<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1649</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210513">May 13, 2021</action-date><action-desc><sponsor name-id="S384">Mr. Tillis</sponsor> (for himself, <cosponsor name-id="S287">Mr. Cornyn</cosponsor>, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, <cosponsor name-id="S381">Mr. Rounds</cosponsor>, and <cosponsor name-id="S383">Mr. Sullivan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 3606 of title 18, United States Code, to grant probation officers authority to arrest hostile third parties who obstruct or impede a probation officer in the performance of official duties. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idCC75714632D9451BA8C2F3A0017F1556"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Probation Officer Protection Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="idA743AF484AB548FDAD87FE39DEE377F6"><enum>2.</enum><header>Authority of probation officers</header><subsection id="idE77E276CAC9643B0B6687D468F432467"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3606 of title 18, United States Code, is amended—</text><paragraph id="idAD06BF97AC964CD0B690AC0493D31CD1"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="USC">and return of a probationer</header-in-text></quote> and by inserting <quote><header-in-text level="section" style="USC">authority of probation officers</header-in-text></quote>;</text></paragraph><paragraph id="id21B9E2F4B90C498FB2E4C2EAB78B6C2F"><enum>(2)</enum><text>by striking <quote>If there</quote> and inserting <quote>(a) If there</quote>; and</text></paragraph><paragraph id="id95298776B7E24388A7B9123116D41F50"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id095693EBBF6C47A9B95CB47720659DA4"><subsection id="id697893852F994140BD2FFD767CDFBC98"><enum>(b)</enum><text>A probation officer, while in the performance of his or her official duties, may arrest a person without a warrant if there is probable cause to believe that the person has forcibly assaulted, resisted, opposed, impeded, intimidated, or interfered with the probation officer, or a fellow probation officer, in violation of section 111. The arrest authority described in this subsection shall be exercised under such rules and regulations as the Director of the Administrative Office of the United States Courts shall prescribe.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id917D8FB4ACB648C5A73D8F73DEB80D8E"><enum>(b)</enum><header>Table of sections</header><text>The table of sections for subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/229">chapter 229</external-xref> of title 18, United States Code, is amended by striking the item relating to section 3606 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id318E1D28A62D47B0A436CA8D2854281A"><toc><toc-entry bold="off" level="section">3606.
