which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize title VI of the Higher Education Act of 1965 in order to improve and encourage innovation in international education, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing International and Foreign Language Education Act</short-title></quote>.</text></section><section id="id82AAFD23022C487D905FA0B23DC152F5"><enum>2.</enum><header>Graduate and undergraduate language and area centers and programs</header><text display-inline="no-display-inline">Section 602(b)(2)(B)(ii) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1122">20 U.S.C. 1122(b)(2)(B)(ii)</external-xref>) is amended—</text><paragraph id="id8C54DBD593844F7FA39FFECF9D598175"><enum>(1)</enum><text>in subclause (III), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="id35DAFA825A8B4C2A97408853D3C1CE9D"><enum>(2)</enum><text>in subclause (IV), by striking the period and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="id97E69CBF95B441B490BC08985C11F9FF"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0C85C4546A954B55AFA4991EE8569ACA"><subclause id="id970239B0A8D348BF8EB3A13A4E3DBE36" indent="up1"><enum>(V)</enum><text>the beginning, intermediate, or advanced study of a foreign language related to the graduate student's area of specialization.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id81B0F3C3F74C4C278BDF688A0E9D20F6"><enum>3.</enum><header>International research and innovation</header><text display-inline="no-display-inline">Part A of title VI of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1121">20 U.S.C. 1121</external-xref> et seq.) is amended—</text><paragraph id="id5A5EAC05F063490288B009522ABD037A"><enum>(1)</enum><text display-inline="yes-display-inline">by striking sections 605 and 606 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB41557D46F164D9D84AE40014026973B"><section id="id30750791345b450383137b589df1ae39"><enum>605.</enum><header>International research and innovation</header><subsection id="id3dd1807cffe6461fb8cbbbe925ac0bbb"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to support international and foreign language education research and innovation projects that encourage and contribute to comprehensive and ongoing assessment and strengthening of the United States capacity in international education, including program development, coordination, delivery, and outcomes in order to meet national needs.</text></subsection><subsection id="id128C0BEAFB244BB099BF10C6B5CD159A"><enum>(b)</enum><header>Definition of eligible grant recipient</header><text>In this section, the term <term>eligible grant recipient</term> means the following:</text><paragraph id="id12222b30da124e38969c5621c94efda2"><enum>(1)</enum><text>An institution of higher education.</text></paragraph><paragraph id="idccef24e14d70482e9c89a79451984f77"><enum>(2)</enum><text>A public or private nonprofit library.</text></paragraph><paragraph id="idccd9f866123743448551a1108e634f09"><enum>(3)</enum><text>A nonprofit educational organization.</text></paragraph><paragraph id="idb9eb08f9361543d6b6f8eedba65c6ee9"><enum>(4)</enum><text>An entity that has received a grant under any program under this title for any preceding year.</text></paragraph><paragraph id="id88086b5c59654e6dbbbaaf4692eb31e2"><enum>(5)</enum><text>A partnership or consortium of 2 or more entities described in paragraphs (1) through (4).</text></paragraph></subsection><subsection id="id74b81be61b764f6580f1998b64cbf755"><enum>(c)</enum><header>Program authorized</header><paragraph id="id678C8477BCE141FAA33C26AA68722F57"><enum>(1)</enum><header>In general</header><text>From amounts made available to carry out this section, the Secretary may—</text><subparagraph id="idea5797ca550b4fbb9bab0e3754d43106"><enum>(A)</enum><text>conduct research and studies that contribute to the purposes of this title, including research to provide a systematic understanding of our Nation’s international and foreign language education capacity, structures, and effectiveness in meeting growing demands in the education, government, business, and nonprofit sectors;</text></subparagraph><subparagraph id="id514a18e3a30041e192ce1e250ce7a11d"><enum>(B)</enum><text>create innovative paradigms, or enhance or scale up proven strategies and practices, that address systemic challenges to developing and delivering international and foreign language education resources and expertise—</text><clause id="idEF3F88002BF143F8B9050F42A3D1652A"><enum>(i)</enum><text>for incorporating across educational disciplines and institutions; and</text></clause><clause id="idECD58D1A0CFD4393AFD4B66CCE260F6A"><enum>(ii)</enum><text>for employers and other stakeholders; and</text></clause></subparagraph><subparagraph id="id0ce279e9a7984a13857767acb3a1eb32"><enum>(C)</enum><text>develop and manage a national standardized database on the strengths, gaps, and trends in the Nation’s international and foreign language education capacity, and document the outcomes of programs funded under this title every grant cycle.