<official-title>To amend title 11, United States Code, to provide bankruptcy protections for medically distressed debtors, and for other purposes.</official-title>

<section commented="no" section-type="section-one" id="H9A6CB41F69634344BC99FEC89531878F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Bankruptcy Fairness Act of 2021</short-title></quote>.</text></section> <section id="H2C502EDF64B343018017D1374227B8D"><enum>2.</enum><header>Definitions</header> <subsection id="idF611A42D2B914DAD8C66C325134BE70E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 101 of title 11, United States Code, is amended—</text> 
<paragraph id="HB439557E84B0422700BD1E267E007065"><enum>(1)</enum><text>by inserting after paragraph (39A) the following:</text> <quoted-block style="OLC" id="HECF4361172F745EAAB65A1FC3C9EB56E"> <paragraph id="H8F9355D92C614228A0F5642017EE22CD"><enum>(39B)</enum><text>The term <term>medical debt</term> means any debt incurred voluntarily or involuntarily—</text> 
<subparagraph id="id9B9F42BEEB2C4E6685CBB4B472C67229"><enum>(A)</enum><text>as a result of the diagnosis, cure, mitigation, or treatment of injury, deformity, or disease of an individual; or</text></subparagraph> <subparagraph id="idCBDF361FE090480889393E81D6CEA1D3"><enum>(B)</enum><text>for services performed by a medical professional for the prevention of disease or illness in an individual.</text></subparagraph></paragraph> 
<paragraph id="idA1204B6C836A429C99227A9BB231FE48"><enum>(39C)</enum><text display-inline="yes-display-inline">The term <term>medically distressed debtor</term> means—</text> <subparagraph id="idD4D7AFD3275446EEA29DA194740F8F68"><enum>(A)</enum><text display-inline="yes-display-inline">a debtor who, during the 3-year period preceding the date of the filing of the petition—</text> 
<clause id="H306AB0BC64794CD985E48C4D8F96932D"><enum>(i)</enum><text display-inline="yes-display-inline">incurred or paid aggregate medical debt for the debtor, a dependent of the debtor, or a nondependent parent, grandparent, sibling, child, grandchild, or spouse of the debtor that was not paid by any third-party payor and was greater than the lesser of—</text> <subclause id="H67024E76BA0B401A00D8DFCC34CD0474"><enum>(I)</enum><text>10 percent of the adjusted gross income (as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/26/62">section 62</external-xref> of the Internal Revenue Code of 1986) of the debtor; or</text></subclause> 
<subclause id="HDF09AA958445459BA82301CAE96CB81"><enum>(II)</enum><text display-inline="yes-display-inline">$10,000;</text></subclause></clause> <clause id="H6AC9A83461E741BDA72800F39CD8FF71"><enum>(ii)</enum><text>did not receive domestic support obligations, or had a spouse or dependent who did not receive domestic support obligations, of at least $10,000 due to a medical issue of the individual obligated to pay that would cause the obligor to meet the requirements under clause (i) or (iii), if the obligor was a debtor in a case under this title; or</text></clause> 
<clause id="id1FC40B57BFCD42249FBA7167747C7525"><enum>(iii)</enum><text>experienced a change in employment status that resulted in a reduction in wages, salaries, commissions, or work hours or resulted in unemployment due to—</text> <subclause id="idEFEB475AFD3E442A813A73C00089AB87"><enum>(I)</enum><text>an injury, deformity, or disease of the debtor;</text></subclause> 
<subclause id="id834576E183864D6A9575C2D641784E61"><enum>(II)</enum><text>care for an injured, deformed, or ill dependent or nondependent parent, grandparent, sibling, child, grandchild, or spouse of the debtor; or</text></subclause> <subclause id="idCCB0FAF4919A4DDDB0CAC662D63C922D"><enum>(III)</enum><text>the national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to the coronavirus disease 2019 (COVID–19) or another emergency declared by a Federal, State, or local official relating to a public health crisis; or</text></subclause></clause></subparagraph> 
<subparagraph id="idBFBC8059B45141389E5C82645C192D46"><enum>(B)</enum><text>a debtor who is the spouse of a debtor described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="idC4690AE71A6A4D06A87E12FE731BD568"><enum>(b)</enum><header>Conforming amendments</header><text>Section 104 of title 11, United States Code, is amended—</text> 
<paragraph id="id46435B6E69D2467197F8E8AB1B733545"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), by inserting <quote>101(39C)(A),</quote> after <quote>101(19A),</quote>; and</text></paragraph> <paragraph id="id59BA56227EBD47978FA6A63D5402D91E"><enum>(2)</enum><text>in subsection (b), by inserting <quote>101(39C)(A),</quote> after <quote>101(19A),</quote>.</text></paragraph></subsection></section> 
<section id="H8C6B1FC443954E53A4C4F40913F890EB"><enum>3.</enum><header>Exemptions</header> 
<subsection id="HB1E782BA8A2541CA8C91BB7BE2F7004D"><enum>(a)</enum><header>Exempt property</header><text>Section 522 of title 11, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id04589A77F33E4F86BFAE9E4480F5C9CE"> <subsection id="HC195955AC125405EA8D3916A8B3FCA5"><enum>(r)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="id42F46191E7B947728C0277F48551EEFF"><enum>(1)</enum><text>If a medically distressed debtor exempts property listed in subsection (b)(2), the debtor may, in lieu of the exemption provided under subsection (d)(1), elect to exempt the aggregate interest of the debtor, not to exceed $250,000 in value, in property described in paragraph (3).</text></paragraph> 
