which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to carry out a pilot program to develop and provide to States and transportation planning organizations accessibility data sets, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Connecting Opportunities through Mobility Metrics and Unlocking Transportation Efficiencies Act</short-title></quote> or the <quote><short-title>COMMUTE Act</short-title></quote>.</text></section><section id="id012cdedc18514a5697e8021b0bca6574"><enum>2.</enum><header>Accessibility data pilot program</header><subsection id="id2177dceb01c74c8bb3047c7c0922f16e"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation (referred to in this section as the <quote>Secretary</quote>) shall establish an accessibility data pilot program (referred to in this section as the <quote>pilot program</quote>).</text></subsection><subsection id="idfb36c83f6b9e4feda4bdf45e64dbd5eb"><enum>(b)</enum><header>Purpose</header><text>The purpose of the pilot program is to develop or procure an accessibility data set and make that data set available to each eligible entity selected to participate in the pilot program to improve the transportation planning of those eligible entities by—</text><paragraph id="idce9b0e6b6c8e48ff9ec97573d1d56e31"><enum>(1)</enum><text>measuring the level of access by multiple transportation modes to important destinations, which may include—</text><subparagraph id="ida87195029ea042698670908b17cd88b5"><enum>(A)</enum><text>jobs, including areas with a concentration of available jobs;</text></subparagraph><subparagraph id="idda9b46c3e4c841a1bed49f2c1bd2017a"><enum>(B)</enum><text>health care facilities;</text></subparagraph><subparagraph id="idd07e20fa3f05413da19fe43368ded9c2"><enum>(C)</enum><text>child care services;</text></subparagraph><subparagraph id="id686be3bddac840eeb3f99644846713db"><enum>(D)</enum><text>educational and workforce training facilities;</text></subparagraph><subparagraph id="idf62b47d7baed4d8dbc8cea7fc01c511e"><enum>(E)</enum><text>affordable housing; </text></subparagraph><subparagraph id="id8eec892c57a64618afd7591b1a62b43d"><enum>(F)</enum><text>food sources; and</text></subparagraph><subparagraph id="id405c3635406743b4bde633a8cfd1412e"><enum>(G)</enum><text>connections between modes, including connections to—</text><clause id="id34625864abb74ab99d8a6c6c37a5daca"><enum>(i)</enum><text>high-quality transit or rail service;</text></clause><clause id="idc38034918ff04f2e84a3c0e581cc484d"><enum>(ii)</enum><text>safe bicycling corridors; and</text></clause><clause id="idd32a0eb8cf55422c83ea476b4c4bd9e8"><enum>(iii)</enum><text>safe sidewalks that achieve compliance with applicable requirements of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref> et seq.);</text></clause></subparagraph></paragraph><paragraph id="idd26a6290de6b4d799d0530e79f9e3e7b"><enum>(2)</enum><text>disaggregating the level of access by multiple transportation modes by a variety of population categories, which may include—</text><subparagraph id="ide23a88b373f34d2baa8ae8b0585bc6f1"><enum>(A)</enum><text>low-income populations;</text></subparagraph><subparagraph id="idce48991a31c64dc29c37f772645d7743"><enum>(B)</enum><text>minority populations;</text></subparagraph><subparagraph id="id0d6289a2269e4a3ca776e54f1dfbece2"><enum>(C)</enum><text>age;</text></subparagraph><subparagraph id="id8622fc13a35e4af498e0b6615bcdd403"><enum>(D)</enum><text>disability; and</text></subparagraph><subparagraph id="idda454f83e3bb47b7afa05f23e92c9273"><enum>(E)</enum><text>geographical location; </text></subparagraph></paragraph><paragraph id="id13a4d1871aba403dbc50aafd781f8474"><enum>(3)</enum><text>assessing the change in accessibility that would result from new transportation investments; and</text></paragraph><paragraph id="idDAA647F766D94752A4012C0B42BEE0F7"><enum>(4)</enum><text>providing data necessary to prioritize transportation investments that will improve access by all modes of travel. </text></paragraph></subsection><subsection id="id815d8b2563f54fbaa3180ee6ee867c46"><enum>(c)</enum><header>Eligible entities</header><text>An entity eligible to participate in the pilot program is—</text><paragraph id="id00d5fd4b02b941f4adedc7f4e48872d6"><enum>(1)</enum><text>a State (as defined in section 101(a) of title 23, United States Code);</text></paragraph><paragraph id="idd7f93b453bb94c65b8ae8d1aab234bc7"><enum>(2)</enum><text>a metropolitan planning organization; or</text></paragraph><paragraph id="idd5adb8efced94a38a44835b053e1c09f"><enum>(3)</enum><text>a rural transportation planning organization.