which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to carry out a highway cost allocation study, and for other purposes.</official-title></form><legis-body><section id="id3D48B3728582440EB248F92CA39D43E2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Highway Cost Allocation Study Act of 2021</short-title></quote>.</text></section><section id="idFA27E4B9A1DB459B9D0A837E272F3201"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id8e25807c15ad4b69b6322a5154e611c0"><enum>(1)</enum><text>the Highway Trust Fund was designed to be self-sustaining by relying on user fees from motorists on the roadways;</text></paragraph><paragraph id="idfd2b40da158242ada065e3be620f4ed5"><enum>(2)</enum><text>however, since 2008, the Highway Trust Fund has experienced a revenue shortfall;</text></paragraph><paragraph id="ide13669fd5ed24d998f3af37e28ad91b2"><enum>(3)</enum><text>Congress has relied on transfers from the general fund of the Treasury to supplement the Highway Trust Fund since that time, undermining the user fee model;</text></paragraph><paragraph id="id0cb6c20faaf2491e9d35cb13d9686585"><enum>(4)</enum><text>the Department of Transportation last completed a highway cost allocation study in 1997; and</text></paragraph><paragraph id="idff2f11bad5d24ad1840e50302e896e39"><enum>(5)</enum><text>the information gained from an updated highway cost allocation study could allow Congress to equitably ensure the long-term solvency of the Highway Trust Fund. </text></paragraph></section><section id="idB28CE6C62EA64BDBAD00D14B9C6AF44D"><enum>3.</enum><header>Highway cost allocation study</header><subsection id="idB30B694E26914D7ABEE753151941F4F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 4 years after the date of enactment of this Act, the Secretary of Transportation (referred to in this section as the <quote>Secretary</quote>), in coordination with State departments of transportation, shall carry out a highway cost allocation study to determine the direct costs of highway use by various types of users. </text></subsection><subsection id="id2173CA1ACB254FA39E9B8116A23EAEFF"><enum>(b)</enum><header>Inclusions</header><text>The study under subsection (a) shall include an examination of—</text><paragraph id="idCAF8B05404B24DA08B25976DFB4936A1"><enum>(1)</enum><text>the Federal costs occasioned in the design, construction, rehabilitation, and maintenance of Federal-aid highways by—</text><subparagraph id="idE4E2516ABAB44A6A83B899093A4AD65E"><enum>(A)</enum><text>the use of vehicles of different dimensions, weights, number of axles, and other specifications; and</text></subparagraph><subparagraph id="id0A3B333F17654B19B1D38F0E8B56BC00"><enum>(B)</enum><text>the frequency of those vehicles in the traffic stream; and</text></subparagraph></paragraph><paragraph id="idD449F2FE2F3B41A1B33C468DBA5218D2"><enum>(2)</enum><text>the proportionate share of the costs described in paragraph (1) that are attributable to each class of highway users.</text></paragraph></subsection><subsection id="idA4A4453122864ADFB82F1CB3F3EED883"><enum>(c)</enum><header>Requirements</header><text>In carrying out the study under subsection (a), the Secretary shall—</text><paragraph id="idFD73E127807A49C994073E1684FEB63B"><enum>(1)</enum><text>ensure that the study examines only direct Federal costs of highway use;</text></paragraph><paragraph id="id164B8E3085944BCF911DFFD8EECC3069"><enum>(2)</enum><text>capture the various driving conditions in different geographic areas of the United States; and</text></paragraph><paragraph id="idF77DED2F0D92478193EBE2751C1A2563"><enum>(3)</enum><text>to the maximum extent practicable, distinguish between costs directly occasioned by a highway user class and costs occasioned by all highway user classes.</text></paragraph></subsection><subsection id="id6D65C50599FB4BE88EBA8B3D9AF2890E"><enum>(d)</enum><header>Reports</header><paragraph id="idA3254E60C57C442290B4249BECDD1E2E"><enum>(1)</enum><header>Interim reports</header><text>Not less frequently than annually during the period during which the Secretary is carrying out the study under subsection (a), the Secretary shall submit to Congress an interim report on the progress of the study.</text></paragraph><paragraph id="idC134F53608554503AC423F79497DCD72" commented="no"><enum>(2)</enum><header>Final report</header><text>On completion of the study under subsection (a), the Secretary shall submit to Congress a final report on the results of the study, including the recommendations under subsection (e). </text></paragraph></subsection><subsection id="id5D33BDD7BA3640DAAFE35BB9A57B6A8C"><enum>(e)</enum><header>Recommendations</header><text>On completion of the study under subsection (a), the Secretary, in coordination with the Secretary of the Treasury, shall develop recommendations for a set of revenue options to fully cover the costs occasioned by highway users, including recommendations for—</text><paragraph id="id5585B2BFB96D4317B51C023F676098C8"><enum>(1)</enum><text>changes to existing revenue streams; and</text></paragraph><paragraph id="id1773427C086A45F190921A7A49948A9C"><enum>(2)</enum><text>new revenue streams based on user fees. </text></paragraph></subsection><subsection id="idFAA57FFF3E0F4D49955EF164F5ECACEE"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as are necessary. </text></subsection></section></legis-body></bill>
