which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to provide for a 2-year prohibition on employment in a career civil service position for any former political appointee, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reduce Bureaucracy Act</short-title></quote>.</text></section><section id="H206FAA9F3F9E4DAEB6344DCB8799F0FC"><enum>2.</enum><header>Limitation on employment of political appointees in career civil service positions</header><subsection id="HEA99EFC5BF6A469BB817EF23476CE097"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block id="H664B06032D964CCD812B4A7C9D960722" style="USC"><section id="H53454E1B552E49DF89A4E6FF738F746C"><enum>3117.</enum><header>Employment of political appointees </header><subsection id="id4520D7ACFAAA470FADC1E4EF2FDD2C26"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id35CD39F4F5F24D78B087CCCD99B80990"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>agency</term> has the meaning given the term <quote>Executive agency</quote> in section 105;</text></paragraph><paragraph id="id464ABF9936204241997FB5BC2392CA8F"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Associate Director</term> means the Associate Director for Merit System Accountability and Compliance at the Office of Personnel Management;</text></paragraph><paragraph id="id6D18C98736A34D22B977AD3EB724A85E"><enum>(3)</enum><text>the term <term>career position</term> means—</text><subparagraph id="id2DAC56120EB54AB09E4A26CC95226C9C"><enum>(A)</enum><text display-inline="yes-display-inline">a position in the competitive service filled by career or career-conditional appointment;</text></subparagraph><subparagraph id="idC00CAC861748451ABB17C1749D9C5022"><enum>(B)</enum><text display-inline="yes-display-inline">a position in the excepted service filled by an appointment of equivalent tenure as a position described in subparagraph (A);</text></subparagraph><subparagraph id="id513DCC1378E443D3B73CB4010F11AAAE"><enum>(C)</enum><text display-inline="yes-display-inline">a career reserved position, as defined in section 3132(a)(8), in the Senior Executive Service; or</text></subparagraph><subparagraph id="idC1DC288EDA2B4D26B2A51344D222A72A"><enum>(D)</enum><text>a general position in the Senior Executive Service when filled by a career appointee, as defined in section 3132(a)(4); </text></subparagraph></paragraph><paragraph id="idBDC53EEC45744456B7C28D1D7AEF02A4"><enum>(4)</enum><text>the term <term>participated</term> means an action taken as an officer or employee through decision, approval, disapproval, recommendation, the rendering of advice, investigation, or other such action; </text></paragraph><paragraph id="id63D18A64ED48450FAC7D8C63AE4066EC"><enum>(5)</enum><text>the term <term>particular matter</term> includes any investigation, application, request for a ruling or determination, rulemaking, contract, controversy, claim, charge, accusation, arrest, or judicial or other proceeding; </text></paragraph><paragraph id="idD104A8BC8D684D06952F97B9B4AFDC85"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>political appointee</term> means an individual serving in an appointment of any duration to a political position; and</text></paragraph><paragraph id="id772BE952D54F4D82A10FFF1CA6453D93"><enum>(7)</enum><text>the term <term>political position</term> means—</text><subparagraph id="id233CF0ED274F40979529C875F1FCE758"><enum>(A)</enum><text display-inline="yes-display-inline">a position with respect to which appointment is made—</text><clause id="id907D03C8EB614352BCE32A95AAAAD021"><enum>(i)</enum><text>by the President; or</text></clause><clause id="id48A0E901A7F64F099ED1C495F72C5CAD"><enum>(ii)</enum><text>by the President, by and with the advice and consent of the Senate;</text></clause></subparagraph><subparagraph id="id894248ED1C4649BF898694A9A35D1210"><enum>(B)</enum><text>a position that has been excepted from the competitive service by reason of its confidential, policy-determining, policy-making, or policy-advocating character;</text></subparagraph><subparagraph id="idC3F6F8E9FA6B4F4EBAF7EBD6D6EA8448"><enum>(C)</enum><text>a position described in sections 5312 through 5316 (relating to the Executive Schedule); and</text></subparagraph><subparagraph id="id4730322F0A844049B0976149E8794F62"><enum>(D)</enum><text display-inline="yes-display-inline">a general position in the Senior Executive Service during such time as it is filled by—</text><clause id="id6A03A2DC23884002AB0D6F9DBB3B17EA"><enum>(i)</enum><text>a noncareer appointee, as defined in section 3132(a)(7); or</text></clause><clause id="idA8A05E790A50432490AFF7761E201318"><enum>(ii)</enum><text>a limited term appointee or a limited emergency appointee, as defined in paragraphs (5) and (6) of section 3132(a), respectively, who is serving under a political appointment.