which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish an open network architecture testbed at the Institute for Telecommunication Sciences of the National Telecommunications and Information Administration to develop and demonstrate network architectures and applications, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telecommunications Supply Chain Diversity Promotion Act</short-title></quote>.</text></section><section id="id368655D5D6B149B5A3CB3F4924EA8E69"><enum>2.</enum><header>Open network architecture</header><subsection id="id333C2B642BF14513A780CDD227F93E13"><enum>(a)</enum><header>Open network architecture testbed</header><paragraph id="id573AD60233F94AF587A67F9B26846CDF"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="id9081E056941E4C868E3ABE4E2DCC855E"><enum>(A)</enum><text>the term <term>Applied Research Open-RAN testbed</term> means the testbed established under paragraph (2);</text></subparagraph><subparagraph id="idF734A2CF54CA458D8359E9FC22040B43"><enum>(B)</enum><text>the term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information; and</text></subparagraph><subparagraph id="idA2DA4F455B3445DEA99B6BD7A5B637CA"><enum>(C)</enum><text>the term <term>NTIA</term> means the National Telecommunications and Information Administration.</text></subparagraph></paragraph><paragraph id="id3B619407D52D4C34B3A6853640DEDB79"><enum>(2)</enum><header>Establishment</header><text>The Assistant Secretary shall establish an applied research open network architecture testbed at the Institute for Telecommunication Sciences of the NTIA to develop and demonstrate network architectures and applications, equipment integration and interoperability at scale, including—</text><subparagraph id="id261028E1BB74480FB524AE42C56D5650"><enum>(A)</enum><text>Open Radio Access Network (commonly known as <quote>Open-RAN</quote>) technology;</text></subparagraph><subparagraph id="id35F0CD051F41480A95EF381EE09D79DF"><enum>(B)</enum><text>Virtualized Radio Access Network (commonly known as <quote>vRAN</quote>) technology; and</text></subparagraph><subparagraph id="id94B517AB2B2147EC9B68C2153D79F8FF"><enum>(C)</enum><text>cloud native technologies that replicate telecommunications hardware as software-based virtual network elements and functions.</text></subparagraph></paragraph><paragraph id="id7F3BEDB308114FF6B96045142351EA74" commented="no"><enum>(3)</enum><header>Focus; considerations</header><text>In establishing the Applied Research Open-RAN testbed pursuant to this section, the Assistant Secretary shall ensure that such testbed evaluates issues related to deployment and operation of open network architectures in rural areas. </text></paragraph><paragraph id="id64088bdf386447b985e3924e5e17a5c2"><enum>(4)</enum><header>Cooperative research and development agreements</header><text>The Assistant Secretary shall enter into cooperative research and development agreements as appropriate to obtain equipment, devices, and expertise for the Applied Research Open-RAN testbed, in accordance with section 12 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3710a">15 U.S.C. 3710a</external-xref>).</text></paragraph><paragraph id="idb7eb30644f6a4010b2afc9c330982260"><enum>(5)</enum><header>Private sector contributions</header><text>The Assistant Secretary may accept private contributions to the Applied Research Open-RAN testbed in the form of network equipment or devices for testing purposes.</text></paragraph><paragraph id="id7611698c5aff420d9545c5f0b2bad105"><enum>(6)</enum><header>Partnership with Government entities</header><subparagraph id="idAEA1BC27F6EC43B4A5971E92E2C1981F"><enum>(A)</enum><header>Establishment</header><text>In establishing the Applied Research Open-RAN testbed, the Assistant Secretary shall—</text><clause id="iddef9b32850bf4eb9a7044830b189e2cb"><enum>(i)</enum><text>consult with the Federal Communications Commission, including with respect to ongoing work by the Commission to develop other testbeds, including private sector testbeds, related to Open-RAN technologies; and</text></clause><clause id="id3eac584f895f4b599ea9934357c63d8e"><enum>(ii)</enum><text>ensure that the work on the testbed is coordinated with the responsibilities of the Assistant Secretary under any relevant memorandum of understanding with the Federal Communications Commission and the National Science Foundation related to spectrum. </text></clause></subparagraph><subparagraph id="id320986734FE244F98349AB3207438675"><enum>(B)</enum><header>Operations</header><text>In operating the Applied Research Open-RAN testbed, the Assistant Secretary shall, in consultation