which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To protect Federal, State, and local public safety officers.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Our Heroes Act of 2021</short-title></quote>.</text></section><section id="id394D893418074BC78FC0D6CB69A19179"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id9AE247E65A0A41DE9D33E70214C9B262"><enum>(1)</enum><text>Law enforcement officers, first responders, and public safety officials risk their lives every day to serve and protect our neighborhoods and communities.</text></paragraph><paragraph id="idF64D3B613B5E408196ADEEC91E8AD8AE"><enum>(2)</enum><text>These men and women are true public servants who regularly sacrifice and encounter grave daily harm.</text></paragraph><paragraph id="idC28A2165ABC14C9EBB405B9A9AD87C31"><enum>(3)</enum><text>The families of law enforcement officers, first responders, and public safety officials also sacrifice and contribute to their roles as guardians of the public good.</text></paragraph><paragraph id="id5652D3C263664BCCAF5C6B177215E63D"><enum>(4)</enum><text>In recent times, it has become apparent that these women and men are being targeted intentionally by criminals in our society.</text></paragraph><paragraph id="id5D7627045FF4494C87A065AA6D75897A"><enum>(5)</enum><text>Congress must do all it can to promote a system of law and order which enables law enforcement officers, first responders, and public safety officials to properly do their jobs.</text></paragraph></section><section id="ide85892a8e74143eb9a72b68d7f352fc1"><enum>3.</enum><header>Protection of public safety officers</header><subsection id="id52c14d2052014d34a61d388d9aa4540a"><enum>(a)</enum><header>Killing of public safety officers</header><paragraph id="id0A1111D4B3F84899ABABCA228B287877"><enum>(1)</enum><header>Offense</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/51">Chapter 51</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="ida079bbb94165476885e61768a832064c" style="USC"><section id="idb9339f6b5b994bb5bd759e00adb14300"><enum>1123.</enum><header>Killing of public safety officers</header><subsection id="idc5c765c54f0b45c39658b5cc750dbfc2"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idfd5ca0c43c6e45e2893ca412de3adef0"><enum>(1)</enum><text>the terms <term>Federal law enforcement officer</term> and <term>United States judge</term> have the meanings given those terms in section 115;</text></paragraph><paragraph id="id5802c327369442c896e8439a4a709302"><enum>(2)</enum><text>the term <term>federally funded public safety officer</term> means a public safety officer or judicial officer for a public agency that—</text><subparagraph id="id50c53bfe1d2d4f6e911b29cca0a0ee2b"><enum>(A)</enum><text>receives Federal financial assistance; and</text></subparagraph><subparagraph id="id6d1913f3853b47d08f2c8dffdb7e4f08"><enum>(B)</enum><text>is an agency of an entity that is a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, or any territory or possession of the United States, an Indian tribe, or a unit of local government of that entity;</text></subparagraph></paragraph><paragraph id="id5a888233b560492698293bd4ec28fbed"><enum>(3)</enum><text>the term <term>firefighter</term> includes an individual serving as an officially recognized or designated member of a legally organized volunteer fire department and an officially recognized or designated public employee member of a rescue squad or ambulance crew;</text></paragraph><paragraph id="id26e269b367f648859aa3e177db785695"><enum>(4)</enum><text>the term <term>judicial officer</term> means a judge or other officer or employee of a court, including prosecutors, court security, pretrial services officers, court reporters, and corrections, probation, and parole officers;</text></paragraph><paragraph id="idb279bc2607744196992a91c03afae38d"><enum>(5)</enum><text>the term <term>law enforcement officer</term> means an individual, with arrest powers, involved in crime or juvenile delinquency control or reduction or enforcement of the laws;</text></paragraph><paragraph