which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Labor Standards Act of 1938 to expand access to breastfeeding accommodations in the workplace, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Urgent Maternal Protections for Nursing Mothers Act</short-title></quote> or the <quote><short-title>PUMP for Nursing Mothers Act</short-title></quote>.</text></section><section id="idb7ab11f9dbe746b5abc8ad30ae77c499"><enum>2.</enum><header>Breastfeeding accommodations in the workplace</header><subsection id="id41b5651722e44223a1a56ef47b121473"><enum>(a)</enum><header>Expanding employee access to break time and space</header><text>The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201</external-xref> et seq.) is amended—</text><paragraph id="id2ac1cfdf86f842aa9cf36fd13b1566f4"><enum>(1)</enum><text>in section 7, by striking subsection (r);</text></paragraph><paragraph id="id94fa3d429fb14dbab97e7736a6b991b7"><enum>(2)</enum><text>in section 15(a)—</text><subparagraph id="idfd9a44ea20d34509a064cf824885555b"><enum>(A)</enum><text>by striking the period at the end of paragraph (5) and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id047804923c664d76b400fcc6696adfb9"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf97ac46d85444605ba2218cf010a6013"><paragraph id="idba47f177ab4d4d419b89f7501251876d"><enum>(6)</enum><text>to violate any of the provisions of section 18D.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idb05ce914c580499d95b1aaca2d9ff122"><enum>(3)</enum><text>in section 16(b), by striking <quote>7(r)</quote> each place the term appears and inserting <quote>18D</quote>; and</text></paragraph><paragraph id="id88d8334b3ba849149d76fee44ffb650c"><enum>(4)</enum><text>by inserting after section 18C the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide0885232cb61413d93f0683406d21d33"><section id="id0b096a91a5eb4902bd7e0d3aa6cddfbc"><enum>18D.</enum><header>Breastfeeding accommodations in the workplace</header><subsection id="ida5eeef4d0ff64ff3ac541a384d02d2e9"><enum>(a)</enum><header>In general</header><text>An employer shall provide—</text><paragraph id="id600c42f367e940e982f597382456e27f"><enum>(1)</enum><text>a reasonable break time for an employee to express breast milk for such employee’s nursing child for 1 year after the child’s birth each time such employee has need to express the milk; and</text></paragraph><paragraph id="idd3b66507061843b5a93583e46fada834"><enum>(2)</enum><text>a place, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public, which may be used by an employee to express breast milk.</text></paragraph></subsection><subsection id="id4fa2bfc3b3e4490aa19a3849a13aa0fd"><enum>(b)</enum><header>Compensation</header><paragraph id="iddfc32a74bdc24baba0f0792926d03d9d"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), an employer shall not be required to compensate an employee receiving reasonable break time under subsection (a)(1) for any time spent during the workday for such purpose unless otherwise required by Federal or State law or municipal ordinance.</text></paragraph><paragraph id="id7030648D1544484F98871F8A8A7F6FB5"><enum>(2)</enum><header>Relief from duties</header><text>Break time provided under paragraph (1) shall be considered hours worked if the employee is not completely relieved from duty during the entirety of such break.</text></paragraph></subsection><subsection id="id97F8AD84E917403EA337CA8514A5CD32"><enum>(c)</enum><header>Exemption</header><text>An employer that employs less than 50 employees shall not be subject to the requirements of this section, if such requirements would impose an undue hardship by causing the employer significant difficulty or expense when considered in relation to the size, financial resources, nature, or structure of the employer’s business.</text></subsection><subsection id="id4673C881EEEC44CF93243CBA8CA6A0C6"><enum>(d)</enum><header>Laws providing greater protection</header><text>Nothing in this section shall preempt a State law or municipal ordinance that provides greater protections to employees than the protections provided for under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idc5097ba7dad2416b9c485f638def0afe"><enum>(b)</enum><header>Clarifying remedies</header><text>Section 16(b) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216(b)</external-xref>) is amended by striking <quote>15(a)(3)</quote> each place the term appears and inserting <quote>7(r) or 15(a)(3)</quote>.</text></subsection></section><section id="id675ca6d99c4f4604a81319bbefc70d2e"><enum>3.</enum><header>Effective date</header><subsection id="id92803546f80d45ec850af58ba0d1e7bf"><enum>(a)</enum><header>Expanding access</header><text>The amendments made by section 2(a) shall take effect on the date that is 120 days after the date of enactment of this Act.</text></subsection><subsection id="id5588e8ef0c1b4b96bd2e8c17c8a53394"><enum>(b)</enum><header>Remedies and clarification</header><text>The amendments made by section 2(b) shall take effect on the date of enactment of this Act. </text></subsection></section></legis-body></bill>