</text></paragraph></subsection><subsection id="ida8c35554a6374840bed8beb843dda067"><enum>(d)</enum><header>Application</header><text>To be eligible to participate in the pilot program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including information relating to—</text><paragraph id="ida3c46d5dc96e45f3a77cb4ff60dca574"><enum>(1)</enum><text>previous experience of the eligible entity measuring transportation access, especially in low-income, transit-dependent, or other high-needs communities, or other performance management experience;</text></paragraph><paragraph id="idab0c58c90d9e4146aac510869fe1abeb"><enum>(2)</enum><text>the types of important destinations to which the eligible entity intends to measure access;</text></paragraph><paragraph id="id02ca17cf591547ee9657ffbc8ffe092f"><enum>(3)</enum><text>the types of data disaggregation the eligible entity intends to pursue;</text></paragraph><paragraph id="idce161a29493d442ba5880bc3473eb087"><enum>(4)</enum><text>a general description of the methodology the eligible entity intends to apply; </text></paragraph><paragraph id="ide0fa7a1312d842fc95a213ee1465d936"><enum>(5)</enum><text>if the applicant does not intend the pilot program to apply to the full area under the jurisdiction of the applicant, a description of the geographic area in which the applicant intends the pilot program to apply; and</text></paragraph><paragraph id="id9801C4B3BCF4401491238EB09ED57AEF"><enum>(6)</enum><text>a description of how the eligible entity plans to use the data to improve access to jobs and services by all modes of travel, including for communities of color, low-income communities, people who are transit-dependent, and vulnerable road users.</text></paragraph></subsection><subsection id="idbab295a7679243649d4b13775fe65b80"><enum>(e)</enum><header>Selection</header><paragraph id="id8d73dfe56f254ee697421749aba843f0"><enum>(1)</enum><header>In general</header><text>The Secretary shall seek to achieve diversity of participants in the pilot program by selecting a range of eligible entities that shall include—</text><subparagraph id="id7ff88b2bfabe46278abfb79fa2290f5f"><enum>(A)</enum><text>States;</text></subparagraph><subparagraph id="idbab265f7dda546a0a526d45d07b73c97"><enum>(B)</enum><text>metropolitan planning organizations that serve an area with a population of 200,000 people or fewer;</text></subparagraph><subparagraph id="id116f6c7ad34a436d8145173b822dbd4e"><enum>(C)</enum><text>metropolitan planning organizations that serve an area with a population of over 200,000 people; and</text></subparagraph><subparagraph id="id5f3f6e978b844fc7a6617bc262c9d42b"><enum>(D)</enum><text>rural transportation planning organizations.</text></subparagraph></paragraph><paragraph id="idb740acbd87db48c4ad5a040234411d30"><enum>(2)</enum><header>Inclusions</header><text>The Secretary shall seek to ensure that, among the eligible entities selected under paragraph (1), there is—</text><subparagraph id="id345f96359b2b405fa76e3f5d42fb2a93"><enum>(A)</enum><text>a range of capacity and previous experience with measuring transportation access; and</text></subparagraph><subparagraph id="id616c36bb6f50494089943a60f811f754"><enum>(B)</enum><text>a variety of proposed methodologies and focus areas for measuring level of access.</text></subparagraph></paragraph></subsection><subsection id="idb1d872f6fe834e56aece5378b6d6f12f"><enum>(f)</enum><header>Duties</header><text>For each eligible entity participating in the pilot program, the Secretary shall—</text><paragraph id="id6912e6eaf8d94080a76f5f84a5535957"><enum>(1)</enum><text>develop or acquire an accessibility data set described in subsection (b); and</text></paragraph><paragraph id="idb71b562fe3d8476881669d4a1b14b975"><enum>(2)</enum><text>submit the data set to the eligible entity.</text></paragraph></subsection><subsection id="idce22db8823a64fd0a6b3f92c1916a223"><enum>(g)</enum><header>Methodology</header><text>In calculating the measures for the data set under the pilot program, the Secretary shall ensure that methodology is open source.</text></subsection><subsection id="id6c3f832a0d834d9fa1ccd3a94980842b"><enum>(h)</enum><header>Availability</header><text>The Secretary shall make an accessibility data set under the pilot program available to—</text><paragraph id="idb09b278e38f44f9b8e71a99ffed7a66e"><enum>(1)</enum><text>units of local government within the jurisdiction of the eligible entity participating in the pilot program; and</text></paragraph><paragraph id="idc1c5fd0819df45ada624b31fd386f9c7"><enum>(2)</enum><text>researchers.</text></paragraph></subsection><subsection id="id145d16ada14643e0a872d584381c6545"><enum>(i)</enum><header>Report</header><text>Not later than 120 days after the last date on which the Secretary submits data sets to the eligible entity under subsection (f), the Secretary shall submit to Congress a report on the results of the program, including—</text><paragraph id="id36E8EA6FE7D8423AAD0F2217FF827034"><enum>(1)</enum><text>the feasibility of developing and providing periodic accessibility data sets for all States, regions, and localities; and</text></paragraph><paragraph id="idD5D968FA1F85469A86BCBF6E45E259C7"><enum>(2)</enum><text>an identification of specific actions the Secretary and eligible entities participating in the pilot program may take to further the use of accessibility data.</text></paragraph></subsection><subsection id="idba2dedb4a34b4123879c1175b6a391fc"><enum>(j)</enum><header>Funding</header><text>The Secretary shall carry out the pilot program using amounts made available to the Secretary for administrative expenses to carry out programs under the authority of the Secretary.</text></subsection><subsection id="id903ed061b5764ee5aeff3afb4a5db2bc"><enum>(k)</enum><header>Sunset</header><text>The pilot program shall terminate on the date that is 5 years after the date on which the pilot program is implemented. </text></subsection></section></legis-body></bill>