</text></clause></subparagraph></paragraph></subsection><subsection id="HF6E8B521D9504EF0BE7F68FD339CFF40"><enum>(b)</enum><header>Appointment approval required</header><paragraph id="HB3E243BEC2A845B895F88585A50299B9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The head of an agency may not appoint any individual described in paragraph (5) to a career position within the agency without receiving prior written approval from the Associate Director, consistent with the requirements of this subsection.</text></paragraph><paragraph id="HE505113CFFC749FF9411FDBA800B10D2"><enum>(2)</enum><header>Request</header><text display-inline="yes-display-inline">The head of an agency shall submit to the Associate Director a request to approve the appointment of any individual described in paragraph (5) to a career position, which shall include certification by the head of the agency to the Associate Director that the appointment is necessary for the agency to meet the mission of the agency.</text></paragraph><paragraph id="H28C8A7C09C2646589A5681C8151B283A"><enum>(3)</enum><header>Review and determination</header><text display-inline="yes-display-inline">The Associate Director— </text><subparagraph id="id0CCEC1A3385C46BD9EFF92784DDC8FDB"><enum>(A)</enum><text display-inline="yes-display-inline">shall— </text><clause id="idA2B8339E8F3E4DE9BB0E59416E0F478C"><enum>(i)</enum><text display-inline="yes-display-inline">review any request received under paragraph (2); and</text></clause><clause id="idDCD73DDD4D8240B7B1E32C7F09A58D02"><enum>(ii)</enum><text display-inline="yes-display-inline">deny any request described in clause (i), unless the Associate Director determines that the appointment process with respect to the request was fair, open, and free from political influence; and</text></clause></subparagraph><subparagraph id="idA0B5C35D71B643FF8EBF0615883A015F"><enum>(B)</enum><text display-inline="yes-display-inline">may, if the Associate Director makes a determination described in subparagraph (A)(ii), approve a request submitted under paragraph (2).</text></subparagraph></paragraph><paragraph id="HF7B6AEA9268C487D9B2A7041AD2B3133"><enum>(4)</enum><header>Notification to Congress</header><text display-inline="yes-display-inline">With respect to any request approved under paragraph (3)(B), the Associate Director shall, not less than 5 days before the date on which the Associate Director provides approval to the head of the requesting agency, provide to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives the agency certification under paragraph (2) and the rationale of the applicable agency head with respect to that certification.</text></paragraph><paragraph id="H7A65A417C4CD4434A8B13C7C7BCA3C3A"><enum>(5)</enum><header>Covered individuals</header><text>An individual described in this paragraph is—</text><subparagraph id="H45835810D4EF4CA58698AD79C5734599"><enum>(A)</enum><text>a political appointee;</text></subparagraph><subparagraph id="H5A3F7924716546DF9ED1270228BFED46"><enum>(B)</enum><text>a former political appointee who held any political position during the 5-year period before the date on which the applicable request described in paragraph (2) is submitted; or</text></subparagraph><subparagraph id="H7C29228CE2074CD38D9C5779B7EDE120"><enum>(C)</enum><text display-inline="yes-display-inline">at the discretion of the Director of the Office of Personnel Management, a former political appointee who held any political position before the 5-year period described in subparagraph (B).</text></subparagraph></paragraph></subsection><subsection id="H605CDEA20960478B92642B727DD06D05"><enum>(c)</enum><header>Restriction on appointment</header><paragraph id="H16E15714897F4CED8488950B1341969E"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other law, rule, or regulation, during the 2-year period following the date on which a political appointee leaves or departs from a political position, that appointee may not be appointed to any career position in the civil service.</text></paragraph><paragraph id="H8833C370D3EB4A589A112A7D6C322C0C"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to a political appointee who has not personally and substantially participated in any particular matter while employed in a political position.</text></paragraph></subsection><subsection id="HFA2A063E05A7421489319DD49DFC6769"><enum>(d)</enum><header>Application</header><text>Nothing in this section may be construed to restrict the appointment of an individual who is—</text><paragraph id="H966DF003EDD04B80A364038B8298F43D"><enum>(1)</enum><text>entitled to reinstatement under section 3593(b); or</text></paragraph><paragraph id="H264E7051C03E405CBB27F46348336410"><enum>(2)</enum><text>eligible for reinstatement under section 3593(a).