which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide exceptions from permitting and fee requirements for content creation, regardless of distribution platform, including digital or analog video and digital or analog audio recording activities, conducted on land under the jurisdiction of the Secretary of Agriculture and the Secretary of the Interior. </official-title></form><legis-body><section id="id27E43B80150C44A591F6BA347F2E37FF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Interior Land Media Act</short-title></quote> or the <quote><short-title>FILM Act</short-title></quote>.</text></section><section id="id4A69058D62AA405F82307038974995C3"><enum>2.</enum><header>Exceptions for permitting and fee requirements for certain content creation, regardless of distribution platform, including digital or analog video and digital or analog audio recording activities, conducted on land under the jurisdiction of the Secretary of Agriculture and the Secretary of the Interior</header><subsection id="id4BEFE77B9C284A2A94A50CBA86E83549"><enum>(a)</enum><header>National Park System land</header><text display-inline="yes-display-inline">Section 100905 of title 54, United States Code, is amended—</text><paragraph id="id801592AF4D2B48CB8A2F0AF507B3F900" commented="no"><enum>(1)</enum><text>in subsection (c)(1), in the first sentence, by inserting <quote>commercial or non-commercial</quote> before <quote>still photography</quote>;</text></paragraph><paragraph id="id677A28DC160F45008A2F57939D443761"><enum>(2)</enum><text>by redesignating subsections (d) through (f) as subsections (e) through (g), respectively; </text></paragraph><paragraph id="id9A5279840F6340A5BA1AAB2749AB76A5"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2C7BA1A1D1124D66A19D5E2096154B23"><subsection id="ida181329d92644332810f9d341650ab8a"><enum>(d)</enum><header>Content creation, regardless of distribution platform, including digital or analog video and digital or analog audio recording activities</header><paragraph id="idc4d9f0a68b0a4738a807e32475bbc1fe"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), the Secretary shall not require a permit or assess a fee or charge for any commercial or noncommercial content creation, regardless of distribution platform, including digital or analog video and digital or analog audio recording activity, in a System unit (referred to in this subsection as a <quote>covered activity</quote>), if the covered activity—</text><subparagraph id="id87ca2bd3929e41ba8670f0b8fd6223a3"><enum>(A)</enum><text>takes place at a location in which the public is allowed;</text></subparagraph><subparagraph id="id58DAF41D2C6145E2A516BA1B378571EA"><enum>(B)</enum><text>complies with and adheres to visitor use policies, practices, and regulations applicable to the applicable System unit; </text></subparagraph><subparagraph id="id6996e083543542c7b682ba090ca5f387"><enum>(C)</enum><text>is conducted in a manner that does not—</text><clause id="id44BD1222FA934108BE7C94845A17395D"><enum>(i)</enum><text>impede or intrude on the experience of other visitors to the applicable System unit; or</text></clause><clause id="id21D72BDBC04A4E4587E18FA61CA4097D"><enum>(ii)</enum><text>disturb other resource values and wildlife;</text></clause></subparagraph><subparagraph id="id16ad68e16de44d1caa39573be7f3d55c"><enum>(D)</enum><text>does not require the exclusive use of a site or area; </text></subparagraph><subparagraph id="id646FCC1ACA9A412996A21C18A98D2EE6"><enum>(E)</enum><text>complies with other applicable Federal, State, and local laws (including regulations), such as laws relating to the use of unmanned aerial equipment; and</text></subparagraph><subparagraph id="idCB120B6B71354453A651D47C8F7ECA4C"><enum>(F)</enum><text>is conducted by—</text><clause id="idCE4D7054555E4E5EA08C2A9D9BEE69C9"><enum>(i)</enum><text>an individual; or </text></clause><clause id="id99FD83A74E3D4C79AC47262500F073D3"><enum>(ii)</enum><text>a group of not more than 10 individuals.</text></clause></subparagraph></paragraph><paragraph id="id3DBA72AB33964698AB9A6EABBFD9DEE4"><enum>(2)</enum><header>Advance notification not required</header><text>The Secretary shall not require advance notification for the conduct of a covered activity under paragraph (1).