with the Federal Communications Commission, partner with—</text><clause id="idDF7EED4F1CED4A3FB614A34F66DE4906"><enum>(i)</enum><text>the First Responder Network Authority of the NTIA (also known as <quote>FirstNet</quote>) and the Public Safety Communications Research Division of the National Institute of Standards and Technology to examine use cases and applications for Open-RAN technologies in a public safety network; </text></clause><clause id="idF1DDCF34B38145EC9CB8B848A0EF9227"><enum>(ii)</enum><text>other Federal agencies, as appropriate to examine use cases and applications for Open-RAN technologies in other areas of interest to such agencies; and</text></clause><clause id="id86a135f6fbf34373b9fcde8d4c4b20b0"><enum>(iii)</enum><text>international partners, as appropriate.</text></clause></subparagraph></paragraph><paragraph id="idF82E6F02CA7046C3B4E40B5C0EC94294"><enum>(7)</enum><header>Stakeholder input</header><text>The Assistant Secretary shall seek input from stakeholders regarding the establishment and operation of the Applied Research Open-RAN testbed.</text></paragraph><paragraph id="idb87b33d1e13c4eaa9a99fd03703fbc9c"><enum>(8)</enum><header>Implementation deadline</header><text>Not later than 180 days after the date of enactment of this Act, the Assistant Secretary shall—</text><subparagraph id="idC8E380507F4545C8A93FD04165C9281E"><enum>(A)</enum><text>define metrics and parameters for the Applied Research Open-RAN testbed, including functionality, project configuration and capacity, performance, security requirements, and quality assurance;</text></subparagraph><subparagraph id="idE42B0A89D85D4EFEB99C9A50E13B2AB6"><enum>(B)</enum><text>adopt any rules as necessary, in consultation with the Federal Communications Commission; and</text></subparagraph><subparagraph id="id1A7A6C2C76F0481AA623024E710F5017"><enum>(C)</enum><text>begin the development of the Applied Research Open-RAN testbed, including seeking stakeholder input as required by paragraph (7).</text></subparagraph></paragraph><paragraph id="id91254962823b41dea757771b4a519c2d"><enum>(9)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Assistant Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the findings of the testbed and any recommendations for additional legislative or regulatory actions relating to the work of the testbed.</text></paragraph><paragraph id="id31E204F6B7F74FE0A93A9348CA075770"><enum>(10)</enum><header>Authorization of appropriations</header><subparagraph id="id635DA9E6AD024CCC8D1A0416B5A0882B"><enum>(A)</enum><header>In general</header><text>There are authorized to be appropriated for the administration of the Applied Research Open-RAN testbed $20,000,000 for fiscal year 2022, to remain available until expended.</text></subparagraph><subparagraph id="idA0B8DC79281E4657A2A9900F2DCD88D2"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in paragraph (6) shall be construed to obligate FirstNet or any other Federal entity to pay for the cost of the Applied Research Open-RAN testbed created under this section in the absence of the appropriation of amounts under this paragraph. </text></subparagraph><subparagraph id="idFC9A7EDD9469499FA63D49BEA80B1B72"><enum>(C)</enum><header>Authorization for voluntary support</header><text>A Federal entity, including FirstNet, may voluntarily enter into an agreement with NTIA to provide monetary or nonmonetary support for the Applied Research Open-RAN testbed. </text></subparagraph></paragraph></subsection><subsection id="id9f562ec02c9c46f9a1edbc1a3e660d52"><enum>(b)</enum><header>Participation in standards-Setting bodies</header><paragraph id="idbab0cf04a6d94d80b41adbd3e85006a9"><enum>(1)</enum><header>Definitions</header><text>In this section—</text><subparagraph id="idE39CA67B99A14F6DAD9E29ECD596A623"><enum>(A)</enum><text>the term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information;</text></subparagraph><subparagraph id="idEFEC9DE69D774265ACAC28C8A6051502"><enum>(B)</enum><text>the term <term>eligible standards-setting body</term>—</text><clause id="id18875BA70C6C437489274090F49E023A"><enum>(i)</enum><text>means a standards-setting body, participation in which may be funded by a grant awarded under paragraph (2), as determined by the Assistant Secretary; and</text></clause><clause id="idBDB6809060B349FDA89660D5AD334A21"><enum>(ii)</enum><text>includes—</text><subclause id="id7f6958fbddf445c08c8e6c340be24be1"><enum>(I)</enum><text>the 3rd Generation Partnership Project (commonly known as <quote>3GPP</quote>);</text></subclause><subclause id="id772fa4865f6f4a66be3e16a2da641138"><enum>(II)</enum><text>the