which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Workforce Innovation and Opportunity Act to provide funding, on a competitive basis, for summer and year-round employment opportunities for youth ages 14 through 24. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Creating Pathways for Youth Employment Act</short-title></quote>.</text></section><section id="idA33B6254BB164F0DB519B5C5E49D792D"><enum>2.</enum><header>Youth employment opportunities</header><text display-inline="no-display-inline">Title I of the Workforce Innovation and Opportunity Act is amended—</text><paragraph id="id22A13FF56795417EB96824ED880F6808"><enum>(1)</enum><text>by redesignating subtitle E (<external-xref legal-doc="usc" parsable-cite="usc/29/3241">29 U.S.C. 3241</external-xref> et seq.) as subtitle F; and</text></paragraph><paragraph id="idB18F9373ACCB493195D9C2A693A56C59"><enum>(2)</enum><text>by inserting after subtitle D (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221</external-xref> et seq.) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3C8950DB43034AE5B8887384749CEC8E"><subtitle id="id298021FD162A44E096BD2658FA7A7786" style="OLC"><enum>E</enum><header>Youth Employment Opportunities</header><section id="iddfd6516ca002460489c4798edabbab0f"><enum>176.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="idAA3957FBBAD24FAB96DFB99A6DC4637F"><enum>(1)</enum><header>Eligible youth</header><text>The term <term>eligible youth</term> means an individual who—</text><subparagraph id="idB1FF235DF3064B03B1F55A260AECA952"><enum>(A)</enum><text>is not younger than age 14 or older than age 24; and</text></subparagraph><subparagraph id="id556D9109B7E7467C815B53C85134E9F7"><enum>(B)</enum><text>is—</text><clause id="idBAF2B7ACE9EB4D028CA7EE472F7FC48A"><enum>(i)</enum><text>an in-school youth;</text></clause><clause id="id17228B01BB1B4817A41A3CBF65647558"><enum>(ii)</enum><text>an out-of-school youth; or</text></clause><clause id="id8A6903A2806D46D1B13E194AAD95A7F6"><enum>(iii)</enum><text>an unemployed individual.</text></clause></subparagraph></paragraph><paragraph id="id8f3167fac53a4ed192fa7c6e44dd94ee"><enum>(2)</enum><header>Hardest-to-employ, most-at-risk</header><text>The term <term>hardest-to-employ, most-at-risk</term>, used with respect to an individual, includes individuals who are homeless, in foster care, involved in the juvenile or criminal justice system, or are not enrolled in or at risk of dropping out of an educational institution and who live in an underserved community that has faced trauma through acute or long-term exposure to substantial discrimination, historical or cultural oppression, intergenerational poverty, civil unrest, a high rate of violence, or a high rate of drug overdose mortality.</text></paragraph><paragraph id="idcaab67322ec44eef93fabbb27afb1f0a"><enum>(3)</enum><header>Indian tribe; tribal organization</header><text>The terms <term>Indian tribe</term> and <term>tribal organization</term> have the meanings given the terms in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id7E93A5B01ACD4AF7B2F4B0825E866951"><enum>(4)</enum><header>In-school youth; out-of-school youth</header><text display-inline="yes-display-inline">The terms <term>in-school youth</term> and <term>out-of-school youth</term> have the meanings given the terms in section 129(a)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3570D30B624B40CBB7EC17EA1CC34A88"><enum>(5)</enum><header display-inline="yes-display-inline">Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="id992dfe8e3ab64cd69ae51a3d4c19e043"><enum>(6)</enum><header>Subsidized employment</header><text>The term <term>subsidized employment</term> means employment for which the employer receives a total or partial subsidy to offset costs of employing an eligible youth under this subtitle.</text></paragraph><paragraph id="id7279079129d049a6ade68c44f047f39b"><enum>(7)</enum><header>Tribal area</header><text>The term <term>tribal area</term> means—</text><subparagraph id="id1235231968864049A7FCB39B834C7F73"><enum>(A)</enum><text>an area on or adjacent to an Indian reservation;</text></subparagraph><subparagraph id="id83242563CD4D4DC3BEE7079D9A5D8FD0"><enum>(B)</enum><text>land held in trust by the United States for Indians;</text></subparagraph><subparagraph id="id97942E8282674BC2BF0903365321CF79"><enum>(C)</enum><text>a public domain Indian allotment;</text></subparagraph><subparagraph id="id4C785DDCAE9A41D5B7EF17F4AE40444F"><enum>(D)</enum><text>a former Indian reservation in Oklahoma; and</text></subparagraph><subparagraph id="idCC008F11F4CA4D30A41974B974352053"><enum>(E)</enum><text>land held by an incorporated Native group, Regional Corporation, or Village Corporation under the provisions of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="id04e3f334dda44aa3bc959c54ec6e028c"><enum>(8)</enum><header>Tribal college or university</header><text>The term <term>tribal college or university</term> has the meaning given the term <term>Tribal College or University</term> in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>).</text></paragraph><paragraph id="id96e7286cc91f4d37b11cf8e77416cb83"><enum>(9)</enum><header>Tribally designated housing entity</header><text>The term <term>tribally designated housing entity</term>, used with respect to an Indian tribe (as defined in this section), has the meaning given in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></paragraph></section><section id="ide4c34a4f130448d9b2c5d975a7b4634d"><enum>176A.</enum><header>Allocation of funds</header><subsection id="idc48a720461b84be5be49174205f12e3c"><enum>(a)</enum><header>Allocation</header><text>Of the funds appropriated under section 176E that remain available after any reservation under subsection (b), the Secretary may make available—</text><paragraph id="id33329be545c74e36b651cf0c323b97df"><enum>(1)</enum><text>not more than $1,500,000,000 in accordance with section 176B to provide eligible youth with subsidized summer employment opportunities; and</text></paragraph><paragraph id="id19a476581f0a42259b162234d7cf9933"><enum>(2)</enum><text>not more than $2,000,000,000 in accordance with section 176C to provide eligible youth with subsidized year-round employment opportunities.</text></paragraph></subsection><subsection id="id39720a2e5d7d42cbbb9c93f35da4a041"><enum>(b)</enum><header>Reservation</header><text>The Secretary may reserve not more than 10 percent of the funds appropriated under section 176E to provide technical assistance and oversight, in order to assist eligible entities in applying for and administering grants awarded under this subtitle.</text></subsection></section><section id="ida71dbcffb42a401aaf1e0484acaba2f9"><enum>176B.</enum><header>Summer employment competitive grant program</header><subsection id="iddb437214afc3410eae6a4c7b4e5ce729"><enum>(a)</enum><header>In general</header><paragraph id="id8A657745E0AA461EB2210DB851560E4E"><enum>(1)</enum><header>Grants</header><text>Using the amounts made available under 176A(a)(1), the Secretary shall award, on a competitive basis, planning and implementation grants.</text></paragraph><paragraph id="idCCAD3623464044B6BB1F075383DD6949"><enum>(2)</enum><header>General use of funds</header><text>The Secretary shall award the grants to assist eligible entities by paying for the program share of the cost of—</text><subparagraph id="id78E25938A2424DF585B4D0DB580DEE35"><enum>(A)</enum><text>in the case of a planning grant, planning a summer youth employment program to provide subsidized summer employment opportunities; and</text></subparagraph><subparagraph id="id8D1C3F03D373429CB7AF278273BC3E78"><enum>(B)</enum><text>in the case of an implementation grant, implementation of such a program, to provide such opportunities.