which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide a work opportunity tax credit for military spouses and to provide for flexible spending arrangements for childcare services for uniformed services families. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jobs and Childcare for Military Families Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id0442FA598FB34FB8A30DFDE7C3329755"><enum>2.</enum><header>Work opportunity tax credit for military spouses</header><subsection id="id4FADA672CDEB47C4AD0F576BCF9659CF"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/51">Section 51(d)(1)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="idA2A4BD1CF77E4B56A647A18F47471A7E"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of subparagraph (I),</text></paragraph><paragraph id="idBD17184C7BD2400D8D23D0EBFEC02533"><enum>(2)</enum><text>by striking the period at the end of subparagraph (J) and inserting <quote>, or</quote>, and</text></paragraph><paragraph id="id3B0CFE3F34CD4B28957495C43B698F47"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD93B7C54CDE942CDBFD1600F185EAE1B"><subparagraph id="idCB8E28057339470F9076FFC4723136EE"><enum>(K)</enum><text>a qualified military spouse.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0848B398201A425A90C7EC5A8443D586"><enum>(b)</enum><header>Qualified military spouse</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/51">Section 51(d)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF573008755C745658DA379DE668F2623"><paragraph id="idE2BB26C1DE6B471D8E653353311C9657"><enum>(16)</enum><header>Qualified military spouse</header><text>The term <term>qualified military spouse</term> means an individual who is certified by the designated local agency as being, as of the hiring date, the spouse or domestic partner (as recognized under State law or by the Armed Forces) of a member of the Armed Forces.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idBCDD737D75ED427F9D7817937223F069"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to individuals who begin work for the employer after the date of enactment of this Act.</text></subsection></section><section id="idCA128FB041B84FA6AB3C20D07DFE238E"><enum>3.</enum><header>Flexible spending arrangements for childcare services for uniformed services families</header><subsection id="idE4B22A503ED14382BEFD36116BBE3B2A"><enum>(a)</enum><header>FSAs required</header><text>Not later than 12 months after the date of enactment of this Act, the Secretary concerned shall establish procedures to implement flexible spending arrangements with respect to basic pay and compensation for members of the uniformed services (as defined in section 101 of title 37, United States Code) for childcare services for dependent children of such members on a pre-tax basis in accordance with sections 125 and 129 of the Internal Revenue Code of 1986.</text></subsection><subsection id="id2FC2871A7EA34692B21F8ACA6644278B"><enum>(b)</enum><header>Considerations</header><text>The procedures required by subsection (a) shall take into account the considerations specified in section 663(b) of the National Defense Authorization Act for Fiscal Year 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/84">Public Law 111–84</external-xref>; 123 Stat. 2371) and such other considerations as the Secretaries concerned consider appropriate.</text></subsection><subsection id="id3A1A6D9E18F94F5897672015CAD616A4"><enum>(c)</enum><header>Secretary concerned defined</header><text>In this section, the term <term>Secretary concerned</term> means the following:</text><paragraph id="idBCD52B790B50495EAC4539C46AFAAEA5"><enum>(1)</enum><text>The Secretary of Defense, with respect to members of the Army, the Navy, the Marine Corps, and the Air Force.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDD0D52E2CA274736BC16E50C46E3C11C"><enum>(2)</enum><text>The Secretary of Homeland Security, with respect to members of the Coast Guard.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idAE57A3366E034FF0B55FF489250000CC"><enum>(3)</enum><text>The Secretary of Commerce, with respect to officers of the commissioned officer corps of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id344E22A70A6748F48020B252EAA39691"><enum>(4)</enum><text>The Secretary of Health and Human Services, with respect to members of the Public Health Service.</text></paragraph></subsection></section></legis-body></bill>
