Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require certain grantees under title I of the Housing and Community Development Act of 1974 to submit a plan to track discriminatory land use policies, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC48B78B6A35A42FBA23D14DAC8FB050F"><section section-type="section-one" id="HB41216446CA446E189EF184015E1A367"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Yes In My Backyard Act</short-title></quote>.</text></section><section id="HA3B06A8639174D9BB8324DE8439C8075"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to discourage the use of discriminatory land use policies and remove barriers to making housing more affordable in order to further the original intent of the Community Development Block Grant program.</text></section><section id="H9FC5DDF1D3B741AA9E21C1B64AD72DD3"><enum>3.</enum><header>Land use plan</header><subsection id="H3C5114A9C2A14B50A603BDF61958255C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 104 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0CE048994F31493F88154657675D7ECD"><subsection id="H194059771FAD445AB2018AEA9E43A4BA"><enum>(n)</enum><header>Plan To track discriminatory land use policies</header><paragraph id="H23736FFF1F274300A45632E90FC90016"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Prior to receipt in any fiscal year of a grant from the Secretary under subsection (b), (d)(1), or (d)(2)(B) of section 106, each recipient shall have prepared and submitted, not less frequently than once during the preceding 5-year period, in accordance with this subsection and in such standardized form as the Secretary shall, by regulation, prescribe, with respect to each land use policy described in paragraph (2) that is applicable to the jurisdiction served by the recipient, a description of—</text><subparagraph id="H923EA13733F84E7989C0279472D42E83"><enum>(A)</enum><text>whether the recipient has already adopted the policy in the jurisdiction served by the recipient;</text></subparagraph><subparagraph id="H762C620FFAC0447591355B4F121ACB2D"><enum>(B)</enum><text>the plan of the recipient to implement the policy in that jurisdiction; or</text></subparagraph><subparagraph id="H088B84FC31EC40808E8B29B9FA1A7ABA"><enum>(C)</enum><text display-inline="yes-display-inline">the ways in which adopting the policy will benefit the jurisdiction.</text></subparagraph></paragraph><paragraph id="H7C11BE993335445F86E59DD320F16BBA"><enum>(2)</enum><header>Land use policies</header><text>The policies described in this paragraph are as follows:</text><subparagraph id="HEFD1072E98244D5E9B99B8384A56275A"><enum>(A)</enum><text>Enacting high-density single-family and multifamily zoning.</text></subparagraph><subparagraph id="HCED7890C4E7A4D708EC1E1D779FC29EB"><enum>(B)</enum><text>Expanding by-right multifamily zoned areas.</text></subparagraph><subparagraph id="HBDBE61411AA34EE88E3203CBE93D8515"><enum>(C)</enum><text>Allowing duplexes, triplexes, or fourplexes in areas zoned primarily for single-family residential homes.</text></subparagraph><subparagraph id="HA13850B1A25246C084CA6BC1B072161A"><enum>(D)</enum><text>Allowing manufactured homes in areas zoned primarily for single-family residential homes.</text></subparagraph><subparagraph id="HD38A2FFF13C64E4CA1F02EE8E61546E4"><enum>(E)</enum><text>Allowing multifamily development in retail, office, and light manufacturing zones.</text></subparagraph><subparagraph id="H7BC320133EFC4AFEA3721A295827B827"><enum>(F)</enum><text>Allowing single-room occupancy development wherever multifamily housing is allowed.</text></subparagraph><subparagraph id="HBC83E5220CE34D8E99CE86A88B1D717B"><enum>(G)</enum><text>Reducing minimum lot size.</text></subparagraph><subparagraph id="HE4D16E4C60AD455B9271637B96A5ADA8"><enum>(H)</enum><text display-inline="yes-display-inline">Ensuring historic preservation requirements and other land use policies or requirements are coordinated to encourage creation of housing in historic buildings and historic districts.