0936C9BA68C08F5EE"><enum>(B)</enum><text>to increase invention and innovation;</text></subparagraph><subparagraph id="H703EBF45205549299C10D07A955673F9"><enum>(C)</enum><text>to create businesses and jobs;</text></subparagraph><subparagraph id="H270DA86E21F94132AF84D1A83011936C"><enum>(D)</enum><text>to fulfill personal, professional, and community needs;</text></subparagraph><subparagraph id="HF01F95B28A7149B1B56642B528F5EB1A"><enum>(E)</enum><text>to create value and mitigate harm;</text></subparagraph><subparagraph id="H805211792AAC48D38B478D536670ED66"><enum>(F)</enum><text>to increase self-sufficiency for individuals, households, and communities;</text></subparagraph><subparagraph id="H3452980A82FE421297C1D17484C4A506"><enum>(G)</enum><text>to reduce dependency on global supply chains; and</text></subparagraph><subparagraph id="H383F5630E47F498DA336121D8C079E47"><enum>(H)</enum><text>to align workforce development with new and emerging jobs.</text></subparagraph></paragraph><paragraph id="HD208E14A82FC452191F839872BC51A64"><enum>(5)</enum><text>To provide a platform for education, research, and for catalyzing new methods in science, technology, engineering, and mathematics education, and introducing digital fabrication as an essential new literacy.</text></paragraph><paragraph id="HCEB08234937D4B87B72052D5B3B2D01C"><enum>(6)</enum><text>To create new ways of educating the workforce that will enable workers to compete in a 21st century global marketplace.</text></paragraph></subsection><subsection id="H45B95F3D142245A9AD860C64B12A514D"><enum>(b)</enum><header>Activities</header><text>To attain the goals described in subsection (a), the corporation shall carry out activities, including the following:</text><paragraph id="H6E859F288CEF4C8BAB17278057F934DE"><enum>(1)</enum><text>Seeking, initially, to establish a minimum of one fab lab in each Congressional District.</text></paragraph><paragraph id="H23CBD22A00364180BDE48EDA3F73A218"><enum>(2)</enum><text>Seeking to establish additional labs within the network created under subsection (a)(2), in response to local demand, and to provide guidelines for their sustainable operation.</text></paragraph><paragraph id="H30411866570B48A383658B64BF961CFC"><enum>(3)</enum><text>Linking fab labs into a national network, and promoting further expansion of fab labs across the United States.</text></paragraph><paragraph id="HB7343FD8D380410784E3510D7DD738CD"><enum>(4)</enum><text>Serving as a resource to assist diverse public and private stakeholders with the effective operation of fab labs, and the training of fab lab leaders and mentors.</text></paragraph><paragraph id="H6BFCB806C934492FA9A25D5FA56F5E40"><enum>(5)</enum><text>Maintaining a national registry of fab labs.</text></paragraph><paragraph id="HA2C22127DEEA487DA39F8A99F34A505A"><enum>(6)</enum><text>Providing standards and protocols for connecting fab labs regionally, nationally, and globally.</text></paragraph><paragraph id="id5E410C4F99BC43AEBED4B4E5FA9A5105"><enum>(7)</enum><text>Assisting fab labs in producing fab labs.</text></paragraph></subsection></section><section id="H9BE335A6951A4069A43EFC7A3E6E283A"><enum>6.</enum><header>Membership and organization</header><text display-inline="no-display-inline">Except as provided in this Act, eligibility for membership in the corporation and the rights and privileges of members shall be in accordance with the laws governing tax exempt organizations in the District of Columbia.</text></section><section id="H07D165A9EE304D809D8318775D508BE9"><enum>7.</enum><header>Governing body</header><subsection id="H88D2D6975FF94F93B6DD7ED58B2AB8F5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), directors, officers, and other staff of the corporation, and their powers and duties, shall be in accordance with the laws governing tax exempt organizations in the District of Columbia.</text></subsection><subsection id="HF7D81844722D45F282172E91009850BB"><enum>(b)</enum><header>Board membership</header><paragraph id="H9CDEE45EB1224FA4813C1785EF01E470"><enum>(1)</enum><header>Composition</header><text>The board of the corporation shall be composed of not fewer than 7 members and not more than 15 members.</text></paragraph><paragraph id="HA2BC2CE263FD4EEAA1BC419E33186EC1"><enum>(2)</enum><header>Representation</header><subparagraph id="H9F73A48C2FDF4942A8BCE6582231AB83"><enum>(A)</enum><header>In general</header><text>The membership of the board of the corporation shall collectively represent the diversity of fab labs.