<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>World Press Freedom Protection and Reciprocity Act</short-title></quote>.</text></section> <section id="ida7912e076c4a4dda9a9ff891a28acf80"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="id89c7f056f51441f98a9f57c6083ddaaa"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="id16385E06B4AF46D0A8AC8985F81711FF"><enum>(A)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>; and</text></subparagraph>
<subparagraph id="id2280DC7CD9FC4F428353EABD25F2F56F"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>.</text></subparagraph></paragraph> <paragraph id="ideadc6857ccef42fe9c5d7a647d0ea120"><enum>(2)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means an individual who is not—</text>
<subparagraph id="id1aaac41576b2463c91f50f1f7d7e140a"><enum>(A)</enum><text>a United States citizen; or</text></subparagraph> <subparagraph id="idde52247ccc794cf899b59acbd9438268"><enum>(B)</enum><text>an alien lawfully admitted for permanent residence to the United States.</text></subparagraph></paragraph>
<paragraph id="idfd7b0e7e77bb4857bca4d60140727666"><enum>(3)</enum><header>Internationally-recognized right to freedom of expression</header><text>The term <term>internationally-recognized right to freedom of expression</term> are the rights set forth in—</text> <subparagraph id="id23DA60618AE24E538A00A98C3F08C5CF"><enum>(A)</enum><text>Article 19 of the Universal Declaration of Human Rights, done at Paris December 10, 1948; and </text></subparagraph>
<subparagraph id="id5F03B89BEC4F47D09A8768CD2E8B9003"><enum>(B)</enum><text>Article 19 of the International Covenant on Civil and Political Rights, done at New York December 19, 1966.</text></subparagraph></paragraph> <paragraph id="id0283dd4dad394db8ba437450fd47e1f0"><enum>(4)</enum><header>Major non-NATO ally</header><text>The term <term>major non-NATO ally</term> means a country designated by the President as a major non-NATO ally pursuant to section 517 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2321k">22 U.S.C. 2321k</external-xref>).</text></paragraph></section>
<section id="idb63d470e59a2487a96697ef078f38e2d"><enum>3.</enum><header>Statement of policy</header>
<subsection id="id09c72f09dd444c3b8477fd25e2b90b09"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph id="id5cad5daa9b874d738bccb0b80e07b871"><enum>(1)</enum><text>Freedom of the press is a critical component of democratic governance that enhances transparency, accountability, and participation of civil society. </text></paragraph>
<paragraph id="idF71A7C5C9A51441B9E66EF3AB16B6B2B"><enum>(2)</enum><text>United States Government efforts to protect and expand freedom of the press and free expression strengthen the national interests of the United States by— </text> <subparagraph id="id762661768CA24A4A82637B5919F86A46"><enum>(A)</enum><text>supporting democracy;</text></subparagraph>
<subparagraph id="id6B87881C315247E18B789047C118D5E4"><enum>(B)</enum><text>promoting good governance and public health;</text></subparagraph> <subparagraph id="id04532D65C15247B8924CC466FCE8ED4B"><enum>(C)</enum><text>mitigating conflict; and </text></subparagraph>
<subparagraph id="id0840B09B022A43E0ADECC233A433559A"><enum>(D)</enum><text>encouraging transparency and civil society development around the world.</text></subparagraph></paragraph> <paragraph id="id5ea92fc78fb14312a62d822d3161e43d"><enum>(3)</enum><text>Journalists, media personnel, and other individuals and organizations around the world that receive and impart information and ideas face increasing restrictions, threats, censorship, arbitrary detention, torture, enforced disappearances, extrajudicial killings, and other violence for exercising their internationally-recognized right to freedom of expression.</text></paragraph>
<paragraph id="id81f51580ceee4457b48d0973b6418a54"><enum>(4)</enum><text>Impunity for attacks on journalists, bloggers, and media personnel is an acute problem around the world and a primary challenge to protecting freedom of expression and freedom of the press.</text></paragraph> <paragraph id="idb58b5a12b95b43e7991a869913b4eb07"><enum>(5)</enum><text>According to research and press freedom rankings issued annually by Freedom House, the Committee to Protect Journalists, and Reporters Without Borders, some of the countries with the most restrictive media and information environments include Cuba, Djibouti, Eritrea, Iran, Laos, Myanmar, North Korea, the Philippines, Saudi Arabia, Syria, Turkmenistan, and Vietnam. </text></paragraph>
