<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1539</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210510">May 10, 2021</action-date><action-desc><sponsor name-id="S414">Mr. Ossoff</sponsor> (for himself and <cosponsor name-id="S415">Mr. Warnock</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Help America Vote Act of 2002 to ensure access to water and food for voters waiting in line at polling stations in Federal elections.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voters’ Access to Water Act</short-title></quote>.</text></section><section id="id9D9C8C9674164F9F83FF9BA2B4271014"><enum>2.</enum><header>Prohibiting restrictions on donations of food and beverages at polling stations</header><subsection id="id9051c4124a194d74a4eaed8863b3be8b"><enum>(a)</enum><header>Findings and purpose</header><text>Congress finds the following:</text><paragraph id="id89adb71f43d94556ba25897403b549b0"><enum>(1)</enum><text>States have a legitimate interest in prohibiting electioneering at or near polling places, and each State has some form of restriction on political activities near polling places when voting is taking place.</text></paragraph><paragraph id="id1b4c8773b5f34f82b8fa0aa4826e1a1c"><enum>(2)</enum><text>In recent elections, voters have waited in unacceptably long lines to cast their ballot. During the 2018 midterm election, more than 3,000,000 voters were made to wait longer than the acceptable threshold for wait times set by the Presidential Commission on Election Administration, including many well-documented cases where voters were made to wait for several hours. A disproportionate number of those who had to wait long periods were Black or Latino voters, who were more likely than White voters to wait in the longest lines on Election Day.</text></paragraph><paragraph id="id5f0f19d84fb14ad8a542b338934a4b8d"><enum>(3)</enum><text>Allowing volunteers to donate food and water to all people waiting in line at a polling place, regardless of the voters’ political preference and without engaging in electioneering activities or partisan advocacy, helps ensure Americans who face long lines at their polling place can still exercise their Constitutional right to vote, without risk of dehydration, inadequate food, discomfort, and risks to health.</text></paragraph></subsection><subsection id="id1c99da3e9d0d48338293eb6123bf41c2"><enum>(b)</enum><header>Requirement</header><text>Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081</external-xref> et seq.) is amended—</text><paragraph id="id61f2e4beeb5d46a2a38523b4d968c3c4"><enum>(1)</enum><text>by redesignating sections 304 and 305 as sections 305 and 306, respectively; and</text></paragraph><paragraph id="id74abe861a967402dae674ce20ef5cf90"><enum>(2)</enum><text>by inserting after section 303 the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id771373257d9d46da8ba7f58236eb8855"><section id="id40f34171ff8945d08d708fa98cdbe2fc"><enum>304.</enum><header>Prohibiting States from restricting donations of food and beverages at polling stations</header><subsection id="id63fd9175c503429cacf0122eccd99d15"><enum>(a)</enum><header>Prohibition</header><text>Subject to the exception in subsection (b), a State may not impose any restriction on the donation of food and nonalcoholic beverages to persons outside of the entrance to the building where a polling place for a Federal election is located, provided that such food and nonalcoholic beverages are distributed without regard to the electoral participation or political preferences of the recipients.</text></subsection><subsection id="ida1a548d85408437fa549aba5fff3164c"><enum>(b)</enum><header>Exception</header><text>A State may require persons distributing food and nonalcoholic beverages outside the entrance to the building where a polling place for a Federal election is located to refrain from political or electioneering activity.</text></subsection><subsection id="id2295b47b4f1d4c5f8f984cc7bd86499e"><enum>(c)</enum><header>Effective date</header><text>This section shall apply with respect to elections for Federal office occurring on and after January 1, 2022.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1C205DEAB1EC42E1A1584F289DE37D6E"><enum>(c)</enum><header>Timing of issuance</header><text>Section 311(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21101">52 U.S.C. 21101(b)</external-xref>) is amended—</text><paragraph id="H20E976BC582F4DD99451F419601220CD"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (2);</text></paragraph><paragraph id="H1C0D164E31454A5CB9339B31B0BA9270"><enum>(2)</enum><text>by striking the period at the end of paragraph (3) and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H31B4D2EC459A4BC79DE230E99FC1B112"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H3B8DBB7B4B0D42DBB0E4C6AEE0C97F82" style="OLC"><paragraph id="HF79CBC833580483FB5B1E55714A7E5D0"><enum>(4)</enum><text display-inline="yes-display-inline">in the case of the recommendations with respect to section 304, January 1, 2022.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ideaa2d566b9bd40fe893cd101f1d2d4b4"><enum>(d)</enum><header>Clerical amendments</header><text>The table of contents of such Act is amended—</text><paragraph id="id50e7b83084d942e69d5a06fa85b94513"><enum>(1)</enum><text>by redesignating the items relating to sections 304 and 305 as relating to sections 305 and 306, respectively; and</text></paragraph><paragraph id="id477b89f81e7f4f0b808eb299d1818679" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by inserting after the item relating to section 303 the following new item:</text><quoted-block style="OLC" id="id6f0411b0-118a-4dd5-bea2-43b14ed24250"><toc><toc-entry level="section" idref="id40f34171ff8945d08d708fa98cdbe2fc">Sec. 304.
