Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Surface Mining Control and Reclamation Act of 1977 to make modifications to the Abandoned Mine Reclamation Fund, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abandoned Mine Land Reclamation Fee Reauthorization Act of 2021</short-title></quote>.</text></section><section id="idc9c35a35af4d4d43b3f8e472a40a93e7"><enum>2.</enum><header>Reclamation fee</header><subsection id="idBB97647E173642278DDD924D35944AF0"><enum>(a)</enum><header>Amount</header><text display-inline="yes-display-inline">Section 402(a) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(a)</external-xref>) is amended—</text><paragraph id="idE72C2D5D973D49708739B29EEB3C2C6C"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>28 cents</quote> and inserting <quote>16.8 cents</quote>;</text></paragraph><paragraph id="idBB94F31695524A7AA39A9E95D257445C"><enum>(2)</enum><text display-inline="yes-display-inline"> by striking <quote>12 cents</quote> and inserting <quote>7.2 cents</quote>; and</text></paragraph><paragraph id="idFB7CE986B3974B12B54DCCD6DB3A171A"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>8 cents</quote> and inserting <quote>4.8 cents</quote>.</text></paragraph></subsection><subsection id="id0f74ca70a366434f91898951005db66d"><enum>(b)</enum><header>Duration</header><text display-inline="yes-display-inline">Section 402(b) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(b)</external-xref>) is amended by striking <quote>September 30, 2021</quote> and inserting <quote>September 30, 2028</quote>. </text></subsection></section><section id="id9DFC3007D1174B328700A705A210921B"><enum>3.</enum><header>Increased revenue sharing with coal-producing States</header><text display-inline="no-display-inline">Section 35(a) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191(a)</external-xref>) is amended, in the first sentence, by striking <quote>50 per centum thereof</quote> and inserting <quote>50 percent of the amount received, or in the case of any amount received from coal leases, 60 percent of the amount received,</quote>. </text></section><section id="ide1fd27e2c1e54094862fcb12eb235acc"><enum>4.</enum><header>Sequestration provisions</header><subsection id="idA6A6F39C16CA46F5A06ED967FA58A253"><enum>(a)</enum><header>Exemption of payments to states and indian tribes from the abandoned mine reclamation fund from sequestration</header><paragraph id="id035759e6292b45119fc55af8d32a792d"><enum>(1)</enum><header>In general</header><text>Section 255(g)(1)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/905">2 U.S.C. 905(g)(1)(A)</external-xref>) is amended by inserting after <quote>Payments to Social Security Trust Funds (28–0404–0–1–651).</quote> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb6f5f656e2cd45c7a578987bd56f2cb3"><paragraph id="idef016bab699b453b85cde6e892fc4b67"><enum>(1)</enum><text>Payments to States and Indian Tribes from the Abandoned Mine Reclamation Fund and payments to States and Indian Tribes under section 402(i)(2) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(i)(2)</external-xref>) (12–50q5–0–2–999).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id5f0419cfb0354e858115d798bb22f53f"><enum>(2)</enum><header>Applicability</header><text>The amendment made by paragraph (1) shall apply to any sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900</external-xref> et seq.) on or after the date of enactment of this Act.</text></paragraph></subsection><subsection id="idC190F11635314426988E58AC70E4BE83"><enum>(b)</enum><header>Payment from withheld amounts</header><paragraph id="id1DC9651F73EF47EA90AC8991CFE4D187"><enum>(1)</enum><header>In general</header><text>From amounts withheld pursuant to section 251A of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901a">2 U.S.C. 901a</external-xref>) from payments to States and Indian tribes under section 402(g) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(g)</external-xref>) during fiscal years 2013 through 2021, the Secretary of the Interior (referred to in this Act as the <quote>Secretary</quote>) shall distribute for fiscal year 2022 to each State and each Indian tribe from which the amounts were withheld an amount equal to the total amount so withheld from the State or Indian tribe.</text></paragraph><paragraph id="id0AFA67A7FFA048C9AD80D8B067174886"><enum>(2)</enum><header>Use</header><text>Amounts distributed under paragraph (1) may be used by a State or Indian tribe only for the purposes authorized by section 402(g) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(g)</external-xref>). </text></paragraph></subsection></section><section id="idD0ADF3CE9D6445C0822DCED5E8F18CBA"><enum>5.