without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To enhance protections of Native American tangible cultural heritage, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id278a43e4-cdfb-44ad-9da7-15df4719489c" changed="not-changed"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguard Tribal Objects of Patrimony Act of 2021</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="iddb0f2924-5444-46c2-97a3-b8de2af27345" changed="not-changed"><enum>2.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph commented="no" display-inline="no-display-inline" id="id8cb921ac8a2a4a12a0df74e5127b01aa" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">to carry out the trust responsibility of the United States to Indian Tribes;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c68ce6584a74d8091a7b9a83fff930a" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">to increase the maximum penalty for actions taken in violation of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) (including section 1170 of title 18, United States Code, as added by that Act), in order to strengthen deterrence;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbbe03837c220432c84016f467537ec37" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">to stop the export, and facilitate the international repatriation, of cultural items prohibited from being trafficked by the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) (including section 1170 of title 18, United States Code, as added by that Act) and archaeological resources prohibited from being trafficked by the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>) by—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD96B64296098487890F42E440F647EC5" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">explicitly prohibiting the export; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8A6D91F011FD4594AAD83D1095CD9680" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">creating an export certification system; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC85A2F4FB2EF476CA8CB46C99C01734A" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">confirming the authority of the President to request from foreign nations agreements or provisional measures to prevent irremediable damage to Native American cultural heritage;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81845d822c474f96a9419d01376b106c" changed="not-changed"><enum>(4)</enum><text display-inline="yes-display-inline">to establish a Federal framework in order to support the voluntary return by individuals and organizations of items of tangible cultural heritage, including items covered by the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) (including section 1170 of title 18, United States Code, as added by that Act) and the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80d638a1d5824b5d9970777cf5143bb4" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">to establish an interagency working group to ensure communication between Federal agencies to successfully implement this Act, the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) (including section 1170 of title 18, United States Code, as added by that Act), the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>), and other relevant Federal laws;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcff13f8101cf4a98a99b7720f862821c" changed="not-changed"><enum>(6)</enum><text display-inline="yes-display-inline">to establish a Native working group of Indian Tribes and Native Hawaiian organizations to assist in the implementation of this Act, the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) (including section 1170 of title 18, United States Code, as added by that Act), the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>), and other relevant Federal laws;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee02f1a03703435f99483eec1bb51a57" changed="not-changed"><enum>(7)</enum><text display-inline="yes-display-inline">to exempt from disclosure under section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id78679D83A1C641DCA16B3AF812D29E77" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">information submitted by Indian Tribes or Native Hawaiian organizations pursuant to this Act; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8DA5E841C7794A2286DAFFD8217761DF" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">information relating to an Item Requiring Export Certification for which an export certification was denied pursuant to this Act; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4b6442886eb44efc9a0ae191ab21b27f" changed="not-changed"><enum>(8)</enum><text display-inline="yes-display-inline">to encourage buyers to purchase legal contemporary art made by Native artists for commercial purposes. </text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id49c01808-440d-4ab5-851c-57d69b7ef577" changed="not-changed"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id6aad4a61d87c4c45a0239909859a8e81" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Archaeological resource</header><text display-inline="yes-display-inline">The term <term>archaeological resource</term> means an archaeological resource (as defined in section 3 of the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470bb">16 U.S.C. 470bb</external-xref>)) that is Native American.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID32F9994103204E2FB0A12C3CB1AA3F04" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Cultural affiliation</header><text display-inline="yes-display-inline">The term <term>cultural affiliation</term> means that there is a relationship of shared group identity that can be reasonably traced historically or prehistorically between a present day Indian Tribe or Native Hawaiian organization and an identifiable earlier group.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID747A2BB5D3784C698283FB898CBB53E4" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Cultural item</header><text display-inline="yes-display-inline">The term <term>cultural item</term> means any 1 or more cultural items (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd475aade8e514a5ab359c3a6b01de4c4" changed="not-changed"><enum>(4)</enum><header display-inline="yes-display-inline">Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id868a14f82f314878a5146de2d81e5bd9" changed="not-changed"><enum>(5)</enum><header display-inline="yes-display-inline">Item prohibited from exportation</header><text display-inline="yes-display-inline">The term <term>Item Prohibited from Exportation</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9ef0ca3495f3468eb081f9243c7c1e44" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a cultural item prohibited from being trafficked, including through sale, purchase, use for profit, or transport for sale or profit, by—</text><clause commented="no" display-inline="no-display-inline" id="id582ED253FE5C42E28BDD1145624F1F2B" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">section 1170(b) of title 18, United States Code, as added by the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id1FE81117EC1D4FCA96BABB21B359B6C2" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline"> any other Federal law or treaty; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a8a80ff96da425f9bbb608e10d28348" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">an archaeological resource prohibited from being trafficked, including through sale, purchase, exchange, transport, receipt, or offer to sell, purchase, or exchange, including in interstate or foreign commerce, by—</text><clause commented="no" display-inline="no-display-inline" id="id6E85DD03768147BBBF32CD9E66552AB4" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">subsections (b) and (c) of section 6 of the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470ee">16 U.S.C. 470ee</external-xref>); or </text></clause><clause commented="no" display-inline="no-display-inline" id="id6BCCF10FF7914B4E8745894FD12B658B" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">any other Federal law or treaty. