<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1609</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210513">May 13, 2021</action-date><action-desc><sponsor name-id="S369">Mr. Markey</sponsor> (for himself, <cosponsor name-id="S318">Mr. Wicker</cosponsor>, and <cosponsor name-id="S330">Mr. Bennet</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to ensure that electrochromic glass qualifies as energy property for purposes of the energy credit.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dynamic Glass Act</short-title></quote>.</text></section><section id="id09CD990F805E459A98ADD0D20D00B93F"><enum>2.</enum><header>Inclusion of electrochromic glass as energy property for purposes of the energy credit</header><subsection id="id98C5B73CA1A74925BA30DBBD506E0039"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/48">Section 48(a)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="id0D45CC5D1E4A4F3DAB1FA8648B460912"><enum>(1)</enum><text>in paragraph (2)(A)(i)—</text><subparagraph id="idD9C8038768744ED099541DD10F13C251"><enum>(A)</enum><text>in subclause (IV), by striking <quote>and</quote> at the end, and</text></subparagraph><subparagraph id="id7C9F3A920FD0461EBFDE0193B56AA323"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFEE4B2B30045431CB4B66B55EC804DD4"><subclause id="id0033536E0DE34D4F8F63B1A72B336588"><enum>(VI)</enum><text>energy property described in paragraph (3)(A)(ix) but only with respect to property the construction of which begins before January 1, 2024, and</text></subclause><after-quoted-block>,</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0C3314AA0BCE46148DF9C47505D12CAF"><enum>(2)</enum><text>in paragraph (3)(A)—</text><subparagraph id="idEAC6025AF4FB40978A8FD69E8398AF1E"><enum>(A)</enum><text>in clause (vii), by striking <quote>or</quote> at the end,</text></subparagraph><subparagraph id="id8B55CF3148E5444C8953EF08A32BAB0B"><enum>(B)</enum><text>in clause (viii), by adding <quote>or</quote> at the end, and</text></subparagraph><subparagraph id="id15D4027AA8D949A0B26E5B80311CDEF8"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id904446DF33044CCA8D6AC29738289B67"><clause id="id439A2A687BB243039556F86B3473BD91"><enum>(ix)</enum><text>glass which uses electricity to change its light transmittance properties in order to heat or cool a structure,</text></clause><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id63D23E02563047C7B45A9831D2FFBF5F"><enum>(3)</enum><text>in paragraph (6), by striking <quote>paragraph (3)(A)(i)</quote> each place it appears and inserting <quote>clause (i) or (ix) of paragraph (3)(A)</quote>.</text></paragraph></subsection><subsection id="idBE4CAD9262B3484B845AD28799259F8F"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