</text></subparagraph></paragraph><paragraph id="id2037D46EA8CA4EA1AF06246B6434321B"><enum>(2)</enum><header>Method of implementation</header><text>The Secretary may carry out the activities described in paragraph (1) directly or through grants or contracts to eligible grant recipients in accordance with subsection (d).</text></paragraph></subsection><subsection id="idfb5ab0e13c6b44b8aa6b7694cc0c28d2"><enum>(d)</enum><header>Research and study and innovation grants</header><paragraph id="id84C6460B231847C68C3F470C75969B28"><enum>(1)</enum><header>Research and study grants authorized</header><text>From amounts made available to carry out this section, the Secretary may award grants, on a competitive basis, to eligible entities to pay for the Federal share of research and studies relating to the systematic development, collection, analysis, publication, and dissemination of data and other information resources in a manner that is easily understandable and made publicly available, and that contributes to achieving the purposes of this title. Such research and studies may include any of the following:</text><subparagraph id="id1e735f367c314666ac46b516aa4d6eeb"><enum>(A)</enum><text>Assessing and documenting international and foreign language education capacity and supply, such as—</text><clause id="idb8dba38175684efcb1bd40a8957466c3"><enum>(i)</enum><text>studies and surveys to determine the numbers of foreign language courses, programs, and enrollments at all levels of education and in all languages, including a determination of gaps in those courses or programs determined to be critical to the national interest;</text></clause><clause id="id5d1729c2003d4f6aa43f7289143e1180"><enum>(ii)</enum><text>studies and surveys of the number and types of degrees or certificates awarded in foreign language studies, area studies, global studies, and international business and professional studies, including identification of gaps in those areas of study determined critical to the national interest;</text></clause><clause id="id4b94d182cc9e4e2dae06ec2ef9fa1319"><enum>(iii)</enum><text>studies and surveys, by language, degree, and world area, of—</text><subclause id="idE1B8AA8642CE4812A52F946B0A86B1B6"><enum>(I)</enum><text>the number of foreign language studies, area studies, global studies, or international studies faculty, including international business faculty; and</text></subclause><subclause id="id2A22EAF90C33449A9847E609DBBEA926"><enum>(II)</enum><text>the number of foreign language studies teachers in grades kindergarten through grade 12; and</text></subclause></clause><clause id="id8cd29903c13d44cab15d30ee4e796d5f"><enum>(iv)</enum><text>studies and surveys of the number of undergraduate and graduate students engaging in long- or short-term education abroad or internship abroad programs as part of their curriculum, including the countries of destination.</text></clause></subparagraph><subparagraph id="id706a08ce3ccd4817bc928a86ad1e72c2"><enum>(B)</enum><text>Assessing the demands for international and foreign language education, the outcomes of international and foreign language education programs, and the alignment of such demand and outcomes, such as—</text><clause id="id9aaf46519a3c4a80808a55335e86fe40"><enum>(i)</enum><text>studies, surveys, and research symposia to determine—</text><subclause id="idE9F0BA596F7D46C4883714A6A0A57AEF"><enum>(I)</enum><text>the demand for increased or improved instruction in foreign language studies, area studies, global studies, or other international fields; and</text></subclause><subclause id="id5B935B7234074A5598A5C2A18C7B2A99"><enum>(II)</enum><text>the demand for employees with such skills and knowledge in government, education, and the private sector;</text></subclause></clause><clause id="idc118075aa98b4bc8a4f3adaf99d0c0bc"><enum>(ii)</enum><text>studies, surveys, and research symposia to assess the employment or utilization of graduates of programs supported under this title by governmental, educational, and private sector entities; and</text></clause><clause id="idaf7a30b844dd4907a5ae03732436f6ec"><enum>(iii)</enum><text>studies, surveys, and research symposia to assess standardized outcomes and the effectiveness and benchmarking of programs supported under this title.