which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish safety standards for certain limousines, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC3D36452BEB147128E0EF936D3143917"><section section-type="section-one" id="H4FC5804A487C4EB2B16FD1295277F664"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safety, Accountability, and Federal Enforcement of Limos Act of 2021</short-title></quote> or the <quote><short-title>SAFE Limos Act</short-title></quote>.</text></section><section id="H5A276694EA17435DA579B47A56F0EF3D"><enum>2.</enum><header>Limousine compliance with Federal safety standards</header><subsection id="HC355588190894F21AAD8E4188FB5D635"><enum>(a)</enum><header>Limousine standards</header><paragraph id="H88642105BD0E40AE8F80992D297466CA"><enum>(1)</enum><header>Safety belt and seating system standards for limousines</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary shall prescribe a final rule—</text><subparagraph id="HAB4D220CE9F04ABFBBF37FB736177F19"><enum>(A)</enum><text>that amends Federal Motor Vehicle Safety Standard Numbers 208, 209, and 210 to require to be installed in limousines at each designated seating position, including on side-facing seats—</text><clause id="H4C1CAC9EE42249C3B03256B047BEB32A"><enum>(i)</enum><text>an occupant restraint system consisting of integrated lap shoulder belts; or</text></clause><clause id="H05BC95014F8341F08C33972108C8062E"><enum>(ii)</enum><text>an occupant restraint system consisting of a lap belt if the occupant restraint system described in clause (i) does not meet the need for motor vehicle safety; and</text></clause></subparagraph><subparagraph id="HCF9454FE96F34A768547746B7A170E34"><enum>(B)</enum><text>that amends Federal Motor Vehicle Safety Standard Number 207 to require limousines to meet standards for seats (including side-facing seats), seat attachment assemblies, and seat installation to minimize the possibility of their failure by forces acting on them as a result of vehicle impact.</text></subparagraph></paragraph><paragraph id="H28FA77DA372B4341B5418DEA73E971BE"><enum>(2)</enum><header>Report on retrofit assessment for limousines</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that assesses the feasibility, benefits, and costs with respect to the application of any requirement established under paragraph (1) to a limousine introduced into interstate commerce before the date on which the requirement takes effect.</text></paragraph></subsection><subsection id="H949364D3B17842BD9610D030C2438E60"><enum>(b)</enum><header>Safety regulation of limousines</header><paragraph id="H682637FA8AD54BA8934184534569DEE2"><enum>(1)</enum><header>In general</header><text>Section 30102(a)(6) of title 49, United States Code, is amended—</text><subparagraph id="H6810C8F2C89C46F0878E066535D00A46"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HC1FD513F8F1748198BD6CD8E28023E4D"><enum>(B)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="HD2E5911CB65D4E13A2B857B2EC2EA04F"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H5108B476F31745309FB2EE3776CF7152"><subparagraph id="HB9031CE180BC4E3AB08A93B5AE7BBC5B"><enum>(C)</enum><text>modifying a passenger motor vehicle (as such term is defined in section 32101) that has already been purchased by the first purchaser (as such term is defined in subsection (b)) by increasing the wheelbase of the vehicle so that the vehicle has increased seating capacity.</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H23486838B2424035AEFF0C2A52F02E97"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall apply beginning on the date that is 1 year after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H85AC860BEB2F4B18A4878F9B3EAD99C4"><enum>(c)</enum><header>Limousine compliance with Federal safety standards</header><paragraph id="HE9641EDC96AC48F393241F03A1E69F15"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">Chapter 301</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/30128">section 30128</external-xref> the following:</text><quoted-block style="USC" id="HEC4A219F2456479AB909C9F40559C234"><section id="H7A5C090346C24000B007B60B17946E8E"><enum>30129.</enum><header>Limousine compliance with Federal safety standards</header><subsection id="H1BF94EF82517454AB8FAB01F934791DA"><enum>(a)</enum><header>Requirement</header><text>Beginning on the date that is 1 year after the date of the enactment of this section, a limousine remodeler may not offer for sale, lease, or rent, introduce or deliver for introduction into interstate commerce, or import into the United States a new limousine unless the limousine remodeler has submitted to the Secretary a vehicle remodeler plan (or an updated vehicle remodeler plan required by subsection (b), as applicable) that describes how the remodeler is mitigating risks to motor vehicle safety posed by the limousines of the remodeler. A vehicle remodeler plan shall include the following:</text><paragraph id="H0602F6DA538B4AB5B953896724CA8936"><enum>(1)</enum><text>Verification and validation of compliance with applicable motor vehicle safety standards.