</enum><header>Amounts distributed from Abandoned Mine Reclamation Fund</header><text display-inline="no-display-inline">Section 401(f)(2) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1231">30 U.S.C. 1231(f)(2)</external-xref>) is amended—</text><paragraph commented="no" id="id6275BF22D48A4CEDA1C734D526937939"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph commented="no" id="id9A536ECDBB184CF7A8369D5472BE3E1A"><enum>(A)</enum><text>in the subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">2022</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">2037</header-in-text></quote>; and</text></subparagraph><subparagraph commented="no" id="id316A6952BC6C4423BC8143CBCA04CA69"><enum>(B)</enum><text>in the matter preceding clause (i), by striking <quote>2022</quote> and inserting <quote>2037</quote>; and</text></subparagraph></paragraph><paragraph commented="no" id="id8EEDB0F2EF324A9CA4AAE8D6C78CF505"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph commented="no" id="id2B71F976E9B64746BF12785B3672F4C2"><enum>(A)</enum><text>in the subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">2023</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">2038</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBE0E59F731A4485C83BDCD7C7E5C93E5"><enum>(B)</enum><text>by striking <quote>2023</quote> and inserting <quote>2038</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7CF477D226BA473BA1D1D664C1EE2B77"><enum>(C)</enum><text>by striking <quote>2022</quote> and inserting <quote>2037</quote>.</text></subparagraph></paragraph></section><section id="idF83302A9FBBA48909E322AC7B62B2273"><enum>6.</enum><header>Applicability of certain transfer requirement to payments to States and Indian tribes</header><text display-inline="no-display-inline">Section 402(i)(3) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(i)(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBC2C6CC1C2CE4FA2A741D293438A3131"><subparagraph id="idA25AC4D5036441E7AB1D1CAA928FF8C3"><enum>(C)</enum><header>Application</header><text>Subparagraph (B) shall not apply to transfers to the Secretary of the Interior for distribution to States and Indian tribes under paragraph (2).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idDA93AD69FAE249F7A17265B93DA2818B"><enum>7.</enum><header>Additional grants from Abandoned Mine Reclamation Fund</header><subsection id="id18AFE35E1CD6458CA9032319215E8135"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title IV of the Surface Mining Control and Reclamation Act of 1977 is amended by inserting after section 415 (<external-xref legal-doc="usc" parsable-cite="usc/30/1244">30 U.S.C. 1244</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id328C5A9340A848FBA6BE7C54015E5B88"><section id="idD9BFB5DDE6E64EB68FBE2435CD70B6E4"><enum>416.</enum><header>Additional grants for priority 1 and priority 2 sites</header><subsection id="idB3C6B0BC009A4458A95C7538C10746E6"><enum>(a)</enum><header>Definition of eligible State or Indian tribe</header><text display-inline="yes-display-inline">In this section, the term <term>eligible State or Indian tribe</term> means a State or Indian tribe—</text><paragraph id="idEE8E360C330D4FF6B389B2D4548BF967"><enum>(1)</enum><text display-inline="yes-display-inline">with an approved State Reclamation Plan under section 405; and</text></paragraph><paragraph id="idD5E58C5BE0224D9ABC355C914EB7804F"><enum>(2)</enum><text> that is not certified under section 411(a).</text></paragraph></subsection><subsection id="id143E3A9AB5F84843AB7D85F17E5AB11E"><enum>(b)</enum><header>Additional grants</header><text display-inline="yes-display-inline">Of amounts in the fund that are not otherwise appropriated, $140,000,000 shall be made available to the Secretary, without further appropriation, for each of fiscal years 2022 through 2037, to make grants to eligible States and Indian tribes for the conduct of reclamation projects designed to achieve the priorities described in paragraphs (1) and (2) of section 403(a). </text></subsection><subsection id="id4EC9347C3F284977AC8F3B5A6D705204"><enum>(c)</enum><header>Requirement</header><text display-inline="yes-display-inline">In making grants under subsection (b) to eligible States and Indian tribes, the Secretary shall allocate the grants to those States and Indian tribes based on the amount of coal historically produced in the State or from the Indian lands concerned before August 3, 1977, in the same manner as under section 402(g)(5).