which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, to ensure that all firearms are traceable, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Untraceable Firearms Act of 2021</short-title></quote>.</text></section><section id="id7D9F8E9A97E348899ED5BADE7D2A0A3D"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id7174FE9A98B443D4A9C0AA4DD6231156"><enum>(1)</enum><text display-inline="yes-display-inline">without the enactment of this Act, the Bureau of Alcohol, Tobacco, Firearms and Explosives has the authority to regulate ghost guns (as defined in section 921(a) of title 18, United States Code, as amended by section 3 of this Act) and unfinished frames and receivers; and</text></paragraph><paragraph id="idA62D28B246DE4E938447BB69F8396737"><enum>(2)</enum><text>the purpose of this Act is to clarify and strengthen such authority. </text></paragraph></section><section id="id60e79846c0004510aface1f88fa067a1"><enum>3.</enum><header>Requirement that all firearms be traceable</header><subsection id="id95020B2F06064731AF1B7D505A8484DC"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 921(a) of title 18, United States Code, is amended—</text><paragraph commented="no" id="id4ff672ac818d4a87baa1bd4426bb31ef"><enum>(1)</enum><text>in paragraph (10), by adding at the end the following: <quote>The term <term>manufacturing firearms</term> shall include assembling a functional firearm or molding, machining, or 3D printing a frame or receiver, and shall not include making or fitting special barrels, stocks, or trigger mechanisms to firearms.</quote>;</text></paragraph><paragraph commented="no" id="idF4A29248E2AA40D7932F4C11B4531F13"><enum>(2)</enum><text>by inserting after paragraph (29) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCE663750808142F19DA9F4617CA40B54"><paragraph id="id544BAA2E5E6746578B21C125897A8EE0" indent="up1"><enum>(30)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idBEE46B588F9B42EFB3D9E29418CC632E"><enum>(A)</enum><text>The term <term>frame or receiver</term>—</text><clause id="id88E07734312F4079919DE91E6675ACEB" indent="up1"><enum>(i)</enum><text>means a part of a weapon that provides or is intended to provide the housing or structure to hold or integrate 1 or more fire control components, even if pins or other attachments are required to connect those components to the housing or structure;</text></clause><clause id="id25B343780DF24AD1A6353BEF1FDB2492" indent="up1"><enum>(ii)</enum><text>includes a frame or receiver, blank, casting, or machined body, that requires modification, including machining, drilling, filing or molding, to be used as part of a functional firearm, and which is designed and intended to be used in the assembly of a functional firearm, unless the piece of material has had—</text><subclause id="id6225BC63957447B795336808CD8523B8" commented="no"><enum>(I)</enum><text>its size or external shape altered solely to facilitate transportation or storage; or</text></subclause><subclause id="id8BFB9978654140ABB152609212E955BD" commented="no"><enum>(II)</enum><text>solely its chemical composition altered.</text></subclause></clause></subparagraph><subparagraph indent="up1" id="idE8F9F419804D48D5A81D0DD5114CA7F0"><enum>(B)</enum><text>For purposes of subparagraph (A)(i), if a weapon with more than 1 part that provides the housing or a structure designed to hold or integrate 1 or more fire control or essential components, each such part shall be considered a frame or receiver, unless the Attorney General has provided otherwise by regulation with respect to the specific make and model of weapon on or before January 1, 2022.