which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To support Foreign Service families, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id0481BD20DCFB40A69119C55896EC8863"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Service Families Act of 2021</short-title></quote>.</text></section><section id="id085685415df24037874873b3d84bb8fa"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idafb5501517984e81a24cc35d9c62ae38"><enum>(1)</enum><header>Department</header><text>The term <term>Department</term> means the Department of State.</text></paragraph><paragraph id="id4abc55d349ca45d8b254ce8b64f23c0e"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of State. </text></paragraph></section><section section-type="subsequent-section" id="id22529E3B718A49FEAABB2F956AB1ED12"><enum>3.</enum><header>Telecommuting opportunities</header><subsection id="idd38981c61d6b4bb4b28545871ed2d6a5"><enum>(a)</enum><header>DETO policy</header><paragraph id="idE62E287D4E924F8489517C4FEA1939CD"><enum>(1)</enum><header>In general</header><text>Each Federal department and agency shall establish a policy enumerating the circumstances under which employees may be permitted to temporarily perform work requirements and duties from approved overseas locations pursuant to an approved Domestically Employed Teleworking Overseas (DETO) agreement.</text></paragraph><paragraph id="idCF9161762D8E495EA4D79EB21C87660A"><enum>(2)</enum><header>Participation</header><text>The policy described under paragraph (1) shall—</text><subparagraph id="idde4da5df680d44e5987db4607a73f134"><enum>(A)</enum><text>ensure that telework does not diminish employee performance or agency operations;</text></subparagraph><subparagraph id="idf78d9454439041fc96c2f15ae370b696"><enum>(B)</enum><text>require a written agreement that—</text><clause id="id2b3d2b9f14ae43439f7eeb27499c06b8"><enum>(i)</enum><text>is entered into between an agency manager and an employee authorized to telework, that outlines the specific work arrangement that is agreed to; and</text></clause><clause id="idf55c4d9c1fec474097e2551d2bd8c192"><enum>(ii)</enum><text>is mandatory in order for any employee to participate in telework;</text></clause></subparagraph><subparagraph id="id355b8b997c334de4aa25f52a2a578d58"><enum>(C)</enum><text>provide that an employee may not be authorized to telework if the performance of that employee does not comply with the terms of the written agreement between the agency manager and that employee;</text></subparagraph><subparagraph id="idf6355387dd2f41e3a2a8703284a248f8"><enum>(D)</enum><text>except in emergency situations as determined by the head of an agency, not apply to any employee of the agency whose official duties require on a daily basis (every work day)—</text><clause id="id660477ac5ac34314be5851042a6e8ffb"><enum>(i)</enum><text>direct handling of secure materials determined to be inappropriate for tel­e­work by the agency head; or</text></clause><clause id="id3f335f59d15b48748a37479d460942d7"><enum>(ii)</enum><text>on-site activity that cannot be handled remotely or at an alternate worksite;</text></clause></subparagraph><subparagraph id="id072968d846534e8aa95f7a6518f76579"><enum>(E)</enum><text>be incorporated as part of the continuity of operations plans of the agency in the event of an emergency; and</text></subparagraph><subparagraph id="id55bb9451deb34c61a512f52df2df71a5"><enum>(F)</enum><text>enumerate the circumstances under which employees may be permitted to temporarily perform work requirements and duties from approved overseas locations. </text></subparagraph></paragraph></subsection><subsection id="id64bb94bce1704b0f9b63a1a4a09ed7bd"><enum>(b)</enum><header>Access to ICASS system</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall revise chapter 900 of volume 6 of the Foreign Affairs Manual, the International Cooperative Administrative Support Services Handbook, the Personnel Operations Handbook, and any other relevant regulations to allow each Federal agency that has enacted a policy under subsection (a) to have access to the International Cooperative Administrative Support Services (ICASS) system.</text></subsection></section><section id="id3d730f750b3c4b2aa108c1c007d9602a"><enum>4.</enum><header>Employment and education programs for eligible family members of members of the Foreign Service</header><text display-inline="no-display-inline">Section 706(b) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4026">22 U.S.C. 4026(b)</external-xref>) is amended—</text><paragraph id="idad91aea34f8b424c932c7e95e6425fa9"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id0f4b8d7d40e74721a4dc08012a5d1996"><enum>(A)</enum><text>by striking <quote>The Secretary may</quote> and inserting <quote>The Secretary shall</quote>; and</text></subparagraph><subparagraph id="idb3127cbe20a848dabc3b9819337eacfc"><enum>(B)</enum><text>by amending subparagraph (C) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8838fcc03f91408ba28ed8008f51fd5c"><subparagraph id="ida2a359c6a56c460c9de78116b52cd033"><enum>(C)</enum><text>establishing a program for assisting eligible family members in accessing employment and education opportunities, which shall be modeled after the programs authorized under sections 1784 and 1784a of title 10, United States Code, and based on regulations modeled after those prescribed pursuant to subsection (b) of such section 1784.