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59a3eadbd37947b786c59ca95877df5f" changed="not-changed"><enum>(6)</enum><header display-inline="yes-display-inline">Item requiring export certification</header><subparagraph commented="no" display-inline="no-display-inline" id="id5626c34a04834f639cc0a8560e571d61" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>Item Requiring Export Certification</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id2d4d6532fdb44870bc4b2b8af9c64c15" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">a cultural item; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id08dbd49728324dc698ccb5fc541845d8" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">an archaeological resource.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb07e99cf400b48a1a21e12f5d10a8c76" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">The term <term>Item Requiring Export Certification</term> does not include an item described in clause (i) or (ii) of subparagraph (A) for which an Indian Tribe or Native Hawaiian organization with a cultural affiliation with the item has provided a certificate authorizing exportation of the item.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddfac791ede1c493697695b707c2919e0" changed="not-changed"><enum>(7)</enum><header display-inline="yes-display-inline">Native American</header><text display-inline="yes-display-inline">The term <term>Native American</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id61CE42C270DC4CB8A7005219283F31E3" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">Native American (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>)); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1a6e647294664227beff48641fac9dcd" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">Native Hawaiian (as so defined).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0febcd9c49f54240ba34d77cd8862e1a" changed="not-changed"><enum>(8)</enum><header display-inline="yes-display-inline">Native Hawaiian organization</header><text display-inline="yes-display-inline">The term <term>Native Hawaiian organization</term> has the meaning given the term in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51e2adfbef4343adb46f7cd47a3ac023" changed="not-changed"><enum>(9)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id979d26dd952f4dad9ed07705f081542a" changed="not-changed"><enum>(10)</enum><header display-inline="yes-display-inline">Tangible cultural heritage</header><text display-inline="yes-display-inline">The term <term>tangible cultural heritage</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id46b6ac89ad084beb8a563115f9794eda" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">Native American human remains; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf62346dcef3a402f933141a73acfc535" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">culturally, historically, or archaeologically significant objects, resources, patrimony, or other items that are affiliated with a Native American culture. </text></subparagraph></paragraph></section><section id="idACE27AEF05F8425CA2E66B323861CDC2" changed="not-changed"><enum>4.</enum><header>Enhanced NAGPRA penalties</header><text display-inline="no-display-inline">Section 1170 of title 18, United States Code, is amended—</text><paragraph id="idC22CE97722C446D7B076BAC0B2BB5D23" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>5 years</quote> each place it appears and inserting <quote>10 years</quote>; and</text></paragraph><paragraph id="idC28A18F693E84CBF92B811BBC98F54B7" changed="not-changed"><enum>(2)</enum><text>in subsection (a), by striking <quote>12 months</quote> and inserting <quote>1 year and 1 day</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id8912a12c-d0b0-4b1a-9f23-b82621e1d7f9" changed="not-changed"><enum>5.</enum><header display-inline="yes-display-inline">Export prohibitions; export certification system; international agreements</header><subsection commented="no" display-inline="no-display-inline" id="id4aedf827423d4f3594a99779c3cc581e" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Export prohibitions</header><paragraph commented="no" display-inline="no-display-inline" id="idda6f88af82c44a01a2d6efd3960bcfaa" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD22AFF584DD74CA88064E17D01C03BA8" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">to export, attempt to export, or otherwise transport from the United States any Item Prohibited from Exportation; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEC7916DCC1DF49DF82D2865089C0D693" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">to conspire with any person to engage in an activity described in subparagraph (A); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29914C86947F407AA4C6E7BF8377E75F" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">to conceal an activity described in subparagraph (A). </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0bcdb4ab5b8a43d3954faf3459a5b528" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">Any person who violates paragraph (1) and knows, or in the exercise of due care should have known, that the Item Prohibited from Exportation was taken, possessed, transported, or sold in violation of, or in a manner unlawful under, any Federal law or treaty, shall be fined in accordance with section 3571 of title 18, United States Code, imprisoned for not more than 1 year and 1 day for a first violation, and not more than 10 years for a second or subsequent violation, or both.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8dadb08cc06b4b598f4293bace5aaa3b" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Detention, forfeiture, and repatriation</header><subparagraph commented="no" display-inline="no-display-inline" id="id633bd71da27744be85997e4def541fd0" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">Detention and delivery</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall—</text><clause commented="no" display-inline="no-display-inline" id="id29CB8C2742704E15B2E9EF546112BA98" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">detain any Item Prohibited from Exportation that is exported, attempted to be exported, or otherwise transported from the United States in violation of paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id13554E8B1D1D44A28C8FF23A65E23457" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">deliver the Item Prohibited from Exportation to the Secretary.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24087bf3cc6442e4b4e2171812d52608" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Forfeiture</header><text display-inline="yes-display-inline">Any Item Prohibited from Exportation that is exported, attempted to be exported, or otherwise transported from the United States in violation of paragraph (1) shall be subject to forfeiture to the United States in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">chapter 46</external-xref> of title 18, United States Code (including section 983(c) of that chapter). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63a96e9da5364a0d86b390f801d23a3e" changed="not-changed"><enum>(C)</enum><header display-inline="yes-display-inline">Repatriation</header><text display-inline="yes-display-inline">Any Item Prohibited from Exportation that is forfeited under subparagraph (B) shall be expeditiously repatriated to the appropriate Indian Tribe or Native Hawaiian organization in accordance with, as applicable—</text><clause commented="no" display-inline="no-display-inline" id="idDFB12DCB6D5A4F49AFE226F69765E6C4" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) (including section 1170 of title 18, United States Code, as added by that Act); or </text></clause><clause commented="no" display-inline="no-display-inline" id="idC294E885BBAF40CAB80B1A9E9A93050E" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>).</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1749e3fc4b6d45288ae9ff6ebcff3be1" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Export certification system</header><paragraph commented="no" display-inline="no-display-inline" id="id4802206d8f014e03bcea380328d3bfc4" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Export certification requirement</header><subparagraph commented="no" display-inline="no-display-inline" id="id3d3c5fd3417741a99998e35cb54fa963" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No Item Requiring Export Certification may be exported from the United States without first having obtained an export certification in accordance with this subsection.