Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to submit to Congress an annual report on peaker plants in the United States and to provide financial incentives for replacing peaker plants with technology that receives, stores, and delivers energy generated by renewable energy resources, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Energy Alternatives is Key to Emission Reductions Act of 2021</short-title></quote> or the <quote><short-title>PEAKER Act of 2021</short-title></quote>.</text></section><section id="idD59195E295BB4A2D8CDAD06500AD9F02"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id06471f7d14c849d1b4704b11b1c3d038"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idb3c79a481164493b92f9db6fc516b94e"><enum>(A)</enum><text>the Committee on Finance of the Senate;</text></subparagraph><subparagraph id="id077385925BCC484CBAB2D00F995C7C78"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></subparagraph><subparagraph id="idED493667D9944A8AB48FB762B5286115"><enum>(C)</enum><text>the Committee on Environment and Public Works of the Senate;</text></subparagraph><subparagraph id="id86317838377B4AA18EC03C005D900383"><enum>(D)</enum><text>the Committee on Ways and Means of the House of Representatives; and</text></subparagraph><subparagraph id="idF510FA901FA448E59F318CD23FA80BB7"><enum>(E)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idECCC5802CC8D44D486ABD06AE611AAB5"><enum>(2)</enum><header>Disadvantaged community</header><text>The term <term>disadvantaged community</term> means a community that—</text><subparagraph id="id4a7ede0408484a228db11429100178df"><enum>(A)</enum><text>is located in an area with a high concentration of individuals who—</text><clause id="id63033E9C86AC4474BE4AF852B9E5F082"><enum>(i)</enum><text>are members of low- and moderate-income households (as defined in section 570.3 of title 24, Code of Federal Regulations (or a successor regulation));</text></clause><clause id="id6357FB3DC2AA4BDD95EDF26E5372FE84"><enum>(ii)</enum><text>experience high levels of unemployment; </text></clause><clause id="idF1833CBD11FC4E43BD733397B6BD1818"><enum>(iii)</enum><text>face a high rent burden; </text></clause><clause id="idEB0743084B6E4CD49FF6264452309802"><enum>(iv)</enum><text>face a high energy burden;</text></clause><clause id="idB6CD130987294A7FA6A6DFA19E0C4314"><enum>(v)</enum><text>have low levels of home ownership; </text></clause><clause id="id650D23F3052F45F98D11CA8EED6F7F0B"><enum>(vi)</enum><text>have low levels of educational attainment; or </text></clause><clause commented="no" display-inline="no-display-inline" id="idB1C424BF6DD34F35B9B9BFB4AEA8B313"><enum>(vii)</enum><text>are members of groups that have historically experienced discrimination on the basis of race or ethnicity;</text></clause></subparagraph><subparagraph id="idd94aacc8d7fc430a9afa74f298b04afb"><enum>(B)</enum><text>is burdened by high cumulative environmental pollution or other hazards that can lead to negative public health effects; or</text></subparagraph><subparagraph id="id23AD8D29F01649749963CA79260440E7"><enum>(C)</enum><text>is determined to be a disadvantaged community, an environmental justice community, a climate-burdened community, or an otherwise similarly vulnerable community pursuant to any Federal or State-level initiative, including any relevant mapping initiative.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id504146D4CC10470E8D92446C8E271035"><enum>(3)</enum><header>High energy burden</header><text>The term <term>high energy burden</term> means, with respect to a household, expenditure of the household on residential energy costs that equals 6 percent or more of the household income.</text></paragraph><paragraph id="ide1fc4266f84a4e3abbac2e1157d46165"><enum>(4)</enum><header>Peaker plant</header><text>The term <term>peaker plant</term> means a fossil fuel-fired power plant or unit of a power plant that is run primarily to meet peak electricity demand, as determined by the Secretary, in coordination with the Administrator of the Environmental Protection Agency and the applicable local electrical grid operator.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCBE951E2E5CE4387B52F5E97625064B6"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy. </text></paragraph></section><section id="id19D1CC64670A47C688B6D580977C2193"><enum>3.