which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Administrator of the Small Business Administration to establish a forgivable loan program for remote recreational businesses, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HCF17B58E02CA4D22BC8DF1764FCBFF54"><section section-type="section-one" id="H07FF0AF8C448420AAB30303C34211F08"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Remote Recreational Small Business Interruption Program Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HD2DF627D904F4E27B19A5B3245747CE4"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HD0891F4F5F97471DB47DA6C8223EFC26"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text></paragraph><paragraph id="H6D88C0B43BBE4367B319ADA289BD1FF5"><enum>(2)</enum><header>Remote recreational business</header><text display-inline="yes-display-inline">The term <term>remote recreational business</term> means a business in the contiguous United States that is—</text><subparagraph id="H7ED4823B4FAE4965A027ED9E9EC48170"><enum>(A)</enum><text display-inline="yes-display-inline">a small business concern (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)) operating in the recreational industry;</text></subparagraph><subparagraph id="H75D0A2FD3EB44F98A13BEC483068DF23"><enum>(B)</enum><text display-inline="yes-display-inline">located within 75 miles of the United States and Canadian border; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAA4F7F5654CF43F99BA0050D11802B7E"><enum>(C)</enum><text display-inline="yes-display-inline">only accessible by land via Canada. </text></subparagraph></paragraph></section><section id="H6F0418291DF549B2B7243232DA7B7F5C"><enum>3.</enum><header>Forgivable loan program for remote recreational businesses</header><subsection id="H3DBDC2D92E8E42A0AA7CEAFFB1362B72"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall establish a program to make forgivable loans available to remote recreational businesses that experienced a loss in revenue that is greater than 50 percent during the period beginning on March 1, 2020 and ending on July 1, 2020 as compared with the same period during 2019.</text></subsection><subsection id="HF8CA9B5E14F74EE5ABF0AF47E5527C2A"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible for a forgivable loan under subsection (a), a remote recreational business shall—</text><paragraph id="H7FAAFA3148724102A47D78005FC14184"><enum>(1)</enum><text display-inline="yes-display-inline">have been in operation on March 1, 2020; and</text></paragraph><paragraph id="H34459675EB6A41109C7DB1FAE33CA051"><enum>(2)</enum><text display-inline="yes-display-inline">show that the closure of the United States and Canadian border restricted the ability of American customers to access the location of the remote recreational business.</text></paragraph></subsection><subsection id="H63D58B90609E4A00AFC26C8CEA5B40D0"><enum>(c)</enum><header>Loan amount</header><text display-inline="yes-display-inline">The maximum loan amount under subsection (a) shall be equal to 75 percent of the gross annual receipts for the remote recreational business for fiscal year 2019.</text></subsection><subsection id="HA931FA4143CD4D18B3EC513BEEF17F75"><enum>(d)</enum><header>Forgiveness</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall forgive 100 percent of the value of a loan made to a remote recreational business under subsection (a) less the amount the remote recreational business received from—</text><paragraph id="HADAC7F1E1C104E32BC01BF72C1D71A91"><enum>(1)</enum><text>any other loan forgiveness program, including any program established under the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>); or</text></paragraph><paragraph id="H752DACB430ED4145B08538C2D5781022"><enum>(2)</enum><text>an advance under section 1110 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