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfaaee68379df40008923f182d80e82bb" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">The Secretary, in consultation with Indian Tribes and Native Hawaiian organizations, shall publish in the Federal Register a notice that includes—</text><clause commented="no" display-inline="no-display-inline" id="id86f1f7acdbcd438580675b214dc9da86" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">a description of characteristics typical of Items Requiring Export Certification, which shall—</text><subclause commented="no" display-inline="no-display-inline" id="idb52809083405409e961bd893c2a263cb" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">include the definitions of the terms— </text><item commented="no" display-inline="no-display-inline" id="idee8f01801eed41d4af268d5ab44caae1" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline"><quote>cultural items</quote> in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>); and</text></item><item commented="no" display-inline="no-display-inline" id="id21081E4ABA4E4E74BEA2F477DE12B4F9" changed="not-changed"><enum>(bb)</enum><text display-inline="yes-display-inline"><quote>archaeological resource</quote> in section 3 of the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470bb">16 U.S.C. 470bb</external-xref>);</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id6199EFD113E1401BB599588DBF93618D" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">describe the provenance requirements associated with the trafficking prohibition applicable to—</text><item commented="no" display-inline="no-display-inline" id="id63ADB50AF9B94EF9AB1E9000FF334CE4" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline">cultural items under section 1170(b) of title 18, United States Code; and</text></item><item commented="no" display-inline="no-display-inline" id="id0DCA7C7B12E64D2AB900BC4A2C171015" changed="not-changed"><enum>(bb)</enum><text display-inline="yes-display-inline"> archaeological resources under subsections (b) and (c) of section 6 of Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470ee">16 U.S.C. 470ee</external-xref>); </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id1B40472E5EED494DAE82B3BA9E8F30F3" changed="not-changed"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="id8E35A41B24D64AC593D8C942AE2117E3" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline">include the definitions of the terms <quote>Native American</quote> and <quote>Native Hawaiian</quote> in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>); and</text></item><item commented="no" display-inline="no-display-inline" id="id6A78E659E8E84D8A80FD6FDE90D0B59C" indent="up1" changed="not-changed"><enum>(bb)</enum><text display-inline="yes-display-inline">describe how those terms apply to archaeological resources under this Act; and </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id93591a6767b548fd93c8ecad48c3a1d5" changed="not-changed"><enum>(IV)</enum><text display-inline="yes-display-inline">be sufficiently specific and precise to ensure that—</text><item commented="no" display-inline="no-display-inline" id="idB83B049B014747CCA2B7FDFB8AE86F59" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline">an export certification is required only for Items Requiring Export Certification; and </text></item><item commented="no" display-inline="no-display-inline" id="id05D3C7F3DB4C4311B12AC6BD7B5C206C" changed="not-changed"><enum>(bb)</enum><text display-inline="yes-display-inline">fair notice is given to exporters and other persons regarding which items require an export certification under this subsection; and </text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id8fe9f4eb631a448495a33e3ed888ed19" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of characteristics typical of items that do not qualify as Items Requiring Export Certification and therefore do not require an export certification under this subsection, which shall clarify that—</text><subclause commented="no" display-inline="no-display-inline" id="id340f377a8b384377a3d415092adbec8a" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">an item made solely for commercial purposes is presumed to not qualify as an Item Requiring Export Certification, unless an Indian Tribe or Native Hawaiian organization challenges that presumption; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd122b4ae7dc943559e74f2fac905c314" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">in some circumstances, receipts or certifications issued by Indian Tribes or Native Hawaiian organizations with a cultural affiliation with an item may be used as evidence to demonstrate a particular item does not qualify as an Item Requiring Export Certification.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6cbbc18f36b479fb1c374124fe622f7" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Eligibility for export certification</header><text display-inline="yes-display-inline">An Item Requiring Export Certification is eligible for an export certification under this subsection if—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1DFCD360EA3643BFB70CE0B6435B7BDA" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the Item Requiring Export Certification is not under ongoing Federal investigation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9923C440BCE0439F8646C79BF215EBD9" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the export of the Item Requiring Export Certification would not otherwise violate any other provision of law; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66DDBFFFCA7F4EC189C0278BA498B470" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">the Item Requiring Export Certification—</text><clause commented="no" display-inline="no-display-inline" id="id8821c2a4f8344954a4d5578f6de31b2e" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">is not an Item Prohibited from Exportation;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide5ff5b2d95104ee78ce6c5b776ce1a7c" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">was excavated or removed pursuant to a permit issued under section 4 of the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470cc">16 U.S.C. 470cc</external-xref>) and in compliance with section 3(c) of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3002">25 U.S.C. 3002(c)</external-xref>), if the permit for excavation or removal authorizes export; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id5d9cf95825dc4c99a0065b57d86696e9" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">is accompanied by written confirmation from the Indian Tribe or Native Hawaiian organization with authority to alienate the Item Requiring Export Certification that—</text><subclause commented="no" display-inline="no-display-inline" id="id0AEC421E20A0400B92164C74E7DC1AB6" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">the exporter has a right of possession (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>)) of the Item Requiring Export Certification; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5EEB441413CE4669B39D223BA68381A5" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">the Indian Tribe or Native Hawaiian organization has relinquished title or control of the Item Requiring Export Certification in accordance with section 3 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3002">25 U.S.C. 3002</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id450e8173b7494368a996690df5f0885e" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Export certification application and issuance procedures</header><subparagraph commented="no" display-inline="no-display-inline" id="idef0f07f1533d4dc5a27e14eea13525aa" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">Applications for export certification</header><clause commented="no" display-inline="no-display-inline" id="idadf7e8d0ca0845948cbe3475e5ae1922" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An exporter seeking to export an Item Requiring Export Certification from the United States shall submit to the Secretary an export certification application in accordance with clause (iii).