</enum><header>Annual report on peaker plants in the United States</header><subsection id="id25140AEBC032415A9BBF5839A9504108"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, and annually thereafter, the Secretary, in coordination with the Administrator of the Environmental Protection Agency, the White House Environmental Justice Advisory Council, the White House Environmental Justice Interagency Council, the Council on Environmental Quality, and any other relevant Federal entity that the Secretary determines to be appropriate, shall submit to the appropriate committees of Congress a report that—</text><paragraph id="idC7DB096177BA4B69A408DF52C1D870CD"><enum>(1)</enum><text>identifies each peaker plant in the United States; and</text></paragraph><paragraph id="idDE3C31547E0C405EBE325CC1E17BD053"><enum>(2)</enum><text>for each peaker plant identified under paragraph (1)—</text><subparagraph id="id5C18161A02D74A35AACE1003BFCC302A"><enum>(A)</enum><text>describes the location of the peaker plant and related socioeconomic and demographic data for that location, including whether the peaker plant is located in or adjacent to a disadvantaged community;</text></subparagraph><subparagraph id="id1388689164444BE18C92F5DFB9E9BD60"><enum>(B)</enum><text>evaluates the quantity of carbon dioxide, nitric oxides, sulfur oxides, fine particulate matter (PM<subscript>2.5</subscript>), and methane emitted per unit of electricity generated by the peaker plant;</text></subparagraph><subparagraph id="id5DB120D055D240C8A40917FC88ADED8B"><enum>(C)</enum><text>identifies—</text><clause id="idF8563BD264A544A9B95C1D3AAF0B746B"><enum>(i)</enum><text>the total number of hours that the peaker plant generates electricity during the year covered by the report;</text></clause><clause id="idC6EB159863204355A2FBA02704F38FEB"><enum>(ii)</enum><text>the capacity factor of the plant;</text></clause><clause id="id9CD31BB0984A4CD1832BBC5417F971C1"><enum>(iii)</enum><text>the average number of hours that the peaker plant generates electricity each time that the peaker plant generates electricity; and</text></clause><clause id="id6B0E052259B440AF8F644A7872F3F0A1"><enum>(iv)</enum><text>the percentage of the total number of instances in which the peaker plant is started that result in the peaker plant generating electricity for—</text><subclause id="id53B61BAAF0C847C0B2D032B6609CC7CB"><enum>(I)</enum><text>not less than 4 hours;</text></subclause><subclause id="idDFA7D1531571458AA472FFC582CDB371"><enum>(II)</enum><text>not less than 8 hours; and </text></subclause><subclause id="id32BCDB86A96741FEB4B3675DFDD51CF9"><enum>(III)</enum><text>not less than 12 hours; and</text></subclause></clause></subparagraph><subparagraph id="idB3BF3EB2AE2B4841A8DA568B76350F53"><enum>(D)</enum><text>identifies, for each day on which the 3 air monitors closest to the peaker plant indicate that Federal ozone or particulate matter standards have been exceeded, the percentage of peak demand met by the peaker plant for the electrical grid load zone served by the peaker plant.</text></subparagraph></paragraph></subsection><subsection id="idd38a2424c8d84b1cbe05b0b97913f717"><enum>(b)</enum><header>Community engagement</header><text>In preparing a report under subsection (a), the Secretary shall initiate and carry out public engagement with residents and stakeholders from disadvantaged communities containing a peaker plant.</text></subsection></section><section id="idFC657C80533449AA92A4828BDC4E5AE2"><enum>4.</enum><header>Credit for generation and storage of energy from renewable sources</header><subsection id="id0C0A7927F8884C58B54D14C47E06603F"><enum>(a)</enum><header>In general</header><text>Subpart E of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 48C the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1867DF068C624887A106395625890DB0"><section id="id5774A5B8965048DEBFACC8459F1E56FE"><enum>48D.</enum><header>Renewable energy generation and storage credit</header><subsection id="id0245E35DCF044395859951B8E5E323F2"><enum>(a)</enum><header>In general</header><text>For purposes of section 46, the renewable energy generation and storage credit for any taxable year is an amount equal to 10 percent of the qualified investment for such taxable year with respect to any qualified renewable energy facility.</text></subsection><subsection id="id9AFA688A0476434FBE86B8B9A5562AD7"><enum>(b)</enum><header>Qualified investment with respect to qualified renewable energy facilities</header><paragraph id="idA046FB882D824FCC8AE387A299544295"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a), the qualified investment with respect to a qualified renewable energy facility for any taxable year is the basis of any qualified property placed in service by the taxpayer during such taxable year which is part of a qualified renewable energy facility.