<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1612</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210513">May 13, 2021</action-date><action-desc><sponsor name-id="S324">Mrs. Shaheen</sponsor> (for herself, <cosponsor name-id="S388">Ms. Hassan</cosponsor>, <cosponsor name-id="S309">Mr. Casey</cosponsor>, <cosponsor name-id="S363">Mr. King</cosponsor>, and <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to assist States to rehabilitate or replace certain bridges, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id0CB71DDD15D648B0A53F7F3514C9D602"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthen And Fortify Existing Bridges Act of 2021</short-title></quote> or the <quote><short-title>SAFE Bridges Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="H3A2622FEAF8C4E79B961FEA330AE6930"><enum>2.</enum><header>Strengthen and fortify existing bridges</header><subsection id="H1E5D72CD1F7049B9B763A4F09FF84626"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HFB31440382D04D0EB31A183C97C1546E"><enum>(1)</enum><header>Bridge</header><text>The term <term>bridge</term> means a highway bridge on a public road, whether on or off a Federal-aid highway.</text></paragraph><paragraph id="H9526FC1E1FA84D72A3441FAFB5CF8332"><enum>(2)</enum><header>Eligible
 bridge</header><text display-inline="yes-display-inline">The term <term>eligible bridge</term> means a bridge that is classified as in poor condition.</text></paragraph><paragraph id="H45AC362DE10E46B4AF802ACDE61E6E7E"><enum>(3)</enum><header>Federal-aid
 highway</header><text display-inline="yes-display-inline">The term <term>Federal-aid highway</term> has the meaning given the term in section 101(a) of title 23, United States Code.</text></paragraph><paragraph id="H82652484344040EBBC2A207A8E7F4601"><enum>(4)</enum><header>Public
 road</header><text display-inline="yes-display-inline">The term <term>public road</term> has the meaning given the term in section 101(a) of title 23, United States Code.</text></paragraph><paragraph id="H2E8AC097A15D4F4F910685C9686DDB7E"><enum>(5)</enum><header>Rehabilitation</header><text display-inline="yes-display-inline">The term <term>rehabilitation</term> means, with respect to a bridge, the carrying out of major work necessary, as determined by the Secretary—</text><subparagraph id="HF9E162EF541C45A89488EEE253031CC0"><enum>(A)</enum><text>to restore or increase the structural capacity of the bridge; or</text></subparagraph><subparagraph id="HA885438585A24477BC612CAADB8070C2"><enum>(B)</enum><text>to correct a major safety defect of the bridge.</text></subparagraph></paragraph><paragraph id="H8A8ADB95D32144F8B758431FEE43BC9C"><enum>(6)</enum><header>Replacement</header><text display-inline="yes-display-inline">The term <term>replacement</term> means, with respect to a bridge, the construction of a new facility that, as determined by the Secretary, is in the same general traffic corridor as the replaced bridge.</text></paragraph><paragraph id="idB24B8CC8E122432EBD57061361A6743E"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="id30ACCBD1997C4C0C9699D9719C784807"><enum>(8)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means—</text><subparagraph id="id2DB8CA817A9543C5AA7187E7260CB31C"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text></subparagraph><subparagraph id="id4B4428D6F65D4A81BF41F2A025EE35EE"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia; and</text></subparagraph><subparagraph id="id0C158B6E654E4CEA9624794C0ED6C8B3"><enum>(C)</enum><text>the Commonwealth of Puerto Rico.</text></subparagraph></paragraph></subsection><subsection id="H79D37BE09EEA4D6B8793B349C9BF9BBD"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary shall establish a program to assist States to rehabilitate or replace eligible bridges.</text></subsection><subsection id="H66E156D71169420B9C5AEBF69044860E"><enum>(c)</enum><header>Apportionment of
			 funds</header><paragraph id="H04B62C7930454DC883300FE8A702D98E"><enum>(1)</enum><header>In
 general</header><text>Amounts made available to carry out the program established under subsection (b) for a fiscal year shall be apportioned to each State according to the ratio that—</text><subparagraph id="H90C2252839B94F51BDBBFF1827B0E503"><enum>(A)</enum><text display-inline="yes-display-inline">the total cost to rehabilitate or replace eligible bridges in that State; bears to</text></subparagraph><subparagraph id="H9AFE083B8E3F4A77B86738F01B5D5055"><enum>(B)</enum><text display-inline="yes-display-inline">the total cost to rehabilitate or replace eligible bridges in all States.</text></subparagraph></paragraph><paragraph id="H236D72C240F74A6FB89ED81F5B5E1BAB"><enum>(2)</enum><header>Calculation of
 total cost</header><subparagraph commented="no" id="id2A243F0FA2AB4309B987DDB714371ABA"><enum>(A)</enum><header>In general</header><text>For purposes of the calculation under paragraph (1), the Secretary shall multiply the deck area of eligible bridges by the unit price on a State-by-State basis, as determined by the Secretary, to determine the total cost to rehabilitate or replace eligible bridges in each State.</text></subparagraph><subparagraph id="HB0D57E6979514288879AEA0B56A5EC1C"><enum>(B)</enum><header>Data used in
