<official-title>To impose certain measures with respect to Hizballah-dominated areas in Lebanon and to impose sanctions with respect to senior foreign political figures in Lebanon supporting Hizballah.</official-title>

<section section-type="section-one" id="HCD036D969B58427A839B1F8A488AF34A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hizballah Money Laundering Prevention Act of 2021</short-title></quote>. </text></section> <section id="HB1A71FA5EB524D0A92E37F679212CE82"><enum>2.</enum><header>Measures with respect to Hizballah-dominated areas in Lebanon</header> <subsection id="H084EA581FB50473EABBB3F6B667290AC"><enum>(a)</enum><header>Determination regarding jurisdictions of Lebanon</header> <paragraph id="H6FB8A26DB237485FA3864F0B14B1970B"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of the Treasury shall determine, under section 5318A of title 31, United States Code, whether reasonable grounds exist for concluding that any of the jurisdictions of Lebanon described in paragraph (2) are jurisdictions of primary money laundering concern.</text></paragraph>
<paragraph id="H38FEA6CB5BF8432E952429D99A4EC03F"><enum>(2)</enum><header>Jurisdictions described</header><text>The jurisdictions of Lebanon described in this paragraph are the following:</text> <subparagraph id="HA6C882BC19384FD783D69E112688520F"><enum>(A)</enum><text display-inline="yes-display-inline">The Nabatieh Governorate.</text></subparagraph>
<subparagraph id="H456680A1F2E449E982D3EBFA9AB07F55"><enum>(B)</enum><text>The Haret Hreik municipality in the Baabda district in the Dahieh suburbs south of Beirut.</text></subparagraph> <subparagraph id="H6BC649675BB34692A580E8F33684940D"><enum>(C)</enum><text>The Chiyah municipality in the Baabda district in the western suburbs of Beirut.</text></subparagraph>
<subparagraph id="HAB5AD0DF9926434F86F2ED49B5994778"><enum>(D)</enum><text>The Hadeth Beirut municipality in the Baabda district in the suburbs of Beirut.</text></subparagraph> <subparagraph id="HE9D6474C08554792920C963B14DF2587"><enum>(E)</enum><text>The Hermel district in the Baalbek-Hermel Governorate.</text></subparagraph>
<subparagraph id="HEBF66479AE904E52B6C61036F464D17E"><enum>(F)</enum><text>The Baalbek and Temnin el-Foka municipalities in the Baalbe-Hermel Governorate.</text></subparagraph> <subparagraph id="H4D8240D273044B9BAA5AEF45C0D605EC"><enum>(G)</enum><text>The Tyre district in the South Governorate.</text></subparagraph></paragraph></subsection>
<subsection id="H7108616A691145F78365DED0CBBA613D"><enum>(b)</enum><header>Prohibitions or conditions on opening or maintaining certain correspondent or payable-Through accounts</header><text display-inline="yes-display-inline">If the Secretary of the Treasury determines under subsection (a) that reasonable grounds exist for concluding that any jurisdiction described in that subsection (a) is a jurisdiction of primary money laundering concern, the Secretary, in consultation with the Federal functional regulators (as defined in section 509 of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6809">15 U.S.C. 6809</external-xref>)), shall impose the special measures described in section 5318A(b)(5) of title 31, United States Code, with respect to the Central Bank of Syria.</text></subsection> <subsection id="H975091A9C0D941DDAF93BF0966654EA3"><enum>(c)</enum><header>Report required</header> <paragraph id="H8CA6E86E58F1453A83795801A2325FCD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after making a determination under subsection (a) with respect to whether a jurisdiction is a jurisdiction of primary money laundering concern, the Secretary of the Treasury shall submit to the appropriate congressional committees a report that includes the reasons for the determination.</text></paragraph>
<paragraph id="H32A1A36C9D224EEE86BB5DCEE57BB42B"><enum>(2)</enum><header>Form</header><text>A report required by paragraph (1) shall be submitted in unclassified form but may include a classified annex.</text></paragraph> <paragraph id="HD06114EC9B1347B99E2DB9D5E83268D7"><enum>(3)</enum><header>Appropriate congressional committees defined</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text>
<subparagraph id="H1B5A9A5C234C4373ABC379006E53D4C4"><enum>(A)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</text></subparagraph> <subparagraph id="H4BCD3D675F1A4917B8EB6F6987C4044A"><enum>(B)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives.</text></subparagraph></paragraph></subsection></section>
