<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 149</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210202">February 2, 2021</action-date><action-desc><sponsor name-id="S385">Ms. Cortez Masto</sponsor> (for herself and <cosponsor name-id="S373">Mr. Cassidy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XI of the Social Security Act to provide Secretarial authority to temporarily waive or modify application of certain Medicare requirements with respect to ambulance services furnished during certain emergency periods.</official-title></form><legis-body><section id="H70C971A5A6974495A4F1E0B3F56E0406" section-type="section-one"><enum>1.</enum><header>Secretarial authority to temporarily waive or modify application of certain Medicare requirements with respect to ambulance services furnished during certain emergency periods</header><subsection id="HE18B31453CC24FF7B5EAC2A2D2E74610"><enum>(a)</enum><header>Waiver authority</header><text>Section 1135(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(b)</external-xref>) is amended—</text><paragraph id="idF432CB56039E4B72A61390F4E6A68B0B"><enum>(1)</enum><text>in the first sentence—</text><subparagraph id="HAC5EE9C1EFFF463E88883D7A4C2B1F04"><enum>(A)</enum><text>in paragraph (7), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HF8A1AF70C92D47A3895F05FFBA685946"><enum>(B)</enum><text>in paragraph (8), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H193E8BFD54764E6EA216A778FA7D65B0" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>by inserting after paragraph (8) the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9F529633CB67415FBB97E36BEFE5C33B"><paragraph display-inline="no-display-inline" commented="no" id="idEFB28459B511478BAD1F9D5C67A3D5C3"><enum>(9)</enum><text>any requirement under section 1861(s)(7) or section 1834(l) that an ambulance service include the transport of an individual to the extent necessary to allow payment for ground ambulance services furnished in response to a 911 call (or the equivalent in areas without a 911 call system) in cases in which an individual would have been transported to a destination permitted under Medicare regulations (as described in section 410.40 to title 42, Code of Federal Regulations (or successor regulations)) but such transport did not occur as a result of community-wide emergency medical service (EMS) protocols due to the public health emergency described in subsection (g)(1)(B).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idFD5A447567C24206BE472AD63EE5F5E6"><enum>(2)</enum><text>in the flush matter at the end, by adding at the end the following: <quote>Ground ambulance services for which payment is made pursuant to paragraph (9) shall be paid at the base rate that would have been paid under the fee schedule established under 1834(l) (excluding any mileage payment) if the individual had been so transported and, with respect to ambulance services furnished by a critical access hospital or an entity described in paragraph (8) of such section, at the amount that otherwise would be paid under such paragraph.</quote>.</text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id66105029039B4B7590FC89364F0E2513"><enum>(b)</enum><header>Emergency period exception</header><text>Section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>) is amended, in the matter preceding clause (i), by striking <quote>subsection (b)(8)</quote> and inserting <quote>paragraphs (8) and (9) of subsection (b)</quote>.</text></subsection></section></legis-body></bill>