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0EF5B89DE64441B3929CC52BFE97E6EF"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id1BFB8EDD2ABD47A88A9A03AC385254C9"><enum>(1)</enum><text>Section 401 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1231">30 U.S.C. 1231</external-xref>) is amended—</text><subparagraph id="id865CBFFD300342C9B83EC8985AA61037"><enum>(A)</enum><text>in subsection (c)—</text><clause id="id44FF6D6F9DAC47E9B253D64DDD103577"><enum>(i)</enum><text>in paragraph (10), by striking <quote>and</quote> at the end;</text></clause><clause id="id00DF93BC3C1343FD8554BCC45838DB4D"><enum>(ii)</enum><text>by redesignating paragraph (11) as paragraph (12); and</text></clause><clause id="id1D4382CBD3E84A8586068A3BB6B2C2F6"><enum>(iii)</enum><text>by inserting after paragraph (10) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFACA15F6CC774D47AE5BA222777ECC2E"><paragraph id="HC6A5D48037C24F79971A0072D57CAACC"><enum>(11)</enum><text display-inline="yes-display-inline">to make additional grants under section 416; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HD5325340BE404B5BB7E60E1F9111DE71"><enum>(B)</enum><text>in subsection (d)(3), by inserting <quote>and section 416</quote> before the period at the end.</text></subparagraph></paragraph><paragraph id="H5BB1E0B3FB0E419FBF3D7C7260D4F344"><enum>(2)</enum><text>Section 402(g) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(g)</external-xref>) is amended—</text><subparagraph id="H77B2FE89018A48CCAD2EB1C9320FB479"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>and section 416</quote> after <quote>subsection (h)</quote>; and</text></subparagraph><subparagraph id="HA49312363AC94A43BEE89CE715F2C5B3"><enum>(B)</enum><text>in paragraph (3), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H52948FB29C7644D7833F30E41EE9EE01"><subparagraph id="H78EDCF7B4D044812B265A18E79D7CA93"><enum>(F)</enum><text display-inline="yes-display-inline">For the purpose of section 416.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="id220F54875BB04CA69B32E7DF97F84A4F"><enum>8.</enum><header>State memoranda of understanding for remediation of mine drainage; community reclaimer partnerships</header><subsection id="HBB1433042FE04713B1DB2F8931E738B3"><enum>(a)</enum><header>State memoranda of understanding for certain remediation of mine drainage</header><text>Section 405 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1235">30 U.S.C. 1235</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H54DDF3F60E2448E8A8B6C31596900C43"><subsection id="H98B49C1BE8A34936999E013D81A55F04"><enum>(m)</enum><header>State memoranda of understanding for remediation of mine drainage</header><paragraph id="H99BF6D799FBC48AE8728F57BBC7F5E65"><enum>(1)</enum><header>Authorization</header><subparagraph id="idC1731F0DDA6949638950A04A0B907542"><enum>(A)</enum><header>In general</header><text>Subject to the approval of the Secretary and the Administrator of the Environmental Protection Agency (referred to in this subsection as the <quote>Administrator</quote>) under paragraph (4), a State with an approved State Reclamation Plan may enter into a memorandum of understanding with relevant Federal or State agencies to remediate mine drainage on abandoned mine land and water impacted by abandoned mines within the State. </text></subparagraph><subparagraph id="id9F56C23916E242E0AA8FBC1B3AC929AC"><enum>(B)</enum><header>Updates</header><text>A memorandum of understanding entered into under subparagraph (A) may be updated as necessary and resubmitted for approval under paragraph (4).</text></subparagraph></paragraph><paragraph id="H12B844988C4D425E98D6A7E317C31D80"><enum>(2)</enum><header>Memoranda of understanding requirements</header><subparagraph id="idD771EDE3902F4846BB2748890E653DC8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A memorandum of understanding entered into under paragraph (1)(A) shall establish a strategy to address water pollution resulting from mine drainage at sites eligible for reclamation and mine drainage abatement expenditures under section 404, including specific procedures for—</text><clause id="H5969C2013A1444F8A3ABBF1BBF752351"><enum>(i)</enum><text>ensuring that activities carried out to address mine drainage will result in improved water quality;</text></clause><clause id="H73F9E068565F41F69D1C1F63EDAB73D3"><enum>(ii)</enum><text>monitoring, sampling, and reporting of collected information as necessary to achieve the condition required under clause (i);</text></clause><clause id="H16BA35FADC7E4231895AE509EFD31D68"><enum>(iii)</enum><text>operation and maintenance of treatment systems as necessary to achieve the condition required under clause (i); and</text></clause><clause id="HA3E64F0EB6C74E2F95392DC5E4BA5B9D"><enum>(iv)</enum><text>other purposes, as considered necessary by the State or Federal agencies that are parties to the memorandum of understanding, to achieve the condition required under clause (i).