<section id="HC8299A6873E941BBB018322AF561C7A1"><enum>3.</enum><header>Sanctions with respect to senior foreign political figures in Lebanon supporting Hizballah</header>
<subsection id="H164C499860434C29A330D39DCC34F48D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall impose the sanctions described in section 1263(b) of the Global Magnitsky Human Rights Accountability Act (subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note) with respect to each individual on the list required by subsection (b). </text></subsection> <subsection id="H1A0C7E86875B46638668A62555949B29"><enum>(b)</enum><header>List</header> <paragraph id="H86B0AFB4CDB3472D83DB59817565B66C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a list of individuals who are senior foreign political figures in Lebanon that the President determines—</text>
<subparagraph id="idE0E04C4106DB4FB5896B9D0C9FE0071E"><enum>(A)</enum><text display-inline="yes-display-inline">have knowingly provided material support to or engaged in a significant transaction with Hizballah; or </text></subparagraph> <subparagraph id="idC7267EB4B05C46C590F94485A2537007"><enum>(B)</enum><text display-inline="yes-display-inline">meet the criteria for the imposition of sanctions under—</text>
<clause id="idFF51E5F36CFC4EC48BCBD8E88A58D43C"><enum>(i)</enum><text display-inline="yes-display-inline">the Hizballah International Financing Prevention Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/102">Public Law 114–102</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note); or</text></clause> <clause id="idF2C3F14DC7954C43A63534A1E179C5F9"><enum>(ii)</enum><text display-inline="yes-display-inline">the Global Magnitsky Human Rights and Accountability Act (subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note). </text></clause></subparagraph></paragraph>
<paragraph id="H9889521106AB476E957FB8ADE46B4593"><enum>(2)</enum><header>Form</header><text display-inline="yes-display-inline">The list required by paragraph (1) shall be submitted in unclassified form but may contain a classified annex.</text></paragraph></subsection> <subsection commented="no" id="HF284F370C2F94D28BBBDAE1A9AF19112"><enum>(c)</enum><header>Exception to comply with United Nations Headquarters Agreement; Enforcement</header><text display-inline="yes-display-inline">Subsections (e) and (f) of section 1263 of the Global Magnitsky Human Rights Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note) apply with respect to the imposition of sanctions under this section to the same extent as such subsections apply with respect to the imposition of sanctions under such section 1263. </text></subsection>
<subsection id="H7EE1DC77679E40A0951F8397BF2AC02F"><enum>(d)</enum><header>Waiver</header><text>The President may waive the imposition of sanctions under subsection (a) with respect to an individual if the President—</text> <paragraph id="HEFAE3F04C6EC4D79B01E4D1B682787FD"><enum>(1)</enum><text>determines that such a waiver is in the national interests of the United States; and</text></paragraph>
<paragraph id="H904A6A85D75E47CDBB00E1BB0347A8C3"><enum>(2)</enum><text>submits to the appropriate congressional committees notice of, and a justification for, the waiver.</text></paragraph></subsection> <subsection id="HF7C5F0F225C44443BB23EF0F233BE431"><enum>(e)</enum><header>Regulatory Authority</header><text>The President shall issue such regulations, licenses, and orders as are necessary to carry out this section.</text></subsection>
<subsection id="H21166FAB69FE4063A702A6330E0C442B"><enum>(f)</enum><header>Exception relating to importation of goods</header>
<paragraph id="HDBA09487FBAC413899502EA7BB5D082A"><enum>(1)</enum><header>In general</header><text>The authorities and requirements to impose sanctions under this section shall not include the authority or requirement to impose sanctions on the importation of goods.</text></paragraph> <paragraph id="HA449C0704DB643CA80183E20331B54B3"><enum>(2)</enum><header>Good defined</header><text>In this subsection, the term <term>good</term> means any article, natural or man-made substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></paragraph></subsection>
<subsection id="HA6A8B3A50F80432C9863BFC8CD6181BB"><enum>(g)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph id="H40F4DAA39E51474797CCB363AD74690B"><enum>(1)</enum><text>the Committee on Foreign Relations and the Committee on Banking, Housing, and Urban Affairs of the Senate; and</text></paragraph>
<paragraph id="H274641FACD2E49DEBB3C52A40E3F3B91"><enum>(2)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives.</text></paragraph></subsection></section> </legis-body> </bill>
