which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to establish a Joint Chiefs Landscape Restoration Partnership program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Joint Chiefs Landscape Restoration Partnership Act of 2021</short-title></quote>.</text></section><section id="idFF11045FC04F4010BD2ED10A3A3E3E27"><enum>2.</enum><header>Joint Chiefs Landscape Restoration Partnership program</header><subsection id="id6DED3A32CB0F4AF0AEE52BA763382904"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id3C1DDD43C8C84318AAA2753B6971EC5C"><enum>(1)</enum><header>Chiefs</header><text>The term <term>Chiefs</term> means the Chief of the Forest Service and the Chief of the Natural Resources Conservation Service.</text></paragraph><paragraph id="id0a852be1f6af424c8a9c339921f091c2"><enum>(2)</enum><header>Eligible activity</header><text>The term <term>eligible activity</term> means an activity—</text><subparagraph id="ida46654f8426d4732994bcb6cd169d009"><enum>(A)</enum><text>to reduce the risk of wildfire;</text></subparagraph><subparagraph id="idcf0c83ba2a68447b93c89a3c425719d8"><enum>(B)</enum><text>to protect water quality and supply; or</text></subparagraph><subparagraph id="id36dfac5ccad94cf9a1ff4398d67c4b36"><enum>(C)</enum><text>to improve wildlife habitat for at-risk species. </text></subparagraph></paragraph><paragraph id="idDBA0DB380F8C42CB9D184CEA07CA9790"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the Joint Chiefs Landscape Restoration Partnership program established under subsection (b)(1).</text></paragraph><paragraph id="id6288604BA8E9456B8658DDF662EE781B"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="id112CE858920D4C9591C50AF21C4F760C"><enum>(5)</enum><header>Wildland-urban interface</header><text>The term <term>wildland-urban interface</term> has the meaning given the term in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>).</text></paragraph></subsection><subsection id="id3b392463f155431594e5bc6e736b8bd9"><enum>(b)</enum><header>Establishment</header><paragraph id="idba8e0d00b3c549e68dd567248a0e3157"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a Joint Chiefs Landscape Restoration Partnership program to improve the health and resilience of forest landscapes across National Forest System land and State, Tribal, and private land.</text></paragraph><paragraph id="id912cbea709cd4636b7f4bc4365e8a54f"><enum>(2)</enum><header>Administration</header><text>The Secretary shall administer the program by coordinating eligible activities conducted on National Forest System land and State, Tribal, or private land across a forest landscape to improve the health and resilience of the forest landscape by—</text><subparagraph id="idd057c8da42c7446bbc91249749b6b393"><enum>(A)</enum><text>assisting producers and landowners in implementing eligible activities on eligible private or Tribal land using the applicable programs and authorities administered by the Chief of the Natural Resources Conservation Service under title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3801">16 U.S.C. 3801</external-xref> et seq.), not including the conservation reserve program established under subchapter B of chapter 1 of subtitle D of that title (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831</external-xref> et seq.); and</text></subparagraph><subparagraph id="id57982cfb019244048c0fd0df72fbad50"><enum>(B)</enum><text>conducting eligible activities on National Forest System land or assisting landowners in implementing eligible activities on State, Tribal, or private land using the applicable programs and authorities administered by the Chief of the Forest Service.</text></subparagraph></paragraph></subsection><subsection id="id1ce061b521dc4706be5a9b10d73a08e4"><enum>(c)</enum><header>Selection of eligible activities</header><text>The appropriate Regional Forester and State Conservationist shall jointly submit to the Chiefs on an annual basis proposals for eligible activities under the program.</text></subsection><subsection id="id569a8ce164b04f449e950ffb01a46205"><enum>(d)</enum><header>Evaluation criteria</header><text>In evaluating and selecting proposals submitted under subsection (c), the Chiefs shall consider—</text><paragraph id="id81D09C6BFF164611B136EC4EB60259E1"><enum>(1)</enum><text>criteria including whether the proposal—</text><subparagraph id="id0ac640c1cecc4983ae665cea4b72dd1e"><enum>(A)</enum><text>reduces wildfire risk in a municipal watershed or the wildland-urban interface;</text></subparagraph><subparagraph id="idd853705eddd64a01904b77ced1abb472"><enum>(B)</enum><text>was developed through a collaborative process with participation from diverse stakeholders;</text></subparagraph><subparagraph id="id6432f08ab24a4592acf35db66e520f1f"><enum>(C)</enum><text>increases forest workforce capacity or forest business infrastructure and development;</text></subparagraph><subparagraph id="id7151de58234b48858268a13f34fe68db"><enum>(D)</enum><text>leverages existing authorities and non-Federal funding;</text></subparagraph><subparagraph id="id2f0d489c2a7d4c26a84e7565fbe5c643"><enum>(E)</enum><text>provides measurable outcomes; or</text></subparagraph><subparagraph id="id7a9247621a7e4530aac7e4525a35143d"><enum>(F)</enum><text>supports established State and regional priorities; and</text></subparagraph></paragraph><paragraph id="id3B63C5ED768F4930A7914D6B73213785"><enum>(2)</enum><text>such other criteria relating to the merits of the proposals as the Chiefs determine to be appropriate.