</text></paragraph><paragraph id="id4889E1BCBDAF4B6C89ACF4AB0D2E8CD7"><enum>(2)</enum><header>Qualified property</header><text>For purposes of this subsection, the term <term>qualified property</term> means property—</text><subparagraph id="id6670C0626AA54F4E97C95CF6E551D4B2"><enum>(A)</enum><text>which is—</text><clause id="idFB67823B43E0428BB570E52D9827C7A7"><enum>(i)</enum><text>tangible personal property, or</text></clause><clause id="id3E6EAA80E991457AA5F7688951F6F667"><enum>(ii)</enum><text>other tangible property (not including a building or its structural components), but only if such property is used as an integral part of the qualified renewable energy facility,</text></clause></subparagraph><subparagraph id="id6458915327D646B29D7CFEF64481397A"><enum>(B)</enum><text>with respect to which depreciation (or amortization in lieu of depreciation) is allowable,</text></subparagraph><subparagraph id="id1A6A3B7EEF9D483C8DA8640AF88E6D8F"><enum>(C)</enum><text>which is constructed, reconstructed, erected, installed, or acquired by the taxpayer, and</text></subparagraph><subparagraph id="id609BFC723C524468B89853BC70184C36"><enum>(D)</enum><text>the original use of which commences with the taxpayer.</text></subparagraph></paragraph><paragraph id="idCB1890B95A724BAF973A350967330B53"><enum>(3)</enum><header>Qualified renewable energy facility</header><subparagraph id="idAEE6EF7EF54E4269A97F8BE5345ACD2F"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term <term>qualified renewable energy facility</term> means a facility which—</text><clause id="idE23BB14545B74C70BDE8D65C4139C827"><enum>(i)</enum><text>uses solar, wind, low-impact hydroelectric (as certified by the Low Impact Hydropower Institute), geothermal, tidal, or wave energy to generate electricity which will be received and stored by property described in clause (ii),</text></clause><clause id="idFCB7E1F74170404C84FED842A1B87EA4"><enum>(ii)</enum><text>contains property which receives, stores, and delivers electricity described in clause (i), provided that such electricity is—</text><subclause id="idBA85238B4D4F407EAB3AA77BAB06A0A2"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id49B73C9C91A647F2B1A5427D53B7EBDA"><enum>(aa)</enum><text>sold by the taxpayer to an unrelated person, or</text></item><item id="id318206B4F7FB4B3F95DF5574A97BFAB1" indent="up1"><enum>(bb)</enum><text>in the case of a facility which is equipped with a metering device which is owned and operated by an unrelated person, sold or consumed by the taxpayer, and</text></item></subclause><subclause id="id89E2889AFC0D41E6A6F5924D2643D279"><enum>(II)</enum><text>at a minimum, discharged at such times as a peaker plant within the same electrical grid load zone would operate to meet peak electricity demand (as determined by the grid operator for such electrical grid), and</text></subclause></clause><clause commented="no" id="idD91B390830A540FBBEB57A8F53EAF164"><enum>(iii)</enum><text>which is placed in service—</text><subclause commented="no" id="id1C8A7C7028A244DCA640BEC1451FF047"><enum>(I)</enum><text>in a disadvantaged community which is located within—</text><item commented="no" id="idCA7A499F4AAE467986C58A5BEDF4D1B8"><enum>(aa)</enum><text>the same census tract as a peaker plant, or </text></item><item commented="no" id="id125423D598D64D50B0B525C0AAB986CA"><enum>(bb)</enum><text>a census tract that is adjacent to a census tract in which a peaker plant is located, and</text></item></subclause><subclause commented="no" id="id06A32D13D5C448E0BE61578544DD8E9C"><enum>(II)</enum><text>after December 31, 2021.</text></subclause></clause></subparagraph><subparagraph commented="no" id="id7CCBFEBA1FE448B2A4DB7DAB166FEFC2"><enum>(B)</enum><header>Special rule</header><text>For purposes of this paragraph, a facility shall not be deemed to be a qualified renewable energy facility unless the taxpayer demonstrates, to the satisfaction of the Secretary, that—</text><clause commented="no" id="idB54EFE78FCC949AC9316154933E90B4B"><enum>(i)</enum><text>the property described in clause (i) of subparagraph (A) is co-located with property described in clause (ii) of such subparagraph,</text></clause><clause commented="no" id="id170B0592DB7F4110A7AACB7C503E4023"><enum>(ii)</enum><text>such taxpayer has, with respect to the property described in clause (ii) of such subparagraph, entered into a contract which ensures that such property operates primarily to receive, store, and deliver electricity from any property described in clause (i) of such subparagraph, or</text></clause><clause commented="no" id="idACABEAB86BA54923819F65B5C2B81A85"><enum>(iii)</enum><text>the property described in clause (ii) of such subparagraph receives electricity during periods of typically high production of electricity, as a percentage of the grid generation mix, from sources described in clause (i) of such subparagraph, as determined by the grid operator for the electrical grid.