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="iddac04f20a5094ec58d7fd76736b76918"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (9);</text></paragraph><paragraph id="id74ad443dbe944065bf723bed4b0a2217"><enum>(3)</enum><text>by inserting after paragraph (1) the following new paragraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8098227af768417cafe4427a7b580733"><paragraph id="id96d4e2dd64334b248b44b68820dc6c69"><enum>(2)</enum><text>The Secretary shall prescribe regulations—</text><subparagraph id="id331cafd3e6674833bc54e21e0048d497"><enum>(A)</enum><text>to implement such measures as the President orders pursuant to paragraph (1)(C);</text></subparagraph><subparagraph id="idcf402966118f4f398e30444c24edacf4"><enum>(B)</enum><text>to provide preference to eligible family members in hiring for any civilian position in the Department of State if—</text><clause id="id892135e280594c62b56bb83c26e36681"><enum>(i)</enum><text>the eligible family member is among persons determined to be best qualified for the position; and</text></clause><clause id="iddc7f81e1ed174ed38fe922bc25c91daf"><enum>(ii)</enum><text>the position is located in the country of assignment of their sponsoring employee;</text></clause></subparagraph><subparagraph id="id4156832434b34b60b73e91fb9230d89c"><enum>(C)</enum><text>to ensure that notice of any vacant position in the Department is provided in a manner reasonably designed to reach eligible family members of sponsoring employees whose permanent duty stations are in the same country as that in which the position is located; and</text></subparagraph><subparagraph id="id886f3765858a4bbca3531d22e6b18a97"><enum>(D)</enum><text>to ensure that an eligible family member who applies for a vacant position in the Department shall, to the extent practicable, be considered for any such position located in the same country as the permanent duty station of their sponsoring employee.</text></subparagraph></paragraph><paragraph id="id6622fb6c0d4541b6996eba4a82fc8a56"><enum>(3)</enum><text>Nothing in this section may be construed to provide an eligible family member with preference in hiring over an individual who is preference eligible.</text></paragraph><paragraph id="id710681a35760447e89521515ec3c60da"><enum>(4)</enum><text>Under regulations prescribed by the Secretary, a chief of mission may, consistent with all applicable laws and regulations pertaining to the ICASS system, make available to a non-Department entity space in an embassy or consulate for the purpose of the non-Department entity providing employment-related training for eligible family members.</text></paragraph><paragraph id="id8f0f488a3ab54419835195dd2f2b8632"><enum>(5)</enum><text>The Secretary may work with the Director of the Office of Personnel Management and the heads of other Federal departments and agencies to expand and facilitate the use of existing Federal programs and resources in support of eligible family member employment.</text></paragraph><paragraph id="id14e4ec9ce36c46a5a2ca607d9aa506a0"><enum>(6)</enum><text>The Secretary may—</text><subparagraph id="ida8954ad5550245abb01ef8b3455118a3"><enum>(A)</enum><text>develop partnerships with firms in the private sector to enhance employment opportunities for eligible family members and to provide for improved job portability for such spouses, especially in the case of an eligible family member accompanying a sponsoring employee to a new geographical area because of a change of permanent duty station of the sponsoring employee; and</text></subparagraph><subparagraph id="id24821dd6b14541fda2232b1d495999b8"><enum>(B)</enum><text>work with the United States Chamber of Commerce and other appropriate private-sector entities to facilitate the formation of such partnerships.</text></subparagraph></paragraph><paragraph id="id341c7fe828704479bc2f5e72d8d3caeb"><enum>(7)</enum><text>The Secretary may prescribe regulations to incorporate hiring preferences for eligible family members of sponsoring employees into contracts between the Department and private sector entities.</text></paragraph><paragraph id="idae9f38e5fe0c4ad486946c804aac41cf"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id37ded5eeff68430f9c86e68f3389d3bb"><enum>(A)</enum><text>The Secretary of State shall seek to enter into a cooperative agreement with the Council of State Governments to assist with funding of the development of interstate compacts on licensed occupations in order to alleviate the burden associated with relicensing in such an occupation by an eligible family member in connection with a permanent change of duty station of their sponsoring employee.</text></subparagraph><subparagraph indent="up1" id="id6AEE3225AFE74587B53E2F2B5890E9E1"><enum>(B)</enum><text>The total amount of assistance provided under subparagraph (A) for all interstate compacts in any fiscal year may not exceed $4,000,000. </text></subparagraph><subparagraph indent="up1" id="id56850EDB8B5E44C9965E009C85CF83AF"><enum>(C)</enum><text>The amount provided under subparagraph (A) as assistance for the development of any particular interstate compact may not exceed $1,000,000. </text></subparagraph><subparagraph id="ide9b7774493c84abcaf8a9c43a088a0da" indent="up1"><enum>(D)</enum><text>Not later than February 28 each year, the Secretary shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report on interstate compacts described in subparagraph (A) developed through assistance provided under that subparagraph. Each report shall set forth the following:</text><clause id="id27b79480df0b44a296c26557a51c081c"><enum>(i)</enum><text>Any interstate compact developed during the preceding calendar year, including the occupational licenses covered by such compact and the States agreeing to enter into such compact.