which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To address the workforce needs of the telecommunications industry.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id443EFCF9BF1346F580D15F8F57FE7F4C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telecommunications Skilled Workforce Act</short-title></quote>.</text></section><section commented="no" id="idC5F514BBE55441E7ADAE6E51E88A8BA4"><enum>2.</enum><header>Telecommunications interagency working group</header><subsection commented="no" id="id2A1F4101E16E48F9AB04F452AF7A13C8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part I of title III of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2A7CD2E343634EA89EA579C5F3600D21"><section id="idF4A97610D3E5413DAA8DF91607AFF838"><enum>344.</enum><header>Telecommunications interagency working group</header><subsection id="id927FD9FCDE5E4289B7ED7879AAD97AB2"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id59A5284ED9774F858CCD549557C8B7CC"><enum>(1)</enum><header>5G</header><text>The term <term>5G</term>, with respect to wireless infrastructure and wireless technology, means fifth-generation wireless infrastructure and wireless technology. </text></paragraph><paragraph id="id92100BC3466644F69C4DB1436E420015"><enum>(2)</enum><header>Rural area</header><text>The term <term>rural area</term> means any area other than—</text><subparagraph id="idD226794ECA3B4337A6C498374F5C0566"><enum>(A)</enum><text>a city, town, or incorporated area that has a population of more than 20,000 inhabitants; or</text></subparagraph><subparagraph id="id5DD989050CE1436683237B0CFACF07B2"><enum>(B)</enum><text>an urbanized area adjacent to a city or town that has a population of more than 50,000 inhabitants.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id63DE61A0E6D04D33A80E588C0506E76B"><enum>(3)</enum><header>Telecommunications interagency working group</header><text>The term <term>telecommunications interagency working group</term> means the interagency working group established under subsection (b).</text></paragraph></subsection><subsection commented="no" id="id3CC4542AED834D0B8816BD265178CAC7"><enum>(b)</enum><header>Establishment</header><text>Not later than 60 days after the date of enactment of this section, the Chairman of the Commission, in consultation with the Secretary of Labor, shall establish within the Commission an interagency working group to develop recommendations to address the workforce needs of the telecommunications industry.</text></subsection><subsection id="id5b464583225044538768f8d0008a882d"><enum>(c)</enum><header>Duties</header><text>In developing recommendations under subsection (b), the telecommunications interagency working group shall—</text><paragraph id="id016e917e47164b1b9fae6a31dcdb8f37"><enum>(1)</enum><text>determine whether, and if so how, any Federal laws (including regulations), guidance, policies, or practices, or any budgetary constraints, inhibit institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) or for-profit businesses from establishing, adopting, or expanding programs intended to address the workforce needs of the telecommunications industry, including the workforce needed to build and maintain the 5G wireless infrastructure necessary to support 5G wireless technology;</text></paragraph><paragraph id="idb1b2b46cfddd4e039c9816565eb57ee8"><enum>(2)</enum><text>identify potential policies and programs that could encourage and improve coordination among Federal agencies, between Federal agencies and States, and among States, on telecommunications workforce needs;</text></paragraph><paragraph id="idd416019023af43a38d1fcadea388d981"><enum>(3)</enum><text>identify ways in which existing Federal programs, including programs that help facilitate the employment of veterans and military personnel transitioning into civilian life, could be leveraged to help address the workforce needs of the telecommunications industry;</text></paragraph><paragraph id="id40d56e53e9e54cc9bfb97f4ffdf13b05"><enum>(4)</enum><text>identify ways to encourage individuals and for-profit businesses to participate in qualified industry-led workforce development programs, including the Telecommunications Industry Registered Apprenticeship Program;</text></paragraph><paragraph id="ide2273e98241a427194baf29a190298be"><enum>(5)</enum><text>identify ways to improve recruitment in qualified industry-led workforce development programs, including the Telecommunications Industry Registered Apprenticeship Program and other industry-recognized apprenticeship programs; and</text></paragraph><paragraph id="id2ebff9517158427695d0e169786d11e0"><enum>(6)</enum><text>identify Federal incentives that could be provided to institutions of higher education, for-profit businesses, State workforce development boards established under section 101 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>), or other relevant stakeholders to establish or adopt programs, or expand current programs, to address the workforce needs of the telecommunications industry, including such needs in rural areas.</text></paragraph></subsection><subsection id="idacf023e902954be9a75c4cefc7aac8c6"><enum>(d)</enum><header>Members</header><text>The telecommunications interagency working group shall be composed of representatives of such Federal agencies and relevant non-Federal industry stakeholder organizations as the Chairman of the Commission, in consultation with the Secretary of Labor, considers appropriate, including—</text><paragraph id="id115350527d934b0588555daed4394d35"><enum>(1)</enum><text> a representative of the Department of Education, appointed by the Secretary of Education;</text></paragraph><paragraph id="id91e15d90bb49420e93ca00b8fbf473a8"><enum>(2)</enum><text>a representative of the National Telecommunications and Information Administration, appointed by the Assistant Secretary of Commerce for Communications and Information;</text></paragraph><paragraph id="id89a157db61a649898b7a882c6d18bdd7"><enum>(3)</enum><text>a representative of the Department of Commerce, appointed by the Secretary of Commerce;</text></paragraph><paragraph id="idba6c8d4f4c344307b03c9749a6ba9e38"><enum>(4)</enum><text>a representative of the Commission, appointed by the Chairman of the Commission;</text></paragraph><paragraph id="idb0a6d9b6a7c549e0b01a31de4f9a34ba"><enum>(5)</enum><text>a representative of the Telecommunications