</text></subparagraph></paragraph></subsection><subsection id="id6d6e9ecfb0ff4c849f64c32d02f3f284"><enum>(b)</enum><header>Periods and amounts of grants</header><paragraph id="idc5089ac68fae40c8afcc15165a1105dd"><enum>(1)</enum><header>Planning grants</header><text>The Secretary may award a planning grant under this section for a 1-year period, in an amount of not more than $200,000.</text></paragraph><paragraph id="idd36697ce30c2427e8b292948854d8cb6"><enum>(2)</enum><header>Implementation grants</header><text>The Secretary may award an implementation grant under this section for a 3-year period, in an amount of not more than $5,000,000.</text></paragraph></subsection><subsection id="id4dc524a9c5b142fcb84954995752fde1"><enum>(c)</enum><header>Eligible entities</header><paragraph id="id1db19e1a7b2d4c54a4c4fe9ee6462e40"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a planning or implementation grant under this section, an entity shall—</text><subparagraph id="idad0e871188774d71a568d8d749346219"><enum>(A)</enum><text>be a—</text><clause id="idF55ACFAA7F964505A5E5BAF33D6B5C3F"><enum>(i)</enum><text>State, local government, or Indian tribe or tribal organization, that meets the requirements of paragraph (2); or</text></clause><clause id="id831AB2A6D93D421DA03BDAD7EDB0AD89"><enum>(ii)</enum><text>community-based organization that meets the requirements of paragraph (3); and</text></clause></subparagraph><subparagraph id="idd5c154d8874040a1a1a1a7f4659e4727"><enum>(B)</enum><text>meet the requirements for a planning or implementation grant, respectively, specified in paragraph (4).</text></subparagraph></paragraph><paragraph id="id168835828d074e098ef1ff2c5ef03318"><enum>(2)</enum><header>Government partnerships</header><text>An entity that is a State, local government, or Indian tribe or tribal organization referred to in paragraph (1) shall demonstrate that the entity has entered into a partnership with State, local, or tribal entities—</text><subparagraph id="id26f352af49e54c4c958e085023050655"><enum>(A)</enum><text>that shall include—</text><clause id="id6db4fd7bec3347cc97e4b0fd6b389618"><enum>(i)</enum><text>a local educational agency or tribal educational agency (as defined in section 6132 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7452">20 U.S.C. 7452</external-xref>));</text></clause><clause id="id2ac535716cf448d1ae73efd561f534fa"><enum>(ii)</enum><text>a local board or tribal workforce development agency;</text></clause><clause id="idb555615808934c1c8494c1e70c053cc5"><enum>(iii)</enum><text>a State, local, or tribal agency serving youth under the jurisdiction of the juvenile justice system or criminal justice system;</text></clause><clause id="id97784514cacb43f79b8505b91afc778f"><enum>(iv)</enum><text>a State, local, or tribal child welfare agency;</text></clause><clause id="id96cdbd3892544e25b2baa52371788827"><enum>(v)</enum><text>a State, local, or tribal agency or community-based organization, with—</text><subclause id="id1e97cbc078f24f4497b883db1832e82b"><enum>(I)</enum><text>expertise in providing counseling services, and trauma-informed and gender-responsive trauma prevention, identification, referral, and support (including treatment) services; and</text></subclause><subclause id="idf9491617995c4ecdb51adc2576276b00"><enum>(II)</enum><text>a proven track record of serving low-income vulnerable youth and out-of-school youth; and</text></subclause></clause><clause id="id9e88992404b849288e07bbe7be80da6f"><enum>(vi)</enum><text>if the State, local government, or Indian tribe or tribal organization is seeking an implementation grant, and has not established a summer youth employment program, an entity that is carrying out a State, local, or tribal summer youth employment program; and</text></clause><clause id="id163a0693b49a40f89fbd0cabcb769160"><enum>(vii)</enum><text>an employer or employer association; and</text></clause></subparagraph><subparagraph id="idf2b26dd21ee041db8b4995d69b4df0af"><enum>(B)</enum><text>that may include—</text><clause id="idab1078245afe4516a51884e76787718a"><enum>(i)</enum><text>an institution of higher education or tribal college or university;</text></clause><clause id="id14a94b02a4414e918139a033f409192b"><enum>(ii)</enum><text>a representative of a labor or labor-management organization;</text></clause><clause id="idc216f9bdf8294e46aa405b0fbfd35c14"><enum>(iii)</enum><text>an entity that carries out a program that receives funding under the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5601">42 U.S.C. 5601</external-xref> et seq.) or section 212 of the Second Chance Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17532">42 U.S.C. 17532</external-xref>);</text></clause><clause id="id396fa1ab2e0a497fa7b59d3dc57e2ab2"><enum>(iv)</enum><text>a collaborative applicant as defined in section 401 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>) or a private nonprofit organization that serves homeless individuals and households (including such an applicant or organization that serves individuals or households that are at risk of homelessness in tribal areas) or serves foster youth;</text></clause><clause id="id6126140a08034c93aa7181fd2ca48324"><enum>(v)</enum><text>an entity that carries out a program funded under the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301</external-xref> et seq.), including Native American programs funded under section 116 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2326">20 U.S.C. 2326</external-xref>) and tribally controlled postsecondary career and technical institution programs funded under section 117 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/2327">20 U.S.C. 2327</external-xref>);</text></clause><clause id="id379d4b1a7e9444ceb5edf160a5ef6090"><enum>(vi)</enum><text>a local or tribal youth committee;</text></clause><clause id="idc3ec2a87116d4c1d85a18c2ae0bd69a3"><enum>(vii)</enum><text>a State or local public housing agency or a tribally designated housing entity; and</text></clause><clause id="id9e1cdd22a93a4bc3bd43cabcfd4c0897"><enum>(viii)</enum><text>another appropriate State, local, or tribal agency.</text></clause></subparagraph></paragraph><paragraph id="id1e0c15f7c23e45ab86f5c638c99c1dc7"><enum>(3)</enum><header>Community-based organization partnerships</header><text>A community-based organization referred to in paragraph (1) shall demonstrate that the organization has entered into a partnership with State, local, or tribal entities—</text><subparagraph id="id1acb60c31a71477bb33911bb13dd519a"><enum>(A)</enum><text>that shall include—</text><clause id="idc864dd2f059b47bfb95370b1903105ed"><enum>(i)</enum><text>a unit of general local government or tribal government;</text></clause><clause id="id4283c29e6e6b4ad5be08ebbbf04865a1"><enum>(ii)</enum><text>an agency described in paragraph (2)(A)(i);</text></clause><clause id="id40fcb9ecc9ee40b3a2a303784a79afcc"><enum>(iii)</enum><text>a local board or tribal workforce development agency;</text></clause><clause id="idb0ce48b0e47d4aa8b3e242e2113cbe9f"><enum>(iv)</enum><text>a State, local, or tribal agency serving youth under the jurisdiction of the juvenile justice system or criminal justice system;</text></clause><clause id="id29ec0bd5f23d46549ed97b3f490fbcfc"><enum>(v)</enum><text>a State, local, or tribal child welfare agency;</text></clause><clause id="idb64dee6f936c4da8a8e2543ec98bdf3c"><enum>(vi)</enum><text>if the organization is seeking an implementation grant, and has not established a summer youth employment program, an entity that is carrying out a State, local, or tribal summer youth employment program; and</text></clause><clause id="idba388c7c75464bfdb282281a7572c6c0"><enum>(vii)</enum><text>an employer or employer association; and</text></clause></subparagraph><subparagraph id="idcf8b2122fc794691999f2089d4b9ec42"><enum>(B)</enum><text>that may include one or more entities described in paragraph (2)(B).