which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To codify a statutory definition for long-term care pharmacies.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Long-Term Care Pharmacy Definition Act of 2021</short-title></quote>.</text></section><section id="id2ae6ed110cbd4549b3d3d89f8ac28c54"><enum>2.</enum><header>Definition</header><text display-inline="no-display-inline">Section 1860D–2 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id72a9fca228d24ce5a2433971446e88e8"><subsection id="id573bdd651ec7411ca57c754189be60af"><enum>(f)</enum><header>Long-Term care pharmacy defined</header><paragraph id="id057f4893377c498993b560b154cbc9e8"><enum>(1)</enum><header>In general</header><text>The term <term>long-term care pharmacy</term> means a pharmacy licensed under applicable State law that is able to provide enhanced pharmacy and clinical services to individuals who require enhanced medication services and reside in a facility (as defined in paragraph (4)).</text></paragraph><paragraph id="id1cde7d6b7c6e4a669a103a6b8c852ce0"><enum>(2)</enum><header>Enhanced pharmacy and clinical services</header><text>As used in this subsection, the term <term>enhanced pharmacy and clinical services</term> includes—</text><subparagraph id="id49fcfb2aa1d64d07b3bdccab0f5696a2"><enum>(A)</enum><text>medications dispensed pursuant to a prescription or chart order in specialized packaging which shall include unit of use packaging, unit dose packaging, single use containers, packaging from remote automated dispensing technology, or other packaging required;</text></subparagraph><subparagraph id="id7613e56ef7ab4644a60fc50aa7e89584"><enum>(B)</enum><text>drug utilization review to identify potential adverse drug reactions and inappropriate drug usage;</text></subparagraph><subparagraph id="idb2c1bef755924609a64f80ed69854d3d"><enum>(C)</enum><text>medication reconciliation services at the transition of care and other necessary clinical management and medication services;</text></subparagraph><subparagraph id="id626c75833e1140be87156f772b6c1fcb"><enum>(D)</enum><text>timely medication delivery 24 hours a day, 7 days a week;</text></subparagraph><subparagraph id="ide11378c74bc14102a7c01714098a5d05"><enum>(E)</enum><text>pharmacist on-call availability to provider dispensing and clinical services 24 hours a day, 7 days a week;</text></subparagraph><subparagraph id="idc6988b882d0c4f18b5eb9d264c8918cb"><enum>(F)</enum><text>emergency supplies of medication as permitted by law and as required, including emergency kits or remote automated dispensing technology at a facility; and</text></subparagraph><subparagraph id="id118b3343119d468582a9880320bb3004"><enum>(G)</enum><text>such other services as the Secretary determines appropriate.</text></subparagraph></paragraph><paragraph id="id68bb7a9d2efb4d178182dfbd56e5c7d0"><enum>(3)</enum><header>Individuals requiring enhanced medication services</header><text>As used in this subsection, the term <term>individual who requires enhanced medication services</term> means an individual who has one or more comorbid and medically complex chronic conditions that are life-threatening or significantly limit overall health or function, pose a high risk of hospitalization or other adverse health outcomes, and require enhanced pharmacy and clinical services.</text></paragraph><paragraph id="idae50607c85754e5c8605f63a523bc819"><enum>(4)</enum><header>Facility</header><text>As used in this subsection, the term <term>facility</term> includes a facility described in section 1819(a), 1919(a), or 1905(d), or any other setting in which individuals who require enhanced medication services reside as determined by the Secretary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
