which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20220921">September 21, 2022</action-date><action-desc>Reported by <sponsor name-id="S338">Mr. Manchin</sponsor>, with amendments</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Agriculture to convey certain National Forest System land in the State of Arizona to the Arizona Board of Regents, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Arizona Experiment Station Land Conveyance Act of <deleted-phrase reported-display-style="strikethrough">2021</deleted-phrase></short-title><added-phrase reported-display-style="italic">2022</added-phrase></quote>.</text></section><section id="id175431B40DE14D428AE222BC07A70C34"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id75D077DBA3B94DD4B9EDCD239C9540C2"><enum>(1)</enum><header>Easement</header><text>The term <term>easement</term> means an easement to access and use Forest Service Road 9201D from its junction with Forest Service Road 0618 (commonly known as <quote>Beaver Creek</quote>).</text></paragraph><paragraph id="id76192332F56D44FE89FB38E50F53F983"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the approximately 13.3 acres of National Forest System land within the Coconino National Forest in the State of Arizona, as generally depicted on the map entitled <quote>Act to Convey Certain NFS Land and non-Federal Land in Arizona Winter Quarters</quote> and dated June 20, 2019.</text></paragraph><paragraph id="id092497C3E5AE46D2A6D7145884327C0E"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="idBF6A4F1EFE134297BFEE8BDD16DFF2BB" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>University</header><text>The term <term>University</term> means the Arizona Board of Regents, acting on behalf of the University of Arizona Experiment Station. </text></paragraph></section><section id="id89A96B2661D04E82A1156167AB3B9908"><enum>3.</enum><header>Coconino National Forest land conveyance</header><subsection id="idFBD4D06AAD484283B96892C0A80FF671"><enum>(a)</enum><header>Conveyance authorized</header><text>Subject to this section, if the University submits to the Secretary not later than 180 days after the date of enactment of this Act a written request <deleted-phrase reported-display-style="strikethrough">for the conveyance of the Federal land,</deleted-phrase><added-phrase reported-display-style="italic">to acquire the Federal land for market value, as determined by the appraisal conducted under subsection (d), </added-phrase>the Secretary shall, not later than 1 year after the date of enactment of this Act, convey to the University all right, title, and interest of the United States in and to that land, including related infrastructure, improvements, and easements on that land.</text></subsection><subsection id="idB7FB37D3977B49AD9C053EE574ABDF83"><enum>(b)</enum><header>Terms and Conditions</header><text>The conveyance authorized under subsection (a) shall be—</text><paragraph id="id48A958FD97F54FDA96BA92C9CCD2CFCF"><enum>(1)</enum><text>subject to valid existing rights;</text></paragraph><paragraph id="idE082D7D8B3384713816E4C8A9D00EE28"><enum>(2)</enum><text>notwithstanding any other provision of law; and</text></paragraph><paragraph id="idB8D729CB12F6497AB2008E6B4C239CB6"><enum>(3)</enum><text>subject to any other terms and conditions as considered appropriate by the Secretary.</text></paragraph></subsection><subsection id="idAE852DA91F7641CD8DB1646431AA1E7E"><enum>(c)</enum><header>Forest Service access</header><text>The Secretary shall retain all other rights not included in the conveyance authorized under subsection (a) to Forest Service Road 9201D from its junction with Forest Service Road 0618 (commonly known as <quote>Beaver Creek</quote>), including the maintenance of, and continued administrative access to, that road. </text></subsection><subsection id="idF483B62ED94841AAACE47BDCF70C2226" changed="deleted" reported-display-style="strikethrough"><enum>(d)</enum><header>Use of conveyed land</header><paragraph id="id8FCF37802F144E21A33B46487CF7953C"><enum>(1)</enum><header>In general</header><text>As a condition of the conveyance under subsection (a), the Federal land shall be—</text><subparagraph id="idB784274A56CD4870A43082FC33A20BCA"><enum>(A)</enum><text>maintained by the University; and</text></subparagraph><subparagraph id="idCA7CB3CCF5804FEE8B64CE34682B2D69"><enum>(B)</enum><text>used for the purposes of land-grant colleges and universities in accordance with—</text><clause id="idC46C26B38A254B66821973FB4184BEB7"><enum>(i)</enum><text>the Act of July 2, 1862 (commonly known as the <quote>First Morrill Act</quote>) (12 Stat. 503, chapter 130; <external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301 et seq.</external-xref>);</text></clause><clause id="id81050B0FF84D450BACCA2FC645C0F71F"><enum>(ii)</enum><text>the Smith-Lever Act (<external-xref legal-doc="usc" parsable-cite="usc/7/341">7 U.S.C. 341 et seq.</external-xref>); and</text></clause><clause id="idD99ADE752140453684FCB54E2BA412CD"><enum>(iii)</enum><text>the Hatch Act of 1887 (<external-xref legal-doc="usc" parsable-cite="usc/7/361a">7 U.S.C. 361a et seq.</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="id012E469BC5284BD0B1789AFCF8A89D7F"><enum>(2)</enum><header>Reversion</header><text>If any portion of the Federal land conveyed under subsection (a) is used in a manner inconsistent with paragraph (1), the Federal land shall, at the discretion of the Secretary, revert to the United States.</text></paragraph></subsection><subsection id="ide976c56ae93e461fa390aa57fdde9e16" changed="added" reported-display-style="italic"><enum>(d)</enum><header>Appraisal</header><paragraph id="iddd33eab97a6946f6ac66f834dd668128"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date on which the University submits a written request under subsection (a), the Secretary shall complete an appraisal to determine the market value of the Federal land.</text></paragraph><paragraph id="idE312D0BB84DE4CD8A6BFD9D2A94F3B25"><enum>(2)</enum><header>Standards</header><text>The appraisal under paragraph (1) shall be conducted in accordance with—</text><subparagraph id="id5a43f28412c74fa6b6829dde109c1c27"><enum>(A)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></subparagraph><subparagraph id="id0566092706d34ff58b73eec9fd6d84b4"><enum>(B)</enum><text>the Uniform Standards of Professional Appraisal Practice. </text></subparagraph></paragraph></subsection></section></legis-body><endorsement><action-date date="20220921">September 21, 2022</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