</text></paragraph><paragraph id="id0DB7E435F8114E5983D6DE2EB83223E8"><enum>(3)</enum><header>Exceptions</header><text>Notwithstanding paragraph (1), the Secretary may require a permit, assess a fee or charge, or both, for the conduct of a covered activity, if—</text><subparagraph id="idA2782ABF4A0E44BF964ED134FBCECB16"><enum>(A)</enum><text> the covered activity takes place at a location in which members of the public are generally not allowed; </text></subparagraph><subparagraph id="idFB326009C8B14273AE2647CF5C326DFF"><enum>(B)</enum><text>additional administrative costs are likely to be incurred by the Secretary with respect to the covered activity; </text></subparagraph><subparagraph id="idd3335a71f2134488bdd280290b64d967"><enum>(C)</enum><text>the covered activity is being conducted in a localized area that receives very high volume visitation; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCB4AF830E6A7473796D9DF6C1F4805C2"><enum>(D)</enum><text>the covered activity requires the use of a set or staging equipment; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65DC1256CE2342C7A673F7E1C4CC15EF"><enum>(E)</enum><text>the covered activity is being conducted by a group of 11 or more individuals.</text></subparagraph></paragraph><paragraph id="id37938CF2DCBC485C8AFC29A54297AD5D" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Voluntary permit applications</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), an individual or small group of individuals conducting a covered activity that meets the requirements of that paragraph may elect to apply for a permit for the covered activity for any reason, including to benefit from any assurances provided by the permit.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="idC2C07D91213E409A9701B99850DD9005" commented="no"><enum>(4)</enum><text>in subsection (e) (as so redesignated), in the matter preceding paragraph (1), by inserting <quote>, a covered activity described in subsection (d), </quote> after <quote>still photography</quote>; and</text></paragraph><paragraph commented="no" id="id410CE1119B0E4B51B2C2CB882E7A4BAD"><enum>(5)</enum><text>in subsection (g) (as so redesignated)—</text><subparagraph commented="no" id="id68B53136B779445C96700977604AA6B2"><enum>(A)</enum><text>by striking <quote>The Secretary shall</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC0C65053C9F8464CA43F45A50DEBC127"><paragraph commented="no" id="idFA7768B769224BCC839C13429ED889AA"><enum>(1)</enum><header>In general</header><text>The Secretary shall</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="idCF7B7E6A821744D3A5C6F6B173E6C988"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8F462E3FD51E465B9A18DA2619DDB543"><paragraph commented="no" id="id23C5E01387C14EF9BCDC7F1107F45B75"><enum>(2)</enum><header>Coordination</header><subparagraph commented="no" id="idA516869CF3E549A08CD971A283DEEE0C"><enum>(A)</enum><header>In general</header><text>If a permit is required for an activity under this section and 1 or more additional Federal agencies or jurisdictional units are involved in the permitting of the activity, the Secretary and the head of the Federal agency or jurisdictional unit shall, to the maximum extent practicable, coordinate permit processing procedures.</text></subparagraph><subparagraph id="id9BBD566BE217446DA62855B4D41A39AE" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Identification of lead permit agency contact</header><text>To maximize the efficient and coordinated processing of permits under this section in which more than 1 Federal agency or jurisdictional unit is involved in the permitting of the activity, the Secretary and the heads of any other applicable Federal agencies shall consider, to the maximum extent practicable, identifying a lead contact or office to process and coordinate applicable permits and fees.