which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require additional disclosures relating to donations to the Presidential Inaugural Committee, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inaugural Committee Transparency Act of 2021</short-title></quote>.</text></section><section id="id9438D9F911E74646870342EFCFA23F7F"><enum>2.</enum><header>Disclosure of certain donations to and spending by the Presidential Inaugural Committee</header><text display-inline="no-display-inline">Section 510 of title 36, United States Code, is amended—</text><paragraph id="id20784F9B1C484334863548AD7A38EA6C"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idD27A687EC4CC4E4A84A61AD2E540253F"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>, and disclosing any disbursement made in an amount equal to or greater than $200 and the purpose of each disbursement</quote> before the period at the end; and</text></subparagraph><subparagraph id="id46414A3A2AE94EB2A4E88E9DFD62917A"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id957F21AF58B540949EC6CCA0ED9B831F"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></clause><clause id="id376FF22AED624E6A93ACAA4165CD4C54"><enum>(ii)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="idD91AC35BB917411EBADEF07494F70490"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id90A71FA47945486B9D2C4DA7C34F75E1"><subparagraph id="idC8144050589F4D669388BEB8C6EDD2A5"><enum>(D)</enum><text>for any disbursement in an amount equal to or greater than $200 that is made, including any such disbursement made after the end of the inaugural period—</text><clause id="idA4E3288D49BD467EA9975E2676246DB4"><enum>(i)</enum><text>the name and address of the person to whom the disbursement was made;</text></clause><clause id="id91488B59880040AF86559A39562BEEEF"><enum>(ii)</enum><text>the date on which the disbursement was made; and</text></clause><clause id="id03A3BD850B394BF98C3F38FDCAB119EF"><enum>(iii)</enum><text>the total amount and purpose of the disbursement.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id6D445F8895BC4795A609394E762D185D"><enum>(2)</enum><text>by amending subsection (c) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC3F44C93C6D447649907A53CCB679104"><subsection id="id8D4137B0E0494870A563E3EB03D55C04"><enum>(c)</enum><header>Prohibition</header><paragraph id="id018315C223784D7DAFFCA9CB150BE000"><enum>(1)</enum><header>In general</header><text>It shall be unlawful—</text><subparagraph id="id8836E77E828540808D2A18FB8B4AB39E"><enum>(A)</enum><text>for an Inaugural Committee to solicit, accept, or receive a donation from a foreign national;</text></subparagraph><subparagraph id="id69136E180D2546BCB16F3A496FC1D84B"><enum>(B)</enum><text>for a person—</text><clause id="idACE12A235B3D403F8003AE70867486C7"><enum>(i)</enum><text>to make a donation to an Inaugural Committee in the name of another person, or to knowingly authorize his or her name to be used to effect such a donation; or</text></clause><clause id="idAED3C493B93E48B8983F2BD90ED88959"><enum>(ii)</enum><text>to knowingly accept a donation to an Inaugural Committee made by a person in the name of another person;</text></clause></subparagraph><subparagraph id="idAB3461DE86F842838FB86C66001350BD"><enum>(C)</enum><text>for a foreign national to, directly or indirectly, make a donation, or make an express or implied promise to make a donation, to an Inaugural Committee; or</text></subparagraph><subparagraph id="idCEEF1B539B8B48158BDF7E119200F71C"><enum>(D)</enum><text>to convert a donation to an Inaugural Committee to personal use as described in paragraph (3).</text></subparagraph></paragraph><paragraph id="idD1291BA2610A48518A3C5A889A57C141"><enum>(2)</enum><header>Definition of foreign national</header><text>In this subsection, the term <term>foreign national</term> has the meaning given the term in section 319(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441e">2 U.S.C. 441e(b)</external-xref>).</text></paragraph><paragraph id="idCB81113DB4A44AB6BE19BCE8DA0B1739"><enum>(3)</enum><header>Conversion of donation to personal use</header><text>For purposes of paragraph (1)(D), a donation shall be considered to be converted to personal use if any part of the donated amount is used to fulfill a commitment, obligation, or expense of a person that would exist irrespective of the responsibilities of the Inaugural Committee.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id287F76FA68D8482281E5A274E2B16418"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF58C5416F5DD46E9B371731568F25094"><subsection id="idAEDB045C8A0A46FEA26599FF2113C8A1"><enum>(d)</enum><header>Requirement</header><paragraph id="idABC71DC0FCF04C139E504CA4033645AD"><enum>(1)</enum><header>In general</header><text>Not later than the date that is 90 days after the date of the Presidential inaugural ceremony, the committee shall disburse any remaining donated funds to an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code.</text></paragraph><paragraph id="id3AE71FFE0CDE43638A66DF3D041D4AD1"><enum>(2)</enum><header>Extension</header><subparagraph id="id5CD595AB69034F3A88B2E682921F1CA3"><enum>(A)</enum><header>Request</header><text>Upon request from the Inaugural Committee, the Federal Election Commission may extend the 90-day period described in paragraph (1).</text></subparagraph><subparagraph id="id561694B7F33647EFAC51476398E0EC6C"><enum>(B)</enum><header>Supplemental report</header><text>In the case of an extension under subparagraph (A), the Inaugural Committee shall, not later than the last day of the extension period, file a supplement to the report required under subsection (b)(1).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
