which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To impose notice and consent requirements on internet platforms that use algorithms to manipulate the availability of content on the platform.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Data and Algorithm Transparency Agreement Act</short-title></quote> or the <quote><short-title>DATA Act</short-title></quote>.</text></section><section id="id48E3EA5DDDBF4E9A8C52DCE8CE93FA02"><enum>2.</enum><header>Notice and consent requirements for internet platforms that use algorithms to manipulate the availability of platform content</header><subsection id="id67E89C0A1C764303A1BCD5044048A9A0"><enum>(a)</enum><header>In general</header><text>Beginning 1 year after the date of enactment of this Act, any covered platform shall comply with the requirements of subsection (c).</text></subsection><subsection id="id5434986B01F244A0912C8BC7EF72563E"><enum>(b)</enum><header>Definitions</header><text>In this Act: </text><paragraph id="idCF3E7ED5929D4CEFB033DF12F97575D7"><enum>(1)</enum><header>Covered data</header><text>The term <term>covered data</term> means, with respect to an individual, data regarding the habits, traits, preferences, beliefs, or location of the individual.</text></paragraph><paragraph id="id5654C24AFADB488F883842197359CAEE"><enum>(2)</enum><header>Covered platform</header><text>the term <term>covered platform</term> means a public-facing website, internet application, or mobile internet application, including a social network, video sharing service, ad network, mobile operating system, search engine, email service, or internet access service that—</text><subparagraph id="idADF030A2E36E42069B8ABFC79D84F3B0"><enum>(A)</enum><text>has not less than 30,000,000 active monthly users in the United States; and</text></subparagraph><subparagraph id="id1CC7722866484A739FAAE8D4FEFE635D"><enum>(B)</enum><text>uses an algorithm to increase or decrease the availability of content on the website or application.</text></subparagraph></paragraph></subsection><subsection id="id46C79515F4524100894BB6342DABD925"><enum>(c)</enum><header>Requirements</header><paragraph id="id23D01067D7604A4EAB3B35EC8EB3B91C"><enum>(1)</enum><header>No collection of covered data without consent</header><subparagraph id="idD06D8A2E00204E958522F41352F20960"><enum>(A)</enum><header>In general</header><text>A covered platform shall not collect any covered data of an individual without obtaining the individual's express consent for such data collection.</text></subparagraph><subparagraph id="id3380DE88661842F3A2874AE5497A3D94"><enum>(B)</enum><header>Revocation of consent; right to delete</header><text>A covered platform shall—</text><clause id="id987A7E63D4E8442F9D984A895FCA3068"><enum>(i)</enum><text>allow any individual to revoke or withdraw the individual's prior consent to the covered platform collecting the individual's covered data; and</text></clause><clause id="idB39DC9BF122B4520AD8B1CEC627C2E38"><enum>(ii)</enum><text>at the request of an individual, delete any covered data of the individual collected or held by the platform. </text></clause></subparagraph></paragraph><paragraph id="id926A84AC887943539682AD76DE15EADD"><enum>(2)</enum><header>No sale, sharing, or conveyance of data without consent</header><subparagraph id="id94705247451C410BB53933D6B4B4C09F"><enum>(A)</enum><header>In general</header><text>A covered platform shall not sell, share, or otherwise convey to a third party entity any covered data of an individual without obtaining the individual's express consent.</text></subparagraph><subparagraph id="id7FFFF59EC4C24B3D9E651DF134A93024"><enum>(B)</enum><header>Revocation of consent</header><text>A covered platform shall allow any individual to revoke or withdraw the individual's prior consent to any sale, sharing, or conveyance of the individual's covered data.</text></subparagraph></paragraph><paragraph id="id9612C193AA16402D82D87027025C40F4"><enum>(3)</enum><header>Notice of requirements</header><subparagraph id="id0A03FE793D7A44039D21456F42F4315E"><enum>(A)</enum><header>In general</header><text>A covered platform shall provide notice to users of the platform of the requirements described in paragraphs (1) and (2).</text></subparagraph><subparagraph id="idF155DB0C9E4546539AC4C0E6FD256C7C"><enum>(B)</enum><header>Manner of notification</header><text>The notice required under subparagraph (A) shall contain the information described in subparagraph (C) and shall be provided by a covered platform to a user—</text><clause id="id08F2727DB2644F66B9D2C2B2E13ECB57"><enum>(i)</enum><text>in plain language and in a conspicuous manner;</text></clause><clause id="idD7E248FCAF81450892C3D1EAF3072B77"><enum>(ii)</enum><text>in addition to any notice relating to the terms of service of the platform; </text></clause><clause id="id9164A866C82C4597A6541B0BC8E48267"><enum>(iii)</enum><text>each time the user logs in to the platform unless the user affirmatively waives receiving the notice; and</text></clause><clause id="id8521C7D61679453C88C6AF854FB6F918"><enum>(iv)</enum><text>each time the platform modifies its terms of service.