Russell National School Lunch Act to enhance direct certification under the school lunch program.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idD3215A3148A742E586892D8EF1A0500D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Caregivers, Access, and Responsible Expansion for Kids Act of 2021</short-title></quote> or the <quote><short-title>CARE for Kids Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id23A070E296B142B485567C60F3E80EBE"><enum>2.</enum><header>Enhancing direct certification</header><text display-inline="no-display-inline">Section 9(b)(5) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(5)</external-xref>) is amended—</text><paragraph id="idE58CE11B33124116B0F9A928AE521F8D"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>(including any school operated by the Bureau of Indian Education)</quote> before <quote>may certify</quote>; and</text></paragraph><paragraph id="id880387169454400bae0203caf60a69aa"><enum>(2)</enum><text>in subparagraph (E)—</text><subparagraph id="id8526D29D34AB4323AF63AE9EAC3D0FF1"><enum>(A)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="id7B11447CA0444809899C25455B122F39"><enum>(B)</enum><text>in clause (ii)—</text><clause id="id849F2786D2BE4757918592B3F798E31A"><enum>(i)</enum><text>by striking <quote>who</quote> and inserting <quote>whom</quote>; and</text></clause><clause id="id7A9EC7CB9AB341098A9D352161CA25B5"><enum>(ii)</enum><text>by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="id338DBC168A2C4AA784E1E7A433EB5152"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0827943a747c488f87741e2d9e92460f"><clause id="idc74faa28fc5f4dc1aa49010633b95080"><enum>(iii)</enum><text>a child whose placement with a caregiver was carried out with the involvement of an agency that administers a State plan under part B or E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.) or a tribal child welfare agency, without regard to whether the agency is responsible for the care and placement of the child;</text></clause><clause id="id0A32BFF66620426384E649B19B78B5DF"><enum>(iv)</enum><text>a child for whom an adoption assistance payment is made under section 473(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(a)</external-xref>) or under a similar State-funded or State-operated program, as determined by the Secretary;</text></clause><clause id="id628E75D5E1E5432BA90131CF2176DD7E"><enum>(v)</enum><text>a child for whom a kinship guardianship assistance payment is made under section 473(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(d)</external-xref>) or under a similar State-funded or State-operated program, as determined by the Secretary, without regard to whether the child was previously in foster care; or</text></clause><clause commented="no" id="id3602528b4c1643bbad87540025d04e14"><enum>(vi)</enum><text>a child of a family that—</text><subclause commented="no" id="id52AF5CF39687494F981231E5D4308C71"><enum>(I)</enum><text>lives in housing dedicated to low-income families with a caregiver who is a grandparent or another older person that cares for the child full-time; or</text></subclause><subclause commented="no" id="id7211D13B1E86423E908AA9AAA35D9697"><enum>(II)</enum><text>receives housing or housing assistance under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101</external-xref> et seq.).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="idF41A6D66B88542B4B29B5E41EBCF33BE"><enum>3.</enum><header>Extended eligibility</header><text display-inline="no-display-inline">Section 9(b)(9) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(9)</external-xref>) is amended—</text><paragraph id="idAAC153F644A74347A66E7F457709782D"><enum>(1)</enum><text>by redesignating subparagraph (C) as subparagraph (D);</text></paragraph><paragraph id="id51C6731A69194500B0D81211E9D9F0D7"><enum>(2)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id553ED632199946CD948FC3D327453EEA"><subparagraph id="idF3EAD51A061A43E3AEC3541A1727DB6E"><enum>(C)</enum><header>Eligibility of transferred children</header><clause id="idD63ED838DAEE4D9EA1FA75406B62C9F9"><enum>(i)</enum><header>Definition of covered child</header><text>In this subparagraph, the term <quote>covered child</quote> means a child that—</text><subclause id="id37FA6EF039AC4AECB2DA8A3E45065A8F"><enum>(I)</enum><text>has been determined eligible for free or reduced price meals under this Act by a local educational agency (referred to in this subparagraph as the <quote>original local educational agency</quote>); and</text></subclause><subclause id="idDEA13C6EC5E844598DF2D50DB0052A8E"><enum>(II)</enum><text>transfers to another school that is under the jurisdiction of a different local educational agency (referred to in this subparagraph as the <quote>new local educational agency</quote>).</text></subclause></clause><clause id="id779132AFE78242B487B8E086961BDCF1"><enum>(ii)</enum><header>Eligibility</header><text>An eligibility determination made by an original local educational agency with respect to a covered child shall be transferred to, and honored by, the new local educational agency, including the period for which that determination was authorized, subject to an extension under clause (iii).