which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to improve the Law Enforcement Officers Safety Act of 2004 and provisions relating to the carrying of concealed weapons by law enforcement officers, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1F276735624949F6BD2369F280AB7D15"><section section-type="section-one" id="H495CAAE196C346A28FC93CC72A2BE2F7"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>LEOSA Reform Act</short-title></quote>.</text></section><section id="H449ADDECD16B4CDFA4D42B778C30F21D"><enum>2.</enum><header>Conforming the Law Enforcement Officers Safety Act of 2004 and the Gun-Free School Zones Act of 1990</header><text display-inline="no-display-inline">Section 922(q)(2)(B) of title 18, United States Code, is amended—</text><paragraph id="HCF0D552F614C45F1BAE3F3395B67A822"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (vi);</text></paragraph><paragraph id="H2B0BA16CF466451682056C10683DA823"><enum>(2)</enum><text>by striking the period at the end of clause (vii) and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H5601DA5D5DFD491C9F17DB556822B392"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H00A5659E2FC74FE2A57055D5EDBFB823"><clause id="H4ADC3DD9F0F640548BF65C02B641A3B3" indent="up2"><enum>(viii)</enum><text display-inline="yes-display-inline">by an individual authorized by section 926B or 926C to carry a concealed firearm.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H661BD36FFA314528A73A63A87EA5CF76"><enum>3.</enum><header>Making improvements to the Law Enforcement Officers Safety Act of 2004</header><subsection display-inline="no-display-inline" id="H6165B9F55930453DA62F7AE9708CE4ED"><enum>(a)</enum><text display-inline="yes-display-inline">Each of sections 926B(a) and 926C(a) of title 18, United States Code, is amended by inserting <quote>or any other provision of Federal law, or any regulation prescribed by the Secretary of the Interior pertaining to a unit of the National Park System</quote> after <quote>thereof</quote>.</text></subsection><subsection id="HD9CC771603EC4A6FAEFBC50868CACC32"><enum>(b)</enum><text display-inline="yes-display-inline">Each of sections 926B(b) and 926C(b) of such title are amended—</text><paragraph id="HFD348C6C06D74734A1EB16B47EABB7C4"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>, except to the extent that the laws apply on property used by a common or contract carrier to transport people or property by land, rail, or water or on property open to the public (whether or not a fee is charged to enter the property)</quote> before the semicolon; and</text></paragraph><paragraph display-inline="no-display-inline" id="H250E929700434378A254F9BFCA55BD04"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>, except to the extent that the laws apply on property used by a common or contract carrier to transport people or property by land, rail, or water or on property open to the public (whether or not a fee is charged to enter the property)</quote> before the period.</text></paragraph></subsection><subsection id="HF8148755615F4554A745D14CE17D927D"><enum>(c)</enum><text display-inline="yes-display-inline">Each of sections 926B(e)(2) and 926C(e)(1)(B) of such title is amended by inserting <quote>any magazine and</quote> after <quote>includes</quote>.</text></subsection><subsection id="HC5996B711DFB454C8D9F8A38BF561E00"><enum>(d)</enum><text>Section 926C(c)(4) of such title is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H00B4C12DDF86488FB375612B7241ED27"><paragraph id="H68097042BD2A477C8949C77A2ED7CCC9"><enum>(4)</enum><text display-inline="yes-display-inline">has met the standards for qualification in firearms training during the most recent period of 12 months (or, at the option of the State in which the individual resides, a greater number of months, not exceeding 36 months), and for purposes of this paragraph, the term <term>standards for qualification in firearms training</term> means—</text><subparagraph id="H523CA2BEC08F42AF833553B2B0C801A7"><enum>(A)</enum><text display-inline="yes-display-inline">the standards for active duty law enforcement officers as established by the former agency of the individual;</text></subparagraph><subparagraph id="HC5386AAFDDEB45908FCC2121ABABD17A"><enum>(B)</enum><text>the standards for active duty law enforcement officers as established by the State in which the individual resides;</text></subparagraph><subparagraph id="H7B6D961E9C0A4C418CA6B07F5AEC14CD"><enum>(C)</enum><text>the standards for active duty law enforcement officers employed by any law enforcement agency in the State in which the individual resides; or</text></subparagraph><subparagraph id="H05FD431DE7684AA4B328F673BCD4374C"><enum>(D)</enum><text>any standard for active duty law enforcement officers for firearms qualification conducted by any certified firearms instructor within the State in which the individual resides;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9E1D92D1FD1045AD9F65A26D81BDED1A"><enum>(e)</enum><text display-inline="yes-display-inline">Section 926C(d) of such title is amended—</text><paragraph id="H961BAC268460439685D74BCCC6DE32AF"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>not less recently than one year before the date the individual is carrying the concealed firearm, been tested or otherwise found by the agency to meet the active duty standards for qualification in firearms training as established by the agency to carry</quote> and inserting <quote>met the standards for qualification in firearms training required by subsection (c)(4) for</quote>; and</text></paragraph><paragraph id="HE4063F150F46440A98FFC0A4B18CAA3E"><enum>(2)</enum><text>in paragraph (2), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7D0C3CA8497C420CAE398EE62CA5CE42"><subparagraph id="HC07D3207D7CF4A599307DC1885E99DB4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">a certification issued by the former agency of the individual, the State in which the individual resides, any law enforcement agency within the State in which the individual resides, or any certified firearms instructor within the State in which the individual resides that indicates that the individual has met the standards for qualification in firearms training required by subsection (c)(4).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HCC7A347AB27546258F8C5456C567FDC6"><enum>4.</enum><header>Permitting qualified current and retired law enforcement officers to carry firearms in certain Federal facilities</header><text display-inline="no-display-inline">Section 930 of title 18, United States Code, is amended—</text><paragraph id="H388F89DE519E4C788701B01F9691894B"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="H0D12C8E10602495DBE8522C52CC028AF"><enum>(A)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HEE6FE21D55374875823CBB6AE304D863"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>or</quote>; and</text></subparagraph><subparagraph id="HBBA1D613AB814202A6AE5056C12E2C37"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H25931C422AF541E097B635620EAEF663"><paragraph id="HFF73FD790A6A410EADEAF6B3E4612B49"><enum>(4)</enum><text display-inline="yes-display-inline">the possession of a firearm or ammunition in a Facility Security Level I or II civilian public access facility by a qualified law enforcement officer (as defined in section 926B(c)) or a qualified retired law enforcement officer (as defined in section 926C(c)).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H572F2B8E715C4D37A486571E227AB350"><enum>(2)</enum><text>in subsection (g), by adding at the end the following:</text><quoted-block style="OLC" id="HEDE8DB95AAC64451B2814D8C3B3F3791"><paragraph id="HEFDC578480B743559967EA503EBFE238"><enum>(4)</enum><text>The term <term>Facility Security Level</term> means a security risk assessment level assigned to a Federal facility by the security agency of the facility in accordance with the biannually issued Interagency Security Committee Standard.</text></paragraph><paragraph id="HB233548AAC9943A99F6D310CCDEE37BE"><enum>(5)</enum><text>The term <term>civilian public access facility</term> means a facility open to the general public.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