<paragraph id="idbacce52df5654f128a4ca0543db8df14"><enum>(6)</enum><text>Since a failed coup attempt in 2016, the Government of the Republic of Turkey has used terrorism and national security laws to shutter hundreds of media outlets and jail dozens of journalists, compounding the effects of more than a decade of expanding ruling party influence over the ownership of mainstream media in the country at the expense of independent outlets. </text></paragraph> <paragraph id="id7d4db896b8a54d9e8edb1af4c83d5cd2"><enum>(7)</enum><text>The People’s Republic of China, which maintains one of the most restrictive media and information environments in the world, seeks to control free speech inside and outside of China through—</text>
<subparagraph id="idC2A3EB723F374EABAB7D68EFF598FBA1"><enum>(A)</enum><text>censorship;</text></subparagraph> <subparagraph id="id1DFFDB4D698743288518B4AD2FBFD97B"><enum>(B)</enum><text>onerous media organization registration requirements;</text></subparagraph>
<subparagraph id="id404FFBB618144BE78BB9BEDF376F19A1"><enum>(C)</enum><text>harassment and retaliation;</text></subparagraph> <subparagraph id="id590C7C41A412472AB7C5B84AA7E47C1E"><enum>(D)</enum><text>imprisonment;</text></subparagraph>
<subparagraph id="id70E25CEFA3A74863BD6FAF50FD3AB9A5"><enum>(E)</enum><text>conditioning of press credential renewals for all journalists and visa issuance for foreign journalists on <quote>positive</quote> coverage of China; and </text></subparagraph> <subparagraph id="id0CB5CD55CCC2400A80848FD2854B019B"><enum>(F)</enum><text>the operation of a digital surveillance system so pervasive that both routine and sensitive reporting activities and many aspects of daily life are subject to government monitoring.</text></subparagraph></paragraph>
<paragraph id="id803AF229500B46F99F60769B5990B22C"><enum>(8)</enum><text>The Russian Federation has continued to use sophisticated tools to block and control information online and employ draconian laws to pressure independent media.</text></paragraph> <paragraph id="id2ea85d7c7aeb4b30ad52e11fe7d5398d"><enum>(9)</enum><text>The expansion and export of new technologies used for censorship and surveillance—</text>
<subparagraph id="id166907A542FC432795B9A3212E7EE8F2"><enum>(A)</enum><text>represent a notable threat to human rights, including press freedoms, transparency, and democratic governance globally; and </text></subparagraph> <subparagraph id="id10A7A98788CA44C1939DFB211BB58772"><enum>(B)</enum><text>constitute a critical challenge to United States national interests.</text></subparagraph></paragraph>
<paragraph id="id5c1a3df57027404d8e5aa9d172c0163a"><enum>(10)</enum><text>Other countries’ restrictions on the activities of United States journalists and media personnel, other countries’ censorship and blocking of websites of United States news and media corporations, and other restrictions on the cross-border flow of information—</text> <subparagraph id="idbaf280a458ec49e39deb352482319d38"><enum>(A)</enum><text>damage the competitiveness of United States corporations;</text></subparagraph>
<subparagraph id="idCE97BBB48DC3439F90A95A27D7FFA695"><enum>(B)</enum><text>limit United States access to information critical for United States investors, consumers, and others making market and financial decisions; and</text></subparagraph> <subparagraph id="idaeee03de1e734a39b99abdf52008ef49"><enum>(C)</enum><text>should be considered a restriction of trade and the creation of an unfair competitive advantage benefitting foreign government-controlled news organizations and other foreign news and media corporations.</text></subparagraph></paragraph></subsection>
<subsection id="id51af2266fa784f2d8604cee9d9a667b3"><enum>(b)</enum><header>Policy statement</header><text>It is the policy of the United States—</text> <paragraph id="id226665592fc14f469082116966a9048e"><enum>(1)</enum><text>to advocate for detained and targeted journalists and other media personnel overseas, including citizen journalists and bloggers;</text></paragraph>
<paragraph id="idc5e181fe42284774ac3cc24da787311b"><enum>(2)</enum><text>to call on governments, in both bilateral discussions and through multilateral organizations—</text> <subparagraph id="idC347DC2961694816A16CD69BD1500BB6"><enum>(A)</enum><text>to end restrictions on the internationally-recognized right to freedom of expression; and </text></subparagraph>