</text></clause><clause id="id75692E7689D94997B8724E9DDFBF00FD"><enum>(iii)</enum><header>Extension of duration</header><text>A new local educational agency shall honor the eligibility determination for a covered child under clause (ii) for a period that is 1 year longer than the period for which that determination was authorized by the original local educational agency if the covered child began living with a caregiver—</text><subclause id="idB6E12D1AC11D4628BF15DFB8DE33C4E0"><enum>(I)</enum><text>in the 12-month period preceding the date on which the covered child is enrolled in a school under the jurisdiction of a new local educational agency; and</text></subclause><subclause id="idA6DBB9314E4C4C4C9364549C88760459"><enum>(II)</enum><text>who is—</text><item id="id96D47DE3A86C4C1DBF8875426DFB2CD5"><enum>(aa)</enum><text>a grandparent or other relative and has legal authority to secure services for the child through an educational or healthcare consent affidavit, power of attorney, or other legal documentation; or</text></item><item id="id77905F0740394BEC80CFCB92D6DE3182"><enum>(bb)</enum><text>a grandparent or other relative and has legal custody of the child or has commenced the process of seeking legal custody of the child in a court of law.</text></item></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id2E14A2D8F36F4AFDA13A0CE2924FCD0B"><enum>(3)</enum><text>in subparagraph (D) (as so redesignated)—</text><subparagraph id="idDE38487714704FE3A0234347CB311A7C"><enum>(A)</enum><text>by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="idFE36EF7E25B4444089F61F675DC1C07D"><enum>(B)</enum><text>in the matter preceding subclause (I) (as so redesignated), by striking <quote>Except as</quote> and all that follows through <quote>(3)(H)(ii)</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id548F267AF30E44879647C5E1DA13B11D"><clause id="id9BD4527D0F29415F965A0285146BCF2E"><enum>(i)</enum><header>In general</header><text>Except as otherwise specified in clause (ii), subparagraph (C), subparagraphs (E) and (H)(ii) of paragraph (3)</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id947278A51413423B80CC52D8B56B4E83"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id56E7E31B8BA8473E8D7DA90DCBD63990"><clause id="id3CCED8ACA4BA4EEE85D944AC82AD30AB"><enum>(ii)</enum><header>Extension for certain children</header><text>A school food authority shall extend the eligibility determination made by a local educational agency with respect to a child for a period that is 1 year longer than the period for which that determination was authorized by the local educational agency, if the child began living with a caregiver—</text><subclause id="id31C3E42343A4498CBE75F85BB9D8DE2A"><enum>(I)</enum><text>in the 12-month period preceding the date on which the covered child is enrolled in the new school; and</text></subclause><subclause id="id24819F73FF8145D38527D3342D883B81"><enum>(II)</enum><text>who is—</text><item id="idE4152A49207A47B787317C6F59CBC443"><enum>(aa)</enum><text>a grandparent or other relative and has legal authority to secure services for the child through an educational or healthcare consent affidavit, power of attorney, or other legal documentation; or</text></item><item id="id58AB9E9CBDA74860975BE9F1548FA68D"><enum>(bb)</enum><text>a grandparent or other relative and has legal custody of the child or has commenced the process of seeking legal custody of the child in a court of law.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id2D727132AF254BBE94F5922B9253EF58"><enum>4.</enum><header>Expanding automatic eligibility</header><subsection id="idB0C419CADAB6497AA748DB6E199A3C49"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 9(b)(12)(A) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(12)(A)</external-xref>) is amended—</text><paragraph id="idD6B227522AEC4CB8BFD3391FBB646D3B"><enum>(1)</enum><text>by conforming the margins of clauses (iv) through (vii) to the margin of clause (iii); and</text></paragraph><paragraph id="idD7A81D0A5945414D923451CC89E9204D"><enum>(2)</enum><text>in clause (vii)—</text><subparagraph id="id8150DF18ECD74F8A8CF5A37FB5A71308"><enum>(A)</enum><text>in subclause (I), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="id296457BF75B54C5699929B3B342AD007"><enum>(B)</enum><text>in subclause (II)—</text><clause id="idF54AAFA4D92C4CB88F23F06C61413B01"><enum>(i)</enum><text>by striking <quote>who</quote> and inserting <quote>whom</quote>; and</text></clause><clause id="idCE56FEB25E6047E884677439B945BBC5"><enum>(ii)</enum><text>by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="id90B12FAC938343AEAAC0BEF4BFAF0CA1"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idaeab98cba0074c1181ceac276af4d10e"><subclause id="id06f7bde2581e42eba6d4de34b6ff93f4"><enum>(III)</enum><text>a child whose placement with a caregiver was carried out with the involvement of an agency that administers a State plan under part B or E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.) or a tribal child welfare agency, without regard to whether the agency is responsible for the care and placement of the child;</text></subclause><subclause id="id5DAFA319FCAC470E835E5A5E1DDD1AE2"><enum>(IV)</enum><text>a child for whom an adoption assistance payment is made under section 473(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(a)</external-xref>) or under a similar State-funded or State-operated program, as determined by the Secretary;</text></subclause><subclause id="idcb27c0014c3d406cafaef27aead8b570"><enum>(V)</enum><text>a child for whom a kinship guardianship assistance payment