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="id349B84519CA142C29E8936FB69456651"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6AB345A6A8CD464B8EF670EBDEFDF344"><paragraph id="id8CB18D1A81E24B04AF91D87BBAFD71FA" indent="up1"><enum>(36)</enum><text>The term <term>ghost gun</term>—</text><subparagraph id="id9116ED1CAA44494EA21AA5499E6629DB"><enum>(A)</enum><text>means a firearm, including a frame or receiver, that lacks a unique serial number engraved or cast on the frame or receiver by a licensed manufacturer or importer in accordance with this chapter; and</text></subparagraph><subparagraph id="id25423F248EE6426DAAAE9AD54386B191"><enum>(B)</enum><text>does not include—</text><clause id="idCA19DEBCD5734BA9B3AA0316AE34451B"><enum>(i)</enum><text>a firearm that has been rendered permanently inoperable; </text></clause><clause id="idd3fb2f8fdcb54b9cbcd90752b65651fc"><enum>(ii)</enum><text>a firearm identified by means of a unique serial number assigned by a State agency and engraved or cast on the receiver or frame of the weapon before the effective date of the <short-title>Untraceable Firearms Act of 2021</short-title> in accordance with a State law;</text></clause><clause id="id8eccfec5043a491c8d56918a3031236b"><enum>(iii)</enum><text>a firearm manufactured or imported before December 16, 1968; or</text></clause><clause id="id991c15b8c5c44d94b388636630606e0f"><enum>(iv)</enum><text>a firearm identified as provided for under <external-xref legal-doc="usc" parsable-cite="usc/26/5842">section 5842</external-xref> of the Internal Revenue Code of 1986.</text></clause></subparagraph></paragraph><paragraph indent="up1" id="id4AC55DB8FEA141DABDF9D187C505E4C2"><enum>(37)</enum><text>The term <term>fire control component</term>—</text><subparagraph id="id8F4CB54BCA04476381EAA6CB9128C7EA"><enum>(A)</enum><text>means a component necessary for the firearm to initiate or complete the firing sequence; and </text></subparagraph><subparagraph id="id9776E90D95B74F2F9EF3119623CE8C4D"><enum>(B)</enum><text>includes a hammer, bolt or breechblock, cylinder, trigger mechanism, firing pin, striker, and slide rails.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="idCE82068FF8C249698F923F34727D216B"><enum>(b)</enum><header>Prohibition; requirements</header><text>Section 922 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id475e08c50ec746c1905f607f1de52790"><subsection id="id4CDECB843446435CAECD7D32E669B736"><enum>(aa)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id25E4E54D910A4F8C97586234E581C658"><enum>(1)</enum><text>The Congress finds and declares the following:</text><subparagraph id="id93bff55eb580440eb99d30c86a952634" indent="up1"><enum>(A)</enum><text>Firearms tracing is the systematic tracking of the movement of a firearm recovered by law enforcement officials from the first sale of a firearm by the manufacturer or importer through the distribution chain (including the wholesaler and retailer) to the first retail purchaser.</text></subparagraph><subparagraph id="id01906021fa544c9aa0b24e83d3a6193e" indent="up1"><enum>(B)</enum><text>Law enforcement agencies across the country work with the Bureau of Alcohol, Tobacco, Firearms and Explosives to trace firearms and thereby obtain investigative leads in the fight against violent crime and terrorism.</text></subparagraph><subparagraph id="id9733b245f832443e8b4b6af3866d0c25" indent="up1"><enum>(C)</enum><text>The ability of law enforcement agencies to trace a firearm is dependent on the serial number or other marks on the firearm that identify the manufacturer or importer who manufactured or imported the firearm and that are unique to the firearm.</text></subparagraph><subparagraph id="idf1b4d6499e394c10afe589f63dcf5f84" indent="up1"><enum>(D)</enum><text>Interstate gun trafficking interferes with lawful commerce in firearms and significantly contributes to gun crime. Of the 254,700 firearms traced by the Bureau of Alcohol, Tobacco, Firearms and Explosives in 2018, 71,910 of those firearms were originally sold by a licensed firearms dealer in a State other than the State where the firearms were recovered. These guns made up 28.2 percent of all firearm recoveries in 2018.</text></subparagraph><subparagraph id="idfeffbce7203848f693b4ae6ab0beae4a" indent="up1"><enum>(E)</enum><text>Even before the sale of a firearm, the gun, its component parts, and the raw materials from which they are made have considerably moved in interstate commerce.