</text></clause></subparagraph><subparagraph id="id36179EE6E6DE415BBB74C308C9A8A36A"><enum>(C)</enum><header>Contents of notification</header><text>A notice required under this paragraph shall include the following:</text><clause id="id0A8B60B68396451DBDEDB02E72142505"><enum>(i)</enum><text>With respect to the collection of covered data by a covered platform—</text><subclause id="id0BD9F19A70E24AFEB7EF51EABF533056"><enum>(I)</enum><text>the type of data to be collected; </text></subclause><subclause id="id3F051F92EFA84510BCA0F7AA7154B434"><enum>(II)</enum><text>whether the collection of data will continue beyond the user's immediate use of the covered platform; and</text></subclause><subclause id="idCD88505FA8DD49FF95599046E2B1801E"><enum>(III)</enum><text>how the data will be used by the covered platform.</text></subclause></clause><clause id="id224ADD8D2A4149D89BF43368E62F8B4E"><enum>(ii)</enum><text>With respect to the sale, sharing, or conveyance of covered data by a covered platform—</text><subclause id="idD694082A517141D5A92403D6666E3AA3"><enum>(I)</enum><text>the specific data that will be sold, shared, or otherwise conveyed to a third party entity;</text></subclause><subclause id="idDAF866EFE5614B8184340E8027DEEEE8"><enum>(II)</enum><text>the name of any third party entity to which data will be sold, shared, or otherwise conveyed; and</text></subclause><subclause id="idB5E91EB30431474FABD57BE1C31034BD"><enum>(III)</enum><text>the country of origin of the third party entity to which the data will be sold, shared, or conveyed.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="id2C2081C7B0EB404694CBB1703C9D49C0"><enum>3.</enum><header>Enforcement</header><subsection id="id20DF075425204327A98F9E547D8E6D43"><enum>(a)</enum><header>Enforcement by the Federal Trade Commission</header><paragraph id="id73cd018d539b42a18ef168871714a820"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this Act or a regulation promulgated under this Act shall be treated as an unfair or deceptive act or practice in violation of a rule promulgated under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id82b5c281a1bd44c08fe38db8abbc3117"><enum>(2)</enum><header>Powers of the commission</header><subparagraph id="idaea1f7eeca974eeea0c0a75a7d5886df"><enum>(A)</enum><header>In general</header><text>The Federal Trade Commission shall enforce this Act and any regulation promulgated under this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph id="idbe3dddf21b2d45b0a7dc99362221b80d"><enum>(B)</enum><header>Privileges and immunities</header><text>Any covered entity who violates this Act or a regulation promulgated under this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.).</text></subparagraph></paragraph></subsection><subsection id="id8b9b036eece0413a8bb13d7af9987041" commented="no"><enum>(b)</enum><header>Private right of action</header><paragraph id="id8ec122fd991c4de4bc659ddf2ee5b6b9"><enum>(1)</enum><header>In general</header><text>An individual alleging a violation of this Act may bring a civil action in any court of competent jurisdiction, State or Federal.</text></paragraph><paragraph id="id5f2f3f1271944434bb2335e781980a06"><enum>(2)</enum><header>Injury in fact</header><text>A violation of this Act with respect to the requirements to notify and obtain the express consent of the user before the user’s data may be collected, sold, shared, or otherwise conveyed to a third-party entity constitutes a concrete and particularized injury in fact to that individual.</text></paragraph><paragraph id="id7459b3eccfc5492a826be9ff4df50cf7"><enum>(3)</enum><header>Relief</header><text>In a civil action brought under paragraph (1) in which the plaintiff prevails, the court shall award—</text><subparagraph id="id23f45682c8084165a24fcf63fa8940bd"><enum>(A)</enum><text>the greater of— </text><clause id="idB1BC30243D244DF6A1650E32E97974BE"><enum>(i)</enum><text>not less than $5,000; and</text></clause><clause id="idB8F24A3C3B4A4FD0A0F152CAFB3B5EBB"><enum>(ii)</enum><text>actual damages; and</text></clause></subparagraph><subparagraph id="id0b5cb0fa17204deca9050e0c7d9a15b3"><enum>(B)</enum><text>reasonable attorney’s fees and litigation costs.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id29ACD90DD0154096949FBE0674CBBFC6"><enum>(c)</enum><header>Rulemaking</header><text>The Federal Trade Commission shall promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this Act.</text></subsection></section></legis-body></bill>