</text></clause></subparagraph><subparagraph commented="no" id="id5C43DD6EEAC04E198661E8112D61C8F9"><enum>(B)</enum><header>Requirement</header><text>The strategy established under subparagraph (A) shall be satisfactory to the State and Federal agencies that are parties to the memorandum of understanding.</text></subparagraph></paragraph><paragraph id="H60784CC0B9A041FB9EF95512462F98BF"><enum>(3)</enum><header>Public review and comment</header><subparagraph id="H87B2AE26BAE843828BB2321FF5F4A242"><enum>(A)</enum><header>In general</header><text>Before submitting a memorandum of understanding to the Secretary and the Administrator for approval under paragraph (4), a State shall—</text><clause id="H873276DAF6C44E749CC5A20BDAC6757C"><enum>(i)</enum><text>invite interested members of the public to comment on the memorandum of understanding; and</text></clause><clause id="H301C3BD9E5E24B31B84F8620404FA31E"><enum>(ii)</enum><text>hold not less than 1 public meeting concerning the memorandum of understanding in a location reasonably accessible to persons who may be affected by implementation of the memorandum of understanding.</text></clause></subparagraph><subparagraph id="H01C77CFACEDE457B8358BDEF12765711"><enum>(B)</enum><header>Notice of meeting</header><text display-inline="yes-display-inline">Not later than 15 days before the date of a meeting under subparagraph (A), the State shall publish notice of the meeting in local newspapers of general circulation, on the internet, and by any other means considered necessary or desirable by the Secretary and the Administrator.</text></subparagraph></paragraph><paragraph id="H363AD07957A24D5CAB741DC3EA651271"><enum>(4)</enum><header>Submission and approval</header><subparagraph id="idBA6F2CDD426F43C79D493293674FBDC7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Before entering into a memorandum of understanding under paragraph (1)(A), a State shall submit the memorandum of understanding to the Secretary and the Administrator for approval. </text></subparagraph><subparagraph id="id1CBBF60228A74B83980E0D9F96A824B0"><enum>(B)</enum><header>Deadline</header><text display-inline="yes-display-inline">Not later than 120 days after the date on which a State submits the memorandum of understanding for approval under subparagraph (A), the Secretary and the Administrator shall approve or disapprove the memorandum of understanding. </text></subparagraph><subparagraph id="id1897307907134EF3B1919CA02CB24F26"><enum>(C)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary and the Administrator shall approve a memorandum of understanding under this paragraph if the Secretary and Administrator find that the memorandum of understanding will facilitate additional activities to improve water quality under the approved State Reclamation Plan of the State.</text></subparagraph></paragraph><paragraph id="H2CBE0B57259C400887803CC711554097"><enum>(5)</enum><header>Treatment as part of State plan</header><text display-inline="yes-display-inline">A memorandum of understanding that is approved by the Secretary and the Administrator under this subsection shall be considered to be part of the approved State Reclamation Plan of the State.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idBE4CA219C5E6478DAAA8A29C184FD15C"><enum>(b)</enum><header>Community reclaimer partnerships</header><text>Section 405 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1235">30 U.S.C. 1235</external-xref>) (as amended by subsection (a)) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id96705EB09BC74C529DB63311E77B1110"><subsection id="H06EE0E232A18438090DD5BB774206023"><enum>(n)</enum><header>Community Reclaimer partnerships</header><paragraph id="HB1A490F06B1E475D8E5E16DE59B0CCE5"><enum>(1)</enum><header>Definition of community reclaimer</header><text display-inline="yes-display-inline">In this subsection, the term <quote>community reclaimer</quote> means any person who—</text><subparagraph id="H645B4919D59C4F9DA715CD88CB3DC03A"><enum>(A)</enum><text>seeks to voluntarily assist a State with a reclamation project under this section;</text></subparagraph><subparagraph id="H2AA0E5D2891A45C8948F5F4E66C9E29E"><enum>(B)</enum><text>did not participate in any way in—</text><clause id="idF15CECFBD13C485C8F4B3603D3D3609D"><enum>(i)</enum><text>the creation of site conditions at the project site; or</text></clause><clause id="id4A594CBEE54A408CBA1ED9788136B2CD"><enum>(ii)</enum><text> activities that caused any land or waters at the project site to become eligible for reclamation or drainage abatement expenditures under section 404;</text></clause></subparagraph><subparagraph id="H36822CA64E744C2FA87BBD7D2038C7B8"><enum>(C)</enum><text>is not a past or current owner or operator of any site with ongoing reclamation obligations; and</text></subparagraph><subparagraph id="HA345C26015654A69A09049B7F5FAC1FE"><enum>(D)</enum><text>is not subject to outstanding violations listed pursuant to section 510(c).