</text></subparagraph></paragraph><paragraph id="idEAC9E3A6791A44DCAEF99B80BB9B1A73"><enum>(4)</enum><header>Entities eligible for particular grants</header><subparagraph id="id93764FB0A44A44DE9FE2A2E52664E478"><enum>(A)</enum><header>Entities eligible for planning grants</header><text>The Secretary may award a planning grant under this section to an eligible entity that—</text><clause id="id7a2a7fa143d649fda174a47d4092a355"><enum>(i)</enum><text>is preparing to establish or expand a summer youth employment program that meets the minimum requirements specified in subsection (d); and</text></clause><clause id="idc2938d3234cd4ba780791179f2a22e13"><enum>(ii)</enum><text>has not received a grant under this section.</text></clause></subparagraph><subparagraph id="id533844a52e4e40129c5d1ba0cf9a1cd7"><enum>(B)</enum><header>Entities eligible for implementation grants</header><clause id="id6fc74f7251d84ecc89f757fb7fc2003f"><enum>(i)</enum><header>In general</header><text>The Secretary may award an implementation grant under this section to an eligible entity that—</text><subclause id="id1c0a4d54b69248fe9c4515bf9ffe9cc4"><enum>(I)</enum><text>has received a planning grant under this section; or</text></subclause><subclause id="id452e4d702c684cba9f21b4a22b32e3ee"><enum>(II)</enum><text>has established a summer youth employment program and demonstrates a minimum level of capacity to enhance or expand the summer youth employment program described in the application submitted under subsection (d).</text></subclause></clause><clause id="id9D003374AD8E495DB10EFFA615EAFA0D"><enum>(ii)</enum><header>Capacity</header><text>In determining whether an entity has the level of capacity referred to in clause (i)(II), the Secretary may include as capacity—</text><subclause id="idc2cbe819287044988aad60a28d9d991b"><enum>(I)</enum><text>the entity's staff capacity and staff training to deliver youth employment services; and</text></subclause><subclause id="id2a4b4c1a08a449718410ac1bd2e7dc80"><enum>(II)</enum><text>the entity's existing youth employment services (as of the date of submission of the application submitted under subsection (d)) that are consistent with the application.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id3d4f7a832f0a4f25855c86418cdcbceb"><enum>(d)</enum><header>Application</header><paragraph commented="no" display-inline="no-display-inline" id="id84968C37E08C4787A5254EA2FCF0E177"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), an eligible entity desiring to receive a grant under this section for a summer youth employment program shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including, at a minimum, each of the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="idF10C732C283D49A7AF9FCB192EB170D1"><enum>(A)</enum><text display-inline="yes-display-inline">With respect to an application for a planning or implementation grant—</text><clause id="id8F71B652B5324713A68811406DA0EDA9"><enum>(i)</enum><text>a description of the eligible youth for whom summer employment services will be provided;</text></clause><clause commented="no" display-inline="no-display-inline" id="id74F2E5F499B14568983D75B202753EC7"><enum>(ii)</enum><text>a description of the eligible entity, and a description of the expected participation and responsibilities of each of the partners in the partnership described in subsection (c);</text></clause><clause id="idEEFDE45BC1664C748110C2ECA509B414"><enum>(iii)</enum><text>information demonstrating sufficient need for the grant in the State, local, or tribal population, which may include information showing—</text><subclause id="idF74DFE5D62D348D1B6588F2A3DC7C92A"><enum>(I)</enum><text>a high level of unemployment among youth (including young adults) ages 14 through 24;</text></subclause><subclause id="id007753477D7C4821B5BBEFA692D2E9FF"><enum>(II)</enum><text>a high rate of out-of-school youth;</text></subclause><subclause id="id583D823F17274FB7BCF57AAA0B0F5F4F"><enum>(III)</enum><text>a high rate of homelessness;</text></subclause><subclause id="idFA6970287AA846D78980C734E3843F21"><enum>(IV)</enum><text>a high rate of poverty;</text></subclause><subclause id="id16b5b099b0374d00940446c1fce62100"><enum>(V)</enum><text>a high rate of adult unemployment;</text></subclause><subclause id="id2BA00C56FC7F4410920D98062E12D21C"><enum>(VI)</enum><text>a high rate of community or neighborhood crime;</text></subclause><subclause id="idDB4B9F2E0CBD49779A59D9CC0C4BF1C4"><enum>(VII)</enum><text>a high rate of violence; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idDD155CF7CF5B45CF8D71C92031F37BA0"><enum>(VIII)</enum><text>a high level or rate on another indicator of need;</text></subclause></clause><clause id="id905a121957c94b4aaedb7d0e9908725b"><enum>(iv)</enum><text>a description of the strategic objectives the eligible entity seeks to achieve through the program to provide eligible youth with core work readiness skills, which may include—</text><subclause id="idc32d54a13d3143459245a6367477c4c9"><enum>(I)</enum><text>financial literacy skills, including providing the support described in section 129(b)(2)(D);</text></subclause><subclause id="id9de770d2930143dbac2b16ca5a90d0d2"><enum>(II)</enum><text>sector-based technical skills aligned with employer needs;</text></subclause><subclause id="id1916138ac335422895e60113dbd28321"><enum>(III)</enum><text>skills that—</text><item id="id215ED27096C04706BEEE77234A7749F3"><enum>(aa)</enum><text>are soft employment skills, early work skills, or work readiness skills; and</text></item><item id="idE5A835BAA8E4436ABF0523F1F5AD521F"><enum>(bb)</enum><text>include social skills, communications skills, higher-order thinking skills, self-control, and positive self-concept; and</text></item></subclause><subclause id="ide8f4dbb29e354762bd6a057b4a14df0a"><enum>(IV)</enum><text>(for the hardest-to-employ, most-at-risk eligible youth) basic skills like communication, math, and problem solving in the context of training for advancement to better jobs and postsecondary training; and</text></subclause></clause><clause id="id8558EADF6C094299A34F51FB2A696681"><enum>(v)</enum><text>information demonstrating that the eligible entity has obtained commitments to provide the non-program share described in paragraph (2) of subsection (h).