</text></paragraph><paragraph id="H8BD2275443194A84ADDD842919FCC535"><enum>(2)</enum><text>Design, quality control, manufacturing, and training practices adopted by the limousine remodeler.</text></paragraph><paragraph id="HC9F95B5216E64BDC8AB0998FC327BA28"><enum>(3)</enum><text>Customer support guidelines, including instructions for limousine occupants to wear seatbelts and limousine operators to notify occupants of the date and results of the most recent inspection of the limousine.</text></paragraph></subsection><subsection id="H930761272BF24FDF8560B65FFD13E52D"><enum>(b)</enum><header>Updates</header><text>Each limousine remodeler shall submit an updated vehicle remodeler plan to the Secretary each year.</text></subsection><subsection id="H422A1238734B447694EAC0C7C49E6A9A"><enum>(c)</enum><header>Publicly available</header><text>The Secretary shall make any vehicle remodeler plan submitted under subsection (a) or (b) publicly available not later than 60 days after the date on which the plan is received, except the Secretary may not make publicly available any information relating to a trade secret or other confidential business information (as such terms are defined in section 512.3 of title 49, Code of Federal Regulations (or any successor regulation)).</text></subsection><subsection id="H5AECC632F24848838E0ABA0460246ECE"><enum>(d)</enum><header>Review</header><text>The Secretary may inspect any vehicle remodeler plan submitted by a limousine remodeler under subsection (a) or (b) to enable the Secretary to determine whether the limousine remodeler has complied, or is complying, with this chapter or a regulation prescribed or order issued pursuant to this chapter.</text></subsection><subsection id="H43E5B6E05547426B8C04F4943B27AA5E"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to affect discovery, a subpoena or other court order, or any other judicial process otherwise allowed under applicable Federal or State law.</text></subsection><subsection id="H333C6C5682EF4224AD78232A1777E20F"><enum>(f)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph commented="no" id="HB1867CA17A104BA09F0BDA05309DFFD7"><enum>(1)</enum><header>Certified passenger motor vehicle</header><text>The term <quote>certified passenger motor vehicle</quote> means a passenger motor vehicle that has been certified in accordance with section 30115 to meet all applicable motor vehicle safety standards.</text></paragraph><paragraph id="HBCB7725112824B9297410CD76826E4D4"><enum>(2)</enum><header>Incomplete vehicle</header><text display-inline="yes-display-inline">The term <quote>incomplete vehicle</quote> has the meaning given such term in section 567.3 of title 49, Code of Federal Regulations (or any successor regulation).</text></paragraph><paragraph id="H97F5A641527748378EB3A1CE4D61FD2F"><enum>(3)</enum><header>Limousine</header><text>The term <quote>limousine</quote> means a motor vehicle—</text><subparagraph id="H4A98F4159E9840E2BF7784E060902589"><enum>(A)</enum><text>that has a seating capacity of 9 or more persons (including the driver);</text></subparagraph><subparagraph id="H2EA792E365564B8FB63A6FA8EF9D1A7A"><enum>(B)</enum><text>with a gross vehicle weight rating greater than 10,000 pounds but not greater than 26,000 pounds; and</text></subparagraph><subparagraph id="HA9D64483367B44849D6008F16955A863"><enum>(C)</enum><text>that the Secretary has determined by regulation has physical characteristics resembling—</text><clause id="HBA27533B705B4C4DA26B0DB4D01D4318"><enum>(i)</enum><text>a passenger car;</text></clause><clause id="H88EC0B79F2C140E0876ABB68AED5C395"><enum>(ii)</enum><text>a multipurpose passenger vehicle; or</text></clause><clause id="H7C6518B7C9C740D9873BA03ED7FD3774"><enum>(iii)</enum><text display-inline="yes-display-inline">a truck with a gross vehicle weight rating of 10,000 pounds or less.</text></clause></subparagraph></paragraph><paragraph id="HF006BBBC0A3E42428E564D307D6BE541"><enum>(4)</enum><header>Limousine operator</header><text>The term <quote>limousine operator</quote> means a person who owns or leases, and uses, a limousine to transport passengers for compensation.</text></paragraph><paragraph id="H56B9A37B5068471CAF49C9A4E77247E3"><enum>(5)</enum><header>Limousine remodeler</header><text display-inline="yes-display-inline">The term <quote>limousine remodeler</quote> means a person who alters or modifies by addition, substitution, or removal of components (other than readily attachable components) an incomplete vehicle, a vehicle manufactured in two or more stages, or a certified passenger motor vehicle before or after the first purchase of the vehicle to manufacture a limousine.</text></paragraph><paragraph id="H9D6C1DC9A4534F5091BFCB3347F443BC"><enum>(6)</enum><header>Multipurpose passenger vehicle</header><text display-inline="yes-display-inline">The term <quote>multipurpose passenger vehicle</quote> has the meaning given such term in section 571.3 of title 49, Code of Federal Regulations (or any successor regulation).