</text></subparagraph></paragraph><paragraph id="id97EEC286DD29444DA71305B1A972C47F"><enum>(2)</enum><header>Authorization of community reclaimer projects</header><text>The Secretary may authorize a community reclaimer to carry out a reclamation project under this section for which a request for approval submitted by the State under paragraph (3) has been approved by the Secretary in accordance with paragraph (4).</text></paragraph><paragraph id="HD68E0308AF0C496A89AEC6B76194F678"><enum>(3)</enum><header>Project submission</header><subparagraph id="idE81D927BE0A7489F88BD9B2EA59D485D"><enum>(A)</enum><header>In general</header><text>A State may submit to the Secretary a request to authorize a community reclaimer to carry out a reclamation project under this section in the State.</text></subparagraph><subparagraph id="id6E92A512148D466FAA46B7B3871F860A"><enum>(B)</enum><header>Requirements</header><text>A request submitted under subparagraph (A) shall include—</text><clause id="HC375B15C7DD34C6CAA13F1906BFA6DF3"><enum>(i)</enum><text>a description of the project, including any engineering plans that include the seal of a professional engineer;</text></clause><clause id="H914356988D26417E8218DD76A5F92F79"><enum>(ii)</enum><text>a description of the 1 or more project sites, including, if relevant, the nature and extent of pollution resulting from mine drainage;</text></clause><clause id="H09803DB34A0546BF9D74D7B13317FB95"><enum>(iii)</enum><text>identification of the past and current owners and operators of any project sites;</text></clause><clause id="HAF2659C45DEB4874918548A92EE1C7E5"><enum>(iv)</enum><text>the agreement or contract between the State and the community reclaimer to carry out the project;</text></clause><clause id="H384474AA7E8F472B9493D2321C2570D0"><enum>(v)</enum><text>a determination by the State that the project will facilitate the activities of the State Reclamation Plan under subsection (e);</text></clause><clause id="H9DF1625BD18D4CF7AEBC67A46207CC54"><enum>(vi)</enum><text>sufficient information to determine whether the community reclaimer has the technical capability and expertise to successfully conduct the project;</text></clause><clause id="H1B2AE6AC70FC466FAEFFB183DE31BCCF"><enum>(vii)</enum><text>a cost estimate for the project;</text></clause><clause id="id0E53145B2AEA48058B80A64C94C4F1B1"><enum>(viii)</enum><text>evidence that the community reclaimer has sufficient financial resources to ensure the successful completion of the project (including any operation or maintenance costs);</text></clause><clause id="H27CB3030E5D64C638AD49392A7891E17"><enum>(ix)</enum><text>a schedule for completion of the project;</text></clause><clause id="HAB2F2B23AB4D4BFA90B3F3F135EAD5BA"><enum>(x)</enum><text>an agreement between the community reclaimer and the owner of the project site governing access to the project site;</text></clause><clause id="HECE7E0199D134DC68D5FE90E37DF9074"><enum>(xi)</enum><text>sufficient information to ensure that the community reclaimer meets the requirements of paragraph (1);</text></clause><clause id="H4E756753522A441CBC8EEA3163C6D06F"><enum>(xii)</enum><text display-inline="yes-display-inline">a contingency plan designed to be used in response to unplanned adverse events that includes emergency actions, response, and notifications; and</text></clause><clause id="H22557AE5BE434403AC64C1A50A5B3570"><enum>(xiii)</enum><text display-inline="yes-display-inline">an agreement by the State that, before the initiation of the project, the State shall—</text><subclause id="id6E0F9E3B8287468FBBE5F8EF3CB745FD"><enum>(I)</enum><text display-inline="yes-display-inline"> provide notice to adjacent and downstream landowners and the public; and </text></subclause><subclause id="id1D1224EFA6B84164BE80D57267D69B76"><enum>(II)</enum><text display-inline="yes-display-inline">hold a public meeting near the project site.