<subparagraph id="idC1227D4F38B6451CAD9EBA0F14D798F6"><enum>(B)</enum><text>to abide by international commitments set forth in—</text> <clause id="id1961975F3E9B4469B7099AA7DD023463"><enum>(i)</enum><text>Article 19 of the Universal Declaration of Human Rights, done at Paris December 10, 1948; and </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id400E2F03E3454353845871EB640A7ED4"><enum>(ii)</enum><text>Article 19 of the International Covenant on Civil and Political Rights, done at New York December 19, 1966;</text></clause></subparagraph></paragraph> <paragraph id="id7690f8b50bce4d01a95b53291d6cc1de"><enum>(3)</enum><text>to urge foreign governments—</text>
<subparagraph id="idE055857AF213473EA0D10E89860C4625"><enum>(A)</enum><text>to transparently investigate and bring to justice the perpetrators of attacks against journalists, bloggers, and other media personnel; and</text></subparagraph> <subparagraph id="idC956E15C55714EDDB1A708201A01091E"><enum>(B)</enum><text>to halt efforts to censor or block access to news from United States journalists and media personnel and the websites of United States news and media organizations;</text></subparagraph></paragraph>
<paragraph id="id78df9effe1b84646bab556f4f005a054"><enum>(4)</enum><text>to highlight threats against freedom of the press in the Department of State’s Annual Country Reports on Human Rights Practices, as required under section 116(d)(12) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n(d)(12)</external-xref>), and other public statements by senior Department of State officials;</text></paragraph> <paragraph id="idf0d09a9253aa48b486ee83fa9e8aad52"><enum>(5)</enum><text>to seek, as part of bilateral diplomatic negotiations globally, conditions for—</text>
<subparagraph id="id3C201207882E4B63AE05FB3001794159"><enum>(A)</enum><text>a free flow of news and information;</text></subparagraph> <subparagraph id="id117FAC5B11984F1AA5DA055E4175555D"><enum>(B)</enum><text>internet freedom; and </text></subparagraph>
<subparagraph id="idA6814924EBCD4E739B11925DB00F2820"><enum>(C)</enum><text>an end to visas restrictions for United States media personnel;</text></subparagraph></paragraph> <paragraph id="id58a7ae3fcff84a9da9d8039983a08ed8"><enum>(6)</enum><text>to link expansion of the free flow of news and information with ongoing and future trade agreements and other bilateral agreements and communiques by seeking language eliminating—</text>
<subparagraph id="idC2098A0D9BC040DA82EB8866DD2AE3FC"><enum>(A)</enum><text>all limitations on market access for news agency services; and </text></subparagraph> <subparagraph id="id04AD0E74ACCE4DF6AE752630C6FA0FD1"><enum>(B)</enum><text>any restrictions on cross-border data flows involving journalists and the media, including data flowing through the internet;</text></subparagraph></paragraph>
<paragraph id="idaee0001fc2ef4729a606715256218180"><enum>(7)</enum><text>to ensure that pursuing bilateral relationships with foreign governments, particularly governments with restrictive press and information environments, based on the principles of reciprocity across many sectors, including economic, diplomatic, educational, religious, and in the free flow of news and information; and</text></paragraph> <paragraph id="id75938d44f51a443baf5c418e2173543d"><enum>(8)</enum><text>to clearly differentiate, in official statements, media communications, and messaging, between the citizens of a country and the government of such country.</text></paragraph></subsection></section>
<section id="id95d474886e3740a8963d398a8af79248"><enum>4.</enum><header>Statement of policy regarding protection of foreign journalists and other media personnel globally</header><text display-inline="no-display-inline">It is the policy of the United States to consider foreign government officials who are responsible for, are complicit in, or have directly or indirectly engaged in severe restrictions of the internationally-recognized right to freedom of expression, such as arbitrary detention, imprisonment, enforced disappearance, torture, extrajudicial killing, and other substantial threats to the life and liberty of a person, as having committed gross violations of internationally recognized human rights for purposes of imposing sanctions with respect to such officials under—</text> <paragraph id="id8d50a1186105449496c16306f4b2942e"><enum>(1)</enum><text>the Global Magnitsky Human Rights Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note; subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>); and </text></paragraph>