id="id04f22513ce1b4a318fcac9e6f0fe743d"><enum>(6)</enum><text>the term <term>public agency</term> includes a court system, the National Guard of a State to the extent the personnel of that National Guard are not in Federal service, and the defense forces of a State authorized by section 109 of title 32; and</text></paragraph><paragraph id="ide4d321a2aa074112bb57a6b441ae1293"><enum>(7)</enum><text>the term <term>public safety officer</term> means an individual serving a public agency in an official capacity, as a law enforcement officer, as a firefighter, as a chaplain, or as a member of a rescue squad or ambulance crew.</text></paragraph></subsection><subsection id="id861d7bb2c2e34a02882dd0703bb0192a"><enum>(b)</enum><header>Offense</header><paragraph id="id5358902795D445E6A6061C668B6C1896"><enum>(1)</enum><header>In general</header><text>It shall be unlawful for any person to, in any circumstance described in paragraph (2), kill, or attempt or conspire to kill, a current or former judicial officer or public safety officer, while the officer is engaged in official duties, or on account of past performance of official duties. </text></paragraph><paragraph id="idA495BC8DD5AB457EB082EDBF26AE7620"><enum>(2)</enum><header>Circumstances described</header><text>For purposes of paragraph (1), a circumstance described in this paragraph is—</text><subparagraph id="idd909e1ef4adc49779ca58aab99d6231b"><enum>(A)</enum><text>the conduct described in paragraph (1) occurs during the course of, or as the result of, the travel of the defendant or the victim—</text><clause id="idbf18eb63a21b4e18a32ecc12bb80a76c"><enum>(i)</enum><text>across a State line or national border; or</text></clause><clause id="id9f9568aad1f04f7db6bc5bbe0ac087c9"><enum>(ii)</enum><text>using a channel, facility, or instrumentality of interstate or foreign commerce;</text></clause></subparagraph><subparagraph id="id85f48ef2a9134682a09d24c98b5d4238"><enum>(B)</enum><text>the defendant uses a channel, facility, or instrumentality of interstate or foreign commerce in connection with the conduct described in paragraph (1);</text></subparagraph><subparagraph id="id5dea4040f41d42abb04664db119a4bbb"><enum>(C)</enum><text>in connection with the conduct described in paragraph (1), the defendant employs a firearm, dangerous weapon, explosive or incendiary device, or other weapon that has traveled in interstate or foreign commerce;</text></subparagraph><subparagraph id="id977b41803b5b4bfdbda7acb61a05aed1"><enum>(D)</enum><text>the conduct described in paragraph (1)—</text><clause id="idbf90483f78a643579ef0236231704d5d"><enum>(i)</enum><text>interferes with commercial or other economic activity in which the victim is engaged at the time of the conduct; or</text></clause><clause id="idfb2ec7424b6e4ec38d56a372b33667a9"><enum>(ii)</enum><text>otherwise affects interstate or foreign commerce; or</text></clause></subparagraph><subparagraph id="ida1a6c1cf0fd449f1a5d9bc40f24c69b6"><enum>(E)</enum><text>the victim is—</text><clause id="idF38D4A0E37EC4542A21F42E1908F6274"><enum>(i)</enum><text>a Federal law enforcement officer; </text></clause><clause id="id82AD1A79B4E64E93B83CB56E24427A42"><enum>(ii)</enum><text>a United States judge; or</text></clause><clause id="id1A77B8FDA2384C5F8BA68B37FE970CAD"><enum>(iii)</enum><text> a federally funded public safety officer. </text></clause></subparagraph></paragraph></subsection><subsection id="id8c9c183470c548f4ade20e5b0864ab27"><enum>(c)</enum><header>Penalty</header><paragraph id="id9CB5A2930A7F4BA2879065D5486BCA4F"><enum>(1)</enum><header>In general</header><text>Any person that violates subsection (b) shall be fined under this title and imprisoned for not less than 10 years or for life, or, if death results, shall be sentenced to not less than 30 years and not more than life, or may be punished by death.