<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1517</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210429">April 29, 2021</action-date><action-desc><sponsor name-id="S322">Mr. Merkley</sponsor> (for himself, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, and <cosponsor name-id="S247">Mr. Wyden</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the use of funds for the operation or construction of family detention centers, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Freedom for Families Act</short-title></quote>.</text></section><section id="id714387C0A7E04494B75ED9FA8346347B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings: </text><paragraph id="id636d73c357074549b33f138ce0bb4a13"><enum>(1)</enum><text>The Federal Government has intentionally separated and detained families seeking asylum in the United States purportedly to deter other foreign nationals from coming to the United States in the future. Such method of deterrence is ineffective, contrary to human rights norms, and likely violates United States and international law.</text></paragraph><paragraph id="id3850668558B14AD893BE2390601BC321"><enum>(2)</enum><text>On September 7, 2018, the Secretary of Homeland Security issued a proposed rule entitled <quote>Apprehension, Processing, Care, and Custody of Alien Minors and Unaccompanied Alien Children</quote> (83 Fed. Reg. 45486 (September 7, 2018)) that attempted to circumvent a 1997 court agreement commonly known as the <quote>Flores Settlement Agreement</quote> to undermine current legal protections for children and families and increase family detention.</text></paragraph><paragraph id="id964c56e40592489e9c7f3754417809d6"><enum>(3)</enum><text>Detaining families in family residential centers can have long-term consequences on children, such as—</text><subparagraph id="id4965F7B7104842919A0ACDD8F5E6C8D3"><enum>(A)</enum><text>difficulty regulating emotions, achieving developmental milestones, and forming healthy relationships;</text></subparagraph><subparagraph id="id97901B3A448B4F1AB19F3CC28F454E55"><enum>(B)</enum><text>increased rates of anxiety, depression, and post-traumatic stress disorder; and</text></subparagraph><subparagraph id="id8B86C36528414CEEA318F758A5BFB0B0"><enum>(C)</enum><text>heightened risks of suicide and self-harm.</text></subparagraph></paragraph><paragraph id="id27f20fa6724f409d95ee20f2d97a2b6a"><enum>(4)</enum><text>When family units are placed in family detention facilities—</text><subparagraph id="idD387EFB4AC87434A87B3EE9CFCC0206C"><enum>(A)</enum><text>family members experience feelings of isolation and increased stress;</text></subparagraph><subparagraph id="id0876DAAAFBAE40618A9B69A288C0ECCC"><enum>(B)</enum><text>the ability of the parents to care for their children is compromised by the constraints of detention; and</text></subparagraph><subparagraph id="id61876E8BEEFC419EB82174BEDEF3EA21"><enum>(C)</enum><text>the detention setting creates barriers to—</text><clause id="idC2D9B5AF13E54193AEA081C836D46903"><enum>(i)</enum><text>accessing counsel and legal services; and</text></clause><clause id="id996731A452B04CB18EF56138A44F4C59"><enum>(ii)</enum><text>successfully obtaining relief from removal.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe625f343d1e4406b59bd7e9b01a138c"><enum>(5)</enum><text>Nondetention-based practices, such as family case management and community-based programs, are effective and humane alternatives to family detention.</text></paragraph></section><section id="idDCEF7960C3C040D8834815F91017226B"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idE7B615B91AB84E43BBAB548FF0E2B6ED"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idD24D40BE983544A89571D2484A77BF57"><enum>(A)</enum><text>the Committee on the Judiciary and the Committee on Appropriations of the Senate; and</text></subparagraph><subparagraph id="idAD8FF66B34894D219E9E2B254D968E13"><enum>(B)</enum><text>the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id0AAD6B3D234D4F828A53D722E35A345C"><enum>(2)</enum><header>Detain</header><text>With respect to an individual, the term <term>detain</term> means to compel an individual to stay in a location from which the individual cannot leave on his or her own free will.</text></paragraph><paragraph id="idE571225CC6C04F90A56B49071D92C19F"><enum>(3)</enum><header>Family residential center</header><text>The term <term>family residential center</term> means a facility that detains 1 or more noncitizen families and that is directly operated by U.S. Immigration and Customs Enforcement or by a governmental or nongovernmental contractor for U.S. Immigration and Customs Enforcement. </text></paragraph><paragraph id="idC64749104A1B474BA8A711E163E17170"><enum>(4)</enum><header>Noncitizen</header><text>The term <term>noncitizen</term> means an individual who is not a citizen or national of the United States.</text></paragraph><paragraph id="id664952149412477F81267C6D91AAD3FC"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section><section id="id7E629A855B924DBF8B37F0952F04C81B"><enum>4.