<paragraph id="idb4c05f87a4214055838f090194f62323"><enum>(2)</enum><text>section 7031(c) of the <short-title>Department of State, Foreign Operations, and Related Programs Appropriations Act, 2019</short-title> (division F of <external-xref legal-doc="public-law" parsable-cite="pl/116/6">Public Law 116–6</external-xref>).</text></paragraph></section> <section id="ide4afb734cf284cdc87c71953acb7328d"><enum>5.</enum><header>Plan to promote reciprocal access for United States news and media organizations</header> <subsection id="idfcc87248582348fea7bf3cd80110f202"><enum>(a)</enum><header>Plan</header> <paragraph id="id61edfe92b67e4cb8aacb0ff789750401"><enum>(1)</enum><header>In general</header><text>The President shall establish a plan for negotiating access for United States news and media companies and their employees globally and work to enhance reciprocity given to news and media companies operating in the United States.</text></paragraph>
<paragraph id="idaba421fbf62a4210b13c57e11bbc74ad"><enum>(2)</enum><header>Report</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of State shall submit a report to the appropriate congressional committees that summarizes the plan required under paragraph (1).</text></paragraph></subsection> <subsection id="id937b9ae9a08c4dcdb4018002fd8adc41"><enum>(b)</enum><header>Policy statements</header> <paragraph id="id71198e9149fe4ffaaf579feaea52804c"><enum>(1)</enum><header>Findings</header><text>Congress finds the following:</text>
<subparagraph id="idb7e2e6bd36eb4f96b9ee7c30f123a6b4"><enum>(A)</enum><text>United States news and media organizations, including United States-based media organizations, and information portals are blocked or censored by certain foreign governments, while the United States market remains open to websites of foreign news and media organizations and information portals, including state-owned propaganda organizations.</text></subparagraph> <subparagraph id="id450bfdfeec2340e0a693dea10e0ac16f"><enum>(B)</enum><text>The stark lack of reciprocity in market access for news and media organizations and country access for journalists and media personnel—</text>
<clause id="id3229FFB19B184681B2D499768E177B4A"><enum>(i)</enum><text>limits constructive contacts between the United States and the world; and </text></clause> <clause id="id4646BAA7FC2340FEB4B222A1A8481E18"><enum>(ii)</enum><text>allows some foreign governments unbalanced influence over their people’s views of the United States and perceptions in the United States of their policies and programs.</text></clause></subparagraph>
<subparagraph id="id584d0a5c7a22488b8dbd3dc55c559ddc"><enum>(C)</enum><text>Foreign governments with a sizable media and information footprint in the United States have a distinct interest in maintaining such footprint.</text></subparagraph></paragraph> <paragraph id="id647B358A4A9543B8869167466FF81087"><enum>(2)</enum><header>Sense of congress</header><text>It is the sense of Congress that, in the interest of increasing reciprocal access for United States journalists and news and media organizations and expanding press freedoms globally, the President should proactively pursue bilateral agreements with governments referred to in paragraph (1) to ensure reciprocal access by both countries. </text></paragraph></subsection></section>
<section id="id7E0E6F53B864455A87408126C91618D4"><enum>6.</enum><header>Authorization of imposition of sanctions</header>
<subsection id="idF03BC538B49E4621B133010B326257FE"><enum>(a)</enum><header>In general</header><text>The President may impose the sanctions described in subsection (b) with respect to any foreign person the President determines, based on credible evidence—</text> <paragraph id="id1000B8134D504FD0A8859E95E0B97885"><enum>(1)</enum><text>is responsible for the jailing, killing, or torture of journalists or significant efforts to harass, restrict the activities of, terminate the visas of, or threaten the safety of United States journalists and media personnel;</text></paragraph>
<paragraph id="id433167e0f9e64216b20af9fd2e301a5a"><enum>(2)</enum><text>acted as an agent, or on behalf, of a foreign person in a matter relating to an activity described in paragraph (1); or</text></paragraph> <paragraph id="id18d0a50e225f4963b625681cc294b63e"><enum>(3)</enum><text>is a government official, or a senior associate of such an official, that is responsible for, or complicit in, ordering, controlling, or otherwise directing an activity described in paragraph (1).</text></paragraph></subsection>
