<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1543</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210510">May 10, 2021</action-date><action-desc><sponsor name-id="S388">Ms. Hassan</sponsor> (for herself, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S372">Mrs. Capito</cosponsor>, <cosponsor name-id="S337">Mr. Coons</cosponsor>, <cosponsor name-id="S287">Mr. Cornyn</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S324">Mrs. Shaheen</cosponsor>, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S364">Mr. Murphy</cosponsor>, and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to provide best practices on student suicide awareness and prevention training and condition State educational agencies, local educational agencies, and tribal educational agencies receiving funds under section 520A of such Act to establish and implement a school-based student suicide awareness and prevention training policy.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H86C0B7997118453694460AFBA8CFEA28"><section section-type="section-one" id="HFF17D11D5B7548FC82FA4C19BA75146D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Suicide Training and Awareness Nationally Delivered for Universal Prevention Act of 2021</short-title></quote> or the <quote><short-title>STANDUP Act of 2021</short-title></quote>.</text></section><section id="H4F5DB04919A94C2CAA9668CE0CFF57EA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text><paragraph id="idad21169229354754b47997f28aa3658b"><enum>(1)</enum><text>Since 2010, suicide has been the second-leading cause of death for young people ages 10 through 24. In 2019, 6,488 young people ages 10–24 died by suicide.</text></paragraph><paragraph id="id40e0062183134377a0c99f2cd2477f48"><enum>(2)</enum><text>Based on the 2019 Youth Risk Behavior Survey of the Centers for Disease Control and Prevention (in this section referred to as <quote>CDC</quote>), 8.9 percent of youth in grades 9–12 reported that they made at least one suicide attempt during the 12 months before the survey.</text></paragraph><paragraph id="id61963c9cd5e948bf9d6ae072c32cf542"><enum>(3)</enum><text>While there is no complete count of suicide attempts in the United States, CDC data suggests that for every reported death by suicide among people ages 10 through 24, approximately 33.5 young people visit a hospital for self-harm related injuries.</text></paragraph><paragraph id="id701df565076546dca286f5d231ca2823"><enum>(4)</enum><text>In 2019, suicide was the tenth-leading cause of death overall in the United States, with over 47,500 people dying by suicide, and there were more than twice as many suicides in the United States as there were homicides.</text></paragraph><paragraph id="id6a4ceba3d51748e2a44422ec41edb5a5"><enum>(5)</enum><text>Youth often display warning signs and signals before harming themselves or others. Research shows that 70 percent of those who die by suicide tell someone of their plans or give another warning sign.</text></paragraph><paragraph id="id5c6297916d1a4aa989ee9f0f15f91731"><enum>(6)</enum><text>According to the CDC, the rates of suicide among non-Hispanic American Indians and Alaska Natives were 60 percent greater than the general population in 2019 and are the highest of any racial or ethnic group in the United States. In addition, a study of CDC data from 2001 through 2015 shows that suicide rates for Black children ages 5 through 12 were roughly 2 times higher than those of similarly aged White children.</text></paragraph></section><section id="HF73BB41452C3425A83FE7564155DBF89"><enum>3.</enum><header>Student suicide awareness and prevention training</header><subsection id="HE0754562179C4BA0BA7795CC68F62B05"><enum>(a)</enum><header>In general</header><text>Title V of the Public Health Service Act is amended by inserting after section 520A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-32">42 U.S.C. 290bb–32</external-xref>) the following:</text><quoted-block style="OLC" id="H85A26CBA388346A2ADA78C24194C68EA"><section id="H9340D825A5B34A7C9A2B8E22AF110B7C"><enum>520B.</enum><header>Student suicide awareness and prevention training policies</header><subsection id="H6B62EC12FA284FC0AC0563947640846B"><enum>(a)</enum><header>In general</header><text>As a condition on receipt of funds under section 520A, each State educational agency, local educational agency, and tribal educational agency that receives such funds, directly or through a State or Indian Tribe, for activities to be performed in schools with respect to grades 6 through 12, including the Project AWARE State Education Agency Grant Program, shall—</text><paragraph id="H0F7A0E8A1485466B9760F566693A763F"><enum>(1)</enum><text>establish and implement a school-based student suicide awareness and prevention training policy;</text></paragraph><paragraph id="idE0EF1688878D41858B5356C57F23250F"><enum>(2)</enum><text>consult with stakeholders (including principals, teachers, parents, local tribal officials, and other school leaders) in the development of the policy under subsection (a)(1); and</text></paragraph><paragraph id="HC20D37203A99449D8726D8BDE444248E"><enum>(3)</enum><text>collect and report information in accordance with subsection (c).</text></paragraph></subsection><subsection id="H54AC41FE5F994C7EAA008D7BBEBC2A42"><enum>(b)</enum><header>School-Based student suicide awareness and prevention training policy</header><text>A school-based student suicide awareness and prevention training policy implemented pursuant to subsection (a)—</text><paragraph id="HE481141E43FE45C1BBC585918DEA9EF3"><enum>(1)</enum><text>shall be evidence-based;</text></paragraph><paragraph id="id6ebaa29725144a00a604f6fb23d4ffe3"><enum>(2)</enum><text>shall be culturally and linguistically appropriate;</text></paragraph><paragraph id="id003C84BFCEF8423892DC471076EE5E5B"><enum>(3)</enum><text>shall provide evidence-based training to students in grades 6 through 12, using school-based mental health service providers, if such providers are reasonably available, regarding—</text><subparagraph id="idAF105DA12D104417BFC151DF9FF9E21C"><enum>(A)</enum><text>suicide education and awareness, including warning signs for suicide and self-harm;</text></subparagraph><subparagraph id="HFEBF2B31C4804D279C92BD5BA4A5F663"><enum>(B)</enum><text>methods