</text></subparagraph><subparagraph id="H93A318AA75A64950AB13A1C1408FFDC3"><enum>(B)</enum><header>Requirement</header><text>At a minimum, the board of the corporation shall be composed of members from geographic regions across the United States, Tribal communities, educational and research institutions, libraries, nonprofit and commercial organizations, diverse demographic groups, and the Fab Foundation.</text></subparagraph><subparagraph id="H6745AFE1B30F40AD8C3B2E5D18E3631E"><enum>(C)</enum><header>Individual representation</header><text>An individual member of the board of the corporation may represent more than one board role and additional roles may be added to reflect the diversity of the fab lab ecosystem.</text></subparagraph></paragraph><paragraph id="H8D955FD7A375437099A5F6B2E01E967E"><enum>(3)</enum><header>Selection</header><text>The initial board of the corporation shall be chosen, in consultation with the Fab Foundation and in accordance with paragraph (2)(A), as follows:</text><subparagraph id="H130AF9086AAE4A56BA45ECD7A0536BC7"><enum>(A)</enum><text>Two shall be appointed by the majority leader of the Senate.</text></subparagraph><subparagraph id="H7CAA95C9F903434086922FB444DB970F"><enum>(B)</enum><text>Two shall be appointed by the minority leader of the Senate.</text></subparagraph><subparagraph id="H88A914EE427644CA828E2206357D43D4"><enum>(C)</enum><text>Two shall be appointed by the Speaker of the House of Representatives.</text></subparagraph><subparagraph id="H7009F109EB2F4DD7B782CFEA95CBEB46"><enum>(D)</enum><text>Two shall be appointed by the minority leader of the House of Representatives.</text></subparagraph></paragraph></subsection></section><section id="H8FC7E58B08834C2DA3576CFA1AD10089"><enum>8.</enum><header>Powers</header><text display-inline="no-display-inline">The corporation may—</text><paragraph id="H661708FB8B0E4A1BBBF034864C064DA2"><enum>(1)</enum><text>coordinate the creation of a national network of local fab labs in the United States;</text></paragraph><paragraph id="H2C4D95BF78834B379F75A5590A2AA49A"><enum>(2)</enum><text>issue guidelines for the sustainable operation of fab labs;</text></paragraph><paragraph id="H1CBE1FFA29EA4EB9A6952667D6F6B991"><enum>(3)</enum><text>issue standards and guidelines for fab labs;</text></paragraph><paragraph id="H5871B49CA228409E8FE4A3F65E4A8922"><enum>(4)</enum><text>serve as a resource for organizations and communities seeking to create fab labs by providing information, assessing suitability, advising on the lab lifecycle, and maintaining descriptions of prospective and operating sites;</text></paragraph><paragraph id="HD9C3486556CF45F1AA9125620B6C65A0"><enum>(5)</enum><text>accept funds from private individuals, organizations, government agencies, or other organizations;</text></paragraph><paragraph id="H091AB4C84AF04B1CAD10F3C0EF908159"><enum>(6)</enum><text>distribute funds to other organizations to establish and operate fab labs as members of the corporation;</text></paragraph><paragraph id="HFC80230F6099490292E9E732FF5FB187"><enum>(7)</enum><text>facilitate communication between other organizations seeking to join the corporation with operational entities that can source and install fab labs, provide training, assist with operations, account for spending, and assess impact;</text></paragraph><paragraph id="HA2DF5A063EC04E0D8342664D9D78922C"><enum>(8)</enum><text>communicate the benefits available through membership in the corporation to communities and the public;</text></paragraph><paragraph id="H026E9B46A1F04765A149BCA19E8B1132"><enum>(9)</enum><text>facilitate and participate in synergistic programs, including workforce training, job creation, researching the enabling technology and broader impacts of such programs, and the production of civic infrastructure;</text></paragraph><paragraph id="H5C28F3D1F99B4B2B8B33D2EE94E1DA87"><enum>(10)</enum><text>develop processes and methods to mitigate risks associated with digital fabrication;</text></paragraph><paragraph id="HDB46FD2C47064B8A805AD768C2EB412B"><enum>(11)</enum><text>amend a constitution and bylaws for the management of its property and the regulation of its affairs;</text></paragraph><paragraph id="H76D72C7C7E8C442A9BDF579D98C76E6B"><enum>(12)</enum><text>choose directors, officers, trustees, managers, employees, and agents as the activities of the corporation require;</text></paragraph><paragraph