<subsection id="id8EC9F7DCDCD2486EB973F3F66E0D3906"><enum>(b)</enum><header>Sanctions described</header><text>A foreign person described in subsection (a) who is an individual—</text> <paragraph id="id0990A664ED724E47BB3A3F23E116C719"><enum>(1)</enum><text>shall be ineligible to receive a visa from the United States, enter the United States, or be admitted to the United States; and</text></paragraph>
<paragraph id="idB57A39026904498B90A2205E7EC06320"><enum>(2)</enum><text>if such individual has been issued a visa or other documentation by the United States that provides any immigration benefit, shall have such visa or other documentation revoked, in accordance with section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>).</text></paragraph></subsection> <subsection id="idB2D84323C2EE4906953E51DBF55D3835"><enum>(c)</enum><header>Termination of sanctions</header> <paragraph id="idF94E0CE023134E558B901EFFBC99D612"><enum>(1)</enum><header>In general</header><text>The President may terminate the application of sanctions under subsection (b) with respect to an individual if the President makes a determination that—</text>
<subparagraph id="id648E3BEDD8C54B05BD971220482812C6"><enum>(A)</enum><text>credible information exists that the individual did not engage in the activity for which the sanctions were imposed;</text></subparagraph> <subparagraph id="id983DD9CDE3DF4B30BCE2888843FE7DCB"><enum>(B)</enum><text>the individual has been prosecuted appropriately for the activity for which the sanctions imposed;</text></subparagraph>
<subparagraph id="id339D9601B43340AAA311B18E6281997F"><enum>(C)</enum><text>the individual has—</text> <clause id="id1EB4AB60152A4993B91DE4548E9EAD24"><enum>(i)</enum><text>credibly demonstrated a significant change in behavior;</text></clause>
<clause id="idEFC6463089A34D47B7186E5C6ACCDA95"><enum>(ii)</enum><text>been subject to an appropriate consequence for the activity for which the sanctions were imposed; and</text></clause> <clause id="id87587522F03A47FFA570FF500E190B32"><enum>(iii)</enum><text>credibly committed to not engage in an activity described in that subsection in the future; or</text></clause></subparagraph>
<subparagraph id="id33AE170AD89E4785A9F6D3815B967431"><enum>(D)</enum><text>the termination of the application of sanctions is in the national security interests of the United States.</text></subparagraph></paragraph> <paragraph id="id106C030F389E4CAB9C3BE5577AE6FC32"><enum>(2)</enum><header>Notification</header><text>Not later than 15 days before the date on which the application of sanctions is terminated under paragraph (1) with respect to an individual, the Secretary of State shall submit a report to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> that describes the justification for such termination.</text></paragraph></subsection>
<subsection id="idFCC4C59BFE134C1D8D120DB4427C0494"><enum>(d)</enum><header>Exception</header><text>Sanctions described in subsection (b) shall not apply to an individual if admitting the individual into the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or any other applicable international obligation of the United States.</text></subsection> <subsection id="id56337B9574794FA3868247E60687ECCF"><enum>(e)</enum><header>Waiver</header><text>The President may waive the application of the sanctions described in subsection (b) with respect to an individual if the President—</text>
<paragraph id="idDDEAEBC8D5714300A646BC906CA33221"><enum>(1)</enum><text>determines that such a waiver is in the national interest of the United States; and</text></paragraph> <paragraph id="idB4A1900BC81C4873B00DCD413F25DCE8"><enum>(2)</enum><text>upon granting such a waiver, submits a report to the committees specified in subsection (c)(2) that—</text>
<subparagraph id="id677EF36DD37C4B5A9188FB2ACD4524FB"><enum>(A)</enum><text>details the evidence and justification for the necessity of the waiver; and</text></subparagraph> <subparagraph id="id8EB95F67165B4741BFB70F8EB6818829"><enum>(B)</enum><text>explains how the waiver relates to the national security of the United States.</text></subparagraph></paragraph></subsection>
<subsection id="id2869951813C843CF90DC844019CC6E59"><enum>(f)</enum><header>Report</header>
<paragraph id="id9E718305AF274E1BB95AB6293D1AEB90"><enum>(1)</enum><header>In general</header><text>Not later than 180 after the date of the enactment of this Act, and annually thereafter for 5 years, the President shall submit a report to the committees referred to in subsection (c)(2) that identifies each individual with respect to which the application of sanctions has been terminated under subsection (c) during the preceding year, including the country of origin of the individual and the dates on which such sanctions were imposed or terminated, as applicable.</text></paragraph> <paragraph id="id6530494C87224AA0A2E59355E3BD48F1"><enum>(2)</enum><header>Form</header><text>The report required under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph>