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE481771856AE42E7BABBFEDB49696D2C"><enum>(B)</enum><text>With respect to an application for a planning grant—</text><clause id="id1fd3c4da1ec44a36ae936d162778e1d9"><enum>(i)</enum><text>a description of the intermediate and long-term goals for planning activities for the duration of the planning grant;</text></clause><clause id="id507708480a80407bbfb19beac23dc58a"><enum>(ii)</enum><text>a description of how grant funds will be used to develop a plan to provide summer employment services for eligible youth;</text></clause><clause commented="no" display-inline="no-display-inline" id="idEEC7C7A47D0E4C328945002B440626D7"><enum>(iii)</enum><text display-inline="yes-display-inline">a description of how the eligible entity will carry out an analysis of best practices for identifying, recruiting, and engaging program participants, in particular the hardest-to-employ, most-at-risk eligible youth;</text></clause><clause id="idF88D1E772DA444C5A498BBBD4BB46F89"><enum>(iv)</enum><text>a description of how the eligible entity will carry out an analysis of best practices for placing youth participants—</text><subclause id="id4568EB48B2D54DEBA2059A443A296BE9"><enum>(I)</enum><text>in opportunities that—</text><item id="idE6635518D9BF478BB66E879F33BEA2DD"><enum>(aa)</enum><text>are appropriate subsidized employment opportunities with employers based on factors including age, skill, experience, career aspirations, work-based readiness, and barriers to employment; and</text></item><item id="id59EB877242BA48F4A23395B0BF1B2524"><enum>(bb)</enum><text>may include additional services for participants, including core work readiness skill development and mentorship services;</text></item></subclause><subclause id="id5E5AC32ED9964884B10218FD3099CCC2"><enum>(II)</enum><text>in summer employment that—</text><item id="idB26C6007F3EE4FBCB341C18173DC15EA"><enum>(aa)</enum><text>is not less than 6 weeks;</text></item><item id="idE99E6881FA8D4DB28195E056606C4959"><enum>(bb)</enum><text>follows a schedule of not more than 20 hours per week; and</text></item><item commented="no" display-inline="no-display-inline" id="idF98C956967C2455D93770D0DA9921E4E"><enum>(cc)</enum><text>pays not less than the applicable Federal, State, or local minimum wage; and</text></item></subclause></clause><clause id="id7E4BD223693E4D6EA79FE5578F073124"><enum>(v)</enum><text>a description of how the eligible entity plans to develop a mentorship program or connect youth with positive, supportive mentorships, consistent with paragraph (3).</text></clause></subparagraph><subparagraph id="id86CED5DE8BB14E3CB05114371DC08D91"><enum>(C)</enum><text>With respect to an application for an implementation grant—</text><clause id="id166BD31A40614892A00EE199117B0E1D"><enum>(i)</enum><text>a description of how the eligible entity plans to identify, recruit, and engage program participants, in particular the hardest-to-employ, most-at-risk eligible youth;</text></clause><clause commented="no" display-inline="no-display-inline" id="idBFEFD5C016F6430FA572A4889EBB0966"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of the manner in which the eligible entity plans to place eligible youth participants in subsidized employment opportunities, and in summer employment, described in subparagraph (B)(iv);</text></clause><clause commented="no" display-inline="no-display-inline" id="idE2D299636010477D8FCBB964309A4DD7"><enum>(iii)</enum><text>(for a program serving the hardest-to-employ, most-at-risk eligible youth), a description of workplaces for the subsidized employment involved, which may include workplaces in the public, private, and nonprofit sectors;</text></clause><clause commented="no" display-inline="no-display-inline" id="idAD98C33EE46C4FE19D0D237ACDF04F45"><enum>(iv)</enum><text>a description of how the eligible entity plans to provide or connect eligible youth participants with positive, supportive mentorships, consistent with paragraph (3);</text></clause><clause id="idbc18cf567cc74cb78b0b3996f813bba7"><enum>(v)</enum><text>a description of services that will be available to employers participating in the youth employment program, to provide supervisors involved in the program with coaching and mentoring on—</text><subclause id="idEE014C27C8E645D09E875BAC4A2C1A30"><enum>(I)</enum><text>how to support youth development;</text></subclause><subclause id="idD4423CF90F534096B883A16E484D1912"><enum>(II)</enum><text>how to structure learning and reflection; and</text></subclause><subclause id="id9AD3F8E7FE4A4582B111D2D9F7A11D53"><enum>(III)</enum><text>how to deal with youth challenges in the workplace;</text></subclause></clause><clause id="idce5189fde6eb4403ac964fbaced45135"><enum>(vi)</enum><text>a description of how the eligible entity plans to offer structured pathways back into employment and a youth employment program under this section for eligible youth who have been terminated from employment or removed from the program;</text></clause><clause id="id1508303544814A82891FDFCB76E641C5"><enum>(vii)</enum><text>a description of how the eligible entity plans to engage eligible youth beyond the duration of the summer employment opportunity, which may include—</text><subclause id="id1AF9FF09354E493591D1831329D0ECD1"><enum>(I)</enum><text>developing or partnering with a year-round youth employment program;</text></subclause><subclause id="idFCF6DF22B6F2458BB7B74D60DE845E4E"><enum>(II)</enum><text>referring eligible youth to other year-round programs, which may include—</text><item id="idBBB9442142864CFFB560935D66EB0EB3"><enum>(aa)</enum><text>programs funded under section 176C or the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301</external-xref> et seq.);</text></item><item id="id2523CD6E5BA1415A852F153FF759346B"><enum>(bb)</enum><text>after school programs;</text></item><item id="idED841F4725834FBBB224F9B3CADB2D4C"><enum>(cc)</enum><text>secondary or postsecondary education programs;</text></item><item id="id9C8545FFFEFD4A1E9C227EA2C77C17FE"><enum>(dd)</enum><text>training programs;</text></item><item id="id9227D92E0F994736A0DACAF123D682C7"><enum>(ee)</enum><text>cognitive behavior therapy programs;</text></item><item id="id6327966C4B334118BBFA94DF05B365BC"><enum>(ff)</enum><text>apprenticeship programs; and</text></item><item id="id13DA6F80378E48E0A8A4B9ED71DFA602"><enum>(gg)</enum><text>national service programs;</text></item></subclause><subclause id="id8E7702F5C8B6454FA6458C53383133AD"><enum>(III)</enum><text>employing a full-time, permanent staff person who is responsible for youth outreach, followup, and recruitment; or</text></subclause><subclause id="idB50471EA874D4050AEB9D56C8F4D4FDF"><enum>(IV)</enum><text>connecting eligible youth with job development services, including career counseling, resume and job application assistance, interview preparation, and connections to job leads;</text></subclause></clause><clause id="id7AEE0DC9623147418CB2F5BAA5C7D0EB"><enum>(viii)</enum><text>evidence of the eligible entity's capacity to provide the services described in this subsection; and</text></clause><clause id="id23A1FED538894AE2AD52B313A19B40B7"><enum>(ix)</enum><text>a description of the quality of the summer youth employment program, including a program that leads to a recognized postsecondary credential.</text></clause></subparagraph></paragraph><paragraph id="id157D034D512E4527BF2213118C3E0794"><enum>(2)</enum><header>Indian tribe; tribal organizations</header><text>An eligible entity that is an Indian tribe or tribal organization and desires to receive a grant under this section for a summer youth employment program may, in lieu of submitting the application described in paragraph (1), submit an application to the Secretary that meets such requirements as the Secretary develops after consultation with the tribe or organization.