that students can use to seek help for themselves and others; and</text></subparagraph><subparagraph id="HC32E1392864B41A3A719509DD21C822B"><enum>(C)</enum><text>student resources for suicide awareness and prevention;</text></subparagraph></paragraph><paragraph id="HDBF14F974A7B41AE933DA906F695A7C3"><enum>(4)</enum><text>shall provide for retraining of such students every school year;</text></paragraph><paragraph id="H106A03A2E485490393DD9FC0B553EE01"><enum>(5)</enum><text>may last for such period as the State educational agency, local educational agency, or tribal educational agency involved determines to be appropriate; </text></paragraph><paragraph id="HA32B23EF4B3344958347AE01ECB661B5"><enum>(6)</enum><text>may be implemented through any delivery method, including in-person trainings, digital trainings, or train-the-trainer models; and</text></paragraph><paragraph id="id70181319091f40128f40e9c8f6b85b1d"><enum>(7)</enum><text>may include discussion of comorbidities and risk factors for suicidal ideation or self-harm, including substance misuse, sexual, or physical abuse, mental illness, and other evidence-based comorbidities or risk factors. </text></paragraph></subsection><subsection id="H5F6F8BA4BF514A4698A13173A1912F7B"><enum>(c)</enum><header>Collection of information and reporting</header><text display-inline="yes-display-inline">Each State educational agency, local educational agency, and tribal educational agency that receives funds under section 520A shall, with respect to each school served by the agency, collect and report to the Secretary the following information:</text><paragraph id="H38E87F6B0E6B45CDA85BE05E5EC41653"><enum>(1)</enum><text>The number of student trainings conducted.</text></paragraph><paragraph id="HCF43526D1C1545078D74170C8A29B902"><enum>(2)</enum><text>The number of students trained, disaggregated by age and grade level.</text></paragraph><paragraph id="H9C16F9BCEA5A458EACAB077EEC7F88A0"><enum>(3)</enum><text>The number of help-seeking reports made by students after implementation of such policy.</text></paragraph></subsection><subsection id="H57D35F45D02748E390F8035AF3E307C6"><enum>(d)</enum><header>Evidence-Based program listing</header><text>The Secretary, in consultation with the Secretary of Education, shall make publicly available the policies established by State educational agencies, local educational agencies, and tribal educational agencies pursuant to this section and the training that is available to students and teams pursuant to such policies, including identification of whether such training is available to trainees at no cost. </text></subsection><subsection id="H54C7F68077434660B7C74CD3A53EAF9E"><enum>(e)</enum><header>Implementation timeline</header><text display-inline="yes-display-inline">A State educational agency, local educational agency, or tribal educational agency shall establish and begin implementation of the policies required by subsection (a)(1) not later than the beginning of the third fiscal year following the date of enactment of this section for which the agency receives funds under section 520A.</text></subsection><subsection id="H8A3D9B56B62047A1BE100489DA0D350C"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ida70c5e27aed14aaa98be5efdde86b7d3"><enum>(1)</enum><text>The term <term>evidence-based</term> has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="idEC95E3BCD1914098B52FC50FE875B73B"><enum>(2)</enum><text>The term <term>local education agency</term> has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="id1B5DE96D998D4CABBD6B81324F73DC55"><enum>(3)</enum><text>The term <term>school-based mental health service provider</term> has the meaning given to such term in section 4102(6) of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="H0940C4AD9A954D8CAB5AB09819F8FAD7"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>State educational agency</term> has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="HE81A92443ABE4B9BBF8A1A5BD50C67FC"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>tribal educational agency</term> has the meaning given to such term in section 6132 of the Elementary and Secondary Education Act of 1965.</text></paragraph></subsection></section><section id="id295cefd3a772433f891f47bd8134a162"><enum>520B–1.</enum><header>Best practices for student suicide awareness and prevention training</header><text display-inline="no-display-inline">The Secretary, acting through the Assistant Secretary, in consultation with the Secretary of Education and the Bureau of Indian Education, shall—</text><paragraph id="idDEBA7F3839374D87946068D178AD58B6"><enum>(1)</enum><text>publish best practices for school-based student suicide awareness and prevention training, pursuant to section 520B, that are based on—</text><subparagraph id="idC8668DA2EB2747CDB278C800DAF3B98F"><enum>(A)</enum><text>evidence-based practices; and</text></subparagraph><subparagraph id="id517EC0EFF8074D6EBF6407156EAD7154"><enum>(B)</enum><text>input from relevant Federal agencies, national organizations, Indian tribes and tribal organizations, and related stakeholders;</text></subparagraph></paragraph><paragraph id="id95a84934baa641ffab1e2841caaf4d30"><enum>(2)</enum><text>publish guidance, based on the best practices under paragraph (1), to provide State educational agencies, local educational agencies, and tribal educational agencies with information on student suicide awareness and prevention best practices;</text></paragraph><paragraph id="idfab51c4753d945c2a76c7cfeeb4b0ce9"><enum>(3)</enum><text>disseminate such best practices to State educational agencies, local educational agencies, and tribal educational agencies; and</text></paragraph><paragraph id="id07d073c0319c49219d76fa1fde512985"><enum>(4)</enum><text>provide technical assistance to State educational agencies, local educational agencies, and tribal educational agencies.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idEC8E009DD8B74644AF58C693753C4975"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall only apply with respect to applications for assistance under section 520A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-32">42 U.S.C. 290bb–32</external-xref>) that are submitted after the date of enactment of this Act.</text></section></legis-body></bill>
