which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to require the Secretary of Transportation to award grants to States that have enacted and are enforcing certain laws with respect to stretch limousines, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H25894773D0284BE798F20F9C45950808"><section section-type="section-one" id="HB31FED4C7DB34DCC9352B1FE870EE139"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Take Unsafe Limos Off the Road Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HA76B8ADCAB4F4699A7501EAC058F5ED9"><enum>2.</enum><header>Grant program for safety of stretch limousines</header><subsection id="H4D9D198A4FDE48A4B19B3EF953FD045C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/311">chapter 311</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HC9D7A35C65B544B995EFD8D03C892141"><section id="HBCFECC7DD559413DB6AC699FD6EFF5EB"><enum>31162.</enum><header>Grant program for safety of stretch limousines</header><subsection id="HA57B267B36014DB8A405C9A3A0A7C9CB"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H069BEFA18E6D4F219609EA4EA1C92151"><enum>(1)</enum><header>Eligible defect</header><text>The term <term>eligible defect</term> means a defect that would cause a motor vehicle to fail a commercial motor vehicle safety inspection.</text></paragraph><paragraph id="H7216B0978BD0494BA2D7EB339BBCAA1E"><enum>(2)</enum><header>Passenger motor vehicle</header><text>The term <term>passenger motor vehicle</term> has the meaning given the term in section 32101.</text></paragraph><paragraph id="id2817F01C6F364AE5B72C0984133085A4"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="idaa0f92425e8248458152cd4140a1f7c2"><enum>(4)</enum><header>Stretch limousine</header><text>The term <term>stretch limousine</term> means a new or used passenger motor vehicle that—</text><subparagraph id="id012498D8880A4BEDB8C861D7A32C1268"><enum>(A)</enum><text>has been modified, altered, or extended in a manner that increases the overall wheelbase of the vehicle—</text><clause id="id340908D77BCC415A9CF3CDDED806CD64"><enum>(i)</enum><text>beyond the wheelbase dimension of the original equipment manufacturer for the base model and year of the vehicle; and</text></clause><clause id="idC1FC655DC4524FBDBAC69EA397841E04"><enum>(ii)</enum><text>to a length sufficient to accommodate additional passengers; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5DE87502AC9544C29131F1E60137E97E"><enum>(B)</enum><text>after being altered as described in subparagraph (A), has a seating capacity of not fewer than 9 passengers, including the driver.</text></subparagraph></paragraph></subsection><subsection id="HC6E7989BD6BE4037BC04C7B5A38B0F2F"><enum>(b)</enum><header>Grant program</header><text display-inline="yes-display-inline">Each fiscal year, the Secretary shall make a grant, in accordance with this section, to each State that is eligible for a grant under subsection (c).</text></subsection><subsection id="H15AAA4994D234F8DB360FF0B4889F349"><enum>(c)</enum><header>Eligibility</header><text>A State is eligible for a grant under this section for a fiscal year if, on October 1 of that fiscal year, the State—</text><paragraph id="id62D53D1D783B42DFB114EF923BF39742"><enum>(1)</enum><text>has enacted a law that requires the impoundment or immobilization of a stretch limousine that is found to have an eligible defect on inspection; and</text></paragraph><paragraph id="idEE9B5DCBE3A8444B921F6F99A1881F61"><enum>(2)</enum><text>is enforcing the law described in paragraph (1), as determined by the Secretary.</text></paragraph></subsection><subsection id="HE9DF684EB4F8403C95655B0F9AB9C9C5"><enum>(d)</enum><header>Grant amounts</header><paragraph id="HB08714552899478B9A4029FD6FD72ACD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on October 1 of the first fiscal year beginning after the date of enactment of this section, the Secretary shall apportion the amounts appropriated to carry out this section to each State that is eligible to receive a grant under subsection (c) in an amount that is equal to the quotient obtained by dividing—</text><subparagraph id="HBF8EC52B63C64AB697FF2053EC159CD4"><enum>(A)</enum><text>the difference between—</text><clause id="idFE3F6E9EA7644D648BD18EA519761E0C"><enum>(i)</enum><text>$5,000,000; and</text></clause><clause id="idBD6E437E63CA4FD8815A5CAA45932CDF"><enum>(ii)</enum><text>the total amount provided to States under paragraph (2); and</text></clause></subparagraph><subparagraph id="H3F20754344C34E62BF8ACF638A6E0B18"><enum>(B)</enum><text>the number of States eligible for a grant under subsection (c) for the fiscal year.</text></subparagraph></paragraph><paragraph id="HCE43BDA22FC9493898B266A167815546"><enum>(2)</enum><header>Increase of grant amounts</header><text display-inline="yes-display-inline">Beginning on October 1 of the first fiscal year beginning after the date of enactment of this section, a State that is eligible for a grant under subsection (c) may receive an additional $50,000 in grant funds if, on October 1 of that fiscal year, the State has enacted and is enforcing a law or regulation that requires—</text><subparagraph id="H18541BD082FE4F5888BE00E8E3DBE63C"><enum>(A)</enum><text>any safety inspection of a stretch limousine to be conducted at a designated site controlled by the State; and</text></subparagraph><subparagraph id="HCEDD7B19492044CA97DBF9BFE7995DB7"><enum>(B)</enum><text display-inline="yes-display-inline">the inspection described in subparagraph (A) to be conducted by employees trained in the inspection of stretch limousines.</text></subparagraph></paragraph></subsection><subsection id="HE1B403B293D1449A974624E4529970EA"><enum>(e)</enum><header>Use of funds</header><text>A State receiving a grant under this section may use grant amounts—</text><paragraph id="HE07B7E34C2AD44829598B1B74ACE0A66"><enum>(1)</enum><text display-inline="yes-display-inline">for the impoundment or immobilization of a stretch limousine;</text></paragraph><paragraph id="H2C94C541387E4F4E9B0C512402685405"><enum>(2)</enum><text display-inline="yes-display-inline">for the establishment and operating expenses of designated stretch limousine safety inspection sites; or</text></paragraph><paragraph id="HDFE6F21FEF1C49FCA36831EC8A59AA85"><enum>(3)</enum><text>to train employees in the inspection of stretch limousines.</text></paragraph></subsection><subsection id="HF0BFCEE917344FB990699D68601C4B4A"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $5,000,000 for each of fiscal years 2021 through 2024.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H00489A50109E4C3EAC447AE6A647FB9E"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/311">chapter 311</external-xref> of title 49 is amended by inserting after the item relating to section 31161 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H338A0998A97D40C89D3D32065EF5D5D1"><toc regeneration="no-regeneration"><toc-entry level="section">31162. Grant program for safety of stretch limousines. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