</text></subclause></clause></subparagraph></paragraph><paragraph id="HB8EEC252C1374434A289CD58E130132E"><enum>(4)</enum><header>Project Approval</header><text>Not later than 120 days after the date on which the Secretary receives a request submitted under paragraph (3)(A), the Secretary shall approve the request for the community reclaimer to carry out the project, if the Secretary determines that—</text><subparagraph id="HC1CB878F7C1043AF9A73D2A41FB34FAE"><enum>(A)</enum><text>the project—</text><clause id="id8A1B641524B44FCBA900B2AF83999F2D"><enum>(i)</enum><text>complies with the submission requirements under paragraph (3)(B);</text></clause><clause id="id15CDC544AF2341619C742E566F74A46C"><enum>(ii)</enum><text>will be conducted by a community reclaimer or 1 or more approved subcontractors of the community reclaimer;</text></clause><clause id="idEE7AF4B1F9D34359A34C4F3FB5A2448A"><enum>(iii)</enum><text>will be conducted on 1 or more sites inventoried under section 403(c);</text></clause><clause id="idC89863B9791E4A588512E6FCC107DD58"><enum>(iv)</enum><text>in the case of a project that remediates mine drainage, is consistent with an approved State memorandum of understanding under subsection (m); and</text></clause><clause id="idA15225CFAA684A6AA0FB48F04CA15F5C"><enum>(v)</enum><text>is not in a category of projects that would require a permit under title V; and</text></clause></subparagraph><subparagraph id="H72BDB776890744ABB48A75ADB00355FB"><enum>(B)</enum><text display-inline="yes-display-inline">the State that submitted the request—</text><clause id="id1BB21408447741C6B01A5BB0A019B3E9"><enum>(i)</enum><text display-inline="yes-display-inline">has entered into an agreement with the community reclaimer under which the State shall assume all responsibility with respect to the project for any costs or damages resulting from any action or inaction on the part of the community reclaimer in carrying out the project, except for costs or damages resulting from gross negligence or intentional misconduct by the community reclaimer, on behalf of the community reclaimer and the owner of the project site, if the community reclaimer or owner, respectively, did not participate in any way in the creation of site conditions at the project site or activities that caused any land or water to become eligible for reclamation or drainage abatement expenditures under section 404;</text></clause><clause id="HD651A20F05164B8C98E5D63D0AF17432"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id1551E2DE4B9647B9B8BA53C3A9780366"><enum>(I)</enum><text>has the necessary legal authority to carry out the project; and </text></subclause><subclause id="idE28DDDEDC284480AB2EAE6802D22A6DE" indent="up1"><enum>(II)</enum><text>will obtain all authorizations, permits, licenses, and other approvals required by law to ensure completion of the project; and</text></subclause></clause><clause id="H33A6920F8AA246FAB5D25092249BBB7A"><enum>(iii)</enum><text>has sufficient financial resources to ensure completion of the project, including any necessary operation and maintenance costs (including costs associated with emergency actions covered by a contingency plan under paragraph (3)(B)(xii)).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H555B75DDD08F4AA6AC90FA993C52B5DF"><enum>(c)</enum><header>Clarifying State liability for mine drainage projects</header><text display-inline="yes-display-inline">Section 413(d) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1242">30 U.S.C. 1242(d)</external-xref>) is amended, in the second sentence, by striking <quote>Act.</quote> and inserting <quote>Act, unless that control or treatment will be conducted in accordance with a State memorandum of understanding approved under section 405(m).</quote>.</text></subsection><subsection id="H5BD0DEF612A040F9AEBFCA6C252F2E24"><enum>(d)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 405(f) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1235">30 U.S.C. 1235(f)</external-xref>) is amended—</text><paragraph id="HE4584B1BF30F45028E83EF0614702469"><enum>(1)</enum><text>in paragraph (6), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="HB30590C47C1940A3857A3B2376055FB7"><enum>(2)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H5D1A240F586E48E28F1EB636DE28777F"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HB2F9F14199FC4C37AEECA66B5BCFB064"><paragraph id="HACE67B8A4B4A4A308B162B298BDE004E"><enum>(8)</enum><text>a list of projects proposed under subsection (n).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" id="idC6711994627B4B57A9177388BEB6C69E"><enum>9.