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="idF64A1D10F92447039D8C35C0ED130CED"><enum>(c)</enum><header>Certain progress expenditure rules made applicable</header><text>Rules similar to the rules of subsections (c)(4) and (d) of section 46 (as in effect on the day before the date of the enactment of the Revenue Reconciliation Act of 1990) shall apply for purposes of subsection (a).</text></subsection><subsection commented="no" id="idC4AF69F6EA8F4DAFA6586EA840904824"><enum>(d)</enum><header>Definitions</header><text>The terms <term>disadvantaged community</term> and <term>peaker plant</term> have the same meanings given such term under section 2 of the <short-title>PEAKER Act of 2021</short-title>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE3A31C3E09BE44F89B1A0BB12C50F9CF"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="idF51759D147F64EEAB97652F7E2569635"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/46">Section 46</external-xref> of the Internal Revenue Code of 1986 is amended—</text><subparagraph id="id7CF9A1D504674425AB91BF7A2DB9CA03"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (5);</text></subparagraph><subparagraph id="idDE8449DD0ABB469993C4043F60EF8D93"><enum>(B)</enum><text>by striking the period at the end of paragraph (6) and inserting <quote>, and</quote>; and</text></subparagraph><subparagraph id="idCFF66723466940A7AD534C7DC1E187E5"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id05A322239ED54239987F024D3B7EE8FC"><paragraph id="idD204DAF9AAB54D05A45BF1FFF986B918"><enum>(7)</enum><text>the renewable energy generation and storage credit.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id3237BB6DF87943988269138EDAF3C74C"><enum>(2)</enum><text>Section 49(a)(1)(C) of such Code is amended—</text><subparagraph id="id9EF61293D11A40908BDA66C61D549B78"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of clause (iv);</text></subparagraph><subparagraph id="id5266F2723AD2420D8070A0892CEACC92"><enum>(B)</enum><text>by striking the period at the end of clause (v) and inserting <quote>, and</quote>; and</text></subparagraph><subparagraph id="id31868509B50441F6839D94F181F1309A"><enum>(C)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA3612524B2CB4832ADED3113863956F1"><clause id="id5955B1C119474724AF9B8D0697630CA9"><enum>(vi)</enum><text>the basis of any qualified property which is part of a qualified renewable energy facility under section 48D.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="idEE00187E350643A9BF1566E3F2DC09A6"><enum>(3)</enum><text>Section 50(a)(2)(E) of such Code is amended by striking <quote>or 48C(b)(2)</quote> and inserting <quote>48C(b)(2), or 48D(c)</quote>.</text></paragraph><paragraph id="id75085E1018434F318CF8010B93684496"><enum>(4)</enum><text>The table of sections for subpart E of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 48C the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD534F3C530F74A94BE3A2DCAFED0561B"><toc><toc-entry bold="off" level="section">48D. Renewable energy generation and storage credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6E7F7F3C8F5B42E8979BFA3F7DC2D0DA"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to property placed in service after December 31, 2020, under rules similar to the rules of <external-xref legal-doc="usc" parsable-cite="usc/26/48">section 48(m)</external-xref> of the Internal Revenue Code of 1986 (as in effect on the day before the date of the enactment of the Revenue Reconciliation Act of 1990). </text></subsection></section><section id="idC87F21B27B47461CBEF07DAF52D4317C"><enum>5.</enum><header>Renewable energy grant program</header><subsection id="id3ABA6FD28D81436BBA72C6201E192747"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id12C08B4222E84B04B7B5441A7160473E"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means each of the following:</text><subparagraph id="idC880BAE74D8C4A21BA2C8D573B0E2DFC"><enum>(A)</enum><text>A unit of State or local government.</text></subparagraph><subparagraph id="id134EA7E6F095404DB94DF3C33195FF3E"><enum>(B)</enum><text>A tax-exempt nonprofit organization.