</text></clause></subparagraph><subparagraph id="id6249c8579ef541818c89d0d3cfc66814"><enum>(C)</enum><text>The development and publication of specialized materials for use in foreign language studies, area studies, global studies, and other international studies, including in international business and other professional education, as appropriate.</text></subparagraph><subparagraph id="ide90b67ef801947a68c03cf3153f81962"><enum>(D)</enum><text>Studies and surveys that identify and document systemic challenges and changes needed in higher education and elementary school and secondary school systems to make international and foreign language education available to all students as part of the basic curriculum, which may include—</text><clause id="id4FB4810CA6D4444AA02E5C8EE7B515C3"><enum>(i)</enum><text>challenges in current evaluation standards;</text></clause><clause id="id9A2FAB8AB50A45C4969B36E96710E82C"><enum>(ii)</enum><text>program entrance and graduation requirements;</text></clause><clause id="id0E8DEE11AC75400DA3EDF460D5C78341"><enum>(iii)</enum><text>program accreditation;</text></clause><clause id="id61CE7919173A486AAF99F88BBC3F5F3F"><enum>(iv)</enum><text>student postsecondary degree requirements; or</text></clause><clause id="idB904C9BA24AE48159E8F4F17FA023E24"><enum>(v)</enum><text>legal or workplace barriers for teachers and faculty to education and research abroad.</text></clause></subparagraph><subparagraph id="idb864591cabbc480290a81fdc58c50127"><enum>(E)</enum><text>Studies and surveys that identify and document, in underrepresented institutions of higher education (including minority-serving institutions and community colleges)—</text><clause id="id5b8431f469e643c4b2cc1f3f963204d3"><enum>(i)</enum><text>systemic challenges and changes, incentives, and partnerships needed to internationalize educational programming in a comprehensive and sustainable way; and</text></clause><clause id="id24ad91210ce84710954589bde98c0806"><enum>(ii)</enum><text>short- and long-term outcomes of successful internationalization strategies and funding models.</text></clause></subparagraph><subparagraph id="ide2bd9c5b8652482f9cdba24fa889ea25"><enum>(F)</enum><text>Evaluation of the extent to which programs supported under this title reflect diverse perspectives and a wide range of views and generate debate on world regions and international affairs, as described in the application submitted by the eligible recipient under paragraph (3).</text></subparagraph></paragraph><paragraph id="idD7D01966AD394B889253E51A9C2759B4"><enum>(2)</enum><header>Innovation project grants authorized</header><subparagraph id="idFDC599C208FC4613AF630B11DF3707EE"><enum>(A)</enum><header>In general</header><text>For any fiscal year for which the aggregate amount of funds made available under this title is greater than such amount for fiscal year 2020, the Secretary may use such excess amount made available for this section to pay for the Federal share of innovation projects that—</text><clause id="idAA8D2B9528114399A61015D016B1DE8E"><enum>(i)</enum><text>are consistent with the purposes of this title; and</text></clause><clause id="idAA2031D68524412EA6894578A2EA832E"><enum>(ii)</enum><text>establish and conduct innovative strategies or increase the scale of proven strategies.</text></clause></subparagraph><subparagraph id="idAAEF0BAFB3E346F4B2A45C01A987E173"><enum>(B)</enum><header>Types of innovation projects</header><text>Innovation projects carried out under this paragraph may include any of the following:</text><clause id="iddb3966b268dc492ba6631ab54a3f5db0"><enum>(i)</enum><text>Innovative paradigms to improve communication, sharing, and delivery of resources that further the objectives of this title, such as—</text><subclause id="id3eb586743ae144cab7da0d6260aaaea8"><enum>(I)</enum><text>networking and placement structures and systems to more effectively match postsecondary graduates with international and foreign language education skills with the needs of employers across the workforce;</text></subclause><subclause id="idc50ad879bacc45e897137f7ee2cfd9ff"><enum>(II)</enum><text>sharing international specialist expertise across institutions of higher education or in the workforce to pursue specialization or learning opportunities not available at any single institution of higher education, such as shared courses for studying—</text><item id="id45FC309F20D24BBD9E75C30B50B0079F"><enum>(aa)</enum><text>less commonly taught languages, world areas, or regions;</text></item><item id="id5D2D8631F64841E1AD97B642FC893EC7"><enum>(bb)</enum><text>international business; or</text></item><item id="idD42B7663AF024F10835745A54147100F"><enum>(cc)</enum><text>specialized