which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Telecommunications Act of 1996 to preserve and protect the ability of State and local governments, public-private partnerships, and cooperatives to provide broadband services.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9403F64942A04B568E04E8EC8B6A665F"><section section-type="section-one" id="HC7D7F3211ABF458086D43FCB39FA676E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Broadband Act of 2021</short-title></quote>.</text></section><section id="HC391899A419640CEAEA1006B765CF3B8"><enum>2.</enum><header>State, local, public-private partnership, and co-op broadband services</header><text display-inline="no-display-inline">Section 706 of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302</external-xref>) is amended—</text><paragraph id="H4DBBDFE9C70B464FB9DA86D9EADC2A04"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e);</text></paragraph><paragraph id="id4564A9649D274A13AB687985D5C6C110"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" id="H1794481842A046279B540C2C86140F1D"><subsection id="H52E4FAEAF8CF4050995B084C237CB18F"><enum>(d)</enum><header>State, local, public-Private partnership, and co-Op advanced telecommunications capability and services</header><paragraph id="H2C9524A3C63F4EEDBE1E23A8008A2300"><enum>(1)</enum><header>In general</header><text>No statute, regulation, or other legal requirement of a State may prohibit or have the effect of prohibiting any public provider, public-private partnership provider, or cooperatively organized provider from providing, to any person or public or private entity, advanced telecommunications capability or any service that utilizes the advanced telecommunications capability provided by that provider.</text></paragraph><paragraph id="HC593EC6CC0A04B4BBF2E236370BCBB93"><enum>(2)</enum><header>Antidiscrimination safeguards</header><subparagraph id="H702934C73CEB41FC8B365E3C3D9A6994"><enum>(A)</enum><header>Public providers</header><text>To the extent any public provider regulates competing private providers of advanced telecommunications capability or services that utilize advanced telecommunications capability, the public provider shall apply its ordinances and rules without discrimination in favor of—</text><clause id="id55F244238D5143D28B645207727EE8C2"><enum>(i)</enum><text>the public provider; or</text></clause><clause id="id3B8B8BDCB52342A991CACECF9DA06FF8"><enum>(ii)</enum><text>any entity owned by the public provider that provides services that utilize advanced telecommunications capability.</text></clause></subparagraph><subparagraph id="H3E1C756F769F43A59606415E3BCCC02F"><enum>(B)</enum><header>Public-private partnership providers</header><text>To the extent any State or local entity that is part of a public-private partnership provider regulates competing private providers of advanced telecommunications capability or services that utilize advanced telecommunications capability, the State or local entity shall apply its ordinances and rules without discrimination in favor of—</text><clause id="idBE344AA1200F4C4196670313655427E8"><enum>(i)</enum><text>the public-private partnership provider; or</text></clause><clause id="idDCF6859F05B74FCCB49DB8CA40090D29"><enum>(ii)</enum><text>any entity owned by the State or local entity or public-private partnership provider that provides services that utilize advanced telecommunications capability.</text></clause></subparagraph></paragraph><paragraph id="HDB7BD3990CBF4830852D44A252EF61B1"><enum>(3)</enum><header>Savings clause</header><text>Nothing in this subsection shall exempt a public provider, public-private partnership provider, or cooperatively organized provider from any Federal or State telecommunications law or regulation that applies to all providers of advanced telecommunications capability or services that utilize such advanced telecommunications capability.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H929F27D771BB496088E93B2A3DBDE74E"><enum>(3)</enum><text>in subsection (e), as redesignated—</text><subparagraph id="HF6D786DE64AD48098CACD6794DDBF7AD"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>this subsection</quote> and inserting <quote>this section</quote>;</text></subparagraph><subparagraph id="HC66BE662CEFA46759A2D921B21D3455E"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (3);</text></subparagraph><subparagraph id="HD99AFC62FA5044448A94FFD9179FCA8E"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" id="HC511608A13C34093AABEF7E8098493A6"><paragraph id="H8CB9F53F2DA54AEAA986FEF2476FCF00"><enum>(2)</enum><header>Cooperatively organized provider</header><text>The term <term>cooperatively organized provider</term> means an entity that is treated as a cooperative under Federal tax law and that provides advanced te­le­com­mu­ni­ca­tions capability, or any service that utilizes such advanced telecommunications capability, to any person or public or private entity.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H27B4917E05D046A38A68829DF10A4735"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H70764614F2724A38BCEBF64726714771"><paragraph id="H1242BA75CD68496DA3A274CC6CFE5654"><enum>(4)</enum><header>Public provider</header><text>The term <term>public provider</term> means a State or local entity that provides advanced telecommunications capability, or any service that utilizes such advanced telecommunications capability, to any person or public or private entity.</text></paragraph><paragraph id="H7C5461BD315A4DB5921E2E4BF77545D4"><enum>(5)</enum><header>Public-private partnership provider</header><text>The term <term>public-private partnership provider</term> means a public-private partnership, between a State or local entity and a private entity, that provides advanced telecommunications capability, or any service that utilizes such advanced telecommunications capability, to any person or public or private entity.</text></paragraph><paragraph id="H4236EDA7B319414CAFFDDBB4AE62C504"><enum>(6)</enum><header>State or local entity</header><text>The term <term>State or local entity</term> means—</text><subparagraph id="id8033244FEACA4161A93FB7F595EDD973"><enum>(A)</enum><text>a State or political subdivision thereof;</text></subparagraph><subparagraph id="id4529A75117CE4F6EB202AFD981241AAE"><enum>(B)</enum><text>any agency, authority, or instrumentality of a State or political subdivision thereof; or</text></subparagraph><subparagraph id="id65D6BE69BA3941BBAE968A76F3F6B139"><enum>(C)</enum><text>an Indian Tribe (as defined in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>)).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