</text></subparagraph><subparagraph id="idF20747ABBCBE4963B44C892CD633E460"><enum>(C)</enum><text>A community-owned energy generation facility or energy storage facility located in a disadvantaged community.</text></subparagraph><subparagraph id="ida4130f0cc339442f95b26ce26d1f2d49"><enum>(D)</enum><text>A community-based energy cooperative or a similar group of individuals within a community who are pursuing an eligible project described in subsection (d).</text></subparagraph><subparagraph id="id85258b7b446846d6b0f9fe12e785abb4"><enum>(E)</enum><text>A partnership between—</text><clause id="id2EE270B9EEF4462EAE149F1C789C525F"><enum>(i)</enum><text>1 or more of the entities described in subparagraphs (A) through (D); and </text></clause><clause id="id9210FC69AD454775B500644940AF3E5B"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id9E8502AA44124FBE804702CF17B601F7"><enum>(I)</enum><text>an electric utility; or</text></subclause><subclause indent="up1" id="id03F133496C75484D93C37E6C4C359692"><enum>(II)</enum><text>a private entity.</text></subclause></clause></subparagraph></paragraph><paragraph id="idB04F14E9057549DBB0A5DE6D62B35C9E"><enum>(2)</enum><header>Energy storage facility</header><text>The term <term>energy storage facility</term> means a facility that receives, stores, and delivers electricity.</text></paragraph><paragraph id="idEDA895511A324D8FA837C2E4961107E5"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the grant program established under subsection (b).</text></paragraph><paragraph id="ide618434fb10f44528cefe6961f2607a3"><enum>(4)</enum><header>Qualifying community energy proposal</header><text>The term <term>qualifying community energy proposal</term> means a proposal to deploy and implement renewable energy generation, energy storage technology, energy efficiency upgrades, energy demand management strategies, or distributed renewable energy resources that a qualifying community energy study determines can reduce the runtime of an existing or planned peaker plant or otherwise reduce or replace the need for an existing or planned peaker plant. </text></paragraph><paragraph id="ide24344f31cfe442e8192a3c633823eac"><enum>(5)</enum><header>Qualifying community energy study</header><text>The term <term>qualifying community energy study</term> means a study or assessment that—</text><subparagraph id="ide16befe2bed14011b79f41cbe9f0ce87"><enum>(A)</enum><text>seeks to identify clean energy strategies to reduce the runtime of an existing or planned peaker plant or otherwise reduce or replace the need for an existing or planned peaker plant, including strategies that involve—</text><clause id="idad121f952c5f40d39cd9002dc965e39d"><enum>(i)</enum><text>renewable energy generation;</text></clause><clause id="idd220b803ec374e5dbc11172049d16f98"><enum>(ii)</enum><text>energy storage technology;</text></clause><clause id="idc59c9b029f7148909bbdd5b0834fc72b"><enum>(iii)</enum><text>energy efficiency upgrades;</text></clause><clause id="iddfc91f78a40c42c2a676bc20db642334"><enum>(iv)</enum><text>energy demand management strategies; or</text></clause><clause id="id776a05ced3414ed392cdd90898d65d37"><enum>(v)</enum><text>distributed renewable energy deployment; and</text></clause></subparagraph><subparagraph id="id8ec26bbce04944c28cac6997d365c6c6"><enum>(B)</enum><text>is led by or performed in partnership with the communities directly impacted by pollution from a peaker plant that is located within the same or an adjacent census tract.</text></subparagraph></paragraph><paragraph id="idAD255281DDA14773AD7DA4D64078BFBE"><enum>(6)</enum><header>Qualifying energy storage facility</header><text>The term <term>qualifying energy storage facility</term> means an energy storage facility that—</text><subparagraph id="idE451CE63765B48C98F5518C74F6C458F"><enum>(A)</enum><text>is colocated with a qualifying renewable energy facility and operates primarily to receive, store, and deliver renewable energy generated by that qualifying renewable energy facility;</text></subparagraph><subparagraph id="id02DEFF9CBFA24690B0C34D41A0AD940F"><enum>(B)</enum><text>has entered into a contract with 1 or more qualifying renewable energy facilities such that the energy storage system operates primarily to receive, store, and deliver renewable energy generated by those qualifying renewable energy facilities; or</text></subparagraph><subparagraph id="id5A35A8E870BD43B29F89940BB29DD659"><enum>(C)</enum><text>receives electricity during periods of typically high production of renewable energy (as a percentage of the grid generation mix), as determined by the operator of the applicable electrical grid.