</text></paragraph><paragraph id="id0B304A31B2984202A44E817AC4E37EEF"><enum>(3)</enum><header>Mentor</header><text>For purposes of subparagraphs (B)(iv), (B)(v), and (C)(iv) of paragraph (1), a mentor—</text><subparagraph id="id7D663088F4964CC78BAD1C41041A82C3"><enum>(A)</enum><text>shall be an individual who has been matched with an eligible youth based on the youth's needs;</text></subparagraph><subparagraph id="idBCEEFE670ABD4BE19507DA5DDCE671C8"><enum>(B)</enum><text>shall make contact with the eligible youth at least once each week;</text></subparagraph><subparagraph id="id6B3CC1E7C7214DCB93DDBF15CABE9A3B"><enum>(C)</enum><text>shall be a trusted member of the local community; and</text></subparagraph><subparagraph id="id9E6FD1D0D2444288B5A7658610FCB2CB"><enum>(D)</enum><text>may include—</text><clause id="id063AB347CE734CE0BDFF9ABE962E674A"><enum>(i)</enum><text>a mentor trained in trauma-informed care (including provision of trauma-informed trauma prevention, identification, referral, or support services to youth that have experienced or are at risk of experiencing trauma), conflict resolution, and positive youth development;</text></clause><clause id="id0B640E5B08D845B8BBF4AC2B4EA021C8"><enum>(ii)</enum><text>a job coach trained to provide youth with guidance on how to navigate the workplace and troubleshoot problems;</text></clause><clause id="id1959230AE82A4B6489F7F740DEBC3C17"><enum>(iii)</enum><text>a supervisor trained to provide at least two performance assessments and serve as a reference; or</text></clause><clause id="idB69D388463534A6CB94A539EC5672DF8"><enum>(iv)</enum><text>a peer mentor who is a former or current participant in the youth employment program involved.</text></clause></subparagraph></paragraph></subsection><subsection id="idb187f8099f7f47b89a25a94c004b4284"><enum>(e)</enum><header>Awards for populations and areas</header><paragraph commented="no" id="idB86138EA1DAF473F829B74F6A09BFAB2"><enum>(1)</enum><header>Populations</header><text>The Secretary shall reserve, from the amounts made available under section 176A(a)(1)—</text><subparagraph commented="no" id="idEEFB549F86904BE09471DF03E285D6C8"><enum>(A)</enum><text>50 percent to award grants under this section for planning or provision of subsidized summer employment opportunities for in-school youth; and</text></subparagraph><subparagraph commented="no" id="idB43F34685FD647CF92BC69C2181C9538"><enum>(B)</enum><text>50 percent to award such grants to plan for planning or provision of such opportunities for out-of-school youth.</text></subparagraph></paragraph><paragraph id="id3eea066a01604e828f1e81c4b918f7bb"><enum>(2)</enum><header>Areas</header><subparagraph id="id9e914e169c934a68ab959a01d62ced55"><enum>(A)</enum><header>In general</header><text>In awarding the grants, the Secretary shall consider the regional diversity of the areas to be served, to ensure that urban, suburban, rural, and tribal areas are receiving grant funds.</text></subparagraph><subparagraph id="id5f55a2e05d8a47d7b7071f95d09ccb1d"><enum>(B)</enum><header>Rural and tribal area inclusion</header><clause id="id296ad62da86840be9262765f5c5ce9b8"><enum>(i)</enum><header>Rural areas</header><text>Not less than 20 percent of the amounts made available under section 176A(a)(1) for each fiscal year shall be made available for activities to be carried out in rural areas.</text></clause><clause id="id6cc4e1c1e70e45888f1d58caa0747fb6"><enum>(ii)</enum><header>Tribal areas</header><text>Not less than 5 percent of the amounts made available under section 176A(a)(1) for each fiscal year shall be made available for activities to be carried out in tribal areas.</text></clause></subparagraph></paragraph></subsection><subsection id="idb309c545b29d4b5a9c38fcc3ec1c1579"><enum>(f)</enum><header>Program priorities</header><text>In allocating funds under this section, the Secretary shall give priority to eligible entities—</text><paragraph id="id562136ffe13e4d81a48dd56d045c6913"><enum>(1)</enum><text>who propose to coordinate their activities—</text><subparagraph id="ida8b9b77dc09844bf99c83d903aee9c15"><enum>(A)</enum><text>with local or tribal employers; and</text></subparagraph><subparagraph id="id6e2ac9cc13454b4da26407cd09435488"><enum>(B)</enum><text>with agencies described in subsection (c)(2)(A)(i) to ensure the summer youth employment programs provide clear linkages to remedial, academic, and occupational programs carried out by the agencies;</text></subparagraph></paragraph><paragraph id="idd3a39d1206d34565a90f6e425f822305"><enum>(2)</enum><text>who propose a plan to increase private sector engagement in, and job placement through, summer youth employment; and</text></paragraph><paragraph id="id853108f08ecd4ade89c6293744ea87d8"><enum>(3)</enum><text>who have, in their counties, States, or tribal areas (as compared to other counties in their State, other States, or other tribal areas, respectively), a high level or rate described in subsection (d)(1)(A)(iii).</text></paragraph></subsection><subsection id="idbe224480bd5441d8a99687fd2f1da99b"><enum>(g)</enum><header>Use of funds</header><paragraph id="id0a24778008c34f9c9e62c5c424303ea1"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under this section may use the grant funds for services described in subsection (d).</text></paragraph><paragraph id="ide6102b0566c640e4a77d1062edf9978a"><enum>(2)</enum><header>Discretionary uses</header><text>The eligible entity may also use the funds—</text><subparagraph id="id4958ef3ba5814e72b99478cc9264ec21"><enum>(A)</enum><text>to provide wages to eligible youth in subsidized summer employment programs;</text></subparagraph><subparagraph id="idcf620c0de552473381fc2ecd0bf6e705"><enum>(B)</enum><text>to provide eligible youth with support services, including case management, child care assistance, child support services, and transportation assistance; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3955D91444D34A7B876F43391B24CC4E"><enum>(C)</enum><text>to develop data management systems to assist with programming, evaluation, and records management.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9DD536606E384455B261F3B21C922A35"><enum>(3)</enum><header>Administration</header><text>An eligible entity may reserve not more than 10 percent of the grant funds for the administration of activities under this section.</text></paragraph><paragraph id="idbd1f450adb7c41a591799c5fa4b9126f"><enum>(4)</enum><header>Carry-over authority</header><text>Any amounts provided to an eligible entity under this section for a fiscal year may, at the discretion of the Secretary, remain available to that entity for expenditure during the succeeding fiscal year to carry out programs under this section.</text></paragraph></subsection><subsection id="id33d95869a74d4e7a8aa34aeaf4eb815c"><enum>(h)</enum><header>Program share</header><paragraph id="id3f23c888cd274f7f9f6d77cad623ac49"><enum>(1)</enum><header>Planning grants</header><text>The program share for a planning grant awarded under this section shall be 100 percent of the cost described in subsection (a)(2)(A).</text></paragraph><paragraph id="id5826177a977643d5bf972f3197b74fbb"><enum>(2)</enum><header>Implementation grants</header><subparagraph id="id0d32039aa2c34970bbf6d3230747dea3"><enum>(A)</enum><header>In general</header><text>The program share for an implementation grant awarded under this section shall be 50 percent of the cost described in subsection (a)(2)(B).