</enum><header>Prohibition on use of funds for family detention centers</header><subsection id="idEBF9CE76A3314D0FA8F07B46FF787DC6"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, none of the amounts made available after the date of the enactment of this Act for any fiscal year may be obligated or expended to operate or construct a family residential center, whether directly operated by U.S. Immigration and Customs Enforcement or by another governmental or nongovernmental contractor.</text></subsection><subsection id="id93FD3CAFAE704462B5E729F829162F09"><enum>(b)</enum><header>Previously authorized expenditures</header><paragraph id="idAAF5FDD6A0BE46BA9FBE16E4737DF6F1"><enum>(1)</enum><header>In general</header><text>Beginning on the date that is 30 days after the date of the enactment of this Act, none of the amounts made available before such date of enactment for the purpose of operating or constructing a family residential center may be used for such purpose.</text></paragraph><paragraph id="idFC7F617F915344E3AA5699452449C5E2"><enum>(2)</enum><header>Prohibition on transfer</header><text>None of the amounts made available before the date of the enactment of this Act may be reprogrammed or transferred for the purpose of operating or constructing a family residential center.</text></paragraph></subsection><subsection id="id34F39A48AD4E4BFD9FBA6D250AF76151"><enum>(c)</enum><header>Alternatives to detention</header><paragraph id="id15ba07a948ca42ea9c1980ab2acd4499"><enum>(1)</enum><header>Transfer of funds</header><text>Amounts obligated to operate a family residential center as of the date of the enactment of this Act shall be transferred for the implementation and development of appropriate community-based nondetention programs consistent with international best practices for noncitizen families.</text></paragraph><paragraph id="id1f456ec196884ae98afec5412d107f16"><enum>(2)</enum><header>Nonprofit entity contracting partner</header><subparagraph id="idbabc99b060fe4f01814a399fb9a90699"><enum>(A)</enum><header>In general</header><text>The Secretary shall contract with 1 or more community-based qualified nonprofit service providers that have the trust of their communities for the operation of appropriate community-based nondetention programs.</text></subparagraph><subparagraph id="idDDD7607ADC114FF4978F3D57736B16B8"><enum>(B)</enum><header>Limitation on individuals who may serve as designees</header><text>The Secretary may only designate the responsibility under subparagraph (A) to an individual employed by the Office of the Secretary. </text></subparagraph></paragraph><paragraph id="id2C5DE70804E64F4CAD463868A43F5A6D"><enum>(3)</enum><header>Participation</header><text>A noncitizen family entering the United States that is apprehended by the Secretary may be placed in a nondetention program under this subsection if the Secretary makes an individualized determination that participation in the program will facilitate the family's compliance with the immigration laws (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)). </text></paragraph><paragraph id="idC0916CD662EC41A7883D1CE9FD189F08"><enum>(4)</enum><header>Legal orientation</header><text>To facilitate participant compliance with legal requirements, a nondetention program under this subsection shall include—</text><subparagraph id="id862794B625B3433EB74F69BAA7E44A85"><enum>(A)</enum><text>a legal orientation for each participant in the program; and</text></subparagraph><subparagraph id="id0A76F45DD2F446F7AAC81B1175D9A6F1"><enum>(B)</enum><text>meaningful access to counsel. </text></subparagraph></paragraph><paragraph id="idD59096A408BA48F09D765D84682F5518"><enum>(5)</enum><header>Case management training</header><subparagraph id="id581BA99E31C349FABABA18D27F5F879D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide case management training for all personnel of a nondetention program under this subsection, including personnel of—</text><clause id="idEF3A864145624E74972666DE45EB5B56"><enum>(i)</enum><text display-inline="yes-display-inline">the Department of Homeland Security; and</text></clause><clause id="id7F5C149D69C34BE08716368267E7BA66"><enum>(ii)</enum><text display-inline="yes-display-inline">the nonprofit entity contracted under paragraph (2).</text></clause></subparagraph><subparagraph id="id142f7e51e01f4c3e95011a0d21df856e"><enum>(B)</enum><header>Best practices</header><text>The training under subparagraph (A) shall—</text><clause id="id7E2D299078654470A2F28CCE1509C87E"><enum>(i)</enum><text>be based on international and social welfare best practices relating to immigration and refugee case management; and</text></clause><clause id="id519A4065CDD54DD3A400289A98123908"><enum>(ii)</enum><text>include consultation with civil society experts with expertise in case management.</text></clause></subparagraph></paragraph></subsection><subsection id="id8cbfdff1be91481c96ad0957f8413cb4"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed to endorse the separation of noncitizen families who enter the United States at or between ports of entry.</text></subsection></section><section id="id8B77065C594E4E3295787FDB3B237A67"><enum>5.</enum><header>Feasibility review of transferring Alternatives to Detention program</header><text display-inline="no-display-inline"> The Secretary shall review the feasibility of transferring case management programs out of the purview of U.S. Immigration and Customs Enforcement and the Department of Homeland Security. </text></section></legis-body></bill>