research topics of national strategic interest;</text></item></subclause><subclause id="id19a050fdc9d84719b2538935cf24bd54"><enum>(III)</enum><text>producing, collecting, organizing, preserving, and widely disseminating international and foreign language education expertise, resources, courses, and other information through the use of electronic technologies and other networking techniques that contribute to the purposes of this title;</text></subclause><subclause id="idca87018d786e4874b040cfc5fb1f3acc"><enum>(IV)</enum><text>coordinating initiatives to identify, implement, and provide ongoing access to and creation of digital global library resources; and</text></subclause><subclause id="id092feb5397a04640b4cb199443494fc4"><enum>(V)</enum><text>utilizing technology to create open source resources in international studies, area studies, global studies, and foreign language studies that—</text><item id="id8FC254FBC8F54DA9A898BA186BA8F075"><enum>(aa)</enum><text>are adaptable to multiple educational settings; and</text></item><item id="idA16EA07CCC2D40CE8C9EE9D7085E25DE"><enum>(bb)</enum><text>promote interdisciplinary partnerships between technologists, curriculum designers, international and foreign language education experts, language teachers, and librarians.</text></item></subclause></clause><clause id="id7bfdaef07cbc46e5b11cdc68fb66edcc"><enum>(ii)</enum><text>Innovative curriculum, teaching, and learning paradigms that further the purposes of this title, such as—</text><subclause id="id55aad0714bbc4b19bbf6c6ce70bad7ed"><enum>(I)</enum><text>new paradigms for collaborations of disciplinary programs with foreign language studies, area studies, global studies, and international studies, and education abroad programs, that address the internationalization of such disciplinary studies for the purpose of producing globally competent graduates in their fields;</text></subclause><subclause id="id7aab5a64027f446e9cb3f48e7f1678aa"><enum>(II)</enum><text>innovative collaborations between established centers of international and foreign language education excellence and underrepresented institutions and populations seeking to further their goals for strengthening international, area, global, and foreign language studies, including minority-serving institutions and community colleges;</text></subclause><subclause id="id7d839f87d22e4378b10aae70ffa32c1e"><enum>(III)</enum><text>teaching and learning collaborations among foreign language studies, area studies, global studies, or other international studies programs with diaspora communities, including heritage students; and</text></subclause><subclause id="id8f36a24714c540c6a92fc651c2ea1361"><enum>(IV)</enum><text>new approaches and methods to teaching emerging global issues, cross-regional interactions, and underrepresented regions or countries, such as project- and team-based learning.</text></subclause></clause><clause id="id75d83a34865841269783f1c7f3054a4f"><enum>(iii)</enum><text>Innovative assessment and outcome tools and techniques that further the purposes of this title, such as—</text><subclause id="id376fbe32ab0e43878c1a90fdbf367d8a"><enum>(I)</enum><text>international and foreign language education assessment techniques that are coupled with outcome-focused training modules and that meet the purposes of this title, such as certificates and badges, immersion learning, or e-portfolio systems; and</text></subclause><subclause id="id17eed715791541faa822f3bd0bfffee9"><enum>(II)</enum><text>more effective and easily accessible methods of assessing professionally useful levels of proficiency in foreign languages, or competencies in area studies, culture and global knowledge, or other international fields in programs supported under this title, which may include use of open access online and other cost-effective tools for students and educators at all educational levels and in the workplace.</text></subclause></clause></subparagraph></paragraph><paragraph id="idBD1477022A434A6BA19CE9544984BB2E"><enum>(3)</enum><header>Application</header><subparagraph id="idD249A541B47F4B32A205A0AE0F234631"><enum>(A)</enum><header>In general</header><text>Each eligible entity desiring a grant under this subsection shall submit an application to the Secretary at such time, in such manner, and accompanied by such information and assurances as the Secretary may reasonably require.</text></subparagraph><subparagraph id="id592B6823A8204E53800039736373BD52"><enum>(B)</enum><header>Contents</header><text>An application submitted under this paragraph shall include evidence that any proposed innovation project described in paragraph (2) has a reasonable and demonstrable expectation of sustainability once the support provided under the grant is completed.