</text></subparagraph><subparagraph id="id57d4fbfcf59c4189a1600d572e909f2e"><enum>(B)</enum><header>Exception</header><text>Notwithstanding subparagraph (A), the Secretary—</text><clause id="id779f6c215e504564915d93d8a74b0e89"><enum>(i)</enum><text>may increase the program share for an eligible entity; and</text></clause><clause id="idecf3e12838a04c3c888c1d1242de9b34"><enum>(ii)</enum><text>shall increase the program share for an Indian tribe or tribal organization to not less than 95 percent of the cost described in subsection (a)(2)(B).</text></clause></subparagraph><subparagraph id="idfdbbcb122bb345aca041f363aa868778"><enum>(C)</enum><header>Non-program share</header><text>The eligible entity may provide the non-program share of the cost—</text><clause id="id4f62a3f50c414411a27b35c89317b44b"><enum>(i)</enum><text>in cash or in-kind, fairly evaluated, including plant, equipment, or services; and</text></clause><clause id="idb3a5a2df298342d5b8334f736075fda3"><enum>(ii)</enum><text>from State, local, tribal or private (including philanthropic) sources and, in the case of an Indian tribe or tribal organization, from Federal sources.</text></clause></subparagraph></paragraph></subsection></section><section id="id8ae1da5fdf64481789048d75ac771aee"><enum>176C.</enum><header>Year-round employment competitive grant program</header><subsection id="id20CF1E0DB5374582A4827FE0057102A6"><enum>(a)</enum><header>In general</header><paragraph id="idFB50B65CD262449284EFFAC0223394FC"><enum>(1)</enum><header>Grants</header><text>Using the amounts made available under 176A(a)(2), the Secretary shall award, on a competitive basis, planning and implementation grants.</text></paragraph><paragraph id="idBFF7486667A94BC7AA48AE2EDA2E2D42"><enum>(2)</enum><header>General use of funds</header><text>The Secretary shall award the grants to assist eligible entities by paying for the program share of the cost of—</text><subparagraph id="id81FBFCE10FF04C259371E3D1BEA6B03F"><enum>(A)</enum><text>in the case of a planning grant, planning a year-round youth employment program to provide subsidized year-round employment opportunities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6856C2F9154D44EFA69C3ABA43B9D355"><enum>(B)</enum><text>in the case of an implementation grant, implementation of such a program to provide such opportunities.</text></subparagraph></paragraph></subsection><subsection id="id776C3F411BC847C38AEA238252F0DF22"><enum>(b)</enum><header>Periods and amounts of grants</header><text>The planning grants shall have the periods and amounts described in section 176B(b)(1). The implementation grants shall have the periods and grants described in section 176B(b)(2).</text></subsection><subsection id="idc1252181d85e4de89d9db02d532e2b37"><enum>(c)</enum><header>Eligible entities</header><paragraph id="id98694875CF4D4A529C90C633074B2C01"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a planning or implementation grant under this section, an entity shall, except as provided in paragraph (2)—</text><subparagraph id="id8F95996BED694AD1BBA85827EC63645C"><enum>(A)</enum><text>be a—</text><clause id="id81DB22535B324D89A2EA082A36F589CE"><enum>(i)</enum><text>State, local government, or Indian tribe or tribal organization, that meets the requirements of section 176B(c)(2); or</text></clause><clause id="id4FE4129A3BB147D983A8CF0AFBBB5FAD"><enum>(ii)</enum><text>community-based organization that meets the requirements of section 176B(c)(3); and</text></clause></subparagraph><subparagraph id="id30D05598214746228817C1584E22F278"><enum>(B)</enum><text>meet the requirements for a planning or implementation grant, respectively, specified in section 176B(c)(4).</text></subparagraph></paragraph><paragraph id="idD5D0EC9486FF4B0EB4C097F1C98E05DA"><enum>(2)</enum><header>Year-round youth employment programs</header><text>For purposes of paragraph (1), any reference in section 176B(c)—</text><subparagraph id="idC0D34FCC414C4BA8B36E93ED78764B2F"><enum>(A)</enum><text>to a summer youth employment program shall be considered to refer to a year-round youth employment program; and</text></subparagraph><subparagraph id="id7E21733F1465483484F12CD51CF5EDEA"><enum>(B)</enum><text>to a provision of section 176B shall be considered to refer to the corresponding provision of this section.</text></subparagraph></paragraph></subsection><subsection id="id6263930B08AC48AF9A037E6C11BC6F51"><enum>(d)</enum><header>Application</header><paragraph commented="no" display-inline="no-display-inline" id="id3B13B0134982472C9DCB530A12BEA560"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), an eligible entity desiring to receive a grant under this section for a year-round youth employment program shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including, at a minimum, each of the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id91319E3B288F45F0B6E5EB8015FC4391"><enum>(A)</enum><text display-inline="yes-display-inline">With respect to an application for a planning or implementation grant, the information and descriptions specified in section 176B(d)(1)(A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id166BCE7805A44C30A4B384C7D0CD8634"><enum>(B)</enum><text>With respect to an application for a planning grant, the descriptions specified in section 176B(d)(1)(B), except that the description of an analysis for placing youth in employment described in clause (iv)(II)(bb) of that section shall cover employment that follows a schedule—</text><clause commented="no" display-inline="no-display-inline" id="idB8B69091816744FEBA2DE10769BF4AA4"><enum>(i)</enum><text>that consists of—</text><subclause commented="no" display-inline="no-display-inline" id="id6A2E45139EA6466BBB076C7BCF900F2C"><enum>(I)</enum><text>not more than 15 hours per week for in-school youth; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8B49C204C7E646C7B9BA8296F9357C26"><enum>(II)</enum><text>not less than 20 and not more than 40 hours per week for out-of-school youth; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id17271D368ED84AD9862FBF74EBA4C95B"><enum>(ii)</enum><text>that depends on the needs and work-readiness level of the population being served.</text></clause></subparagraph><subparagraph id="id77AF5AF6340B44E084B076B38D140901"><enum>(C)</enum><text>With respect to an application for an implementation grant, the descriptions and evidence specified in section 176B(d)(1)(C)—</text><clause id="id3FC947EA2D204C7281B06FE9FC83811D"><enum>(i)</enum><text>except that the reference in section 176(d)(1)(C)(ii) to employment described in section 176B(d)(1)(B) shall cover employment that follows the schedule described in subparagraph (B); and</text></clause><clause id="id8D0889550FC04E0AB4A1CD85945B1E25"><enum>(ii)</enum><text>except that the reference to programs in clause (vii)(II)(aa) of that section shall be considered to refer only to programs funded under the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301</external-xref> et seq.).</text></clause></subparagraph></paragraph><paragraph id="id5184A31D61D94B63A8F213443368DEF4"><enum>(2)</enum><header>Indian tribe; tribal organizations</header><text>An eligible entity that is an Indian tribe or tribal organization and desires to receive a grant under this section for a year-round youth employment program may, in lieu of submitting the application described in paragraph (1), submit an application to the Secretary that meets such requirements as the Secretary develops after consultation with the tribe or organization.