</text></paragraph></subsection><subsection id="id1948c2d197b546c4bad10ac18a1425bf"><enum>(e)</enum><header>Outreach</header><text>The Secretary shall provide—</text><paragraph id="id064cfec2419c492eb40229eaaa4641f0"><enum>(1)</enum><text>public notice on the websites of the Forest Service and the Natural Resources Conservation Service describing—</text><subparagraph id="id071F2F7C6A614415B1837E29DE3B96E4"><enum>(A)</enum><text>the solicitation of proposals under subsection (c); and </text></subparagraph><subparagraph id="id782AEEA359274011AAC9B22CEABC3241"><enum>(B)</enum><text>the criteria for selecting proposals in accordance with subsection (d); and</text></subparagraph></paragraph><paragraph id="idf6fdaabc93e748e9ad45e9c1f3e2d42e"><enum>(2)</enum><text>information relating to the program and activities funded under the program to States, Indian Tribes, units of local government, and private landowners.</text></paragraph></subsection><subsection id="idc6d66157a51a4cc78d3c70e55c580542"><enum>(f)</enum><header>Exclusions</header><text>An eligible activity may not be carried out under the program—</text><paragraph id="id48b4817b162146308708466fdb166c08"><enum>(1)</enum><text>in a wilderness area or designated wilderness study area;</text></paragraph><paragraph id="idf5b1d80bb7e4477ea603a6ad3ff1a836"><enum>(2)</enum><text>in an inventoried roadless area;</text></paragraph><paragraph id="id0d32d2896e8b492ba5c1c869c49cf806"><enum>(3)</enum><text>on any Federal land on which, by Act of Congress or Presidential proclamation, the removal of vegetation is restricted or prohibited; or</text></paragraph><paragraph id="idaf1a2648d150464e92d072137fcce401"><enum>(4)</enum><text>in an area in which the eligible activity would be inconsistent with the applicable land and resource management plan. </text></paragraph></subsection><subsection id="idDBE9D7B1C3294DE38511B8ADD480B0F0"><enum>(g)</enum><header>Accountability</header><paragraph id="id49db557b93fb42c58015051f7e4aef60"><enum>(1)</enum><header>Initial report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report providing recommendations to Congress relating to the program, including a review of—</text><subparagraph id="idA28FD9F9F41A4A09AD6D10A8839EB23F"><enum>(A)</enum><text>funding mechanisms for the program;</text></subparagraph><subparagraph id="id8B2649D1B66D4CBBAEBC3F631B6004C8"><enum>(B)</enum><text>staff capacity to carry out the program; </text></subparagraph><subparagraph id="idCA24D3649DE0471E9117108D00720048"><enum>(C)</enum><text>privacy laws applicable to the program;</text></subparagraph><subparagraph id="id85D2C1AD74024558A89A4C49F1831F13"><enum>(D)</enum><text>data collection under the program;</text></subparagraph><subparagraph id="id122639AF5EA64CD49A11DEC27A949227"><enum>(E)</enum><text>monitoring and outcomes under the program; and</text></subparagraph><subparagraph id="id51D3FFEC6BBD4AF19CADEB775A52A4AD"><enum>(F)</enum><text>such other matters as the Secretary considers to be appropriate.</text></subparagraph></paragraph><paragraph id="id792067c35f4747b4a885685b120e5972"><enum>(2)</enum><header>Annual reports</header><text>The Chiefs shall annually submit to the Committee on Agriculture, Nutrition, and Forestry and the Committee on Appropriations of the Senate and the Committee on Agriculture and the Committee on Appropriations of the House of Representatives a report describing projects for which funding is provided under the program, including the status and outcomes of those projects.</text></paragraph></subsection><subsection id="id1d2fe2f2d1c44d04bf4dd17755254d85"><enum>(h)</enum><header>Funding</header><paragraph id="id30194f6ee2064d2e9871bfebd0a9e2c6"><enum>(1)</enum><header>Authorization of appropriations</header><text>In addition to amounts otherwise available to the Secretary to carry out the program, there is authorized to be appropriated to the Secretary to carry out the program $90,000,000 for each of fiscal years 2021 through 2030.</text></paragraph><paragraph id="idfb2f018834c24c2b8169af5273428c33"><enum>(2)</enum><header>Duration of availability</header><text>Funds made available under paragraph (1) shall remain available until expended.</text></paragraph><paragraph id="id171c96c9ec914e9295737f59e044db9e"><enum>(3)</enum><header>Distribution of funds</header><text>Of the funds made available under paragraph (1)—</text><subparagraph id="id8186e6c9a7d2477ab229586f55a65921"><enum>(A)</enum><text>not less than 40 percent shall be allocated to carry out eligible activities through the Natural Resources Conservation Service; </text></subparagraph><subparagraph id="idd09e708193d84fce9282a9f0b4d9e4b5"><enum>(B)</enum><text>not less than 40 percent shall be allocated to carry out eligible activities through the Forest Service; and</text></subparagraph><subparagraph id="idA59FEFBB3E19429786199F51A78DC63B"><enum>(C)</enum><text>the remaining funds shall be allocated by the Chiefs to the Natural Resources Conservation Service or the Forest Service—</text><clause id="idDC79ECCD78DF468EBFE42981A246199B"><enum>(i)</enum><text>to carry out eligible activities; or</text></clause><clause id="idFFE8C0254C27453B93B0C1DE9072FC4B"><enum>(ii)</enum><text>for other purposes, such as technical assistance, project development, or local capacity building.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