Alliance for Telecommunications Industry Solutions (commonly known as <quote>ATIS</quote>);</text></subclause><subclause id="id17ce0e1a9c994f29a09c714f0d4e27c2"><enum>(III)</enum><text>the International Telecommunications Union (commonly known as <quote>ITU</quote>);</text></subclause><subclause id="id0df0b41a622b433288bb6bb4ee543006"><enum>(IV)</enum><text>the Institute for Electrical and Electronics Engineers (commonly known as <quote>IEEE</quote>);</text></subclause><subclause id="id22fd9960830c4cfe8dee726d05df409c"><enum>(V)</enum><text>the World Radiocommunications Conferences (commonly known as the <quote>WRC</quote>) of the ITU;</text></subclause><subclause id="idc256fa4738444bb38c7cf5cdf8412c4d"><enum>(VI)</enum><text>the Internet Engineering Task Force (commonly known as the <quote>IETF</quote>);</text></subclause><subclause id="id16489f3f90ae439a8999fdad3b0aa8db"><enum>(VII)</enum><text>the International Organization for Standardization (commonly known as the <quote>ISO</quote>) and the International Electrotechnical Commission (commonly known as the <quote>IEC</quote>); </text></subclause><subclause id="id368ff7373ce04a9f8710c3e6c03230dc" commented="no" display-inline="no-display-inline"><enum>(VIII)</enum><text>the O-RAN Alliance; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9FDB1555631C4EEA8EF55A0909ECE59C"><enum>(IX)</enum><text>the Telecommunications Industry Association (commonly known as <quote>TIA</quote>); and </text></subclause><subclause display-inline="no-display-inline" commented="no" id="id7DC22FBB2A254BCBA7C3BB0B5E9C093E"><enum>(X)</enum><text>any other standards-setting body identified under paragraph (4); </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8B5711CD337244C1AD4FB43DBE3CB723"><enum>(C)</enum><text>the term <term>Secretary</term> means the Secretary of Commerce; and</text></subparagraph><subparagraph id="id7948A918131B4EB69EBB4F8376BA5314"><enum>(D)</enum><text>the term <term>standards-setting body</term> means an international body that develops the standards for open network architecture technologies.</text></subparagraph></paragraph><paragraph id="idFA7CCB8304DA4D218E818F2E91B099CC"><enum>(2)</enum><header>Grant program</header><subparagraph id="id293EF80F82A44F84AE30B599B219E6CC"><enum>(A)</enum><header>In general</header><text>The Secretary, in collaboration with the Assistant Secretary, shall award grants to private sector entities based in the United States to participate in eligible standards-setting bodies.</text></subparagraph><subparagraph id="idB9BB0C3A5EF0472188D4449C568CF16A"><enum>(B)</enum><header>Prioritization</header><text>The Secretary shall prioritize grants awarded under this section to private sector entities that would not otherwise be able to participate in eligible standards-setting bodies without the grant. </text></subparagraph></paragraph><paragraph id="id05b90753201b4adda065dadc86d3bdbe"><enum>(3)</enum><header>Grant criteria</header><text>Not later than 180 days after the date on which amounts are appropriated under paragraph (5), the Secretary, in collaboration with the Assistant Secretary, shall establish criteria for the grants awarded under paragraph (2). </text></paragraph><paragraph id="id902DA338DE2249C9A5C7E18A9E42B6FE"><enum>(4)</enum><header>Consultation with Federal Communications Commission</header><text>The Secretary shall consult with the Federal Communications Commission in—</text><subparagraph id="id84D0E06431D448DCB4870CC469FDFF4A"><enum>(A)</enum><text>determining criteria for the grants awarded under paragraph (2); and</text></subparagraph><subparagraph id="idAD425FA74CF947E6ABB6AFA31CA7B425"><enum>(B)</enum><text>determining which standards-setting bodies, if any, in addition to the standards-setting bodies listed in paragraph (1)(B)(ii) are eligible standards-setting bodies.</text></subparagraph></paragraph><paragraph id="idED3440BC1795427CBA631E64AE511F9C"><enum>(5)</enum><header>Authorization of appropriations</header><subparagraph id="id3E84B455BC0F4524B02C3D8DAE40A39B"><enum>(A)</enum><header>In general</header><text>There are authorized to be appropriated for grants under paragraph (2) $30,000,000 in total for fiscal years 2022 through 2025, to remain available until expended.</text></subparagraph><subparagraph id="idB831F278547647CBB74A3CA91E7FB031"><enum>(B)</enum><header>Administrative costs</header><text>The Secretary may use not more than 2 percent of any funds appropriated under this paragraph for the administration of the grant program established under this subsection. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