</text></subparagraph></paragraph><paragraph id="id295a27eb75ca44d3bab148bd1ff13bc3"><enum>(4)</enum><header>Federal and non-Federal share</header><subparagraph id="idA27F731175C948D79070593C34621B2F"><enum>(A)</enum><header>Federal share</header><text>The Federal share of the total cost of carrying out a program supported by a grant under this subsection shall be not more than 66<fraction>2/3</fraction> percent.</text></subparagraph><subparagraph id="id0090F8A07A6241CCB79B0D656B397D7C"><enum>(B)</enum><header>Non-Federal share</header><text>The non-Federal share of the total cost of carrying out a program supported by this grant shall be not less than 33<fraction>1/3</fraction> percent. Such share may be provided either in-kind or in cash, or from institutional and non-institutional funds, including contributions from State entities and private sector corporations or foundations.</text></subparagraph><subparagraph id="id1f7300b6e94a41e9a6b2e8811c39ee16"><enum>(C)</enum><header>Special rule</header><text>The Secretary may waive or reduce the required non-Federal share under this paragraph for any eligible entity that is, or includes, an institution that—</text><clause id="id830e6f015c1e4c0fa9aac9608a3cff12"><enum>(i)</enum><text>is a minority-serving institution or a community college; and</text></clause><clause id="idca6b502f63d74a53bf5e9004a30c72ed"><enum>(ii)</enum><text>has demonstrated a need for a waiver or reduction in the application submitted under paragraph (3).</text></clause></subparagraph></paragraph></subsection><subsection id="id7a76be0c47bd444f91e7e1429eaae2c4"><enum>(e)</enum><header>Database website; 5-Year report</header><text>The Secretary shall, directly or through a grant or contract to an eligible grant recipient—</text><paragraph id="id940b1afcdea94924b6bdf6618c191d6b"><enum>(1)</enum><text>establish, curate, maintain, and update at least once every grant cycle, a web-based site that—</text><subparagraph id="id18957E3F22A549CEAAE3F18C0CF821CA"><enum>(A)</enum><text>showcases results of the activities supported under this section; and</text></subparagraph><subparagraph id="idCC1A52342A574BD4B232BDD8B8E8B427"><enum>(B)</enum><text>serves as a repository and landing site for access to the information, resources, and best practices generated through activities supported under this section; and</text></subparagraph></paragraph><paragraph id="id38da0ca8fb594cdf9e0964bea0a23bf1"><enum>(2)</enum><text>prepare, publish and disseminate to Congress and the public every 5 years, a report that summarizes—</text><subparagraph id="idCEA42E6DC63D4879B6C3388EBCF566F6"><enum>(A)</enum><text>key findings from the activities conducted under this section; and</text></subparagraph><subparagraph id="idEEC10AF58528456693D8679F94DAA2B7"><enum>(B)</enum><text>policy issues the findings may raise with respect to international and foreign language education and outcomes.</text></subparagraph></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id92DB2132C8B544CFB9B1F2A2063B37DF"><enum>(2)</enum><text>by redesignating sections 607 through 610 as sections 606 through 609, respectively.</text></paragraph></section><section id="id43B7F28285B64928AD88199C6A120B94"><enum>4.</enum><header>Authorization of appropriations for part A</header><text display-inline="no-display-inline">Section 609 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1128b">20 U.S.C. 1128b</external-xref>), as redesignated by section 3(2), is amended by striking <quote>2009</quote> and inserting <quote>2022</quote>.</text></section><section id="idCC413EA6EA6C4AE69B6A0521C5FA9787"><enum>5.</enum><header>Global business and professional education programs</header><text display-inline="no-display-inline">Part B of title VI of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1130">20 U.S.C. 1130</external-xref> et seq.) is amended—</text><paragraph id="id5AACE8F53C6046F5A26C0839484D24DB"><enum>(1)</enum><text display-inline="yes-display-inline">in the title heading, by striking <quote><header-in-text level="title" style="OLC">business and international education programs</header-in-text></quote> and inserting <quote><header-in-text level="title" style="OLC">global business and professional education programs</header-in-text></quote>; and</text></paragraph><paragraph id="idB84957BBE6BF4B299BB3D95900238836"><enum>(2)</enum><text>in section 611 (<external-xref legal-doc="usc" parsable-cite="usc/20/1130">20 U.S.C. 1130</external-xref>)—</text><subparagraph id="id338C5420DE004CCA933A4D699CF3FF0B"><enum>(A)</enum><text>in subsection (a)—</text><clause