</text></subparagraph></paragraph><paragraph id="id98D5EB04E00747F28B260EE498623A4D"><enum>(7)</enum><header>Qualifying renewable energy facility</header><text>The term <term>qualifying renewable energy facility</term> means a facility that—</text><subparagraph id="id797996C5A69C4A449E7F7ED1F9B7CA9C"><enum>(A)</enum><text>generates renewable energy; and</text></subparagraph><subparagraph id="id33910EF2EB2441F88A701F4A377EE4F2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idB99389CAAA004B60B86219C1B0D9D959"><enum>(i)</enum><text>is colocated with a qualifying energy storage facility; or</text></clause><clause id="id896B0E88DF1A43F59B4C1963CE9E9479" indent="up1"><enum>(ii)</enum><text>has entered into a contract described in paragraph (6)(B) with 1 or more qualifying energy storage facilities.</text></clause></subparagraph></paragraph><paragraph id="idDE24110E5A2E43248F86FA4CCCF1C581"><enum>(8)</enum><header>Renewable energy</header><text>The term <term>renewable energy</term> means electricity that is generated by or derived from, as applicable—</text><subparagraph id="id955C18F215F14E148978003458C26820"><enum>(A)</enum><text>a low-impact hydroelectric facility certified by the Low Impact Hydropower Institute;</text></subparagraph><subparagraph id="id61DB1192216B41FD8A1523FF3856EB9A"><enum>(B)</enum><text>solar energy;</text></subparagraph><subparagraph id="id012AAA73EFCE42FC9CAA421F17642DD3"><enum>(C)</enum><text>wind energy;</text></subparagraph><subparagraph id="id312CDF1620CF44BBA5AA66E1B80FB831"><enum>(D)</enum><text>geothermal energy;</text></subparagraph><subparagraph id="idD573097C4099472A813F987B72D7BBEC"><enum>(E)</enum><text>tidal energy; or</text></subparagraph><subparagraph id="id5EA65849C2E74A26908E40BA6336E14A"><enum>(F)</enum><text>wave energy.</text></subparagraph></paragraph></subsection><subsection id="id07C640DD1C704134BBF43F9039E1F47D"><enum>(b)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall establish a grant program to assist eligible entities in—</text><paragraph id="id3B3BC76AE5E84BFEBB24F9E642D7CE65"><enum>(1)</enum><text>carrying out projects for the construction, reconstruction, erection, installation, or acquisition of qualifying renewable energy facilities and qualifying energy storage facilities;</text></paragraph><paragraph id="id8EE44AB2834346E3B132FE088DD23720"><enum>(2)</enum><text>carrying out projects for the implementation of qualifying community energy proposals; and</text></paragraph><paragraph id="idE6F513D30C3D4479B6E07CD6EFF6AE0B"><enum>(3)</enum><text>developing and carrying out qualifying community energy studies.</text></paragraph></subsection><subsection commented="no" id="id1CFC7608332648019A6E443D957BB08C"><enum>(c)</enum><header>Applications</header><text>To be eligible to receive a grant under the program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="id73BB0F49882046009E8CBBC54848023A"><enum>(d)</enum><header>Eligible projects and qualifying community energy studies</header><text>The Secretary may provide a grant under the program for—</text><paragraph id="idE7DDA57B7C5C410AA7BB638B891E60EB"><enum>(1)</enum><text>a project described in subsection (b)(1) only if each qualifying renewable energy facility and qualifying energy storage facility to be constructed, reconstructed, erected, installed, or acquired pursuant to the project will—</text><subparagraph id="id3F2803B03A824F97B22346A5A72FECC8"><enum>(A)</enum><text>be located in, or provide a direct and significant benefit to, a disadvantaged community that is located within—</text><clause id="idC957E333C7AA4566B8B174AC057B68F7"><enum>(i)</enum><text>the same census tract as an existing or planned peaker plant; or </text></clause><clause id="id1A917CD7956E402E871289DAF282E866"><enum>(ii)</enum><text>a census tract that is adjacent to a census tract in which an existing or planned peaker plant is or will be located; and</text></clause></subparagraph><subparagraph id="id01F2045456794FE1BD399563EE513A27"><enum>(B)</enum><text>at a minimum, discharge electricity at such times as a peaker plant within the same electrical grid load zone would operate to meet peak electricity demand, as determined by the operator of the applicable electrical grid;</text></subparagraph></paragraph><paragraph id="idE9299E8FCD344AF48E117912D971D3FE"><enum>(2)</enum><text>a project described in subsection (b)(2) only if the qualifying community energy proposal to be implemented pursuant to the project will be implemented in, or provide a direct and significant benefit to, a disadvantaged community that is located within a census tract described in clause (i) or (ii) of paragraph (1)(A); and</text></paragraph><paragraph id="id4C33DB3AAF1D4C0DBE49D7743700CE30"><enum>(3)</enum><text>the development and carrying out of a qualifying community energy study only if the qualifying community energy study will provide for engagement with, and incorporate feedback from, each disadvantaged community that is located within a census tract described in clause (i) or (ii) of paragraph (1)(A).