</text></clause><clause commented="no" display-inline="no-display-inline" id="id8e6fcff985484824ad9ab920728e5078" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Consequences of false statement</header><text display-inline="yes-display-inline">Any willful or knowing false statement made on an export certification application form under clause (i) shall—</text><subclause commented="no" display-inline="no-display-inline" id="idcd6944735011453594976e99b8dd23f1" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">subject the exporter to criminal penalties pursuant to section 1001 of title 18, United States Code; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id82a4a7f7b0d040c8ae85a0bed743dad9" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">prohibit the exporter from receiving an export certification for any Item Requiring Export Certification in the future unless the exporter submits additional evidence in accordance with subparagraph (B)(iii)(I).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id6b5432efc02b410aa9a7d84df6527785" changed="not-changed"><enum>(iii)</enum><header display-inline="yes-display-inline">Form of export certification application</header><text display-inline="yes-display-inline">The Secretary, in consultation with Indian Tribes and Native Hawaiian organizations, and at the discretion of the Secretary, in consultation with third parties with relevant expertise, including institutions of higher education, museums, dealers, and collector organizations, shall develop an export certification application form, which shall require that an applicant—</text><subclause commented="no" display-inline="no-display-inline" id="idD2716A9B785A4B4BBEC083CA4D8F2816" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">describe, and provide pictures of, each Item Requiring Export Certification that the applicant seeks to export; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4EDB8AF3790B4190A14996F14F266682" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">include all available information regarding the provenance of each such Item Requiring Export Certification; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD4224B1E477A4D56BBD067DB17F429A4" changed="not-changed"><enum>(III)</enum><text display-inline="yes-display-inline">include the attestation described in subparagraph (B)(i). </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4f1c876d99e748a7862ed828c229c359" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Evidence</header><clause commented="no" display-inline="no-display-inline" id="idd882695d900444cc8332f69d4738a4eb" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In completing an export certification application with respect to an Item Requiring Export Certification that the exporter seeks to export, the exporter shall attest that, to the best of the knowledge and belief of the exporter, the exporter is not attempting to export an Item Prohibited from Exportation.</text></clause><clause commented="no" display-inline="no-display-inline" id="idB9422D1F04794331A86DCF14B779B2FC" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Sufficiency of attestation</header><text display-inline="yes-display-inline">An attestation under clause (i) shall be considered to be sufficient evidence to support the application of the exporter under subparagraph (A)(iii)(III), on the condition that the exporter is not required to provide additional evidence under clause (iii)(I).</text></clause><clause commented="no" display-inline="no-display-inline" id="id82d4f504d25f4785a8a32ab60b73bff0" changed="not-changed"><enum>(iii)</enum><header display-inline="yes-display-inline">Additional requirements</header><subclause commented="no" display-inline="no-display-inline" id="id7B87C1B0BEC84657914E8F378D8021B4" changed="not-changed"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall give notice to an exporter that submits an export certification application under subparagraph (A)(i) that the exporter is required to submit additional evidence in accordance with subclause (III) if the Secretary has determined under subparagraph (A)(ii) that the exporter made a willful or knowing false statement on the application or any past export certification application.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE0F470CF6A59471BB01A3A50A13BADDF" changed="not-changed"><enum>(II)</enum><header display-inline="yes-display-inline">Delays or denials</header><text display-inline="yes-display-inline">The Secretary shall give notice to an exporter that submits an export certification application under subparagraph (A)(i) that the exporter may submit additional evidence in accordance with subclause (III) if the issuance of an export certification is—</text><item commented="no" display-inline="no-display-inline" id="idD6A015A5B38F4CC190F772F224110556" changed="not-changed"><enum>(aa)</enum><text display-inline="yes-display-inline">delayed pursuant to the examination by the Secretary of the eligibility of the Item Requiring Export Certification for an export certification; or</text></item><item commented="no" display-inline="no-display-inline" id="idB6358AA57B5D4E389440FE15F3E15DE3" changed="not-changed"><enum>(bb)</enum><text display-inline="yes-display-inline">denied by the Secretary because the Secretary determined that the Item Requiring Export Certification is not eligible for an export certification under this subsection. </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idFBC351339BE34B548FE8B9B910286355" changed="not-changed"><enum>(III)</enum><header display-inline="yes-display-inline">Additional evidence</header><text display-inline="yes-display-inline">On receipt of notice under subclause (I), an exporter shall, or on receipt of a notice under subclause (II), an exporter may, provide the Secretary with such additional evidence as the Secretary may require to establish that the Item Requiring Export Certification is eligible for an export certification under this subsection. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd0e4dbb2daee4fd6820e3fb2384bf7c9" changed="not-changed"><enum>(C)</enum><header display-inline="yes-display-inline">Database applications</header><clause commented="no" display-inline="no-display-inline" id="id96041CB3B7B546E89F1CC4437F510E5A" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish and maintain a secure central Federal database information system (referred to in this subparagraph as the <quote>database</quote>) for the purpose of making export certification applications available to Indian Tribes and Native Hawaiian organizations.</text></clause><clause commented="no" display-inline="no-display-inline" id="id335654a2c2db403298e5ef157a193e1c" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Collaboration required</header><text display-inline="yes-display-inline">The Secretary shall collaborate with Indian Tribes, Native Hawaiian organizations, and the interagency working group convened under section 7(a) in the design and implementation of the database.</text></clause><clause commented="no" display-inline="no-display-inline" id="id1E9B12FC2CF04291BB87DDD18F8969D2" changed="not-changed"><enum>(iii)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Immediately on receipt of an export certification application, the Secretary shall make the export certification application available on the database. </text></clause><clause commented="no" display-inline="no-display-inline" id="idA62C1836F8B04DEF82B90EC1FC3F3ED8" changed="not-changed"><enum>(iv)</enum><header display-inline="yes-display-inline">Deletion from database</header><text display-inline="yes-display-inline">On request by an Indian Tribe or Native Hawaiian organization, the Secretary shall delete an export certification application from the database.</text></clause><clause commented="no" display-inline="no-display-inline" id="id1b49d68b17c547a891a11fed06a2aed5" changed="not-changed"><enum>(v)</enum><header display-inline="yes-display-inline">Technical assistance</header><text display-inline="yes-display-inline">If an Indian Tribe or Native Hawaiian organization lacks sufficient resources to access the database or respond to agency communications in a timely manner, the Secretary, in consultation with Indian Tribes and Native Hawaiian organizations, shall provide technical assistance to facilitate that access or response, as applicable. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1290164b6e4f47c6be0925695b37442c" changed="not-changed"><enum>(D)</enum><header display-inline="yes-display-inline">Issuance of export certification</header><text display-inline="yes-display-inline">On receipt of an export certification application for an Item Requiring Export Certification that meets the requirements of subparagraphs (A) and (B), if the Secretary, in consultation with Indian Tribes and Native Hawaiian organizations with a cultural affiliation with the Item Requiring Export Certification, determines that the Item Requiring Export Certification is eligible for an export certification under paragraph (2), the Secretary may issue an export certification for the Item Requiring Export Certification.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27c0ba2691ec4493ad6c04b463df40cd" changed="not-changed"><enum>(E)</enum><header display-inline="yes-display-inline">Revocation of export certification</header><clause commented="no" display-inline="no-display-inline" id="idA29311A4EA1F48C1B29324A6E22CC623" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If credible evidence is provided that indicates that an item that received an export certification under subparagraph (D) is not eligible for an export certification under paragraph (2), the Secretary may immediately revoke the export certification. </text></clause><clause commented="no" display-inline="no-display-inline" id="id226809FB1A4E4920A90B9D4319326769" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">In determining whether a revocation is warranted under clause (i), the Secretary shall consult with Indian Tribes and Native Hawaiian organizations with a cultural affiliation with the affected Item Requiring Export Certification.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50fbea20a7ea48058cd29182bc39d66b" changed="not-changed"><enum>(4)</enum><header display-inline="yes-display-inline">Detention, forfeiture, repatriation, and return</header><subparagraph commented="no" display-inline="no-display-inline" id="id89D91C9E675841719DEA74A5BF361846" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">Detention and delivery</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall—</text><clause commented="no" display-inline="no-display-inline" id="idC0C040A6E3F4405AA27B875A4E346911" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">detain any Item Requiring Export Certification that an exporter attempts to export or otherwise transport without an export certification; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0DCD8DF182584F3B8EFEBEBCC83D7AF8" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">deliver the Item Requiring Export Certification to the Secretary, for seizure by the Secretary. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF98539AF23C845FF8E265AB33858FA19" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Forfeiture</header><text display-inline="yes-display-inline">Any Item Requiring Export Certification that is detained under subparagraph (A)(i) shall be subject to forfeiture to the United States in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">chapter 46</external-xref> of title 18, United States Code (including section 983(c) of that chapter). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0bb12ff5bb547529ac256b8d1f66090" changed="not-changed"><enum>(C)</enum><header display-inline="yes-display-inline">Repatriation or return to exporter</header><clause commented="no" display-inline="no-display-inline" id="id34B4CDC062FC4C2482FC3DEE1057CD89" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of delivery to the Secretary of an Item Requiring Export Certification under subparagraph (A)(ii), the Secretary shall determine whether the Item Requiring Export Certification is an Item Prohibited from Exportation.</text></clause><clause commented="no" display-inline="no-display-inline" id="id1F7977E31BE1404B89601D112C3BEF5B" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Repatriation</header><text display-inline="yes-display-inline">If an Item Requiring Export Certification is determined by the Secretary to be an Item Prohibited from Exportation and is forfeited under subparagraph (B), the item shall be expeditiously repatriated to the appropriate Indian Tribe or Native Hawaiian organization in accordance with, as applicable—</text><subclause commented="no" display-inline="no-display-inline" id="id526CC3BA380A4C549E7BF541E274F31B" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) (including section 1170 of title 18, United States Code, as added by that Act); or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id518409C5B200451899D8084A778474DE" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida4523f7c251445158dd034955550e333" changed="not-changed"><enum>(iii)</enum><header display-inline="yes-display-inline">Return to exporter</header><subclause commented="no" display-inline="no-display-inline" id="id18EB185C04DE454D8E6211D0128F5C2E" changed="not-changed"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the Secretary determines that credible evidence does not establish that the Item Requiring Export Certification is an Item Prohibited from Exportation, or if the Secretary does not complete the determination by the deadline described in clause (i), the Secretary shall return the Item Requiring Export Certification to the exporter. </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5DE1CFFA31244FD78AFE74CDCC905435" changed="not-changed"><enum>(II)</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="yes-display-inline">The return of an Item Requiring Export Certification to an exporter under subclause (I) shall not mean that the Item Requiring Export Certification is eligible for an export certification under this subsection.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0fedd5485db54d98a210b78cfd759e37" changed="not-changed"><enum>(5)</enum><header display-inline="yes-display-inline">Penalties</header><subparagraph commented="no" certification</header><clause commented="no" display-inline="no-display-inline" id="id50B7B65BE0794D7D924BB8DBA0F7841D" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person to export, attempt to export, or otherwise transport from the United States any Item Requiring Export Certification without first obtaining an export certification. </text></clause><clause commented="no" display-inline="no-display-inline" id="id7C6305BF8A244B31BC39FB73FEC42E3E" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">Except as provided in subparagraph (D), any person who violates clause (i) shall be—</text><subclause commented="no" display-inline="no-display-inline" id="id0B01988EF4A64C739C17C6686D766A16" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline"> assessed a civil penalty in accordance with such regulations as the Secretary promulgates pursuant to section 10; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idDBE8D09A6BA84CF1A4E8EE4A0DA8639F" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">subject to any other applicable penalties under this Act.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9a9464aa3e744f7f99252b44a7f3985e" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Items Prohibited from Exportation</header><text display-inline="yes-display-inline">Whoever exports an Item Prohibited from Exportation without first securing an export certification shall be liable for a civil money penalty, the amount of which shall equal the total cost of storing and repatriating the Item Prohibited from Exportation. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id421AF0D1E32F40869E69C2F26E387B53" changed="not-changed"><enum>(C)</enum><header display-inline="yes-display-inline">Use of fines collected</header><text display-inline="yes-display-inline">Any amounts collected by the Secretary as a civil penalty under subparagraph (A)(ii)(I) or (B)—</text><clause commented="no" display-inline="no-display-inline" id="idAC0A30ACC4754C08A364D2FA3FEF35D8" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">may be used by the Secretary—</text><subclause commented="no" display-inline="no-display-inline" id="id72C664A85FCD44E4993DAC2DC2D26A0C" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">for fines collected under subparagraph (A)(ii)(I), to process export certification applications under this subsection; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idAD62A1FCF28A4A90B4D13D33CFE1D57D" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">for fines collected under subparagraph (B), to store and repatriate the Item Prohibited from Exportation;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idF9280DB1CCBC4FBC8629F5FA16CBD493" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">shall supplement (and not supplant) any appropriations to the Secretary to carry out this subsection; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id92248C6D9F784A4B9A68A6ACCD69D23F" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">shall not be covered into the Treasury as miscellaneous receipts. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id07114f3eca8048a3b2e92e4e86b9dcf7" changed="not-changed"><enum>(D)</enum><header display-inline="yes-display-inline">Voluntary return</header><clause commented="no" display-inline="no-display-inline" id="idDCA837B00181446C9E5DC0E5E73E1DDA" changed="not-changed"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any person who attempts to export or otherwise transport from the United States an Item Requiring Export Certification without first obtaining an export certification, but voluntarily returns the Item Requiring Export Certification, or directs the Item Requiring Export Certification to be returned, to the appropriate Indian Tribe or Native Hawaiian organization in accordance with section 6 prior to the commencement of an active Federal investigation shall not be prosecuted for a violation of subparagraph (A) with respect to the Item Requiring Export Certification. </text></clause><clause commented="no" display-inline="no-display-inline" id="idC571EC8427224EA78FED9BED6C191768" changed="not-changed"><enum>(ii)</enum><header display-inline="yes-display-inline">Actions not commencing a Federal investigation</header><text display-inline="yes-display-inline">For purposes of clause (i), the following actions shall not be considered to be actions that commence an active Federal investigation:</text><subclause commented="no" display-inline="no-display-inline" id="idA8C11EB0117A4F3DB5F2A573F842A05E" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">The submission by the exporter of an export certification application for the Item Requiring Export Certification under paragraph (3)(A)(i).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id73D811412FF3478898F3F4A5C15F9CA4" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">The detention of the Item Requiring Export Certification by the Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, under paragraph (4)(A)(i).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id73BC4087CF9543B9BB34FD04DD5EC97F" changed="not-changed"><enum>(III)</enum><text display-inline="yes-display-inline">The delivery to the Secretary of the Item Requiring Export Certification by the Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, under paragraph (4)(A)(ii).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0A0C4EE621AC460C9ECFB5DDE225DFB6" changed="not-changed"><enum>(IV)</enum><text display-inline="yes-display-inline">The seizure by the Secretary of the Item Requiring Export Certification under paragraph (4)(A)(ii). </text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53018f2eb7e742b0acd4709b45b7de09" changed="not-changed"><enum>(6)</enum><header display-inline="yes-display-inline">Fees</header><subparagraph commented="no" display-inline="no-display-inline" id="idC007AE3F10984037A294FDD1635EA711" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may collect reasonable fees to process export certification applications under this subsection.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id212C96BC28F94376A458F08DF282917D" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">Availability of amounts collected</header><text display-inline="yes-display-inline">Any amounts collected by the Secretary under subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="idB2FF4D24E3E64B4BBB206604F14B34E9" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">shall supplement (and not supplant) any appropriations to the Secretary for the activities described in subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id288DC17EB6AD41CD886FFDF93A9D1853" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be covered into the Treasury as miscellaneous receipts. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7b87ef87c7ae44e4b88748b1ee2553de" changed="not-changed"><enum>(7)</enum><header display-inline="yes-display-inline">Administrative appeal</header><text display-inline="yes-display-inline">If the Secretary denies an export certification or an Item Requiring Export Certification is detained under this subsection, the exporter, on request, shall be given a hearing on the record in accordance with such rules and regulations as the Secretary promulgates pursuant to section 10.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0cedc30f9f7d408d932d45853a8e9889" changed="not-changed"><enum>(8)</enum><header display-inline="yes-display-inline">Training</header><subparagraph commented="no" display-inline="no-display-inline" id="idC3F584F6C00A4882B9A0F39AEABB6DA7" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, the Secretary of State, the Attorney General, and the heads of all other relevant Federal agencies shall require all appropriate personnel to participate in training regarding applicable laws and consultations to facilitate positive government-to-government interactions with Indian Tribes and Native Hawaiian Organizations. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id34E2C411780F4E35B23C1761B119E7C1" changed="not-changed"><enum>(B)</enum><header display-inline="yes-display-inline">U.S. Customs and Border Protection training</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall require all appropriate personnel of U.S. Customs and Border Protection to participate in training provided by the Secretary of the Interior or an Indian Tribe or Native Hawaiian organization to assist the personnel in identifying, handling, and documenting in a culturally sensitive manner Items Requiring Export Certification for purposes of this Act. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2A082C7AAD314852A847E3F44B327DAD" changed="not-changed"><enum>(C)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In developing or modifying and delivering trainings under subparagraphs (A) and (B), the applicable heads of Federal agencies shall consult with Indian Tribes and Native Hawaiian organizations.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id033b8ec82abc4902ba4a55a7674ffd2e" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Agreements To request return from foreign countries</header><text display-inline="yes-display-inline">The President may request from foreign nations agreements that specify concrete measures that the foreign nation will carry out—</text><paragraph commented="no" display-inline="no-display-inline" id="id58291BA4E6D3481AA6B4CE7117443178" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">to discourage commerce in, and collection of, Items Prohibited from Exportation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C7D9CDA9A0043B099AD0BFA8222A503" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">to encourage the voluntary return of tangible cultural heritage; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06A3085850C24CE185225E2C5A89EF6A" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">to expand the market for the products of Indian art and craftsmanship in accordance with section 2 of the Act of August 27, 1935 (49 Stat. 891, chapter 748; <external-xref legal-doc="usc" parsable-cite="usc/25/305a">25 U.S.C. 305a</external-xref>) (commonly known as the <quote>Indian Arts and Crafts Act</quote>).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd1ddbdd3-5b30-455f-a589-5a14e72aa88c" changed="not-changed"><enum>6.</enum><header display-inline="yes-display-inline">Voluntary return of tangible cultural heritage</header><subsection commented="no" display-inline="no-display-inline" id="id48ead3cf-82dd-4cba-ad3a-0827be6d94f8" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Liaison</header><text display-inline="yes-display-inline">The Secretary and the Secretary of State shall each designate a liaison to facilitate the voluntary return of tangible cultural heritage.