</text></subparagraph><subparagraph id="idf1c5f92e5aa141a8a23e9bc53ef942f3" indent="up1"><enum>(F)</enum><text>If unserialized and untraceable firearms may be constructed and transported freely from State to State, ordinary citizens and foreign visitors may fear to travel to or through certain parts of the country due to concern about violent crime and gun violence, and law enforcement agencies may be unable to address it.</text></subparagraph></paragraph><paragraph id="idD43E1C2A16764D6789481F68E273D6C0" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id2BEE3671F911444CBC342CA9FBC6FF12"><enum>(A)</enum><text>Except as provided in subparagraph (B), it shall be unlawful for any person to manufacture, sell, offer to sell, transfer, purchase, or receive a ghost gun in or affecting interstate or foreign commerce.</text></subparagraph><subparagraph id="idA4B2CC5B801046CEAB82AD6E657FFDE0" indent="up1"><enum>(B)</enum><text>Subparagraph (A) shall not apply to—</text><clause id="idc8775104adf94b618777333a5fc29907"><enum>(i)</enum><text>the manufacture of a firearm by a licensed manufacturer if the licensed manufacturer complies with section 923(i) before selling or transferring the firearm to another person;</text></clause><clause id="id0e401447727e4821be3af512c4ce39f3"><enum>(ii)</enum><text>the offer to sell, sale, or transfer of a firearm to, or purchase or receipt of a firearm by, a licensed manufacturer or importer before the date that is 30 months after the date of enactment of the <short-title>Untraceable Firearms Act of 2021</short-title>; or</text></clause><clause id="id10063f484db14d5991b5b39691258018"><enum>(iii)</enum><text>transactions between licensed manufacturers and importers on any date.</text></clause></subparagraph></paragraph><paragraph id="idB5707075EC354EADAA5EDBCFFE78DD18" indent="up1"><enum>(3)</enum><text>It shall be unlawful for a person other than a licensed manufacturer or importer to engrave or cast a serial number on a firearm in or affecting interstate or foreign commerce unless specifically authorized by the Attorney General.</text></paragraph><paragraph id="id8E5D6E0802F84E7D9BEE89E2880AD131" indent="up1"><enum>(4)</enum><text>Beginning on the date that is 30 months after the date of enactment of the <short-title>Untraceable Firearms Act of 2021</short-title>, it shall be unlawful for any person other than a licensed manufacturer or importer to knowingly possess a ghost gun in or affecting interstate or foreign commerce. </text></paragraph><paragraph id="id8953515E867E49A0A725BD74223F9829" indent="up1"><enum>(5)</enum><text>Beginning on the date that is 30 months after the date of enactment of the <short-title>Untraceable Firearms Act of 2021</short-title>, it shall be unlawful for any person other than a licensed manufacturer or importer to possess a ghost gun in or affecting interstate or foreign commerce with the intent to sell or transfer the ghost gun with or without further manufacturing or to manufacture a firearm with the ghost gun.</text></paragraph><paragraph id="id47E179D21B33487F930B66A7B5CB64FB" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idFBFD7D18183B402EABB0DFE0C2C98CEE"><enum>(A)</enum><text>It shall be unlawful for any person to sell, offer to sell, or transfer, in or affecting interstate or foreign commerce, to any person other than a licensed manufacturer a machine that has the sole or primary function of manufacturing firearms.</text></subparagraph><subparagraph id="id7CF6D747A18D4F3AA4235BCA44646FC8" indent="up1"><enum>(B)</enum><text>Except as provided in subparagraph (A), beginning on the date that is 180 days after the date of enactment of the <short-title>Untraceable Firearms Act of 2021</short-title>, it shall be unlawful for any person other than a licensed manufacturer to possess, purchase, or receive, in or affecting interstate or foreign commerce, a machine that has the sole or primary function of manufacturing firearms.</text></subparagraph><subparagraph indent="up1" id="id814C76B3725C42D9B39057D843D3487F"><enum>(C)</enum><text>Subparagraph (B) shall not apply to a person who is engaged in the business of selling manufacturing equipment to a licensed manufacturer who possesses a machine with the intent to sell or transfer the machine to a licensed manufacturer.