Industry Registered Apprenticeship Program, appointed by the Secretary of Labor;</text></paragraph><paragraph id="id205A7E902B7549F19D260914147DCA1E"><enum>(6)</enum><text>a representative of a telecommunications industry association, appointed by the Chairman of the Commission;</text></paragraph><paragraph id="id7891f632c546402fa83f25296b172811"><enum>(7)</enum><text>a representative of an Indian Tribe or Tribal organization, appointed by the Secretary of Labor;</text></paragraph><paragraph id="id9914fdda6b8c4a8595cd064e550de179"><enum>(8)</enum><text>a representative of a rural telecommunications carrier, appointed by the Chairman of the Commission;</text></paragraph><paragraph id="ide0d0383330944b2998d37f25467cf63e"><enum>(9)</enum><text>a representative of a telecommunications contractor firm, appointed by the Chairman of the Commission;</text></paragraph><paragraph id="id3fd70e8bb2424adf9376a23cec0615d7"><enum>(10)</enum><text>a representative of a minority institution (as defined in section 365 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067k">20 U.S.C. 1067k</external-xref>)), appointed by the Secretary of Education; and</text></paragraph><paragraph id="id1BE126B2D98F4B7BA9D87CA5151C847A"><enum>(11)</enum><text>a representative of a labor organization, appointed by the Secretary of Labor.</text></paragraph></subsection><subsection id="idA60BEFC5D3D9418495344A752393F4A2"><enum>(e)</enum><header>No compensation</header><text>A member of the telecommunications interagency working group shall serve without compensation.</text></subsection><subsection id="id22c213ad21004fa984cb6b100305b368"><enum>(f)</enum><header>Report to Congress</header><text>Not later than 180 days after the date on which the telecommunications interagency working group is established, the working group shall submit a report containing recommendations to address the workforce needs of the telecommunications industry to—</text><paragraph id="idCBAC9E3217CA4B7C9CA00BC743B33977"><enum>(1)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></paragraph><paragraph id="idEF6C5709CEFE471C98F29220CE8270AB"><enum>(2)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></paragraph><paragraph id="id0B0F2C02452B4ADEAAE93589460FAAAD"><enum>(3)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></paragraph><paragraph id="idA13D638A7518455C961A22ED667C68EC" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>the Committee on Education and Labor of the House of Representatives.</text></paragraph></subsection><subsection id="id2A3B26B9798C4831816A41CADCC83DFC"><enum>(g)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the telecommunications interagency working group.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id020332E2D23D487ABD6123AC40C715D5"><enum>(b)</enum><header>Sunset</header><text>Section 344 of the Communications Act of 1934, as added by subsection (a), shall be repealed on the day after the date on which the interagency working group established under subsection (b) of that section submits the report to Congress under subsection (f) of that section.</text></subsection></section><section id="id414848aaa2b0418494df220cbcd62d56"><enum>3.</enum><header>Telecommunications workforce guidance</header><text display-inline="no-display-inline"> Not later than 270 days after the date of enactment of this Act, the Chairman of the Federal Communications Commission, in consultation with the Secretary of Labor, shall establish and issue guidance on how States can address the workforce needs of the telecommunications industry, including guidance on how a State workforce development board established under section 101 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>) can— </text><paragraph id="id35e567dd911e4620b2069641e5af59d9"><enum>(1)</enum><text>utilize Federal resources available to States to meet the workforce needs of the telecommunications industry; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcf0fdcd01fd84519964799a3c2ab22bf"><enum>(2)</enum><text>promote and improve recruitment in qualified industry-led workforce development programs, including the Telecommunications Industry Registered Apprenticeship Program.</text></paragraph></section><section id="id1f21e034ea0f40ee9b3b5ed00d88e01c"><enum>4.</enum><header>GAO assessment of workforce needs of the telecommunications industry</header><subsection id="id9E0035CE815345FA95BB3988A79553C8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id56A7662C8E2F44BBABC55D2B33D41B0D"><enum>(1)</enum><header>5G</header><text>The term <term>5G</term>, with respect to wireless infrastructure and wireless technology, means fifth-generation wireless infrastructure and wireless technology. </text></paragraph><paragraph id="id7BB44205D922491EB457EC2831F22F29"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="idDD2D334F58EE4A84926D221409F7517C"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph><subparagraph id="id3C2A687279F943C88B05BD11E3B821C4"><enum>(B)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></subparagraph><subparagraph id="idD58675E7E3B84046A8142ADEB902EF34"><enum>(C)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph><subparagraph id="idE2D72A5F9EDD48E38D73F5CEC069F8DC" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>the Committee on Education and Labor of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id66D20B1D8F214CDF86A58C8E3AEC3D62"><enum>(3)</enum><header>Broadband infrastructure</header><text>The term <term>broadband infrastructure</term> means any buried, underground, or aerial facility, and any wireless or wireline connection, that enables users to send and receive voice, video, data, graphics, or any combination thereof.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1036180CC1E048D09E0BF316CAE61F11"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall submit to the appropriate congressional committees a report that estimates the number of skilled telecommunications workers that will be required to build and maintain—</text><paragraph id="id3B9AC93AE5DC46E4AD94DB42B9AF0378"><enum>(1)</enum><text>broadband infrastructure in rural areas; and</text></paragraph><paragraph id="id247F3BD750E94D79A9D6482F557C434B"><enum>(2)</enum><text display-inline="yes-display-inline">the 5G wireless infrastructure needed to support 5G wireless technology.</text></paragraph></subsection></section></legis-body></bill>