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H53CCA68531B445CD9D80E1DE39FAE3B3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding after the item relating to section 3116 the following:</text><quoted-block id="HCA0AEEE8BA5D499BB3B1C61924063C94" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">3117. Employment of political appointees.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H225758DFA4994BA0B3F0290D776DB45E"><enum>(c)</enum><header>Application</header><paragraph id="H049DEFE1417447578307E9721E385EE0"><enum>(1)</enum><header>Appointment requests</header><text display-inline="yes-display-inline">Section 3117(b) of title 5, United States Code, as added by subsection (a), shall apply to any appointment or request for appointment described in such section submitted to the Associate Director for Merit System Accountability and Compliance after the date of enactment of this Act.</text></paragraph><paragraph id="H5714419054A64A3980CDEB7777622FD2"><enum>(2)</enum><header>Limitation on appointments</header><text>Section 3117(c) of title 5, United States Code, as added by subsection (a), shall apply to any individual who leaves or departs from a political position (as that term is defined in section 3117(a) of such title, as added by such subsection) after the date of enactment of this Act.</text></paragraph></subsection><subsection id="HAD3DCD4D82774549AE781D253DDEAEFA" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Regulations required</header><paragraph commented="no" display-inline="no-display-inline" id="idD6F69B14DC1C45F2BD0F2DA399F4DA4A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall issue regulations necessary to carry out this section and the amendments made by this section. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB931659735F74DE6AB8A342250AFB806"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The regulations issued under paragraph (1) shall include guidance regarding the definition of the term <quote>personally and substantially participated in any particular matter</quote> in section 3117(c)(2) of title 5, United States Code, as added by subsection (a), consistent with section 2641.201 of title 5, Code of Federal Regulations, and the definitions of applicable terms in section 3117(a) of title 5, United States Code, as added by subsection (a). </text></paragraph></subsection></section><section id="id885D1D03C0974796BB571BCD3E3A6129"><enum>3.</enum><header>Reduction in
 number of political appointees</header><subsection commented="no" display-inline="no-display-inline" id="ID52941DB0FEE24705B1069CFE3D00E77C"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section— </text><paragraph display-inline="no-display-inline" commented="no" id="id52712DF9BE034F8CA4C4A1C3CF2BF95B"><enum>(1)</enum><text>the terms <term>limited term appointee</term>, <term>limited emergency appointee</term>, and <term>noncareer appointee</term> have the meanings given the terms in section 3132(a) of title 5, United States Code; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18C9F4E205DE409FB071B0E59468935D"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>political appointee</term> means any individual who—</text><subparagraph commented="no" display-inline="no-display-inline" id="ID5C6387C474454E8CB0CB162200E488FD"><enum>(A)</enum><text display-inline="yes-display-inline">is employed in a position on the Executive Schedule under sections 5312 through 5316 of title 5, United States Code;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0E9D5EA285B642F3822FEC0000D0D903"><enum>(B)</enum><text display-inline="yes-display-inline">is a limited term appointee, a limited emergency appointee, or a noncareer appointee; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD0FDFC01B064495897424847A4F06BC0"><enum>(C)</enum><text display-inline="yes-display-inline">is employed in a position in the executive branch of the Federal Government of a confidential or policy-determining character under Schedule C of subpart C of part 213 of title 5, Code of Federal Regulations, or any successor regulations.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD61358B9B61B45A78348B6DCC100AD30"><enum>(b)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The President, acting through the Director of the Office of Management and Budget and the Director of the Office of Personnel Management, shall take such actions as necessary to ensure that the total number of political appointees shall not exceed 2,000.</text></subsection><subsection id="ID1C1D8C3CA4514D53B1E05F00102B0096" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
 date</header><text display-inline="yes-display-inline">This section shall take effect on the date that is 1 year after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
