<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1617</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210513">May 13, 2021</action-date><action-desc><sponsor name-id="S323">Mr. Risch</sponsor> (for himself, <cosponsor name-id="S324">Mrs. Shaheen</cosponsor>, <cosponsor name-id="S388">Ms. Hassan</cosponsor>, <cosponsor name-id="S389">Mr. Kennedy</cosponsor>, and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the requirements for the Administrator of the Small Business Administration relating to declaring a disaster in a rural area, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Assistance for Rural Communities Act</short-title></quote>.</text></section><section id="id95AE4EAE96834F00955F5E67EBE42E8B"><enum>2.</enum><header>Disaster declaration in rural areas</header><subsection id="idF1326401DB674793BCFCC5B342DCFDFC"><enum>(a)</enum><header>In general</header><text>Section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended by inserting after paragraph (15) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id70FD44263DF84973BBA7B625597A9FDD"><paragraph id="idC3EC64CA3D23421BA1C1557F67AD0830"><enum>(16)</enum><header>Disaster declaration in rural areas</header><subparagraph id="id4EA56A0140E64217A8A5ADBC14A5698F"><enum>(A)</enum><header>Definitions</header><text>In this paragraph—</text><clause id="idC242B883F6B842EBBA40C0E093EEAF7B"><enum>(i)</enum><text>the term <term>rural area</term> means an area with a population of less than 200,000 outside an urbanized area; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id4C20893FA5264A5C876BBDD1BFE7B28A"><enum>(ii)</enum><text>the term <term>significant damage</term> means, with respect to property, uninsured losses of not less than 40 percent of the estimated fair replacement value or pre-disaster fair market value of the damaged property, whichever is lower.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29D00867E80A44CF84B3C6E93117C022"><enum>(B)</enum><header>Disaster declaration</header><text>For the purpose of making loans under paragraph (1) or (2), the Administrator may declare a disaster in a rural area for which a major disaster was declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) if—</text><clause commented="no" display-inline="no-display-inline" id="id6F82808977B54B85A2F09E7E14E3E62D"><enum>(i)</enum><text>the Governor of the State in which the rural area is located requests such a declaration; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9C78C5359B58471FB26A86666284CFB5"><enum>(ii)</enum><text>any home, small business concern, private nonprofit organization, or small agricultural cooperative has incurred significant damage in the rural area.</text></clause></subparagraph><subparagraph id="id9C3B4B41302649859DDD614903C44B9B"><enum>(C)</enum><header>SBA report</header><text>Not later than 120 days after the date of enactment of this paragraph, and every year thereafter, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report on, with respect to the 1-year period preceding submission of the report—</text><clause id="id32BEE1033CDE489C9DCCBA12BF59573A"><enum>(i)</enum><text>any economic injury that resulted from a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) in a rural area; </text></clause><clause id="id201B26886B0040469C0E4FB76E140D3C"><enum>(ii)</enum><text>each request for assistance made by the Governor of a State under subparagraph (B)(i) and the response of the Administrator, including the timeline for each response; and</text></clause><clause id="id83F81CD214244E00B58F00E8E4B296FA"><enum>(iii)</enum><text>any regulatory changes that will impact the ability of communities in rural areas to obtain disaster assistance under this subsection.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8B3A5C35559D4C8CB3528527B5BB633A"><enum>(b)</enum><header>Regulations</header><text>Not later than 120 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall issue regulations to carry out the amendment made by subsection (a).</text></subsection><subsection id="id2A17FCF5F45141CA9A70FC46419EB344"><enum>(c)</enum><header>GAO report</header><paragraph id="id3D87FF99EA16442C9227791EF7EE40A9"><enum>(1)</enum><header>Definition of rural area</header><text>In this subsection, the term <term>rural area</term> means an area with a population of less than 200,000 outside an urbanized area.</text></paragraph><paragraph id="idD8E5AEFC8E134CAA861E68BE35D45467"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report on—</text><subparagraph id="idE87478CD6ACE40D2800A26840AA19BC2"><enum>(A)</enum><text>any unique challenges that communities in rural areas face compared to communities in urbanized areas when seeking to obtain disaster assistance under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>); and</text></subparagraph><subparagraph id="idE9C109A59E904B1EA62D8116AA40165A"><enum>(B)</enum><text>legislative recommendations for improving access to disaster assistance for communities in rural areas.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