</enum><header>Department of the Interior study and report on technological innovations for use in the abandoned mine land reclamation program</header><subsection commented="no" id="id1D548181DF384218B335ED3CD123149A"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall complete a study of technologies for use in the abandoned mine land reclamation program established under title IV of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1231">30 U.S.C. 1231</external-xref> et seq.) (referred to in this Act as the <quote>program</quote>) that would improve reclamation and reduce costs under the program, including the application of technical innovations in the technology development and transfer program of the Office of Surface Mining Reclamation and Enforcement, including—</text><paragraph commented="no" id="id365A4FA5087D4321B9FC58110671FE92"><enum>(1)</enum><text> geomorphic reclamation;</text></paragraph><paragraph commented="no" id="id4D774919136C496E8D5BA3E6FF002D20"><enum>(2)</enum><text>drone technology; and</text></paragraph><paragraph commented="no" id="idF9707061E8AD4CF8AC2C5A27F9F68265"><enum>(3)</enum><text>other technologies that would—</text><subparagraph commented="no" id="idA773C9F230594F90B88F86A65B2F32A3"><enum>(A)</enum><text>improve overall reclamation;</text></subparagraph><subparagraph commented="no" id="idBC83E97DD3B048FF893BC450143C39B0"><enum>(B)</enum><text>reduce costs of reclamation; and </text></subparagraph><subparagraph commented="no" id="idDA728A2AF27645989376F80234CEA3EF"><enum>(C)</enum><text>improve safety. </text></subparagraph></paragraph></subsection><subsection commented="no" id="id8BE46A3CE4204726BE9076E47CD43ED9"><enum>(b)</enum><header>Report</header><text>As soon as practicable after completing the study under subsection (a), the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the results of the study that includes recommendations for areas of improvement identified under the study.</text></subsection></section><section commented="no" id="idadf39e21fb2d4af899ffafd22b0c6cb2"><enum>10.</enum><header>Department of the Interior study and report to strengthen oversight of the abandoned mine land reclamation program</header><subsection commented="no" id="id6915c859c6614a198b4ee1cbf7c91e36"><enum>(a)</enum><header>Study and report</header><paragraph commented="no" id="id4217441D425A485898736DAFAF3488F3"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall complete a study—</text><subparagraph commented="no" id="id4B11815BA2974C32ADD866CEE2AD6B31"><enum>(A)</enum><text>to identify areas throughout the program in which costs could be reduced; and</text></subparagraph><subparagraph id="idab1e3a9eaaf14b049eb6c4e2a396ef58"><enum>(B)</enum><text>to determine the ratio of overhead spending in the administration of the program to spending on the clean up of abandoned mine land sites.</text></subparagraph></paragraph><paragraph commented="no" id="idc4b63276f7a542bf9107b99cd7a24c63"><enum>(2)</enum><header>Report</header><text>As soon as practicable after completing the study under paragraph (1), the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the results of the study that includes recommendations for areas of improvement identified under the study. </text></paragraph></subsection><subsection id="idcaa8935ed88f413e97ffc5dacc529447"><enum>(b)</enum><header>Annual OSMRE report</header><text>The Secretary shall require the Director of the Office of Surface Mining Reclamation and Enforcement to publish annual reports on the efficacy of the Abandoned Mine Land Reclamation Economic Development Pilot Program (also known as the <quote>AML Pilot</quote>), including a detailed accounting of all projects funded and completed using funding made available for that program under the heading <quote><header-in-text style="appropriations" level="appropriations-small">abandoned mine reclamation fund</header-in-text></quote> under the heading <quote><header-in-text style="appropriations" level="appropriations-intermediate">Office of Surface Mining Reclamation and Enforcement</header-in-text></quote> under the heading <quote><header-in-text style="appropriations" level="appropriations-major">Department of the Interior</header-in-text></quote> in title I of the division relating to Department of the Interior, Environment, and related agencies appropriations in each of—</text><paragraph id="idafde731ed7ae477b997cbaec1e1030fe"><enum>(1)</enum><text>the Consolidated Appropriations Act, 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/113">Public Law 114–113</external-xref>; 129 Stat. 2536); </text></paragraph><paragraph id="id62ac4fa30d7e4a1295b8249508c6d581"><enum>(2)</enum><text>the Consolidated Appropriations Act, 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/115/31">Public Law 115–31</external-xref>; 131 Stat. 446);</text></paragraph><paragraph id="id207592826a3248b5ae771d3a717ad190"><enum>(3)</enum><text>the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>;
