<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 1617</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To modify the requirements for the Administrator of the Small Business Administration relating to declaring a disaster in a rural area, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="id74db5b1c-c3d0-47df-8c3d-c94ba74a800c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Assistance for Rural Communities Act</short-title></quote>.</text></section><section id="idf34ad1ba5b79486eb1d66f09650fd25e" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Disaster declaration in rural areas</header><subsection id="idBFC3AE0C89694C528D0222687EB01D2E" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended by inserting after paragraph (15) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCBB8D48DFD3243DF89C90DD0267147D8" changed="not-changed"><paragraph id="idE13358881E0A4473B024167361BAAE3D" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(16)</enum><header display-inline="yes-display-inline">Disaster declaration in rural areas</header><subparagraph id="id93388EA6FCFC4EE3823442A049CB760C" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this paragraph—</text><clause id="id30AEE8256AEB463AA88CEF38416E9FEE" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the term <term>rural area</term> means any county or other political subdivision of a State, the District of Columbia, or a territory or possession of the United States that is designated as a rural area by the Bureau of the Census; and</text></clause><clause id="idC66EAEEB42744F1E99BE83DD0BC4DB18" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>significant damage</term> means, with respect to property, uninsured losses of not less than 40 percent of the estimated fair replacement value or pre-disaster fair market value of the damaged property, whichever is lower.</text></clause></subparagraph><subparagraph id="id8276DF9548E146FEBD023AA20D6DBE08" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Disaster declaration</header><text display-inline="yes-display-inline">For the purpose of making loans under paragraph (1) or (2), the Administrator may declare a disaster in a rural area for which a major disaster was declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) and for which individual assistance was not authorized under section 408 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5174">42 U.S.C. 5174</external-xref>) if—</text><clause id="idD021D06ECC634806B2B8736C9AE43DAE" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the Governor of the State or the Chief Executive of the Indian tribal government in which the rural area is located requests such a declaration; and</text></clause><clause id="id3E6C20F693524E708D5074F0DBAE9BB3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">any home, small business concern, private nonprofit organization, or small agricultural cooperative has incurred significant damage in the rural area.</text></clause></subparagraph><subparagraph id="id216EEE473594429FB0A93B792CC8FE7F" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">SBA report</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this paragraph, and every year thereafter, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report on, with respect to the 1-year period preceding submission of the report—</text><clause id="idDDB3B5EB86F5448CBA10E90BB3974455" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">any economic injury that resulted from a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) in a rural area;</text></clause><clause id="idBAA17C43A5B349D7BE97DA7769D8BE77" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">each request for assistance made by the Governor of a State or the Chief Executive of an Indian tribal government under subparagraph (B)(i) and the response of the Administrator, including the timeline for each response; and</text></clause><clause id="id8571FEDC5F2D4B7492D5DA3F23AD4A76" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">any regulatory changes that will impact the ability of communities in rural areas to obtain disaster assistance under this subsection.</text></clause></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="idC672BE2760B341BA8511CA4C1AF92FCA" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall issue regulations to carry out the amendment made by subsection (a).</text></subsection><subsection id="idEDC0F7C9DF004826A3CCA0F20C225FB7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">GAO report</header><paragraph id="id78E6308F33B24ED7997B5C03A821157B" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of rural area</header><text display-inline="yes-display-inline">In this subsection, the term <term>rural area</term> means any county or other political subdivision of a State, the District of Columbia, or a territory or possession of the United States that is designated as a rural area by the Bureau of the Census.</text></paragraph><paragraph id="id21AB58CD1F024CC48F60B4A24AB8BF07" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report on—</text><subparagraph id="id98E9E6BB18B740C989DC289FB453631B" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">any unique challenges that communities in rural areas face compared to communities in urbanized areas when seeking to obtain disaster assistance under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>); and</text></subparagraph><subparagraph id="id7C36507F200F423DB8B4F97BC2F53430" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">legislative recommendations for improving access to disaster assistance for communities in rural areas. </text></subparagraph></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20220928" chamber="Senate">Passed the Senate September 28, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