<paragraph id="id1F044499A8DF4A0494D65768328ECEA1"><enum>(3)</enum><header>Exclusion of personally identifiable information</header><text>The President may not include any personally identifiable information of any United States citizen in a report submitted under paragraph (1).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id3704D8ABF40141BBBF80B27B78BDCD43"><enum>(4)</enum><header>Applicability of privacy act</header><text>Any information obtained by the President to complete a report required under paragraph (1) shall be subject to section 552a of title 5, United States Code (commonly known as the <quote>Privacy Act</quote>). </text></paragraph></subsection></section>
<section id="id7f4b8698c4264e3fa81820df3cedb52f"><enum>7.</enum><header>Clear labeling for informational materials distributed on behalf of foreign missions or foreign principals</header><text display-inline="no-display-inline">Section 4(b) of the Foreign Agents Registration Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/22/614">22 U.S.C. 614(b)</external-xref>) is amended by adding at the end the following: <quote>Informational materials required to be labeled under this subsection that are in the form of prints shall be marked or stamped conspicuously at the top of the first page with a statement, in the language or languages used therein, that sets forth the information required under this subsection.</quote>.</text></section> <section id="idee8b25d6b6d148b29dc61bd52754e69d"><enum>8.</enum><header>Annual country reports on human rights practices</header> <subsection id="id2c4700b829244c93a9a01cd228edd777"><enum>(a)</enum><header>Report relating to economic assistance</header> <paragraph id="idAEA050628EFA41A4B822E1BFB2B4510F"><enum>(1)</enum><header>In general</header><text>Section 116(d) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n(d)</external-xref>) is amended—</text>
<subparagraph id="idDB7119B327A549908B4DA89A6F48B7BA"><enum>(A)</enum><text>in paragraph (11)(C), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="id78C8BAB1C10F4614BEEB01CB2780E6DB"><enum>(B)</enum><text>in paragraph (12)(C)(ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="id99A1BCE7F92D4EE78558F19823A08A3E"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id425d8b56155e4a2eb9d8b9a8bbd0d9c9"> <paragraph id="id29ff9f243a18472a98dcf71e06bd6972"><enum>(13)</enum><text>an assessment of freedom of expression with respect to electronic information in each foreign country, including the extent to which government authorities in each country—</text>
<subparagraph id="idD08B772AFE5841849319E9AD17559419"><enum>(A)</enum><text>attempt to filter, censor, shape, or otherwise block or remove nonviolent expression of political, religious, ideological opinion via the internet, including electronic mail, and the means by which such authorities attempt to block or remove such expression;</text></subparagraph> <subparagraph id="id69805d7746f1451b84d9e1011093fbc4"><enum>(B)</enum><text>have persecuted or otherwise punished an individual or group for the nonviolent expression of political, religious, or ideological opinion via the internet, including electronic mail;</text></subparagraph>
<subparagraph id="idff18609ee2d942ee9797938cd89c4296"><enum>(C)</enum><text>have sought to collect, request, obtain, or disclose personally identifiable information of a person in connection with such person’s nonviolent expression of political, religious, or ideological opinion on a foreign platform, including expression that would be protected by the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights; and</text></subparagraph> <subparagraph id="idcb58d2d44ae7441a9ffa7e76deb581c9"><enum>(D)</enum><text>monitor wire communications and electronic communications without regard to the principles of privacy, human rights, democracy, and rule of law, to the extent that these practices are known.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="idA9C2E30A8F8C4FBDAD227ED2E086664A"><enum>(2)</enum><header>Conforming amendment</header><text>Section 116 of such Act, as amended by paragraph (1), is further amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id3D1A56CA2C2346149FFEC8B94713E08E"> <subsection id="id7F83390ABAB34966BF64426459FADC95"><enum>(h)</enum><header>Consultation requirement</header> <paragraph id="id97c252b5107f4fab999285cbe1f9a02c"><enum>(1)</enum><header>In general</header><text>In compiling data and making assessments under subsection (d)(13), United States diplomatic personnel shall consult with human rights organizations, technology and internet companies, and other appropriate nongovernmental organizations.</text></paragraph>