<paragraph id="idB67F0B7F7A524808AE2754CD1D7D9F4E" indent="up1"><enum>(2)</enum><text>If a medically distressed debtor exempts property listed in subsection (b)(3) and the exemption provided under applicable law for the kind of property described in paragraph (3) is for less than $250,000 in value, the debtor may elect to exempt the aggregate interest of the debtor, not to exceed $250,000 in value, in any such property.</text></paragraph> <paragraph id="id0A3313573E0D49A8AD96B0FAC5F263A9" indent="up1"><enum>(3)</enum><text>The property described in this paragraph is—</text> 
<subparagraph id="id87FE8A66836B4B1890DC8154327D36AC"><enum>(A)</enum><text>real property or personal property that the debtor or a dependent of the debtor uses as a residence;</text></subparagraph> <subparagraph id="id5E61DC8A28354DF88CE3D2A13BE3F0D4"><enum>(B)</enum><text>a cooperative that owns property that the debtor or a dependent of the debtor uses as a residence; or</text></subparagraph> 
<subparagraph id="id5BF7A28B6B9F44D2AEF79B37735FEF6F"><enum>(C)</enum><text>a burial plot for the debtor or a dependent of the debtor.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H720BE06385D84088BEDC5DE44C119BA6"><enum>(b)</enum><header>Conforming amendments</header><text>Section 104 of title 11, United States Code, is amended—</text> 
<paragraph id="id48C909DAA44F4696981CB8645EBE14D2"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), by inserting <quote>522(r),</quote> after <quote>522(q),</quote>; and</text></paragraph> <paragraph id="id4FD9F445BDF841B4A62D3DF0C9F55DEF"><enum>(2)</enum><text>in subsection (b), by inserting <quote>522(r),</quote> after <quote>522(q),</quote>.</text></paragraph></subsection></section> 
<section id="H6B5D1FB0B3A443C5A006370046792ECC"><enum>4.</enum><header>Waiver of administrative requirements</header> 
<subsection id="id15A81C442E2F428CB95C4E1FD7FC9252"><enum>(a)</enum><header>Case under chapter 7</header><text display-inline="yes-display-inline">Section 707(b) of title 11, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" id="HA963498C60684EA6AF9BD6E1B4D7AA48"> <paragraph id="HE5455A2CBBAF433EA543D21010C80493"><enum>(8)</enum><text>Paragraph (2) does not apply in any case in which the debtor is a medically distressed debtor.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="idF870EBE3D3F14A0BB2542C22945E4FE2"><enum>(b)</enum><header>Case under chapter 13</header><text>Section 1325(b)(1) of title 11, United States Code, is amended—</text> <paragraph id="id78B7843AA6B8477EA22DF0DCC771AD0B"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="idB0C0E0606CF74062BA5265E78A1964F6"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> <paragraph id="id9C6986A18B7044AB941157368E1F8113"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="id2B61B7B13ED240CB81EFC18E86C06E7B"> 
<subparagraph id="idA923E5A6D8F9477CACF46B27CC3BEF86"><enum>(C)</enum><text>the debtor is a medically distressed debtor.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="id55B3E5AC47D14AAB9FE523D22171B648"><enum>5.</enum><header>Credit counseling</header><text display-inline="no-display-inline">Section 109(h)(4) of title 11, United States Code, is amended by inserting <quote>a medically distressed debtor or</quote> after <quote>apply with respect to</quote>.</text></section> 
<section id="idFCA105A3299C4EDAA1D28C23D5B42F49"><enum>6.</enum><header>Student loan undue hardship</header><text display-inline="no-display-inline">Section 523(a)(8) of title 11, United States Code, is amended by inserting <quote>the debtor is a medically distressed debtor, or</quote> before <quote>excepting</quote>.</text></section> <section id="ID00b5271ff7ba424bac71a1784a37c247"><enum>7.</enum><header>Attestation by debtor</header><text display-inline="no-display-inline">Section 521 of title 11, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="id0EECD5BBFE7644B89CECEAB3053FA336"> 
<subsection id="id23d5d17d76214f0e8cc2986bcdeaa9f7"><enum>(k)</enum><text>If the debtor seeks relief as a medically distressed debtor, the debtor shall file a statement of medical expenses relevant to the determination of whether the debtor is a medically distressed debtor, which shall declare under penalty of perjury that such medical expenses were not incurred for the purpose of bringing the debtor within the meaning of the term <term>medically distressed debtor</term>.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="id690BE0AC92FA4CEBBCF22E8BB2F0F5D1"><enum>8.</enum><header>Effective date; application of amendments</header> <subsection id="HD36F6B762EC045599B6D88C53B30642"><enum>(a)</enum><header>Effective date</header><text>Except as provided in subsection (b), this Act and the amendments made by this Act shall take effect on the date of enactment of this Act.</text></subsection> 
<subsection id="HAA6A47E326CD40D185C3D3DE04297500"><enum>(b)</enum><header>Application of amendments</header><text>The amendments made by this Act shall apply only with respect to cases commenced under title 11, United States Code, on or after the date of enactment of this Act.</text></subsection></section> </legis-body> </bill>