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="idF1B3C8EE404C484DB834876765E828A8"><enum>(c)</enum><header>Requirements</header><paragraph commented="no" id="idEADF760451154467945A6BB7649E0897"><enum>(1)</enum><header>Removal of serial numbers</header><text>Section 922(k) of title 18, United States Code, is amended—</text><subparagraph commented="no" id="id01366C34460A46C495BB8E12F2CEC514"><enum>(A)</enum><text>by striking <quote>importer's or manufacturer's</quote> each place it appears; and</text></subparagraph><subparagraph commented="no" id="idEA118926C37E4653BB77DA5115DF8726"><enum>(B)</enum><text>by inserting <quote>authorized by this chapter or under State law</quote> before <quote>removed</quote>. </text></subparagraph></paragraph><paragraph commented="no" id="id9A6E5454C4594F15B340532EFDAA260D"><enum>(2)</enum><header>Licensed importers and manufacturers</header><text>Section 923(i) of title 18, United States Code, is amended—</text><subparagraph commented="no" id="id815A20AF77CB4027ACF5D5B45EC63EF1"><enum>(A)</enum><text>by inserting <quote>(1)</quote> before <quote>Licensed</quote>; and</text></subparagraph><subparagraph commented="no" id="idD8ADC81873B04801AF64F55854C975DB"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id921A6BDC13B54891B37D6E12CF92328E"><text>The serial number shall be engraved or cast on the frame or receiver in a manner sufficient to identify the firearm and the manufacturer or importer that put the serial number on the firearm.</text><paragraph id="id16D65426ED944AA69AEFF64D86DD1E2B" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idEF410677A76D4896A14BB9AE9D691C9A"><enum>(A)</enum><text>Not later than 180 days after the date of enactment of the <short-title>Untraceable Firearms Act of 2021</short-title>, the Attorney General shall prescribe regulations for engraving a unique serial number onto a ghost gun. </text></subparagraph><subparagraph indent="up1" id="id514E736ED3F34F74B4CD3D81DC39D8DE"><enum>(B)</enum><text>The regulations prescribed under subparagraph (A) shall—</text><clause id="id34811F07CFE341439CA08816037D0343"><enum>(i)</enum><text>allow an owner of a firearm described in subparagraph (A) to have a unique serial number engraved on the firearm by a licensed manufacturer or importer; and </text></clause><clause id="id59A56FF8F169457AA29966AC5D4EAEDB"><enum>(ii)</enum><text>require that a serial number be engraved on the frame or receiver in a manner sufficient to identify the firearm and the manufacturer or importer that put the serial number on the firearm. </text></clause></subparagraph><subparagraph indent="up1" id="id96F80E651FF547F7850C126AA6361025"><enum>(C)</enum><text>The regulations authorized under this paragraph shall expire on the date that is 30 months after the date of enactment of the <short-title>Untraceable Firearms Act of 2021</short-title>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" id="idBE5EF0C050F94C989837B80859150B64"><enum>(d)</enum><header>Penalties</header><text>Section 924 of title 18, United States Code, is amended—</text><paragraph id="id395d1fe9f65942a9b323ca572d52adb0"><enum>(1)</enum><text>in subsection (a)(1)(B), by striking <quote>or (q)</quote> and inserting <quote>(q), (aa)(2), (aa)(3), (aa)(5), or (aa)(6)</quote>; </text></paragraph><paragraph id="idC21FD9E012B14C518D2F799831C1B207"><enum>(2)</enum><text>in subsection (c)</text><subparagraph id="id69667F5246514DE19EE7A20028839011"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id4A88421C61AE46D698580BE4B76BC231"><enum>(i)</enum><text>in subparagraph (A), in the matter preceding clause (i), by inserting <quote>functional</quote> before <quote>firearm</quote> each place it appears; </text></clause><clause id="idF47C32934ACC417B9E180447B29F93C2"><enum>(ii)</enum><text>in subparagraph (B), in the matter preceding clause (i), by inserting <quote>functional</quote> before <quote>firearm</quote>; and</text></clause><clause id="id8F27EFE6F04742AFAE33755B6AE2D614"><enum>(iii)</enum><text>in subparagraph (D)(ii), by inserting <quote>functional</quote> before <quote>firearm</quote>; and</text></clause></subparagraph><subparagraph id="idAE0B545B751246E7AA52BB19C51DFB0D"><enum>(B)</enum><text>in paragraph (4), by striking <quote>all or part of the firearm</quote> and all that follows through <quote>person.