<paragraph id="id315041b953ed406ab71978193e686397"><enum>(2)</enum><header>Definitions</header><text>In this subsection and in subsection (d)(13)—</text> <subparagraph id="idb875c35a3aa145b793fdfe3d34cf4f17"><enum>(A)</enum><text>the term <term>electronic communication</term> has the meaning given such term in section 2510(12) of title 18, United States Code;</text></subparagraph>
<subparagraph id="id23f6b59d1d75493cad108994cb1db772"><enum>(B)</enum><text>the term <term>internet</term> has the meaning given the term <term>Internet</term> in section 231(e)(3) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(e)(3)</external-xref>);</text></subparagraph> <subparagraph id="id096ba47798994c85a9823a40a2923911"><enum>(C)</enum><text>the term <term>personally identifiable information</term> means data in a form that identifies a specific person; and</text></subparagraph>
<subparagraph id="idafc8fe68aa8c4df396fb72cabb1d3611"><enum>(D)</enum><text>the term <term>wire communication</term> has the meaning given such term in section 2510(1) of title 18, United States Code.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="id2a27cdf13d024d5e9cc224a6dc949b4e"><enum>(b)</enum><header>Report relating to security assistance</header><text>Section 502B(b) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2304">22 U.S.C. 2304(b)</external-xref>) is amended—</text>
<paragraph id="id69d8c1b327c448959aaa77287330188e"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B);</text></paragraph> <paragraph id="idBD5B72EE88C148258038B3A9212FBC4C"><enum>(2)</enum><text>by inserting <quote>(1)</quote> after <quote>(b)</quote>;</text></paragraph>
<paragraph id="idD19B59E10220486BAFD92E148C196056"><enum>(3)</enum><text>by striking <quote>Wherever applicable, such report shall include</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id399F94C11EE345DE8CF2022C15EE3A01"> <paragraph id="idDC61EB5D3E804D789209C4072F503447" indent="up1"><enum>(2)</enum><text>Wherever applicable, each report required under paragraph (1) shall include—</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<paragraph id="id2B190A47032C44F0BCA67F05F06BAECF"><enum>(5)</enum><text>by striking <quote>Act of 1987). <subparagraph id="id44BFF4F3A4B44CCC92BB6C6A83597FA3"><enum>(A)</enum><text>an assessment of the extent to which government authorities in each country attempt to filter, censor, shape, or otherwise block or remove nonviolent expression of political, religious, or ideological opinion via the internet, including electronic mail;</text></subparagraph> <subparagraph id="idA2EAFA6EF81C47FD8801FBACC5FA32CC"><enum>(B)</enum><text>a description of the means by which such authorities attempt to block or remove such expression;</text></subparagraph>
<subparagraph id="idEB1B0269ECA54D03A9C8C0B74605A251"><enum>(C)</enum><text>an assessment of the extent to which government authorities in each country have persecuted or otherwise punished an individual or group for the nonviolent expression of political, religious, or ideological opinion or belief via the internet, including electronic mail;</text></subparagraph> <subparagraph id="id666AC83FC8B343FC94CC2464A050245A"><enum>(D)</enum><text>an assessment of the extent to which government authorities in each country have sought to collect, request, obtain, or disclose personally identifiable information of a person in connection with such person's nonviolent expression of political, religious, or ideological opinion or belief on a foreign platform, including expression that would be protected by the International Covenant on Civil and Political Rights, done at New York December 19, 1966; and</text></subparagraph>
<subparagraph id="id0B0E3675F6334688B7B7406AA0954AF6"><enum>(E)</enum><text>an assessment of the extent to which wire communications and electronic communications are monitored without regard to the principles of privacy, human rights, democracy, and rule of law, to the extent that these practices are known.</text></subparagraph></paragraph> <paragraph indent="up1" id="id6E3B351E333C4CB89A4A8759B54C7AAA"><enum>(8)</enum><text>In determining</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