id="H957548FF6C8F4394B0517C2A8A7A2EC4"><enum>(13)</enum><text>make contracts;</text></paragraph><paragraph id="H138AB50A42FE41C0BA8D205B82D711B1"><enum>(14)</enum><text>acquire, own, lease, encumber, and transfer property as necessary or convenient to carry out the purposes of the corporation;</text></paragraph><paragraph id="H941B926027B54055BD1D6BCE8CCD33EB"><enum>(15)</enum><text>borrow money, issue instruments of indebtedness, and secure its obligations by granting security interests in its property;</text></paragraph><paragraph id="H71A396C5E5DF4E85B705482DA3A8114F"><enum>(16)</enum><text>charge and collect membership dues and subscription fees; and</text></paragraph><paragraph id="HA6CB60EB26BE453989DA8FADABAA4A8F"><enum>(17)</enum><text>sue and be sued.</text></paragraph></section><section id="HA526BF7E58BA4EC0B25C94EB579B83C5"><enum>9.</enum><header>Exclusive right to name, term, seals, emblems, and badges</header><text display-inline="no-display-inline">The corporation and its participating digital fabrication labs have the exclusive right to use—</text><paragraph id="H3BD080D6F7994C039B7EF35974E333BB"><enum>(1)</enum><text display-inline="yes-display-inline">the name <quote>National Fab Lab Network</quote>; and</text></paragraph><paragraph id="H99E01DFDCFD84D38BD84C322055201D7"><enum>(2)</enum><text display-inline="yes-display-inline">any seals, emblems, and badges the corporation adopts.</text></paragraph></section><section id="H516EFEE6359346A98C29357D316E0F22"><enum>10.</enum><header>Restrictions</header><subsection id="H1A2D51E4F2CB47FD9931C777156BD84C"><enum>(a)</enum><header>Stock and dividends</header><text>The corporation may not issue securities of any kind or declare or pay a dividend.</text></subsection><subsection id="H999BAA1129884624A8B555AB6A342569"><enum>(b)</enum><header>Distribution of income or assets</header><text>The income or assets of the corporation may not inure to the benefit of, or be distributed to, a director, officer, or member during the life of the corporation under this Act. This subsection does not prevent the payment of reasonable compensation to an officer or reimbursement for actual necessary expenses in amounts approved by the board of directors.</text></subsection><subsection id="H5A7A5587D60145CAB49F211E6457EB56"><enum>(c)</enum><header>Loans</header><text>The corporation may not make a loan to a director, officer, or employee.</text></subsection><subsection id="H61E7A72727C2411683AE6F5D190BCD2A"><enum>(d)</enum><header>Claim of governmental approval or authority</header><text>The corporation may not claim congressional approval or the authority of the United States Government for any of its activities, but may recognize establishment of the corporation pursuant to section 4 of this Act.</text></subsection></section><section id="H6F76EF43F32F4236BB6AE63C655B3DA4"><enum>11.</enum><header>Records and inspection</header><subsection id="H236F32F4B644494D9D97307EB671362A"><enum>(a)</enum><header>Records</header><text display-inline="yes-display-inline">The corporation shall keep—</text><paragraph id="HC84760E42DFC427997EBA269E1A80FAF"><enum>(1)</enum><text>correct and complete records of account;</text></paragraph><paragraph id="H64818BD81579464BB47E04B65FDEDEE7"><enum>(2)</enum><text>minutes of the proceedings of its members, board of directors, and committees having any of the authority of its board of directors; and</text></paragraph><paragraph id="H949CA4E5B64C4CC7A87B4FC1FDE64369"><enum>(3)</enum><text>at its principal office, a record of the names and addresses of its members entitled to vote.</text></paragraph></subsection><subsection id="H243491887177490A9DC46C4241C3ABD8"><enum>(b)</enum><header>Inspections</header><text display-inline="yes-display-inline">A member entitled to vote, or an agent or attorney of the member, may inspect the records of the corporation for any proper purpose, at any reasonable time.</text></subsection></section><section id="H29D21F52301D452A8A9A8AB9DEFFE07A"><enum>12.</enum><header>Annual report</header><text display-inline="no-display-inline">Not less frequently than once each year, the corporation shall submit to Congress, including specifically to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Science, Space, and Technology of the House of Representatives</committee-name>, a report on the activities of the corporation during the prior fiscal year.</text></section></legis-body></bill>