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc0bd9af0529247679385742d73f35ab6" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Trainings and workshops</header><text display-inline="yes-display-inline">The liaisons designated under subsection (a) shall offer to representatives of Indian Tribes and Native Hawaiian organizations and collectors, dealers, and other individuals and organizations trainings and workshops regarding the voluntary return of tangible cultural heritage.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idaa4aa9aa456247b8997cdaf0a67c858b" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Referrals</header><paragraph commented="no" display-inline="no-display-inline" id="idc647cc5276434e149a7269e58e392360" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall refer individuals and organizations to 1 or more Indian Tribes and Native Hawaiian organizations with a cultural affiliation to tangible cultural heritage for the purpose of facilitating the voluntary return of tangible cultural heritage.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9ed29efdf3540f4b5886d92adf5ba0f" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Referral representatives</header><text display-inline="yes-display-inline">The Secretary shall compile a list of representatives from each Indian Tribe and Native Hawaiian organization for purposes of referral under paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7378a2f089584ff78255cbac7b81e42a" changed="not-changed"><enum>(3)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Secretary shall consult with Indian Tribes, Native Hawaiian organizations, and the Native working group convened under section 8(a) before making a referral under paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2806bf2e7fb5454d990443246c6d17a6" changed="not-changed"><enum>(4)</enum><header display-inline="yes-display-inline">Third-party experts</header><text display-inline="yes-display-inline">The Secretary may use third parties with relevant expertise, including institutions of higher education, museums, dealers, and collector organizations, in determining to which Indian Tribe or Native Hawaiian organization an individual or organization should be referred under paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id63b98c04aef341df985e1843904e5578" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Legal liability</header><text display-inline="yes-display-inline">Nothing in this section imposes on any individual or entity any additional penalties or legal liability.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="iddef86f05eb8d4b01911e56fdfab7c9af" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Tax documentation</header><text display-inline="yes-display-inline">In facilitating the voluntary return of tangible cultural heritage under this section, the Secretary shall include provision of tax documentation for a deductible gift to an Indian Tribe or Native Hawaiian organization, if the recipient Indian Tribe or Native Hawaiian organization consents to the provision of tax documentation. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idca104005d33f49b794580325505fc3f1" changed="not-changed"><enum>(f)</enum><header display-inline="yes-display-inline">Repatriation under native american graves protection and repatriation act</header><text display-inline="yes-display-inline">The voluntary return provisions of this section shall apply to a specific item of tangible cultural heritage only to the extent that the repatriation provisions under section 7 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3005">25 U.S.C. 3005</external-xref>) do not apply to the item of tangible cultural heritage. </text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id4697aa91-0936-4895-a780-78d2b22fc0d0" changed="not-changed"><enum>7.</enum><header display-inline="yes-display-inline">Interagency working group</header><subsection commented="no" display-inline="no-display-inline" id="id2b9acff95cc746d78c28a3aca3583b43" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall designate a coordinating office to convene an interagency working group consisting of representatives from the Departments of the Interior, Justice, State, and Homeland Security.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id51979ddb0ccb4affab37fc88445f4751" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Goals</header><text display-inline="yes-display-inline">The goals of the interagency working group convened under subsection (a) are—</text><paragraph commented="no" display-inline="no-display-inline" id="id0cf8a525652a4af6bbf08d43dd6f85e1" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">to facilitate the repatriation to Indian Tribes and Native Hawaiian organizations of items that have been illegally removed or trafficked in violation of applicable law;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7d12349194654e639422d37d61c64221" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">to protect tangible cultural heritage, cultural items, and archaeological resources still in the possession of Indian Tribes and Native Hawaiian organizations; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b994e7f9fab44929f401b2b8ac07317" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">to improve the implementation by the applicable Federal agencies of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idBA4FFD1AEE83483795D270CD4EDCB6A9" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) (including section 1170 of title 18, United States Code, as added by that Act);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE617D7DF3A274067B3414D7F0220AEEE" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBDF23E62668340D7B149C91F63B8A5A9" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">other relevant Federal laws.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb70976c7545c4143a617336accaf3274" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Responsibilities</header><text display-inline="yes-display-inline">The interagency working group convened under subsection (a) shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idA4A897D730EB493E91F204C8D62BB796" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">aid in implementation of this Act and the amendments made by this Act, including by aiding in—</text><subparagraph commented="no" display-inline="no-display-inline" id="idE88F7A73CA9F45BCA8C9ED78F2D2DA91" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the voluntary return of tangible cultural heritage under section 6; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3296110FD1424244AC2574ECA05C88C6" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">halting international sales of items that are prohibited from being trafficked under Federal law; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAA77D87152704E02AA70A18E8FB0D08E" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">collaborate with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0F960A03C48340E9A5202233450CDFDE" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the Native working group convened under section 8(a); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC9599935BE78431A875B301C5805598B" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the review committee established under section 8(a) of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3006">25 U.S.C. 3006(a)</external-xref>); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4FF98E208C8D469EA540CBB7A2B708A1" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">the Cultural Heritage Coordinating Committee established pursuant to section 2 of the Protect and Preserve International Cultural Property Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/151">Public Law 114–151</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/19/2601">19 U.S.C. 2601</external-xref> note); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE6B1AAEA5B6F4C5E855CD2A922C1E9EE" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">any other relevant committees and working groups.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id8316821d-f459-489a-9f89-be8839b65da7" changed="not-changed"><enum>8.