which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to expand parental leave for members of the Armed Forces, to reduce the service commitment required for participation in the career intermission program of a military department, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H815F308B317A4680B790E6DBDB923076"><section section-type="section-one" id="HC3C0C5AC08554B578100BA21F3641F53"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Servicemember Parental Leave Equity Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HE674AEEB25814A51AB774D483B1DB2B7"><enum>2.</enum><header>Expansion of parental leave for members of the Armed Forces</header><subsection id="H692BC19E284F41729BDF9DBE664BBBF8"><enum>(a)</enum><header>Expansion</header><text display-inline="yes-display-inline">Section 701 of title 10, United States Code, is amended—</text><paragraph id="H9D56184201A64FD2A4E698D2D29D52F7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (i)—</text><subparagraph id="H090F63B41A82421AB677D1D7C15BEA56"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HC9EBD29FB5654E11B5B1FE38C3C87215"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>twelve weeks</quote> and inserting <quote>18 weeks</quote>;</text></clause><clause id="HE28A6C1E636B4BFEAB7CEAEE62CE29CA"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>six weeks</quote> and inserting <quote>12 weeks</quote>; and</text></clause><clause id="H7F1B321FF65C41E9AAA2963FA3302853"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="USC" display-inline="no-display-inline" id="H965D2E39A2A64A9695E016864943673D"><subparagraph id="H44866D187D914D18A815B1D0648AE465" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">Under the regulations prescribed for purposes of this subsection, a member of the armed forces described in paragraph (2) who is the primary caregiver in the case of a long-term placement of a foster child is allowed up to 12 weeks of total leave to be used in connection with such placement, subject to limits as determined by the Secretary regarding—</text><clause id="H340FD81558CA4C1D92A47AA7CABF77C5"><enum>(i)</enum><text display-inline="yes-display-inline">the total number of times that a member of the armed forces may use leave under this section with respect to the placement of a foster child; and</text></clause><clause id="H3F051EF63384440E971E016AFAD2F50F"><enum>(ii)</enum><text display-inline="yes-display-inline">the frequency with which a member of the armed forces may use leave under this section with respect to the placement of a foster child.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H55644002A5B449FC80F2BA8198460DBB"><enum>(B)</enum><text>in paragraph (5), by striking <quote>birth or adoption</quote> and inserting <quote>birth, adoption, or foster child placement</quote>; and</text></subparagraph><subparagraph id="H03548E19656D473E8C1B2AFC95B32A4A"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (6)(A), by striking <quote>birth or adoption</quote> and inserting <quote>birth, adoption, or foster child placement</quote>;</text></subparagraph></paragraph><paragraph id="HE8C2C98297644C8597CFF627DB74AFC5"><enum>(2)</enum><text>in subsection (j)—</text><subparagraph id="H445E8616BE0B46B9BCA1BC74E89EED69"><enum>(A)</enum><text>in paragraph (1), by striking <quote>21 days</quote> and inserting <quote>12 weeks</quote>;</text></subparagraph><subparagraph id="HFA7C4F0235044CB1AC070A92D887141B"><enum>(B)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (3) through (5), respectively;</text></subparagraph><subparagraph id="H073EBCD20CB84E1AA80804B253974D09"><enum>(C)</enum><text>by inserting after paragraph (1) the following new paragraph:</text><quoted-block style="USC" display-inline="no-display-inline" id="H016BB9A3453E4BFEBAD3E2AE438CD70F"><paragraph id="HE14A61C404D04A9F95E971F09EA76B48" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Under the regulations prescribed for purposes of this subsection, a member of the armed forces described in subsection (i)(2) who is the secondary caregiver in the case of a long-term placement of a foster child is allowed up to 12 weeks of total leave to be used in connection with such placement, subject to limits as determined by the Secretary regarding—</text><subparagraph id="HBDF81F10A27949B29AA0372AEF258E52"><enum>(A)</enum><text>the total number of times that a member of the armed forces may use leave under this section with respect to the placement of a foster child; and</text></subparagraph><subparagraph id="HCA9AFFC1F61444A9904B33E2CFDE8E82"><enum>(B)</enum><text>the frequency with which a member of the armed forces may use leave under this section with respect to the placement of a foster child.