</text></paragraph><paragraph id="id6F28BE8F5EAD43E5B96235FDA855A211"><enum>(2)</enum><header>Directive to Commission</header><subparagraph id="id47DEF0742384496788AA009FA5846B60"><enum>(A)</enum><header>In general</header><text>Pursuant to section 994 of title 28, the United States Sentencing Commission shall promulgate guidelines or amend existing guidelines to provide sentencing enhancements of not less than 5 offense levels for offenses where the finder of fact at trial determines beyond a reasonable doubt that in the commission of a violation of subsection (b), the defendant lures the victim to a location for the purpose of killing, or attempting to kill, the victim.</text></subparagraph><subparagraph id="id2A04341A20DA46BC8A2FBB60E97112B9"><enum>(B)</enum><header>Requirement</header><text>In carrying out this paragraph, the United States Sentencing Commission shall assure reasonable consistency with other guidelines, avoid duplicative punishments for substantially the same offense, and take into account any mitigating circumstances which might justify exceptions.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id8df7e9df286d4ebb9c632872bc30d725"><enum>(2)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/51">chapter 51</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block id="id9daee950-9dbe-4a47-b8bd-c5cccc05f5fd" style="USC"><toc><toc-entry idref="idb9339f6b5b994bb5bd759e00adb14300" level="section">1123. Killing of public safety officers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id757B85A57D374F79BC32F873B24C9EE1"><enum>(b)</enum><header>Assault of public safety officers</header><paragraph commented="no" id="id0D086BEDF29C4A2181CB9365A495DAC4"><enum>(1)</enum><header>Offense</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">Chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id4A22D4F9939F44E6A2C8B856D554B68F" style="USC"><section id="id393a6d206b8d42849b50249fed43dd83"><enum>120.</enum><header>Assaults of public safety officers</header><subsection id="idb33a39c6b28940559fd411a92b79510c"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id36EC56A0C1DE4669AE93F34D775875BF"><enum>(1)</enum><text>the term <term>federally funded public safety officer</term> means a public safety officer or judicial officer for a public agency that—</text><subparagraph id="idE5701DD1744A4F8084429989ACDB634C"><enum>(A)</enum><text>receives Federal financial assistance; and</text></subparagraph><subparagraph id="idF1437C6E74744219A25903EC8CD9FACA"><enum>(B)</enum><text>is an agency of an entity that is a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, or any territory or possession of the United States, an Indian tribe, or a unit of local government of that entity;</text></subparagraph></paragraph><paragraph id="idEF75BD41E8B1408CAE7BBBDF261C58F8"><enum>(2)</enum><text>the term <term>firefighter</term> includes an individual serving as an officially recognized or designated member of a legally organized volunteer fire department and an officially recognized or designated public employee member of a rescue squad or ambulance crew;</text></paragraph><paragraph id="id62E4DB35085542C9A2DCB563FF96F4B6"><enum>(3)</enum><text>the term <term>judicial officer</term> means a judge or other officer or employee of a court, including prosecutors, court security, pretrial services officers, court reporters, and corrections, probation, and parole officers;</text></paragraph><paragraph id="id7750DD94B8F94A21876734BFDE68DB73"><enum>(4)</enum><text>the term <term>law enforcement officer</term> means an individual, with arrest powers, involved in crime or juvenile delinquency control or reduction or enforcement of the laws;</text></paragraph><paragraph id="id3ABC1B96529D47FBB7A044EC298D7350"><enum>(5)</enum><text>the term <term>public agency</term> includes a court system, the National Guard of a State to the extent the personnel of that National Guard are not in Federal service, and the defense forces of a State authorized by section 109 of title 32; and</text></paragraph><paragraph id="id189A821E25CE45B7BF371664E9A4D762"><enum>(6)</enum><text>the term <term>public safety officer</term> means an individual serving a public agency in an official capacity, as a law enforcement officer, as a firefighter, as a chaplain, or as a member of a rescue squad or ambulance crew.