Russell National School Lunch Act to ensure equity for America’s children by providing access to summer meals.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Summer Meals Alternative Relief and Transportation Act of 2021</short-title></quote> or the <quote><short-title>SMART Act of 2021</short-title></quote>.</text></section><section id="idf80000b713704f6da607523f17d56099"><enum>2.</enum><header>Access to nutritious summer meals for children</header><text display-inline="no-display-inline">Section 13(a) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1B5AE7E2A93140E2B914CDE8814B05FA"><paragraph id="id736ff519c21a45f1b63399d63ca8f5ff"><enum>(13)</enum><header>Alternative program for meal delivery</header><subparagraph id="idb536b57802b341689493e7f6d51d9024"><enum>(A)</enum><header>Additional service options</header><clause id="id1876E872B31B4F8FA18BFE9D3FBFD1FC"><enum>(i)</enum><header>In general</header><text>Not later than March, 1, 2022, the Secretary shall establish under the program additional service options for eligible States, in accordance with subparagraph (B), that—</text><subclause id="id593D221D44734D39970AD022918328F0"><enum>(I)</enum><text>allow for the delivery of meals directly to the residence of an eligible child; and</text></subclause><subclause id="id6407C4CB134D4F64A728A0A6FDB32316"><enum>(II)</enum><text>do not require that an eligible child arrive to, or be served a meal at, a specified location other than the residence of the child.</text></subclause></clause><clause id="id04d3aabdf5f64be2bf73654cae757c3c"><enum>(ii)</enum><header>Administration</header><text>In carrying out clause (i), the Secretary shall borrow from previously successful demonstration projects that have delivered nutritious meals, by mail or other mechanism, to the residences of children during the summer period.</text></clause></subparagraph><subparagraph id="id415D1357BB404A3E97EF9277E7FBFD23"><enum>(B)</enum><header>Eligible States</header><text>The Secretary shall permit the additional service options established under subparagraph (A)(i) to be carried out by a State participating in the program if the State has 1 or more areas, as determined by the Secretary, in which eligible children are unable—</text><clause id="id9E5FB189CE2C49089444741FE55F6B9A"><enum>(i)</enum><text>to access meals under the program at congregate feeding sites; and</text></clause><clause id="id63660FE4587A481A97118DCEEA3FD6DD"><enum>(ii)</enum><text>to fully utilize electronic benefit transfer funds provided to a household for the purpose of increasing household access to food for children during the summer months, including because of the distance and transportation options available to a retailer authorized to accept and redeem benefits under the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.).</text></clause></subparagraph><subparagraph id="ide88c29a4906a46019ad5e7e33ac2ebba"><enum>(C)</enum><header>Nutritious meals</header><text>The Secretary shall ensure that meals delivered through the additional service options established under subparagraph (A)(i) meet the criteria for nutritious meals under the program, except that the Secretary shall not impose restrictions that would otherwise prevent the delivery of nutritious meals to children under those additional service options. </text></subparagraph><subparagraph id="id601c5d3138d945bb80fdf30efc526fb4"><enum>(D)</enum><header>Technical assistance and support</header><clause id="id5EF8FEE7EC0A4C1CAAE57A901AB8E37F"><enum>(i)</enum><header>Definition of eligible entity</header><text>In this subparagraph, the term <quote>eligible entity</quote> means a nonprofit organization or institution of higher education—</text><subclause id="idB6A9C2C376374E588566B602A5514F8E"><enum>(I)</enum><text>that has experience in delivering nutritious summer meals to residential homes using mainstream shipping carriers, in coordination with service institutions; and</text></subclause><subclause id="id251CC8098A0041F2A9BB21CCBD88D87A" commented="no"><enum>(II)</enum><text>that experience of which is demonstrated in a public report of a research institution with experience in domestic feeding programs.</text></subclause></clause><clause id="id1B3FB79B1545429F99567844B1B647BE"><enum>(ii)</enum><header>Grants and cooperative agreements</header><text>The Secretary shall provide grants to, or enter into cooperative agreements with, eligible entities to provide technical assistance, support, and evaluation to State agencies and service institutions, in not more than 5 States, carrying out the additional service options established under subparagraph (A)(i). </text></clause><clause id="id33cc9aba442c4b13a8fe936f225de6dd"><enum>(iii)</enum><header>Subgrants</header><text>An eligible entity that receives a grant or enters into a cooperative agreement under clause (ii) may award a subgrant to another eligible entity in the State to assist in carrying out the grant or cooperative agreement.</text></clause><clause id="id73c5dc83078b4ae0a49e141b9ca6749d"><enum>(iv)</enum><header>Duration</header><text>A grant or cooperative agreement under clause (ii) shall be for the period beginning on the date on which the grant is awarded or the cooperative agreement is entered into, as applicable, and ending on the last day of the third fiscal year that begins after the date of enactment of the <short-title>Summer Meals Alternative Relief and Transportation Act of 2021</short-title>.</text></clause></subparagraph><subparagraph id="id3ebc251f19614c4db956fe627b661349"><enum>(E)</enum><header>Report</header><text>Not later than 1 year after the termination of the last grant or cooperative agreement entered into under subparagraph (D)(ii), the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report that—</text><clause id="idE63B20596BE04DDBAB600E99F36CD816"><enum>(i)</enum><text>describes—</text><subclause id="idCC1DB3040F1C4E19A01D2774784B5E1E"><enum>(I)</enum><text>the use of the alternative delivery options established under subparagraph (A)(i); and</text></subclause><subclause id="id019AB54FC87B4587978147442231DC93"><enum>(II)</enum><text>the impact of those options on participation in the program;</text></subclause></clause><clause id="idE05D103110044705967BFF67CCF9B584"><enum>(ii)</enum><text>describes the impact of the technical assistance, support, and evaluation provided under subparagraph (D) on participation in the program; and</text></clause><clause id="id0AB8E59A72E84AA580816962EC574C98"><enum>(iii)</enum><text>is supported by data from a research institution or institution of higher education.</text></clause></subparagraph><subparagraph id="id0329361bd5b641a4a42752138f9ebc79"><enum>(F)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $10,000,000 to carry out this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