id="idA358B5EA05E24F0598D3ADD24A1EDB2C"><enum>(i)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2F2C22F9C2D84284BB6FD1D08447FAB8"><paragraph id="id0ccc2979ea0643ada327dddb1b015f53"><enum>(1)</enum><text>the future economic welfare of the United States will depend substantially on increasing international and global skills in the business, educational, and other professional communities and creating an awareness among the American public of the internationalization of the economy of the United States and numerous other professional areas important to our national interest in the 21st century;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="id34F5F27114B947E8965FE8D9FE053C98"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="id43446A88288D4660AE83D6DBB764FDA4"><enum>(I)</enum><text>by striking <quote>language and area study programs</quote> and inserting <quote>professional schools and programs, language, area study, and global study programs</quote>; and</text></subclause><subclause id="idCFC20272B4D040F28BBDBFE936B1E20C"><enum>(II)</enum><text>by inserting <quote>and other professional </quote> before <quote>personnel</quote>; and</text></subclause></clause><clause id="id72B57DE078DF4F01A461B55182D5DA8D"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>to prosper in an international</quote> and inserting <quote>and other professional fields to prosper in an international global</quote>.</text></clause></subparagraph></paragraph></section><section id="idAA5F6B99C8E04ACBA80B6E237EA781C4"><enum>6.</enum><header>Professional and technical education for global competitiveness</header><text display-inline="no-display-inline">Section 613 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1130a">20 U.S.C. 1130a</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id00B0256FBE0A4F079DAC3F6102A3181D"><section id="id7e6a930c0b6f420ba72c21dc8131c29e"><enum>613.</enum><header>Professional and technical education for global competitiveness</header><subsection id="ida1769502dd0241558477f8d7d638d878"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to support innovative strategies that provide undergraduate and graduate students with the global professional competencies, perspectives, and skills needed to strengthen and enrich the global engagement and competitiveness of the United States in a wide variety of professional and technical fields important to the national interest in the 21st century.</text></subsection><subsection id="idC2E75BFCF5104CFBBA27987FE3F411C3"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idBF302EE255B14300ABA492BB5755C7BF"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id766CD40AE1384FCAB574C676DBCBC052"><enum>(A)</enum><text>an institution of higher education;</text></subparagraph><subparagraph id="id903FBDED0CDC4BC8BA07A2B7B1283186"><enum>(B)</enum><text>a consortium of institutions of higher education; or</text></subparagraph><subparagraph id="idAEE46E8F20294037AA740BF0BDA6463A"><enum>(C)</enum><text>a partnership consisting of 1 or more institutions of higher education and 1 or more corporate entity or nonprofit organization.</text></subparagraph></paragraph><paragraph id="id7FD3194F23F44056B230293E038E086E"><enum>(2)</enum><header>Professional education and technical training</header><text>The term <term>professional education and technical training</term> means a program at an institution of higher education that offers undergraduate, graduate, or post-graduate level education in a professional or technical field that is determined by the Secretary as meeting a national need for global or international competency (which may include a program in the field of business, science, technology, engineering, law, health, energy, environment, agriculture, transportation, or education).</text></paragraph></subsection><subsection id="idc2b6d17de4194b34b8778680881869c2"><enum>(c)</enum><header>Program authorized</header><text>From amounts made available to carry out this section and subject to subsection (g), the Secretary shall award grants or contracts, on a competitive basis, to eligible entities to enable the eligible entities to carry out programs designed to—</text><paragraph id="id3b4fa33a81834e88833a68fce9ffd3ff"><enum>(1)</enum><text>establish an interdisciplinary global dimension in the undergraduate and graduate curricula of programs of business, science, technology, engineering, mathematics, health, environment, energy, agriculture, law, civics, and other professional education and technical training, to be determined by the Secretary based on national needs;</text></paragraph><paragraph id="id21d2ed0b345c4867bfc6b64a074d2015"><enum>(2)</enum><text>produce