</text></clause><clause id="id027de2b354e64ea3a5097cc24dd6024b"><enum>(ii)</enum><text>Any interstate compact developed during a prior calendar year into which one or more additional States agreed to enter during the preceding calendar year.</text></clause></subparagraph><subparagraph id="idc450148dc1464921af2ebe461251fd0b" indent="up1"><enum>(E)</enum><text>The authority to enter into a cooperative agreement under subparagraph (A), and to provide assistance described in that subparagraph pursuant to such cooperative agreement, expire on September 30, 2024.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idA6CB19AE6D9741D496B0EF36760DA852"><enum>(4)</enum><text>by adding after paragraph (9), as redesignated by paragraph (2) of this subsection, the following new paragraph:</text><quoted-block id="idBA866289C9D84185820DE7CCE6388000" style="OLC" act-name=""><paragraph indent="up1" id="id96FAACC3212D484C8C776C66B4277E75"><enum>(10)</enum><text>In this subsection, the term <term>eligible family member</term> has the meaning given the term in section 7121 of volume 3 of the Foreign Affairs Manual (3 FAM 7121).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id051eb05201e04547b6f84dd8a6e2e261"><enum>5.</enum><header>Reporting on Foreign Service family reserve corps</header><subsection id="id0e8cdba21a5d4bce8a6ce2d4891ac048"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary shall brief the appropriate congressional committees on the status of implementation of the Foreign Service Family Reserve Corps.</text></subsection><subsection id="ide9d96d3ecd644039a718c55a46db3d9e"><enum>(b)</enum><header>Elements</header><text>The briefing required under subsection (a) shall include the following elements:</text><paragraph id="idd8f161accc2c4b35aca9590a585f9949"><enum>(1)</enum><text>A description of the status of implementation of the Foreign Service Family Reserve Corps (FSFRC).</text></paragraph><paragraph id="id03c65300b32d43839d7337fcc393b636"><enum>(2)</enum><text>An assessment of the extent to which implementation was impacted by the Department’s hiring freeze and a detailed explanation of the effect of any such impacts.</text></paragraph><paragraph id="id7d99d86a5fea46f29677b56d4ce44716"><enum>(3)</enum><text>A description of the status of implementation of a hiring preference for the FSFRC.</text></paragraph><paragraph id="id455d91bd12894d979cf5d55f3907128a"><enum>(4)</enum><text>A detailed accounting of any individuals eligible for membership in the FSFRC who were unable to begin working at a new location as a result of being unable to transfer their security clearance, including an assessment of whether they would have been able to port their clearance as a member of the FSFRC if the program had been fully implemented.</text></paragraph><paragraph id="id40994d1427a243558ea2b578bc0070d4"><enum>(5)</enum><text>An estimate of the number of individuals who are eligible to join the FSFRC worldwide and the categories, as detailed in the Under Secretary for Management’s guidance dated May 3, 2016, under which those individuals would enroll.</text></paragraph><paragraph id="ide1171d9260f24004a3464f013b6fb19e"><enum>(6)</enum><text>An estimate of the number of individuals who are enrolled in the FSFRC worldwide and the categories, as detailed in the Under Secretary for Management’s guidance dated May 3, 2016, under which those individuals enrolled.</text></paragraph><paragraph id="id400a79f4c4e9493c949188b4d3a1b3a7"><enum>(7)</enum><text>An estimate of the number of individuals who were enrolled in each phase of the implementation of the FSFRC as detailed in guidance issued by the Under Secretary for Management.</text></paragraph><paragraph id="id0092e5a52c5941428de822b16f107d33"><enum>(8)</enum><text>An estimate of the number of individuals enrolled in the FSFRC who have successfully transferred a security clearance to a new post since implementation of the program began.</text></paragraph><paragraph id="id17a496ce0a1a4a92b02ce75c9657bfa1"><enum>(9)</enum><text>An estimate of the number of individuals enrolled in the FSFRC who have been unable to successfully transfer a security clearance to a new post since implementation of the program began.</text></paragraph><paragraph id="iddc5b19e687dc461d8cfbcbf9471a8820"><enum>(10)</enum><text>An estimate of the number of individuals who have declined in writing to apply to the FSFRC.</text></paragraph></subsection><subsection id="idea5590c34bf845128fa3998a5af3177b"><enum>(c)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="id71d54c16f3024b11a5353b9c2d46a4f4"><enum>(1)</enum><text>the Committee on Foreign Relations and the Committee on Appropriations of the Senate; and</text></paragraph><paragraph id="id8b1e4b36b8b141d58cbd76bc5159e9d9"><enum>(2)</enum><text>the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives.</text></paragraph></subsection></section><section id="id582269f4431945c183f28590bc716718"><enum>6.</enum><header>Treatment of family members of Foreign Service officers seeking positions customarily filled by Foreign Service officers or foreign national employees</header><text display-inline="no-display-inline">Section 311 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3951">22 U.S.C. 3951</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3e5776be353c4be1a4bd79cb72265c77"><subsection id="id5456ebcc0c6a490cbb91444461e2481c"><enum>(e)</enum><text>The Secretary shall hold a family member of a government employee described in subsection (a) seeking employment in a position described in that subsection to the same employment standards as those applicable to Foreign Service officers, Foreign Service personnel, or foreign national employees seeking the same or a substantially similar position.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="ide20c1ef5c24145f68a2cd55916d6a1fc"><enum>7.</enum><header>In-State tuition rates for members of qualifying Federal service</header><subsection id="id5B030B78AA024C2092071CD3C18971A2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 135 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1015d">20 U.S.C. 1015d</external-xref>) is amended—</text><paragraph id="idDCBFE6D9510744EE9BB0F082085A14C2"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text level="section" style="OLC">the armed forces on active duty, spouses, and dependent children</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">qualifying Federal service</header-in-text></quote>;</text></paragraph><paragraph id="idDEDB4224727047E99723996DDC73B476"><enum>(2)</enum><text>in subsection (a), by striking <quote>member of the armed forces who is on active duty for a period of more than 30 days and</quote> and inserting <quote>member of a qualifying Federal service</quote>;</text></paragraph><paragraph id="id4C15CCF6B0BC4C0E921EACE6E7C4E6CC"><enum>(3)</enum><text>in subsection (b), by striking <quote>member of the armed forces</quote> and inserting <quote>member of a qualifying Federal service</quote>; and</text></paragraph><paragraph id="id9F4ABEA1AEA64682BB18CECFA8ED5ABD"><enum>(4)</enum><text>by striking subsection (d) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id6784FA24002349AD882BBFB8EE604AC5"><subsection id="id8A7C9460333748D78DA458BDD6FF452E"><enum>(d)</enum><header>Definitions</header><text>In this section, the term <term>member of a qualifying Federal service</term> means—</text><paragraph id="idF3FF556AF9F04312ACA239E01A3B12A6"><enum>(1)</enum><text>a member of the armed forces (as defined in section 101 of title 10, United States Code) who is on active duty for a period of more than 30 days (as defined in section 101 of title 10, United States Code); or</text></paragraph><paragraph id="idF0F106D041D04582BE212A2B8E6F7F4A"><enum>(2)</enum><text>a member of the Foreign Service (as defined in section 103 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3903">22 U.S.C. 3903</external-xref>)) who is on active duty for a period of more than 30 days.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5E056425F2B54999B6A05223A8F7BDB2"><enum>(b)</enum><header>Effective date</header><text>The amendments made under subsection (a) shall take effect at each public institution of higher education in a State that receives assistance under the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> et seq.) for the first period of enrollment at such institution that begins after July 1, 2021.</text></subsection></section><section id="HE5178DF23ED84CB78D48BA2C15921447"><enum>8.</enum><header>Termination of residential or motor vehicle leases and telephone service contracts for certain members of the Foreign Service</header><subsection id="H96E52B05EC9C410F8CAB3C4CCB315AFE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 9 of title I of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4081">22 U.S.C. 4081</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H3AFAF0AF7B4B4F5587DE0691CC2FC743" style="OLC"><section id="HAC998948D49541B691163309FD626330"><enum>907.</enum><header>Termination of residential or motor vehicle leases and telephone service contracts</header><text display-inline="no-display-inline">The terms governing the termination of residential or motor vehicle leases and telephone service contracts described in sections 305 and 305A, respectively of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/50/3955">50 U.S.C. 3955</external-xref> and 3956) with respect to servicemembers who receive military orders described in such Act shall apply in the same manner and to the same extent to members of the Service who are posted abroad at a Foreign Service post in accordance with this Act.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF7075AACDB254E12A4F24D2059CCBDA1"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 2 of the Foreign Service Act of 1980 is amended by inserting after the item relating to section 906 the following new item:</text><quoted-block display-inline="no-display-inline" id="H9F77769B321C494E9436AC0DC363125A" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 907. Termination of residential or motor vehicle leases and telephone service contracts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