</text></paragraph></subsection><subsection id="id0C063BB91106420BB13410099EF75450"><enum>(b)</enum><header>Offense</header><paragraph id="id30AF74F3BB3949AB8C389C9252D254D5"><enum>(1)</enum><header>In general</header><text>It shall be unlawful, in any circumstance described in paragraph (2), to assault, or attempt to assault, a current or former judicial officer or public safety officer, while the officer is engaged in official duties, or on account of past performance of official duties.</text></paragraph><paragraph id="idABD6F80D9A124A0282C981C0E1483770"><enum>(2)</enum><header>Circumstances described</header><text>For purposes of paragraph (1), a circumstance described in this paragraph is—</text><subparagraph id="id0837C969C6FE4B389A66B79438925FDD"><enum>(A)</enum><text>the conduct described in paragraph (1) occurs during the course of, or as the result of, the travel of the defendant or the victim—</text><clause id="idDAE8C4B7D20B477DB2D6C449F45D2A2E"><enum>(i)</enum><text>across a State line or national border; or</text></clause><clause id="idD1820CA886C64D3CAC5A797D943F2331"><enum>(ii)</enum><text>using a channel, facility, or instrumentality of interstate or foreign commerce;</text></clause></subparagraph><subparagraph id="idBF9026906D34490E93433F3069D170AE"><enum>(B)</enum><text>the defendant uses a channel, facility, or instrumentality of interstate or foreign commerce in connection with the conduct described in paragraph (1);</text></subparagraph><subparagraph id="idAF4CA55F5DBB4DAA9700DA161C3F1A0D"><enum>(C)</enum><text>in connection with the conduct described in paragraph (1), the defendant employs a firearm, dangerous weapon, explosive or incendiary device, or other weapon that has traveled in interstate or foreign commerce;</text></subparagraph><subparagraph id="id8B226ABDE1444C799F2ACCBA83DABEDB"><enum>(D)</enum><text>the conduct described in paragraph (1)—</text><clause id="idEB023319C10B43BF8FC62843A0319A9D"><enum>(i)</enum><text>interferes with commercial or other economic activity in which the victim is engaged at the time of the conduct; or</text></clause><clause id="idC4CB68E9B4254806A0FE265A2B3B88F4"><enum>(ii)</enum><text>otherwise affects interstate or foreign commerce; or</text></clause></subparagraph><subparagraph id="id21EE133B0CB1401696D1D60F48254E39"><enum>(E)</enum><text>the victim is—</text><clause id="id482FDAAEC2264E91B0753EDEB1497BAC"><enum>(i)</enum><text>a Federal law enforcement officer; </text></clause><clause id="idEB24D23C00F6466D9235C672954DEF1F"><enum>(ii)</enum><text>a United States judge; or</text></clause><clause id="id97D2CAE505284B698D13292841BD8F56"><enum>(iii)</enum><text> a federally funded public safety officer. </text></clause></subparagraph></paragraph></subsection><subsection id="id076AE29B4C1E4A4C9CB1262320F9ED38"><enum>(c)</enum><header>Penalty</header><paragraph id="id45CFE359C0814338BAFAC0B93E5304F7"><enum>(1)</enum><header>In general</header><text>Any person that violates subsection (b) shall be subject to a fine under this title and—</text><subparagraph id="id7c3024f7776c426f836a389dc0b5d16b"><enum>(A)</enum><text>if the assault resulted in bodily injury (as defined in section 1365), shall be imprisoned not less than 2 years and not more than 10 years;</text></subparagraph><subparagraph id="id044d55e4609c4334840c133410aa35f9"><enum>(B)</enum><text>if the assault resulted in substantial bodily injury (as defined in section 113), shall be imprisoned not less than 5 years and not more than 20 years;</text></subparagraph><subparagraph id="id40aabb63f6a5412f9a17ba19eef05d3d"><enum>(C)</enum><text>if the assault resulted in serious bodily injury (as defined in section 1365), shall be imprisoned for not less than 10 years;</text></subparagraph><subparagraph id="id764b57a570744be39b5698c150011fb4"><enum>(D)</enum><text>if a deadly or dangerous weapon was used during and in relation to the assault, shall be imprisoned for not less than 20 years;