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id4B6DA617DB0D457D91D4834A7A1255D1"><enum>(b)</enum><header>Other land under the jurisdiction of the Secretary of Agriculture and the Secretary of the Interior</header><text>Section 1 of <external-xref legal-doc="public-law" parsable-cite="pl/106/206">Public Law 106–206</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/460l">16 U.S.C.460<italic>l</italic></external-xref>–6d) is amended— </text><paragraph id="id984425BAF2BD445BA11675BCA505629C" commented="no"><enum>(1)</enum><text>in subsection (c)(1), in the first sentence, by inserting <quote>commercial or non-commercial</quote> before <quote>still photography</quote>; </text></paragraph><paragraph id="idC0BB319424BE40CEB92E64F2928CAED9"><enum>(2)</enum><text>by redesignating subsections (d) through (f) as subsections (e) through (g), respectively;</text></paragraph><paragraph id="id65500E4DFE0F478E8F4F8698B0B2B4BD"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id274BDD6E064E4FBEBABAD651EF7B16F9"><subsection id="id26d1dd98f8034dfdbfb6a1737fc66ea0"><enum>(d)</enum><header>Content creation, regardless of distribution platform, including digital or analog video and digital or analog audio recording activities</header><paragraph id="ide46b55f602ac4e90b4e82ff0b71bcdda"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), the Secretary shall not require a permit or assess a fee or charge for any commercial or noncommercial content creation, regardless of distribution platform, including digital or analog video and digital or analog audio recording activity, on land administered by the Secretary (referred to in this subsection as a <quote>covered activity</quote>), if the covered activity—</text><subparagraph id="id9ddb8f452cbc4a47b72681d3ebb24212"><enum>(A)</enum><text>takes place at a location in which the public is allowed;</text></subparagraph><subparagraph id="id7D0B29AB9D084A71A9936322900591AA"><enum>(B)</enum><text>complies with and adheres to visitor use policies, practices, and regulations applicable to the applicable land administered by the Secretary; </text></subparagraph><subparagraph id="id6C44DF2ED6DF457CBBCD69E74BE97C1D"><enum>(C)</enum><text>is conducted in a manner that does not—</text><clause id="idE5A16A47705F4C49A01FE0B204330301"><enum>(i)</enum><text>impede or intrude on the experience of other visitors to the applicable land administered by the Secretary; or</text></clause><clause id="id347D54B8543E47A88E6DD817359C44A4"><enum>(ii)</enum><text>disturb other resource values and wildlife;</text></clause></subparagraph><subparagraph id="id4C5984117F214C60B433292A66316E00"><enum>(D)</enum><text>does not require the exclusive use of a site or area; </text></subparagraph><subparagraph id="idF2239D76D5924985B930FCBCF6DE232B"><enum>(E)</enum><text>complies with other applicable Federal, State, and local laws (including regulations), such as laws relating to the use of unmanned aerial equipment; and</text></subparagraph><subparagraph id="idADD7F4644A7143BB881CEB71F3CD3514"><enum>(F)</enum><text>is conducted by—</text><clause id="idBCF616DE23C74DE1B91FCBF00697433E"><enum>(i)</enum><text>an individual; or </text></clause><clause id="idBF0095406A92454582622FFE16FDC628"><enum>(ii)</enum><text>a group of not more than 10 individuals.</text></clause></subparagraph></paragraph><paragraph id="id88B488F07E8149518065DB4ED0E298D2"><enum>(2)</enum><header>Advance notification not required</header><text>The Secretary shall not require advance notification for the conduct of a covered activity under paragraph (1).</text></paragraph><paragraph id="id9DB307AB91064DDAB49E80D7851A53BB"><enum>(3)</enum><header>Exceptions</header><text>Notwithstanding paragraph (1), the Secretary may require a permit, assess a fee or charge, or both, for the conduct of a covered activity, if—</text><subparagraph id="id4BDB1B02209546C09B0930A11AF3FBA6"><enum>(A)</enum><text>the covered activity takes place at a location in which members of the public are generally not allowed;</text></subparagraph><subparagraph id="id5D9C8CE1A2D64460A2368A41E36C4439"><enum>(B)</enum><text>additional administrative costs are likely to be incurred by the Secretary with respect to the covered activity;</text></subparagraph><subparagraph id="idea53789d2b8e4afeb4ce736f0f25836d"><enum>(C)</enum><text>the covered activity is being conducted in a localized area that receives very high volume visitation; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF36AB38E43AD45A28DA077E770420BAF"><enum>(D)</enum><text>the covered activity requires the use of a set or staging equipment;