</enum><header display-inline="yes-display-inline">Native working group</header><subsection commented="no" display-inline="no-display-inline" id="id56b5d570540e43f7a2c8affb284639b2" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall convene a Native working group consisting of not fewer than 12 representatives of Indian Tribes and Native Hawaiian organizations with relevant expertise, who shall be nominated by Indian Tribes and Native Hawaiian organizations, to advise the Federal Government in accordance with this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1f9e6bee3a8049de974a1ad5adc74448" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">The Native working group convened under subsection (a) may provide recommendations regarding—</text><paragraph commented="no" display-inline="no-display-inline" id="id40b5c58670d64a7ba64c1bba3fc16f44" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the voluntary return of tangible cultural heritage by collectors, dealers, and other individuals and non-Federal organizations that hold such tangible cultural heritage; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d6a5378934442a2b4a9249552c15d18" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the elimination of illegal commerce of cultural items and archaeological resources in the United States and foreign markets. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id058a623ee1b5421fa7eb12e981d828b9" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Requests</header><text display-inline="yes-display-inline">The Native working group convened under subsection (a) may make formal requests to initiate certain agency actions, including requests that—</text><paragraph commented="no" display-inline="no-display-inline" id="id9a8580ac0664461f81c2a00e12186d65" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the Department of Justice initiate judicial proceedings domestically or abroad to aid in the repatriation cultural items and archaeological resources; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6a31921cf20e4b0e82d73c9cc05fee82" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the Department of State initiate dialogue through diplomatic channels to aid in that repatriation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5bbd6b1a34ff4793b91e01b63cc2dd28" changed="not-changed"><enum>(d)</enum><header display-inline="yes-display-inline">Agency and committee display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On request by the Native working group convened under subsection (a), the agencies and committees described in paragraph (2) shall make efforts to provide information and assistance to the Native working group.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id175db05fa9b44b3f9a7d5f71554a497c" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Description of agencies and committees</header><text display-inline="yes-display-inline">The agencies and committees referred to in paragraph (1) are the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="ida3fd3ca0dde64937a57faa255a712a30" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">The Department of the Interior.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb2ed8b64bc684f82bbce4e28213ea2e0" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">The Department of Justice.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9fce4e53988444b6bfca02f898c174e9" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">The Department of Homeland Security.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8a19e44b7edc4c309bacd720f9e9ca6d" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">The Department of State.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD694FF58C2AF4D3FB06F8F4D5F0E691C" changed="not-changed"><enum>(E)</enum><text display-inline="yes-display-inline">The review committee established under section 8(a) of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3006">25 U.S.C. 3006(a)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5507892BEA474F26945F3956E3CA868D" changed="not-changed"><enum>(F)</enum><text display-inline="yes-display-inline">The Cultural Heritage Coordinating Committee established pursuant to section 2 of the Protect and Preserve International Cultural Property Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/151">Public Law 114–151</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/19/2601">19 U.S.C. 2601</external-xref> note).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ba1eb2664374e349c27e8a808d3ca23" changed="not-changed"><enum>(G)</enum><text display-inline="yes-display-inline">Any other relevant Federal agency, committee, or working group.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id31f02a41940a4eefad1d93cb4563ca11" changed="not-changed"><enum>(e)</enum><header display-inline="yes-display-inline">Applicability of Federal Advisory Committee Act</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Native working group convened under subsection (a).</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd5aee5fe-37b3-4237-bd60-a8c7e87d53fd" changed="not-changed"><enum>9.</enum><header display-inline="yes-display-inline">Treatment under Freedom of Information Act</header><subsection commented="no" display-inline="no-display-inline" id="id0c3b2760cbf04caf902d29a38ab9aac1" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (c), the following information shall be exempt from disclosure under section 552 of title 5, United States Code:</text><paragraph commented="no" display-inline="no-display-inline" id="idedde63449aff4dd386c9781d11ff9607" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">Information that a representative of an Indian Tribe or Native Hawaiian organization—</text><subparagraph commented="no" display-inline="no-display-inline" id="idF1ED6D5C54F449C894C2A43411FB3995" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">submits to a Federal agency pursuant to this Act or an amendment made by this Act; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAE3CEFA0F60249449AFEE81C232E9D0B" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">designates as sensitive or private according to Native American custom, law, culture, or religion.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d92e68d6658411d816fb6fb685f60a2" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">Information that any person submits to a Federal agency pursuant to this Act or an amendment made by this Act that relates to an item for which an export certification is denied under this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id79EF59D80CCB41909E7A7F2F8EA43F1D" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">For purposes of subsection (a), this Act shall be considered a statute described in section 552(b)(3)(B) of title 5, United States Code. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0d7dcaaf181a41a1adf0bc4364248838" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">An Indian Tribe or Native Hawaiian organization may request and shall receive its own information, as described in subsection (a), from the Federal agency to which the Indian Tribe or Native Hawaiian organization submitted the information.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id0befc34ef7fe48ea91c393be04492f00" changed="not-changed"><enum>10.</enum><header display-inline="yes-display-inline">Regulations</header><subsection commented="no" display-inline="no-display-inline" id="idC0565A1CB83247D7A762AC7B85C8CF94" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary, in consultation with the Secretary of State, the Secretary of Homeland Security, and the Attorney General, and after consultation with Indian Tribes and Native Hawaiian organizations, shall promulgate rules and regulations to carry out this Act. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id2A157F771CC54CC8B87BEADB5967EA5F" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">The regulations promulgated by the Secretary pursuant to subsection (a) shall include a reasonable deadline by which the Secretary shall approve or deny an export certification application under section 5(b).</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd6a2f9eccee54d6288a281aff06b5b03" changed="not-changed"><enum>11.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $3,000,000 for each of fiscal years 2021 through 2026.</text></section></legis-body><endorsement><action-date>July 28, 2021</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