</quote> and inserting the following: <quote>all or part of the functional firearm, or otherwise make the presence of the functional firearm known to another person, in order to intimidate that person, regardless of whether the functional firearm is directly visible to that person.</quote>; </text></subparagraph></paragraph><paragraph id="id6796018dc0af4b748f41cb421c75fb8f"><enum>(3)</enum><text>in subsection (d)(1), by striking <quote>or (k)</quote> and inserting <quote>(k), (aa)(2), (aa)(3), (aa)(5), or (aa)(6)</quote>; </text></paragraph><paragraph id="id75CC98A26AFD4D09BB203463B88E1D1C"><enum>(4)</enum><text>in subsection (e)(1), by inserting <quote>through the possession of a functional firearm</quote> before <quote>and has three</quote>; and</text></paragraph><paragraph id="id507339ED38DF414FA9FB7F8184FC66E1"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFCD37F4553E84938BD5B76D6AD65D105"><subsection id="id90444D2188FA44D08681FABE3F94FDBC"><enum>(q)</enum><text>A person who violates section 922(aa)(4) shall—</text><paragraph id="id9df4109253764e69aadc5500f3b6ce7e"><enum>(1)</enum><text>in the case of the first violation by the person, be fined under this title, imprisoned not more than 1 year, or both; or</text></paragraph><paragraph id="idbb8d3fcc22dc4c9c8c39a466767bd1dd"><enum>(2)</enum><text>in the case of any subsequent violation by the person, be fined under this title, imprisoned not more than 5 years, or both.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section section-type="subsequent-section" id="H722FE6C67D1140819BDC1D53EA706330"><enum>4.</enum><header>Modernization of the prohibition on un­de­tect­able firearms</header><text display-inline="no-display-inline">Section 922(p) of title 18, United States Code, is amended—</text><paragraph id="H069519C7DCEF41C1B02188B4453693C4"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="idCC42B302B1044BEEA7B282A0593BC8FB"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>any firearm</quote>;</text></subparagraph><subparagraph id="H53CB13FEA56C4FDB8B595CC954A80CA2"><enum>(B)</enum><text display-inline="yes-display-inline">by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEB185DFADE0E4979A479844BC624D359"><subparagraph id="idD4309C1A06884057945C33412240AFE8" indent="up1"><enum>(A)</enum><text>an undetectable firearm; or</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H4B00861002134404A4AB97B8414C08ED"><enum>(C)</enum><text>in subparagraph (B), by striking <quote>any major component of which, when subjected to inspection by the types of x-ray machines commonly used at airports, does not generate</quote> and inserting the following: <quote>a major component of a firearm which, if subjected to inspection by the types of detection devices commonly used at airports for security screening, would not generate</quote>;</text></subparagraph></paragraph><paragraph id="HC41C292FEEC4489EB0B5ED7A120F01DC"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="HFC81D9FB27C74D2E85C80332EDB43638"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB56F3D1865904EFCB580C18046B1C5AF"><subparagraph id="idDAF40076D0C34E4382AF17A09FD9F5BE" indent="up1"><enum>(A)</enum><text>the term <term>undetectable firearm</term> means a firearm, as defined in section 921(a)(3)(A), of which no major component is wholly made of detectable material;</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="id68A4D9201B9C4A948452D8A224754DEF"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDE35A2F829D64B33A133620F325DFE65"><subparagraph id="H8E1397277C2249D999842BBCE4EBE719" indent="up1"><enum>(B)</enum><text>the term <term>major component</term>, with respect to a firearm—</text><clause id="HAC7CD78B044642E78B1370E3C9169D0B"><enum>(i)</enum><text>means the slide or cylinder or the frame or receiver of the firearm;