graduates with proficiencies in both the global aspects of their professional fields and international, cross-cultural, and foreign language skills; and</text></paragraph><paragraph id="idda66b46ba5d646bba272c3312ba0e318"><enum>(3)</enum><text>provide appropriate services to or linkages with corporate, government, and nonprofit communities that—</text><subparagraph id="id5889943BB38C47BCBC4A82F93BC4AFD7"><enum>(A)</enum><text>will expand the knowledge and capacity of such communities for global engagement and competitiveness; and</text></subparagraph><subparagraph id="idABF95310C5EE49E4829AD5AF2E412770"><enum>(B)</enum><text>provide internship or employment opportunities for postsecondary students and graduates with international skills.</text></subparagraph></paragraph></subsection><subsection id="idf93ae6c5d9814f9cad325fba3ea328e3"><enum>(d)</enum><header>Applications</header><text>Each eligible entity desiring a grant or contract under this section shall submit an application to the Secretary at such time, in such manner, and accompanied by such information and assurances as the Secretary may reasonably require, including—</text><paragraph id="id753c0fd7368745eea9a857fe786cc8c3"><enum>(1)</enum><text>evidence that each project proposed in the application has a reasonable and demonstrable expectation of sustainability and replicability once the grant period is completed;</text></paragraph><paragraph id="id65f12ddf215943d3a631c8caee98b193"><enum>(2)</enum><text>a copy of the agreement entered into by the eligible entity with a private entity or nonprofit organization engaged in international economic or other relevant professional activity, or a combination or consortium of such entities or organizations, for the purpose of demonstrating compliance with subsection (c);</text></paragraph><paragraph id="id2463ed4f329046dd926e63f748689648"><enum>(3)</enum><text>assurances that the institution of higher education will use the assistance provided under this section for activities that supplement, and not supplant, activities described in subsection (e) that were carried out by the institution of higher education before receiving the grant or contract; and</text></paragraph><paragraph id="idce48cf7360004ce3b149de1c92c0d311"><enum>(4)</enum><text>assurances that, where applicable, the activities funded by the grant or contract will reflect diverse perspectives and a wide range of views on world regions and international affairs.</text></paragraph></subsection><subsection id="id68c903f379db47efa14356f05cdd2dd0"><enum>(e)</enum><header>Authorized activities</header><paragraph id="id613e993b91d94eaab98ed3e21138efe2"><enum>(1)</enum><header>Mandatory activities</header><text>An eligible entity receiving a grant or contract under this section shall use funds provided under the grant or contract to carry out all of the following activities:</text><subparagraph id="id4e11c75698df4e03ba0bae733127eed4"><enum>(A)</enum><text>Combining or incorporating into undergraduate or graduate professional education and technical training curricula all of the following:</text><clause id="idf672d7fdaba94a4ab1f8367b352c6de4"><enum>(i)</enum><text>Foreign language programs that lead to proficiency, including immersion opportunities.</text></clause><clause id="id6fa34cf2cded429db7eed979acf9ba8a"><enum>(ii)</enum><text>International studies, area studies, or global studies programs.</text></clause><clause id="id21646eea70ef49868634bca3cdef000d"><enum>(iii)</enum><text>Educational programs abroad, internships abroad, or other innovative or technological linkages abroad.</text></clause><clause id="id0863f298eeaf472fa97976e7990dc774"><enum>(iv)</enum><text>Global business, economic, and trade studies, as appropriate.</text></clause></subparagraph><subparagraph id="id78bfb2f9220549caa05631c83378d6f2"><enum>(B)</enum><text>Innovation and improvement in international, global, and foreign language education curricula to serve the needs of business and other professional and nonprofit communities, including development of new programs for nontraditional, midcareer, or part-time students.</text></subparagraph><subparagraph id="id43c1fba646154fc19c0bda3cb4fa7a00"><enum>(C)</enum><text>Establishment of educational programs abroad or internship programs abroad, or other innovative approaches to enable undergraduate or graduate professional students to develop their foreign language skills and knowledge of foreign cultures and societies and global dimensions of their professional fields.