</text></paragraph><paragraph id="H918F78820F074DF4B85EB6D04E80FDDD"><enum>(7)</enum><header>Passenger car</header><text display-inline="yes-display-inline">The term <quote>passenger car</quote> has the meaning given such term in section 571.3 of title 49, Code of Federal Regulations (or any successor regulation).</text></paragraph><paragraph id="H882C48B5ADE847B18A555A961693A182"><enum>(8)</enum><header>Passenger motor vehicle</header><text>The term <quote>passenger motor vehicle</quote> has the meaning given such term in section 32101.</text></paragraph><paragraph id="H3A8E7E5182D246E29DFC7B22F6E8B336"><enum>(9)</enum><header>Truck</header><text display-inline="yes-display-inline">The term <quote>truck</quote> has the meaning given such term in section 571.3 of title 49, Code of Federal Regulations (or any successor regulation).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H07D608284502435E899EA9E3CA1183B9"><enum>(2)</enum><header>Enforcement</header><text>Section 30165(a)(1) of title 49, United States Code, is amended by inserting <quote>30129,</quote> after <quote>30127,</quote>.</text></paragraph><paragraph id="H3C02F226B9694ECBB1E12DAE3F40A55C"><enum>(3)</enum><header>Clerical amendment</header><text>The table of sections for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/30128">section 30128</external-xref> the following:</text><quoted-block style="USC" id="H47CD8936A3BD4226BB4C1EA2968247DA"><toc regeneration="no-regeneration"><toc-entry level="section">30129. Limousine compliance with Federal safety standards.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HCAE60273E6D04172917F9885D3EAE4F4"><enum>(d)</enum><header>Limousine crashworthiness</header><paragraph id="HDDDBB8E827F440BFBC5E18E38C97B31C"><enum>(1)</enum><header>Research</header><text>Not later than 4 years after the date of the enactment of this Act, the Secretary shall complete research into the development of motor vehicle safety standards for side impact protection, roof crush resistance, and air bag systems for the protection of occupants for limousines with alternative seating positions, including perimeter seating arrangements.</text></paragraph><paragraph commented="no" id="HBA9A8F42960544DBA1DE280DDB0391B5"><enum>(2)</enum><header>Rulemaking or report</header><subparagraph commented="no" id="H8719BD1EEE5A44B4B6D9A9F9D8A20523"><enum>(A)</enum><header>Crashworthiness standards</header><clause commented="no" id="H3954D174E2E241BBB4FE7139C1C96E93"><enum>(i)</enum><header>In general</header><text>Not later than 2 years after the completion of the research required under paragraph (1), except as provided in clause (ii), the Secretary shall prescribe a final motor vehicle safety standard, for the protection of occupants in limousines with alternative seating positions, for each of the following:</text><subclause commented="no" id="H0B4EDBCB7DCF43A49ADBE533268E5507"><enum>(I)</enum><text>Side impact protection.</text></subclause><subclause commented="no" id="HA077D7D157C3473C816065A2F51432CC"><enum>(II)</enum><text>Roof crush resistance.</text></subclause><subclause commented="no" id="HEA4E12C0D5684A08970F44E599388DC1"><enum>(III)</enum><text>Air bag systems.</text></subclause></clause><clause commented="no" id="HE3F892C34BAF4AF88F5301BF1229DAB1"><enum>(ii)</enum><header>Requirements and considerations</header><text>The Secretary may only prescribe a motor vehicle safety standard described in clause (i) if the Secretary determines that such standard meets the requirements and considerations set forth in subsections (a) and (b) of section 30111 of title 49, United States Code.</text></clause></subparagraph><subparagraph commented="no" id="H2ED351FD5C524183A3862EC7E3B51007"><enum>(B)</enum><header>Report</header><text>If the Secretary determines that a standard described in subparagraph (A)(i) does not meet the requirements and considerations set forth in subsections (a) and (b) of section 30111 of title 49, United States Code, the Secretary shall publish in the Federal Register and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report describing the reasons for not prescribing such standard.</text></subparagraph></paragraph></subsection><subsection id="HC49B6786EFA9415CA6783E03E3787767"><enum>(e)</enum><header>Limousine evacuation</header><paragraph id="H1B78058986544815B42D3B66738762FB"><enum>(1)</enum><header>Research</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary shall complete research into safety features and standards that aid evacuation in the event that one exit in the passenger compartment of a limousine is blocked.</text></paragraph><paragraph id="H1A78AAC5738B45228C361EBF28FE140E"><enum>(2)</enum><header>Standards</header><text>Not later than 3 years after the date of the enactment of this Act, the Secretary shall prescribe a final motor vehicle safety standard based on the results of the research under paragraph (1).