</text></paragraph><paragraph id="id450C4CDAD2A142789ADABF208321DA8E"><enum>(3)</enum><header>Mentor</header><text>For purposes of paragraph (1), any reference in subparagraphs (B)(iv), (B)(v), and (C)(iv) of section 176B(d)(1) to a mentor shall be considered to refer to a mentor who—</text><subparagraph id="id91C5545FADFC455CBA75409784E3303A"><enum>(A)</enum><text>shall be an individual described in subparagraphs (A) and (C) of section 176B(d)(3);</text></subparagraph><subparagraph id="id292F7A66DD954F7FB6911804B6DD2B47"><enum>(B)</enum><text>shall make contact with the eligible youth at least twice each week; and</text></subparagraph><subparagraph id="id15EFACE121B24403972A184D5694E9A9"><enum>(C)</enum><text>may be an individual described in section 176B(d)(3)(D).</text></subparagraph></paragraph><paragraph id="idFE8460AC726E480C82FA561E3FF93619"><enum>(4)</enum><header>Year-round employment</header><text>For purposes of this subsection, any reference in section 176B(d)—</text><subparagraph id="id7B78AE70EBC54B39A6665C9FB16F429A"><enum>(A)</enum><text>to summer employment shall be considered to refer to year-round employment; and</text></subparagraph><subparagraph id="id64E7C564CEE741429DE5045733372784"><enum>(B)</enum><text>to a provision of section 176B shall be considered to refer to the corresponding provision of this section.</text></subparagraph></paragraph></subsection><subsection id="idCC3E616734A1438CBA9CA133145FE224"><enum>(e)</enum><header>Awards for populations and areas; Priorities</header><paragraph id="id7A940BF79D1D4D9B8756369FB9AC0777"><enum>(1)</enum><header>Populations</header><text>The Secretary shall reserve, from the amounts made available under section 176A(a)(2)—</text><subparagraph commented="no" id="id8397CE312E6F445FA472749168A3A5FE"><enum>(A)</enum><text>50 percent to award grants under this section for planning or provision of subsidized year-round employment opportunities for in-school youth; and</text></subparagraph><subparagraph commented="no" id="idE41A0B1376A24837AA3CD91C72421141"><enum>(B)</enum><text>50 percent to award such grants to plan for planning or provision of such opportunities for out-of-school youth.</text></subparagraph></paragraph><paragraph id="idBB765DCC498D4536A6F5716884C438CB"><enum>(2)</enum><header>Areas; priorities</header><text>In awarding the grants, the Secretary shall—</text><subparagraph id="id1BE843BA8233453C8A7E1B8703C0EFD4"><enum>(A)</enum><text>carry out section 176B(e)(2); and</text></subparagraph><subparagraph id="idBD70A9CB8A5C41638B926AD47A6285A4"><enum>(B)</enum><text>give priority to eligible entities—</text><clause id="id545690155E544E3AB52D32307696C417"><enum>(i)</enum><text>who—</text><subclause id="id2729A217F83542308D64A5C8E7BDCCD6"><enum>(I)</enum><text>propose the coordination and plan described paragraphs (1) and (2) of section 176B(f), with respect to year-round youth employment; and</text></subclause><subclause id="idEABD6A098BEC40939E27C8BC3C279C57"><enum>(II)</enum><text>meet the requirements of section 176B(f)(3); or</text></subclause></clause><clause id="id4294cdae81b54fecbd08e2d9b95690e1"><enum>(ii)</enum><text>who—</text><subclause id="ida0bbf6c355b04db8b877a476f4020aee"><enum>(I)</enum><text>propose a plan to coordinate activities with entities carrying out State, local, or tribal summer youth employment programs, to provide pathways to year-round employment for eligible youth who are ending summer employment; and</text></subclause><subclause id="idE6BAE6682D504A6AA67E70DD40FC2EF6"><enum>(II)</enum><text>meet the requirements of section 176B(f)(3).</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id74551AD3216A48BB9CB772AE57C6BF3A"><enum>(f)</enum><header>Use of funds</header><text>An eligible entity that receives a grant under this section may use the grant funds—</text><paragraph id="id23CA82A7D91D49DC8C82E8B601A8CFC4"><enum>(1)</enum><text>for services described in subsection (d);</text></paragraph><paragraph id="id6E5FFBC2B05C4A51B5D60184046F8406"><enum>(2)</enum><text>as described in section 176B(g)(2), with respect to year-round employment programs;</text></paragraph><paragraph id="id13CBE4D5370F40DE812371316FB8A2DA"><enum>(3)</enum><text>as described in section 176B(g)(3), with respect to activities under this section; and</text></paragraph><paragraph id="idb2e484ea0ea74480ab1c181d97b07ecb"><enum>(4)</enum><text>at the discretion of the Secretary, as described in section 176B(g)(4), with respect to activities under this section.</text></paragraph></subsection><subsection id="id0F7606A1A3C44A648F61AF8B0EA66AB4"><enum>(g)</enum><header>Program share</header><paragraph id="id7B4388CA0A454ED6ABFAAAE399DFFA6D"><enum>(1)</enum><header>Planning grants</header><text>The provisions of section 176B(h)(1) shall apply to planning grants awarded under this section, with respect to the cost described in subsection (a)(2)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF4DE2FCCBDE843EA9C1DEC5074BA80B3"><enum>(2)</enum><header>Implementation grants</header><text>The provisions of section 176B(h)(2) shall apply to implementation grants awarded under this section, with respect to the cost described in subsection (a)(2)(B).</text></paragraph></subsection></section><section id="idbe84f2c2204347f484e052a3fbd5d5b8"><enum>176D.</enum><header>Evaluation and administration</header><subsection commented="no" id="idfa9721cf829c481088d4815db249ac06"><enum>(a)</enum><header>Performance measures</header><paragraph commented="no" id="idA6009E5801C948BC8F25C7B0B1B6570D"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish performance measures for purposes of annual reviews under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="PF19AE4A44A6E6F20BF620FAFA7E35FA"><enum>(2)</enum><header display-inline="yes-display-inline">Components</header><text display-inline="yes-display-inline">The performance measures for the eligible entities shall consist of—</text><subparagraph commented="no" display-inline="no-display-inline" id="P100866E14AA35DCD7C5CBEA3EEDF2E7"><enum>(A)</enum><text>the indicators of performance described in paragraph (3); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="PDA03DF01424223190A63A59FA18EC27"><enum>(B)</enum><text>an adjusted level of performance for each indicator described in subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77B5764B912643209EFDD6A8A3620598"><enum>(3)</enum><header>Indicators of performance</header><subparagraph commented="no" display-inline="no-display-inline" id="idAEE38925DBB548F082ACF96CAA8C6B14"><enum>(A)</enum><header>In general</header><text>The indicators of performance shall consist of—</text><clause id="P6C78097349B342A51E1B6F80DA9DD52"><enum>(i)</enum><text>the percentage of youth employment program participants who are in education or training activities, or in employment, during the second quarter after exit from the program;</text></clause><clause id="P9525545046CB625CB803D2889EE0462"><enum>(ii)</enum><text>the percentage of youth employment program participants who are in education or training activities, or in employment, during the fourth quarter after exit from the program;</text></clause><clause commented="no" display-inline="no-display-inline" id="P29B9C75B4D7CD52D755539ADE86BF87"><enum>(iii)</enum><text display-inline="yes-display-inline">the percentage of youth employment program participants who obtain a recognized postsecondary credential, or a secondary school diploma or its recognized equivalent (subject to subparagraph (B)), during participation in or within 1 year after exit from the program; and</text></clause><clause commented="no" display-inline="no-display-inline" id="PC2284EE84491F303FAA19D84C748952"><enum>(iv)</enum><text display-inline="yes-display-inline">the percentage of youth employment program participants who, during a program year, are in a youth employment program that includes an education or training program that leads to an outcome specified by the Secretary, which may include—</text><subclause commented="no" display-inline="no-display-inline" id="idBF22053D343D4E578F6053604FA2D528"><enum>(I)</enum><text display-inline="yes-display-inline">obtaining a recognized postsecondary credential or employment; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id635896C411C449BEA5F0D5269BFF254C"><enum>(II)</enum><text display-inline="yes-display-inline">achieving measurable skill gains toward such a credential or employment.