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HA96955C9D7724C36B0A0682459041464"><enum>(D)</enum><text>in paragraph (4), as redesignated, by striking <quote>only in one increment in connection with such birth or adoption</quote> and inserting <quote>in more than one increment in connection with such birth, adoption, or foster child placement in accordance with regulations prescribed by the Secretary of Defense</quote>; and</text></subparagraph><subparagraph id="HF45C406954384EC884808D0F986DD114"><enum>(E)</enum><text>by adding at the end the following new paragraph (6):</text><quoted-block style="USC" display-inline="no-display-inline" id="H35561135C3634883829EF3380C1FCD1F"><paragraph id="H052086D1F28A4D038245FA3EE04E54DD" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">Under regulations prescribed for purposes of this subsection, the Secretary shall provide a member of the armed forces described in subsection (i)(2), who would have been a secondary caregiver but for a miscarriage, stillbirth, or infant death, with leave—</text><subparagraph id="HF1CCB58C20A14EFB8A7B054DAC25399A"><enum>(A)</enum><text>in addition to leave under subsection (a); and</text></subparagraph><subparagraph id="H610E644B95464C37BC6CB2B3F6A33F25"><enum>(B)</enum><text>not to exceed the amount of leave under paragraph (1).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H278CBE60F2194FE3AEE4D63763716DBF"><enum>(3)</enum><text>in subsection (l), by inserting <quote>, ordered to temporary duty overnight travel, or ordered to participate in physically demanding field training exercises,</quote> before <quote>during</quote>; and</text></paragraph><paragraph id="HAD51A5E5C02147FF8A683E08B5AF4D42"><enum>(4)</enum><text>by adding at the end the following new subsection (m):</text><quoted-block style="USC" display-inline="no-display-inline" id="HA7C17D747A4D4719AFA3F8CC06F01FA4"><subsection id="H9F870555073A471B884CE72EF4AC04C2"><enum>(m)</enum><text display-inline="yes-display-inline">A member of the armed forces who gives birth while on active duty may be required to meet body composition standards or pass a physical fitness test during the period of 12 months beginning on the date of such birth only with the approval of a health care provider employed at a military medical treatment facility and—</text><paragraph id="HA341173469C14BEEAE91AF9D63CDDAB3"><enum>(1)</enum><text>at the election of such member; or</text></paragraph><paragraph id="H01B96B77D87C430DA72432F5B5712C05"><enum>(2)</enum><text display-inline="yes-display-inline">in the interest of national security, as determined by the Secretary of Defense.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA429D634464C4E9E986E639D870EBCB2"><enum>(b)</enum><header>Regulations; guidance and policies</header><paragraph id="HE259A4F425A04A618D4FD541D3CF746A"><enum>(1)</enum><header>Regulations</header><text>The Secretary of Defense shall prescribe regulations—</text><subparagraph id="HB0BBC6CD62F84387BAC98FC903A9F673"><enum>(A)</enum><text display-inline="yes-display-inline">for leave under subsection (i)(1)(C) and subsection (j)(2) of section 701 of title 10, United States Code, as amended by subsection (a), not later than one year after the date of the enactment of this Act;</text></subparagraph><subparagraph commented="no" id="H9193CF40B10A4F06959E0D81B0BA73FD"><enum>(B)</enum><text>that establish leave, consistent across the Armed Forces, under subsection (j)(6) of such section not later than one year after the date of the enactment of this Act; and</text></subparagraph><subparagraph commented="no" id="HD67F3FDDC34C4AC0B5E021044C1C7D24"><enum>(C)</enum><text display-inline="yes-display-inline">that establish convalescent leave, consistent across the Armed Forces, under subsection (i)(1) of such section not later than 180 days after the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="HB8A4EF1C03964937BACBF55543E16BE5"><enum>(2)</enum><header>Guidance and policies</header><text>Each Secretary of a military department shall prescribe—</text><subparagraph commented="no" id="H04F896F54A0349308C400BDB64BBF108"><enum>(A)</enum><text display-inline="yes-display-inline">policies to establish the maximum amount of leave under subsection (i)(1) of section 701 of title 10, United States Code, as amended by subsection (a), not later than one year after the date of the enactment of this Act;</text></subparagraph><subparagraph id="H454664B101D04B738D4D436FC68C5C4A"><enum>(B)</enum><text display-inline="yes-display-inline">policies to implement leave under subsection (i)(5) or (j)(4) of such section not later than 180 days after the date of the enactment of this Act;</text></subparagraph><subparagraph