</text></paragraph></subsection><subsection id="H5AC03E32754049318D76294C3499F3E4"><enum>(f)</enum><header>Limousine inspection disclosure</header><paragraph commented="no" id="HEB9038A2B4D5480987EEF4C43DFB6CEA"><enum>(1)</enum><header>In general</header><text>A limousine operator may not introduce a limousine into interstate commerce unless the limousine operator has prominently disclosed in a clear and conspicuous notice, including on the website of the operator if the operator has a website, the following:</text><subparagraph commented="no" id="HC77766470C8E4463BDA9CE4778B1BB30"><enum>(A)</enum><text display-inline="yes-display-inline">The date of the most recent inspection of the limousine required under State or Federal law.</text></subparagraph><subparagraph commented="no" id="H7D4DDCB906024C1E9B0321C67F666C42"><enum>(B)</enum><text>The results of the inspection.</text></subparagraph><subparagraph commented="no" id="HD290A67CE27D455795395A91849EAE0B"><enum>(C)</enum><text>Any corrective action taken by the limousine operator to ensure the limousine passed inspection.</text></subparagraph></paragraph><paragraph id="HF4C1DC8EBF414871BA3DC282E50AD015"><enum>(2)</enum><header>Federal Trade Commission enforcement</header><text>The Federal Trade Commission shall enforce this subsection in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.) were incorporated into and made a part of this subsection. Any person who violates this subsection shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.).</text></paragraph><paragraph id="HDC76FF99DC954A1589AB008DDEC7BA0A"><enum>(3)</enum><header>Savings provision</header><text>Nothing in this subsection shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</text></paragraph><paragraph id="HD7A7DBEC41784C82833DE8E80B0D2A1A"><enum>(4)</enum><header>Effective date</header><text>This subsection shall take effect 180 days after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H335A6A112A814A128E22F3A1E04E9330"><enum>(g)</enum><header>Event data recorders for limousines</header><paragraph id="H9EB3CBA6A03A4D478C2B2C6838B94D7B"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary shall prescribe a final motor vehicle safety standard requiring the use of event data recorders for limousines.</text></paragraph><paragraph id="H206829F8815C4894AE587AFDED31364A"><enum>(2)</enum><header>Privacy protections</header><text>Any standard prescribed under paragraph (1) pertaining to event data recorder information shall be consistent with the collection and sharing requirements under the FAST Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>) and any other applicable law.</text></paragraph></subsection><subsection id="H37823B7804B34ECFA5D61ABD021B2390"><enum>(h)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="H693A525A548E497DA7F1FE3D8FE3846D"><enum>(1)</enum><header>Event data recorder</header><text>The term <quote>event data recorder</quote> has the meaning given such term in section 563.5 of title 49, Code of Federal Regulations (or any successor regulation).</text></paragraph><paragraph id="H63B39FF4D0F0440E9002B99856373F47"><enum>(2)</enum><header>Limousine</header><text>The term <quote>limousine</quote> has the meaning given such term in section 30129 of title 49, United States Code, as added by this section.</text></paragraph><paragraph id="H4D3FD2FF29AD41008FFB4DF8EEFA20F6"><enum>(3)</enum><header>Limousine operator</header><text display-inline="yes-display-inline">The term <quote>limousine operator</quote> has the meaning given such term in section 30129 of title 49, United States Code, as added by this section.</text></paragraph><paragraph id="HCFE4D23CB51C4AD0A9677D45276041E9"><enum>(4)</enum><header>Limousine remodeler</header><text display-inline="yes-display-inline">The term <quote>limousine remodeler</quote> has the meaning given such term in section 30129 of title 49, United States Code, as added by this section.</text></paragraph><paragraph id="H2F934DC5F18E48E2B029D1F933D557F4"><enum>(5)</enum><header>Motor vehicle</header><text>The term <quote>motor vehicle</quote> has the meaning given such term in section 30102(a) of title 49, United States Code.</text></paragraph><paragraph id="H5016FB34EA7242F29DD3B86D67956389"><enum>(6)</enum><header>Motor vehicle safety standard</header><text>The term <quote>motor vehicle safety standard</quote> has the meaning given such term in section 30102(a) of title 49, United States Code.</text></paragraph><paragraph id="H8B697A2BE70941FD88DD921ACA35C1FD"><enum>(7)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Transportation.</text></paragraph><paragraph commented="no" id="H110970D454174D219E703AB4CDF14970"><enum>(8)</enum><header>State</header><text>The term <quote>State</quote> has the meaning given such term in section 30102(a) of title 49, United States Code.</text></paragraph></subsection></section></legis-body></bill>