 making determinations</header><text>The Secretary shall make determinations under this subsection based on the latest available data, which shall be updated not less than annually.</text></subparagraph><subparagraph id="H2E999DE27D674871814A2B8B72E2B031"><enum>(C)</enum><header>Use of existing
 inventories</header><text>To the extent practicable, the Secretary shall make determinations under this subsection using inventories prepared under section 144 of title 23, United States Code.</text></subparagraph></paragraph></subsection><subsection id="H06251FE1F95F4AF2A673D5CC65E8CAFF"><enum>(d)</enum><header>Use of
 funds</header><text>Funds apportioned to a State under the program established under subsection (b) shall—</text><paragraph id="H31DD6BD4D69442E0A2C1DC012BFDE434"><enum>(1)</enum><text display-inline="yes-display-inline">be used by that State—</text><subparagraph id="id36E498F59CC94E70AB0F32F745DFC88F"><enum>(A)</enum><text display-inline="yes-display-inline">for the rehabilitation and replacement of 1 or more eligible bridges; or</text></subparagraph><subparagraph id="id8560D3A237EA46A39664977D19162396"><enum>(B)</enum><text>to maintain the surface coating and corrosion protection system of 1 or more eligible bridges;</text></subparagraph></paragraph><paragraph id="HB0A512BFA7EB42088E2917F27CA17D57"><enum>(2)</enum><text display-inline="yes-display-inline">notwithstanding any other provision of law, be administered as if apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, except that the funds shall not be transferable;</text></paragraph><paragraph id="H9C8103E8892848EABFF8B4FD7437E603"><enum>(3)</enum><text display-inline="yes-display-inline">be subject to the requirements described in section 1101(b) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/23/101">23 U.S.C. 101</external-xref> note; 129 Stat. 1323) in the same manner as amounts made available for programs under titles I, II, and III of that Act; and</text></paragraph><paragraph id="HC2234C4C80104A5DB4630BCE42C93727"><enum>(4)</enum><text display-inline="yes-display-inline">not be subject to any limitation on obligations for Federal-aid highways or highway safety construction programs set forth in any Act.</text></paragraph></subsection><subsection commented="no" id="H530ACF63F62043E58E0397C340021BD2"><enum>(e)</enum><header>Condition at
 project completion</header><text>On completion of the rehabilitation or replacement, a bridge that is rehabilitated or replaced under the program established under subsection (b) may not be classified as in poor condition.</text></subsection><subsection id="H7668ADFEEB0D4A5089401884AE140EB6"><enum>(f)</enum><header>Federal
 share</header><text display-inline="yes-display-inline">The Federal share of the cost of a project carried out with funds apportioned to a State under the program established under subsection (b) shall be 100 percent.</text></subsection><subsection id="H1389F7645EE5408797F0F98752BB3CC7"><enum>(g)</enum><header>Reapportionment
 of unobligated funds</header><text display-inline="yes-display-inline">Any funds apportioned to a State under the program established under subsection (b) and not obligated by the State at the end of the third fiscal year beginning after the fiscal year during which the funds were apportioned shall be withdrawn from the State and reapportioned by the Secretary to States that have not had funds withdrawn under this subsection in accordance with the formula under subsection (c).</text></subsection><subsection id="H214B631B4DFE407E84EF3BDC9DC8716E"><enum>(h)</enum><header>Nonsubstitution</header><text display-inline="yes-display-inline">In carrying out the program established under subsection (b), the Secretary shall ensure that funding made available to a State under the program supplements, and does not supplant—</text><paragraph id="H83B676C8E1484C969B0677F9666A7719"><enum>(1)</enum><text display-inline="yes-display-inline">other Federal funding made available for the rehabilitation or replacement of eligible bridges; and</text></paragraph><paragraph id="HC4B052E61ABA4E32B11BD7F47469762E"><enum>(2)</enum><text>the planned obligations of that State with respect to eligible bridges.</text></paragraph></subsection><subsection id="H14333727407F4977822198AD84A68E6D"><enum>(i)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and each year thereafter if States obligated funds apportioned under the program established under subsection (b) during that year, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report that describes the amounts obligated by each State for projects under the program.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1113f9b9e97747acb60d95c183b6b0be"><enum>(j)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $2,750,000,000 for each of fiscal years 2022 through 2027, to remain available until expended.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4C0C5AFC47334CFD949A9BB46E820312"><enum>(k)</enum><header>National bridge and tunnel inventories</header><text>Section 144(b)(5) of title 23, United States Code, is amended by striking <quote>structurally deficient bridge identified under this subsection</quote> and inserting <quote>bridge classified as in poor condition</quote>.</text></subsection></section></legis-body></bill>