is made under section 473(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(d)</external-xref>) or under a similar State-funded or State-operated program, as determined by the Secretary, without regard to whether the child was previously in foster care; or</text></subclause><subclause commented="no" id="idA7FE2874BE0C4EE88A745E1161876320"><enum>(VI)</enum><text>a child of a family that—</text><item commented="no" id="id5E07539F678C4C49BFE5CD9D5DC76CAA"><enum>(aa)</enum><text>lives in housing dedicated to low-income families with a caregiver who is a grandparent or another older person that cares for the child full-time; or</text></item><item commented="no" id="idCF7083EC73014027BF5D3740D5D0E363"><enum>(bb)</enum><text>receives housing or housing assistance under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101</external-xref> et seq.).</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id28C5CEB0C8784851B0FE96DAAC5DD891"><enum>(b)</enum><header>Conforming amendments</header><text>Section 9(d)(2) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(d)(2)</external-xref>) is amended—</text><paragraph id="id597881420C49456383DA604C1109E81F"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>(iv) or (v)</quote> and inserting <quote>(ii), (iii), (iv), (v), or (vii)</quote>;</text></paragraph><paragraph id="id5EF65D0DB80E47969491DE0E4600A78D"><enum>(2)</enum><text>in subparagraph (E), by adding <quote>or</quote> at the end after the semicolon;</text></paragraph><paragraph id="idF44E73EF24A54453A3D1D53054A4AC1A"><enum>(3)</enum><text>by striking subparagraph (F); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35D6A1BB0BA847B1AF8E1A98173E21FE"><enum>(4)</enum><text>by redesignating subparagraph (G) as subparagraph (F) and conforming the margin of subparagraph (F) (as so redesignated) appropriately.</text></paragraph></subsection></section><section section-type="subsequent-section" id="idD681478AF7734B0FA68E6AA882399FFA"><enum>5.</enum><header>Medicaid direct certification</header><text display-inline="no-display-inline">Section 9(b)(15)(A)(i) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(15)(A)(i)</external-xref>) is amended—</text><paragraph id="idCF421379B9A54208815BBB26DEE7CA7B"><enum>(1)</enum><text display-inline="yes-display-inline">in subclause (I)—</text><subparagraph id="id79B44D6D942E4D7180991BCA5D1A17F9"><enum>(A)</enum><text display-inline="yes-display-inline">in item (bb), by striking <quote>(bb) who</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3C1BBAFBC3B442E390F97CD8AE3C1FD1"><subitem id="id6152A2B1BF5C4EB8ABF2F709C8B8D715"><enum>(BB)</enum><text>who</text></subitem><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id090879601141424CA875082C17869424"><enum>(B)</enum><text>by striking <quote>(I)(aa) who</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE2291F9ED12545BAB1BDEEFD27BF8DB6"><item id="id33EB0E970BBA474C9DC740E8682AC81E"><enum>(aa)</enum><subitem commented="no" display-inline="yes-display-inline" id="id7008E9EEA2964F2A9C90FDAC9B36A311"><enum>(AA)</enum><text>who</text></subitem></item><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id151F2E50E9C04722A40DBB097C057B75"><enum>(2)</enum><text>in subclause (II)—</text><subparagraph id="idEC01BCFE4C0542B1B55041754CE26B54"><enum>(A)</enum><text>by striking <quote>regulations) with a child described in subclause (I)</quote> and inserting <quote>regulations)) with a child described in item (aa)</quote>; and</text></subparagraph><subparagraph id="idD8F28538A6EB498190B69476DC849F4F"><enum>(B)</enum><text>by striking <quote>(II) who</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2D3CE120A99B46FE9881C16B346968B3"><item id="id50508A70F725456697424AB2303E52FE"><enum>(bb)</enum><text>who</text></item><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id2901B4F77DA14BBB91133EADDDF2038F"><enum>(3)</enum><text>in the matter preceding item (aa)(AA) (as so redesignated), by striking <quote>The term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3A9C509AEF7540C890715A1207628E59"><subclause id="id78092999763B461399BE83AD95D22684"><enum>(I)</enum><header>In general</header><text>The term</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id2EAF2D1934E94A46B85813794DC0D80B"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id321E9DDA6F3F4D5FA78E5B4730E239DA"><subclause id="id8EF24FFA5FEB4C7B8EDEDD8356E2DC6D" indent="up1"><enum>(II)</enum><header>Other children</header><text>The term <term>eligible child</term> includes a child that receives medical assistance under the Medicaid program—</text><item id="id8187061760394B839C74B0482A849989"><enum>(aa)</enum><text>under subclause (I) of section 1902(a)(10)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)(i)</external-xref>) on the basis of receiving aid or assistance under the State plan approved under part E of title IV of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670</external-xref> et seq.) or by reason of section 473(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673">42 U.S.C. 673(b)</external-xref>); or</text></item><item id="id027F0BDBE8CE4EDD898EA8BE557D0A67"><enum>(bb)</enum><text>under subclause (II) of section 1902(a)(10)(A)(i) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)(i)</external-xref>) on the basis of receiving supplemental security income benefits.</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
