<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1549</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210511">May 11, 2021</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a review of the National Aeronautics and Space Administration preference for domestic suppliers.</official-title></form><legis-body><section id="id893A9480F1F14DCDA9D125DF89CEB3E2" section-type="section-one"><enum>1.</enum><header>Review of preference for domestic suppliers</header><subsection id="id26BA3B41ECF44AB0A75D7B1E91745982" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the Sense of Congress that the National Aeronautics and Space Administration (referred to in this section as <quote>NASA</quote>) should, to the maximum extent practicable and with due consideration of foreign policy goals and obligations under Federal law—</text><paragraph id="id51E19E80B4D04F0D9EF4BD0EAABD7705" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">use domestic suppliers of goods and services; and</text></paragraph><paragraph id="idCDCCC21FAAC142928BEBAD66301B53B9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">ensure compliance with the Federal acquisition regulations, including subcontract flow-down provisions.</text></paragraph></subsection><subsection id="id049F994B37AD405AA5E4FA3473A64AA2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Review</header><paragraph id="id99F45AF18674447EB3C2B1983986A647" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Administrator of NASA shall undertake a comprehensive review of the domestic supplier preferences of NASA and the obligations of NASA under the Federal acquisition regulations to ensure compliance, particularly with respect to Federal acquisition regulations provisions that apply to foreign-based subcontractors.</text></paragraph><paragraph id="id8C8402A1ACAA4F30BE490FE9AE682019" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The review under paragraph (1) shall include— </text><subparagraph id="id9B604AF2A5AE42EF90E6B9E9CE41DB13" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment as to whether NASA has provided funding for infrastructure of a foreign-owned company or State-sponsored entity in recent years; and </text></subparagraph><subparagraph id="idBF3C396A473D435692C06C59157A3972" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a review of any impact such funding has had on domestic service providers. </text></subparagraph></paragraph></subsection><subsection id="id72DEBC9898D7466EA3C4EB5C7546D0F3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Administrator of NASA shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report on the results of the review. </text></subsection></section></legis-body></bill>