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="P16C526EF4753AFF9DD7D2BB8018FF34"><enum>(B)</enum><header display-inline="yes-display-inline">Indicator relating to credential</header><text display-inline="yes-display-inline">For purposes of subparagraph (A)(iii), youth employment program participants who obtain a secondary school diploma or its recognized equivalent shall be included in the percentage counted as meeting the criterion under such subparagraph only if such participants, in addition to obtaining such diploma or its recognized equivalent, have obtained or retained employment or are in a youth employment program that includes an education or training program leading to a recognized postsecondary credential within 1 year after exit from the program.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="P8624D75C4D1BB214B34F5486E6A4E4F"><enum>(4)</enum><header display-inline="yes-display-inline">Levels of performance</header><subparagraph commented="no" display-inline="no-display-inline" id="P2EF155034EED3B5A02BB01AC56C0602"><enum>(A)</enum><header>In general</header><text>For each eligible entity, there shall be established, in accordance with this paragraph, levels of performance for each of the corresponding indicators of performance described in paragraph (3).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="P8456ABE54F585454EE77C9993523D51"><enum>(B)</enum><header>Identification in application</header><text>Each eligible entity shall identify, in the application submitted under subsection (d) of section 176B or 176C, expected levels of performance for each of those indicators of performance for each program year covered by the application.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="P72854D5B4171CDC4B5A274A3E00E0C8"><enum>(C)</enum><header display-inline="yes-display-inline">Agreement on adjusted levels of performance</header><text>The eligible entity shall reach agreement with the Secretary on levels of performance for each of those indicators of performance for each such program year. The levels agreed to shall be considered to be the adjusted levels of performance for the eligible entity for such program years and shall be incorporated into the application prior to the approval of such application.</text></subparagraph></paragraph></subsection><subsection id="idd1c689ce150448b88ee493f1e9934dd0"><enum>(b)</enum><header>Annual review</header><text>The Secretary shall carry out an annual review of each eligible entity receiving a grant under this subtitle. In conducting the review, the Secretary shall review the performance of the entity on the performance measures under this section and determine if the entity has used any practices that shall be considered best practices for purposes of this subtitle.</text></subsection><subsection id="ida1fd5354547d40e099cda26d92a3178a"><enum>(c)</enum><header>Report to Congress</header><paragraph id="idCDB5157D92C64C04ACAC06DD4C18FD46"><enum>(1)</enum><header>Preparation</header><text>The Secretary shall prepare a report on the grant programs established by this subtitle, which report shall include a description of—</text><subparagraph id="idcb9bcd3edb7a41ed970c1477862b4a96"><enum>(A)</enum><text>the eligible entities receiving funding under this subtitle;</text></subparagraph><subparagraph id="id704ddfd873874eb88976949ef54758f8"><enum>(B)</enum><text>the activities carried out by the eligible entities;</text></subparagraph><subparagraph id="id6e278e9f1651404ab4ac13e8ad06ee57"><enum>(C)</enum><text>how the eligible entities were selected to receive funding under this subtitle; and</text></subparagraph><subparagraph id="id7b1a4bbe66944e89aa621d08c6494ac5"><enum>(D)</enum><text>an assessment of the results achieved by the grant programs including findings from the annual reviews conducted under subsection (b).</text></subparagraph></paragraph><paragraph id="id0769F6A132F0465EA8EFAE92E89F4EF4"><enum>(2)</enum><header>Submission</header><text>Not later than 3 years after the date of enactment of the <short-title>Creating Pathways for Youth Employment Act</short-title>, and annually thereafter, the Secretary shall submit a report described in paragraph (1) to the appropriate committees of Congress.</text></paragraph></subsection><subsection id="id1A593B05ED5B4EF98F22E9305D689487"><enum>(d)</enum><header>Application to Indian tribes and tribal organizations</header><text>The Secretary may issue regulations that clarify the application of all the provisions of this subtitle to Indian tribes and tribal organizations.</text></subsection></section><section id="id76a533e3e4144466a328f10c7ad3c3ba"><enum>176E.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text><paragraph id="id63A7819671354D8DB23794F886DB69F4"><enum>(1)</enum><text display-inline="yes-display-inline">to carry out section 176B, $300,000,000 for each of fiscal years 2022 through 2026; and</text></paragraph><paragraph id="idD454077C5F4D4F0BB642A212B2720E06"><enum>(2)</enum><text display-inline="yes-display-inline">to carry out section 176C, $400,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idF4ACFF0777AA4B40AC4015F67C2C631E"><enum>3.</enum><header>Conforming amendments</header><subsection id="id5D0E6414C91042B79D538AFFB80812C3"><enum>(a)</enum><header>References</header><paragraph id="id212E5288D6A64DDCAFCDD1F5D611D0B7"><enum>(1)</enum><text>Section 121(b)(1)(C)(ii)(II) of the Workforce Investment and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3152">29 U.S.C. 3152(b)(1)(C)(ii)(II)</external-xref>) is amended by striking <quote>subtitles C through E</quote> and inserting <quote>subtitles C through F</quote>.</text></paragraph><paragraph id="id24DFE986988C4930B5E3E6AE50399132"><enum>(2)</enum><text>Section 503(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3343">29 U.S.C. 3343(b)</external-xref>) is amended by inserting before the period the following: <quote>(as such subtitles were in effect on the day before the date of enactment of this Act)</quote>.</text></paragraph></subsection><subsection id="idA5A99C3739054E15969DE49DCEFD929E"><enum>(b)</enum><header>Table of contents</header><text>The table of contents in section 1(b) of such Act is amended by striking the item relating to the subtitle heading for subtitle E of title I and inserting the following:</text><quoted-block style="OLC" id="id66c367c8-aa61-4f0a-aacc-b8f29fb56d76"><toc><toc-entry idref="id298021FD162A44E096BD2658FA7A7786" level="subtitle">Subtitle E—Youth Employment Opportunities</toc-entry><toc-entry idref="iddfd6516ca002460489c4798edabbab0f" level="section">Sec. 176.