</text></paragraph></subsection><subsection id="idC475380256E642F09EF3F498DDF5E483"><enum>(e)</enum><header>Technical assistance grants</header><text>The Secretary may use amounts appropriated under subsection (i) to provide grants to eligible entities for the cost of acquiring technical assistance for the preparation and submission of an application under subsection (c).</text></subsection><subsection id="id3FCAE554A0584698A071A665DC0A9647"><enum>(f)</enum><header>Priority for certain eligible entities</header><text>In evaluating applications submitted by eligible entities described in subsection (a)(1)(B), the Secretary shall give priority to applications submitted by local, community-based organizations or energy cooperatives.</text></subsection><subsection id="id80F84DD18CE745CB9D9A1F6B5AE585FD"><enum>(g)</enum><header>Cost sharing</header><paragraph id="idC3D083415EA146148159777CEFA2C556"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), with respect to each project described in paragraph (1) or (2) of subsection (b) for which a grant is provided under the program, the maximum amount provided for the project under the program shall not exceed 60 percent of the total cost incurred by the applicable eligible entity for, as applicable—</text><subparagraph id="idA8810A11D90447FCBAD7B0B109D364C0"><enum>(A)</enum><text>the construction, reconstruction, erection, installation, or acquisition of the applicable qualifying renewable energy facility or qualifying energy storage facility; or</text></subparagraph><subparagraph id="id258DA98A49B146C882C0B87E6E50C5D3"><enum>(B)</enum><text>the implementation of the applicable qualifying community energy proposal.</text></subparagraph></paragraph><paragraph id="id1B33256B569D4A4684BD72EFF6386A10"><enum>(2)</enum><header>Local, community-based organizations and energy cooperatives</header><text>With respect to a project described in paragraph (1) that is carried out by, or for which an application is submitted by, a local, community-based organization or an energy cooperative, the maximum amount provided for the project under the program shall not exceed 80 percent of the total cost incurred by the local, community-based organization or energy cooperative for the activities described in subparagraph (A) or (B) of that paragraph, as applicable.</text></paragraph></subsection><subsection id="id27363aaf595f4a4b9b82699aa64f6e74"><enum>(h)</enum><header>Community engagement</header><text>In carrying out this section, the Secretary shall initiate and carry out public engagement, particularly with residents and stakeholders from disadvantaged communities and communities in or adjacent to areas with existing peaker plants identified in a report under section 3(a), to ensure that—</text><paragraph id="idB5780764589E422B8A55E9F151175215"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idA9246FBAEFD14BB4B4D510035047E9DB"><enum>(A)</enum><text>the public has input into the formulation of the program; and</text></subparagraph><subparagraph id="id3E43F73F5A644B09ADC16984328952CD" indent="up1"><enum>(B)</enum><text>based on that input, the program best addresses the needs and circumstances of disadvantaged communities; and</text></subparagraph></paragraph><paragraph id="id51ea8505363a4dc0bea22317d1f73cfd"><enum>(2)</enum><text>the public has information relating to the program, including—</text><subparagraph id="idA60A72AA32764A18B3000FCDABD20906"><enum>(A)</enum><text>the benefits of, and opportunities for, eligible projects under the program; and </text></subparagraph><subparagraph id="id9A827131C3024E52B646822F620D204C"><enum>(B)</enum><text>the ways in which disadvantaged communities can best use the program to address the clean energy goals of those disadvantaged communities.</text></subparagraph></paragraph></subsection><subsection id="id71633E67EE8347D8B7B360BF73E63EBD"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the program not more than $1,000,000,000 for each of fiscal years 2022 through 2032.</text></subsection></section></legis-body></bill>