id="H8D08D732911F4DD792F99F9869C54890"><enum>(C)</enum><text display-inline="yes-display-inline">policies to implement not less than 21 days of leave pursuant to regulations prescribed under paragraphs (1) and (2) of subsection (j) of such section not later than one year after the date of the enactment of this Act; and</text></subparagraph><subparagraph id="H8E9E5C18BDD245D188EB4E19A746E32F"><enum>(D)</enum><text>policies to implement the maximum amount of leave pursuant to regulations prescribed under paragraphs (1) and (2) of subsection (j) of such section not later than five years after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="HFB6BBB638BBA41F78FAB938308F63100"><enum>(c)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than January 1, 2023, and annually thereafter, each Secretary of a military department shall submit to the Committees on Armed Services of the Senate and House of Representatives a report including the following:</text><paragraph id="HB316440A118F4A238203FDADBD3A54ED"><enum>(1)</enum><text display-inline="yes-display-inline">A description of the use, during the preceding fiscal year, of leave under subsections (i) and (j) of section 701 of title 10, United States Code, as amended by subsection (a), disaggregated by births, adoptions, and foster placements, including—</text><subparagraph id="H723437D4A1424771826604BBE2DB5BB8"><enum>(A)</enum><text display-inline="yes-display-inline">the number of members in each Armed Force under the jurisdiction of the Secretary who became primary caregivers;</text></subparagraph><subparagraph id="H0BCE39AFB921495484511E0C5A1CC146"><enum>(B)</enum><text display-inline="yes-display-inline">the number of members in each Armed Force under the jurisdiction of the Secretary who became secondary caregivers;</text></subparagraph><subparagraph id="H5AF80C529124480980079EB7D520DE7B"><enum>(C)</enum><text>the number of primary caregivers who used primary caregiver leave;</text></subparagraph><subparagraph id="H46B1FFD9C06146FA965EDB9B22F5A95E"><enum>(D)</enum><text>the number of secondary caregivers who used secondary caregiver leave;</text></subparagraph><subparagraph id="H99E02FC9C30E402F96A718CEA09740E6"><enum>(E)</enum><text>the number of primary caregivers who used the maximum amount of primary caregiver leave;</text></subparagraph><subparagraph id="H75ADB5AFD3C649CFAF893A383E60E906"><enum>(F)</enum><text>the number of secondary caregivers who used the maximum amount of secondary caregiver leave;</text></subparagraph><subparagraph id="H74D0500CC14C42A49849F7A22BC4CEF8"><enum>(G)</enum><text>the number of primary caregivers who utilized primary caregiver leave in multiple increments;</text></subparagraph><subparagraph id="HADF6F1FADA1048679A3B66E104EC0BB1"><enum>(H)</enum><text>the number of secondary caregivers who utilized primary caregiver leave in multiple increments;</text></subparagraph><subparagraph id="HC348D7F77A44442EABD1BE24BA4D8BE4"><enum>(I)</enum><text>the median duration of primary caregiver leave used by primary caregivers;</text></subparagraph><subparagraph id="H3A329247C27542908CF3FB93F78C5003"><enum>(J)</enum><text>the median duration of secondary caregiver leave used by secondary caregivers; and</text></subparagraph><subparagraph id="H78E1976A914B4A36BD274889BF0221A3"><enum>(K)</enum><text>other information the Secretary determines appropriate.</text></subparagraph></paragraph><paragraph id="HF76E4F0D94484F818B0BFBBF63A2C744"><enum>(2)</enum><text display-inline="yes-display-inline">An analysis of the effect of leave described in paragraph (1) on—</text><subparagraph id="H23BF0198FF1746D3A4BDA55F819A0694"><enum>(A)</enum><text>readiness; and</text></subparagraph><subparagraph id="HD9170E0FED05469FA4B82273179245AA"><enum>(B)</enum><text>retention.</text></subparagraph></paragraph><paragraph id="HDC29B6F9ECF046789E71946E8DBAC0ED"><enum>(3)</enum><text>A description of any actions taken by the Secretary to mitigate negative effects described in paragraph (2).</text></paragraph><paragraph id="H1E029283843D4748BDEE9CEB3BB05AE1"><enum>(4)</enum><text display-inline="yes-display-inline">The number of members deployed under each paragraph of subsection (l) of section 701 of title 10, United States Code, as amended by subsection (a).</text></paragraph></subsection></section><section id="HE7131FF0898F4AAF9E5E0E405CA82210"><enum>3.</enum><header>Reduction in service commitment required for participation in career intermission program of a military department</header><text display-inline="no-display-inline">Section 710(c)(3) of title 10, United States Code, is amended by striking <quote>two months</quote> and inserting <quote>one month</quote>.</text></section></legis-body></bill>