</text></subparagraph><subparagraph id="H925C52107BB845C59DCB747797EA3D4B"><enum>(I)</enum><text>Increasing the allowable floor area ratio in multifamily housing areas.</text></subparagraph><subparagraph id="HFD9C2DCB41A04574ADF8051C01DE7383"><enum>(J)</enum><text>Creating transit-oriented development zones.</text></subparagraph><subparagraph id="H790D8D7DF7604756BCFC80B5CE696C2E"><enum>(K)</enum><text>Streamlining or shortening permitting processes and timelines, including through one-stop and parallel-process permitting.</text></subparagraph><subparagraph id="H345329084CF24B94B129B2B2E41CE5CD"><enum>(L)</enum><text>Eliminating or reducing off-street parking requirements.</text></subparagraph><subparagraph id="H4DD6A61FE2154BD79007B8E0048696AA"><enum>(M)</enum><text display-inline="yes-display-inline">Ensuring impact and utility investment fees accurately reflect required infrastructure needs and related impacts on housing affordability are otherwise mitigated.</text></subparagraph><subparagraph id="H516DF45A66B944C9B13F6A270A44BD8E"><enum>(N)</enum><text>Allowing prefabricated construction.</text></subparagraph><subparagraph id="HC042781D37B64B7A95B3FBA0E3F2CEF4"><enum>(O)</enum><text>Reducing or eliminating minimum unit square footage requirements.</text></subparagraph><subparagraph id="H0DC1F63A56CF474EB6261DB670076918"><enum>(P)</enum><text>Allowing the conversion of office units to apartments.</text></subparagraph><subparagraph id="H74E5FA09E40B4F5EA5D0C489FA1ADD0A"><enum>(Q)</enum><text>Allowing the subdivision of single-family homes into duplexes.</text></subparagraph><subparagraph id="H2686D54624C04D94AA5B38F24E688161"><enum>(R)</enum><text>Allowing accessory dwelling units, including detached accessory dwelling units, on all lots with single-family homes.</text></subparagraph><subparagraph id="H40AEC1C025BB499C92B4B2AC1869E84C"><enum>(S)</enum><text display-inline="yes-display-inline">Establishing density bonuses.</text></subparagraph><subparagraph id="H6F74FF1E093E48DDB35006644404DBAB"><enum>(T)</enum><text>Eliminating or relaxing residential property height limitations.</text></subparagraph><subparagraph id="H9CA0DB0812D74C3D9651D689769D6B6E"><enum>(U)</enum><text>Using property tax abatements to enable higher density and mixed-income communities.</text></subparagraph><subparagraph id="H3D76C9CA608A4DD0B6B2C8C4CBC24832"><enum>(V)</enum><text>Donating vacant land for affordable housing development.</text></subparagraph></paragraph><paragraph id="H40FDE6A3695F4A06B01E33E8C785BA14"><enum>(3)</enum><header>Effect of submission</header><text>A submission under this subsection shall not be binding with respect to the use or distribution of amounts received under section 106.</text></paragraph><paragraph id="H1142CE576B86448ABA04DF7AE2E534AB"><enum>(4)</enum><header>Acceptance or nonacceptance of plan</header><text>The acceptance or nonacceptance of any plan submitted under this subsection in which the information required under this subsection is provided is not an endorsement or approval of the plan, policies, or methodologies, or lack thereof.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC10BA0A33E874B6FAEA8177A28B934AD"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The requirements under subsection (n) of section 104 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304</external-xref>), as added by subsection (a), shall—</text><paragraph id="HD41F5069C27C43A08A9AFA841271A19C"><enum>(1)</enum><text display-inline="yes-display-inline">take effect on the date that is 1 year after the date of enactment of this Act; and</text></paragraph><paragraph id="H8BCAA4C7C6194E72AD6B182A11A93FF4"><enum>(2)</enum><text>apply to recipients of a grant under subsection (b), (d)(1), or (d)(2)(B) of section 106 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306</external-xref>) before, on, and after such date.</text></paragraph></subsection></section></legis-body></bill>
