<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 1543</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Public Health Service Act to provide best practices on student suicide awareness and prevention training and condition State educational agencies, local educational agencies, and tribal educational agencies receiving funds under section 520A of such Act to establish and implement a school-based student suicide awareness and prevention training policy.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="H8FBC0B2B12724A92B0EA7E47852B1C2A" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Suicide Training and Awareness Nationally Delivered for Universal Prevention Act of 2021</short-title></quote> or the <quote><short-title>STANDUP Act of 2021</short-title></quote>.</text></section><section id="H2F8BBF6C40834B75A59CE0A242AD908B" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Student suicide awareness and prevention training</header><subsection id="H1BE9D108F614472BA6A15B4C6BC21E44" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title V of the Public Health Service Act is amended by inserting after section 520A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-32">42 U.S.C. 290bb–32</external-xref>) the following:</text><quoted-block id="HA93AC42676C94E8FACA34B121F4A40EF" style="OLC" changed="not-changed" display-inline="no-display-inline"><section id="H62E501B6EC9348FB92D476DEE415CB09" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="not-changed"><enum>520B.</enum><header display-inline="yes-display-inline">Student suicide awareness and prevention training</header><subsection id="H0666D41EF8294CC98CA5A524B814FD9B" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In awarding funds under section 520A, the Secretary shall give priority to applications under such section from a State educational agency, local educational agency, or Tribal educational agency, submitted directly or through a State or Indian Tribe, for funding for activities in secondary schools, where such agency has implemented, or includes in such application a plan to implement, a student suicide awareness and prevention training policy, which may include applicable youth suicide early intervention and prevention strategies implemented through section 520E—</text><paragraph id="H30F89A1BA2E34312BB2C045ACB5BED1B" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">establishing and implementing a school-based student suicide awareness and prevention training policy in accordance with subsection (c);</text></paragraph><paragraph id="H97F5745D1C24405F87DE9C99B613E06B" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">consulting with stakeholders (including principals, teachers, parents, local Tribal officials, and other relevant experts) and, as appropriate, utilizing information, models, and other resources made available by the Suicide Prevention Technical Assistance Center authorized under section 520C in the development of the policy under paragraph (1); and</text></paragraph><paragraph id="H4BBED834699E4B2D8D2E0DFD9ED018CC" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">collecting and reporting information in accordance with subsection (d).</text></paragraph></subsection><subsection id="idE5202305540B4294B4C68D4EA1E9FD89" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Consideration</header><text display-inline="yes-display-inline">In giving priority to applicants as described in subsection (a), the Secretary shall, as appropriate, take into consideration the incidence and prevalence of suicide in the applicable jurisdiction and the costs of establishing and implementing, as applicable, a school-based student suicide awareness and prevention training policy.</text></subsection><subsection id="HCCB9DDCF6D8549388802801A6B8CB54F" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">School-Based student suicide awareness and prevention training policy</header><text display-inline="yes-display-inline">A school-based student suicide awareness and prevention training policy implemented pursuant to subsection (a)(1) shall—</text><paragraph id="HADB1058806FC45ABABE71C3BB7F16112" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">be evidence-based;</text></paragraph><paragraph id="H268D7F73221A433D86E51E699C1B628A" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">be culturally- and linguistically-appropriate; </text></paragraph><paragraph id="HCB688BA59EE5439B876F5DED518ECFF8" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">provide evidence-based training to students in grades 6 through 12, in coordination with school-based mental health resources, as applicable, regarding—</text><subparagraph id="H430253D818D042569307C386825F6B6A" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">suicide prevention education and awareness, including associated risk factors;</text></subparagraph><subparagraph id="H1D369E04FDC04DDE8434756C93405B6C" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">methods that students can use to seek help; and</text></subparagraph><subparagraph id="H274C118FF42949B4AB0FDBD926B25739" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">student resources for suicide awareness and prevention; and</text></subparagraph></paragraph><paragraph id="HDE75CFED6D754BF7B1273D0233133768" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">provide for periodic retraining of such students.</text></paragraph></subsection><subsection id="H77E72415C3D0417F9534D2F6F591239F" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Collection of information and reporting</header><text display-inline="yes-display-inline">Each State educational agency, local educational agency, and Tribal educational agency that receives priority to implement a new training policy pursuant to subsection (a)(1) shall report to the Secretary the following aggregated information, in a manner that protects personal privacy, consistent with applicable Federal and State privacy laws:</text><paragraph id="HB06648DA43E54495A1C27CC7CA2D60F7" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">The number of trainings conducted, including the number of student trainings conducted, and the training delivery method used.</text></paragraph><paragraph id="H18832BE4148C45CD9BB6019978E02663" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">The number of students trained, disaggregated by age and grade level.</text></paragraph><paragraph id="HB3641D7BA3934CB5821FCAE049362C65" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">The number of help-seeking reports made by students after implementation of such policy.</text></paragraph></subsection><subsection id="HECBBFECDEA9C48C29FFDF319032F28EA" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Evidence-Based program availability</header><text display-inline="yes-display-inline">The Secretary shall coordinate with the Secretary of Education and the Secretary of the Interior to—</text><paragraph id="id5DEECBAF843C4BBEB23E5BCB747FB958" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">make publicly available the policies established by State educational agencies, local educational agencies, and Tribal educational agencies pursuant to this section and the training that is available to students and teams pursuant to such policies, in accordance with section 543A; and</text></paragraph><paragraph id="id60236CA18B4D46E4AA84BE63ABAE6A17" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">provide technical assistance and disseminate best practices on student suicide awareness and prevention training policies, including through the Suicide Prevention Technical Assistance Center authorized under section 520C, as applicable, to State educational agencies, local educational agencies, and Tribal agencies.</text></paragraph></subsection><subsection id="H889DFC5C3BA04F4AA438849DC600431D" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(f)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Not later than September 30, 2024, the Secretary shall report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives the number of recipients of funds under section 520A who have implemented training policies described in subsection (a)(1) and a summary of the information received under subsection (d).</text></subsection><subsection id="H97713BB31988421A942E5062C80AD33D" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(g)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id46A13CC8753A4456931497508E607331" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>evidence-based</term> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="H375D1E1D8AEA48AD9A8D27875812FEA0" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>local educational agency</term> has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="H79D058DB1C664BA5B1E3A1CDD3841161" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>State educational agency</term> has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="H47835408BD1A499BB4B3996C0D1D949C" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>Tribal educational agency</term> has the meaning given to the term <term>tribal educational agency</term> in section 6132 of the Elementary and Secondary Education Act of 1965.</text></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section><section id="H017AB87F1DA94668BBE43B2FC33B90DD" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="no-display-inline">The amendment made by this Act shall apply only with respect to applications for assistance under section 520A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-32">42 U.S.C. 290bb–32</external-xref>) that are submitted after the date of enactment of this Act.</text></section></legis-body><attestation><attestation-group><attestation-date date="20211214" chamber="Senate">Passed the Senate December 14, 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