</text></subparagraph><subparagraph id="idee2171f0c54041c188070d77fbf91acc"><enum>(D)</enum><text>Development of collaborations on issues of common interest to institutions of higher education, corporations, or nonprofit sector organizations designed to strengthen engagement and competitiveness in global business or trade or other global professional activity.</text></subparagraph></paragraph><paragraph id="id9e545845b0524d55a8194d89e261b9f6"><enum>(2)</enum><header>Permissible activities</header><text>An eligible entity receiving a grant or contract under this section may use funds provided under the grant to carry out any of the following activities:</text><subparagraph id="id92ebf04e18b04127b9a3ff1f70aa919f"><enum>(A)</enum><text>Development of specialized teaching materials and courses (including foreign language studies, area studies, or global studies materials) and innovative technological delivery systems appropriate to professionally oriented students.</text></subparagraph><subparagraph id="idd2ff1b8987bb477a98ee7fc2fa7a1785"><enum>(B)</enum><text>Establishment of student fellowships or other innovative support opportunities for education and training in global professional development activities, including for underrepresented populations, first generation students, and heritage students.</text></subparagraph><subparagraph id="idd5d49f8b03424f32a87f53e67f15d3f9"><enum>(C)</enum><text>Development of opportunities or fellowships for professional school faculty, including junior faculty, to acquire or strengthen international and global skills and perspectives, including faculty in minority-serving institutions or community colleges.</text></subparagraph><subparagraph id="idc35601cbd4b04321ab52ee57772a9f1c"><enum>(D)</enum><text>Summer, or other academic break, institutes, or technology delivered institutes, in global business, science, technology, engineering, mathematics, or other professional fields, foreign language studies, area studies, and global and other international studies designed to carry out the purposes of this section.</text></subparagraph><subparagraph id="iddda7dfe90c274b828ab0a60aa06cc00e"><enum>(E)</enum><text>Internationalization of curricula at the community college level and at such minority-serving institutions to further the purposes of this section.</text></subparagraph><subparagraph id="id1cd3925d37c04013b280711ba4c38067"><enum>(F)</enum><text>Establishment of linkages overseas—</text><clause id="idB79D616BEBEF4578BF8BD4E8DCC321F2"><enum>(i)</enum><text>with institutions of higher education, corporations and other private entities, and nonprofit organizations; and</text></clause><clause id="idDCFAF7506C86456391EC05AE71EDC265"><enum>(ii)</enum><text>that contribute to the educational purpose of this section.</text></clause></subparagraph><subparagraph id="id8ce0fa708dd8494f8d3800b087a7c1cd"><enum>(G)</enum><text>Development of programs to inform the public of—</text><clause id="idDED20C2D3AFF4753A4A8595052BF93BF"><enum>(i)</enum><text>increasing global interdependence in a wide variety of professional fields such as business, science, technology, engineering, mathematics, health, environment, energy, agriculture, law, civics, and other areas; and</text></clause><clause id="idFCDCE1F35C8747A9B65350F7ED9069BE"><enum>(ii)</enum><text>the role of the United States within the global system.</text></clause></subparagraph><subparagraph id="idf8fedefadb6e48c3bcedf333fce81e76"><enum>(H)</enum><text>Establishment of trade education programs through cooperative arrangements with—</text><clause id="id0210E72E7A9E4CFEBE380D46D1C8FC85"><enum>(i)</enum><text>regional, national, and global trade centers and councils; and</text></clause><clause id="idB8D919145AD94966A0EEA50546D35E89"><enum>(ii)</enum><text>bilateral and multilateral trade associations.</text></clause></subparagraph></paragraph></subsection><subsection id="idc3cb70f89ba84164bbb8b5963c64fb9b"><enum>(f)</enum><header>Federal share; non-Federal share</header><paragraph id="id3F8C1579C1614539AA9872BB85C8724D"><enum>(1)</enum><header>In general</header><text>Any funds provided through a grant under this section shall be used to pay the Federal share of the activities carried out under the grant.</text></paragraph><paragraph id="id3439B476EC3F44059BB8F23A2746F71C"><enum>(2)</enum><header>Federal share</header><text>The Federal share of the cost of a program supported by a grant under this section shall not be more than 50 percent.</text></paragraph><paragraph id="id98340EB593DB47E3ABBED73ED09533F1"><enum>(3)</enum><header>Non-Federal share</header><text>The non-Federal share of the cost of the program supported by a grant under this section—</text><subparagraph id="id2DA1E0D7C3274DB2B008709FE201C0E5"><enum>(A)</enum><text>shall be not less than 50 percent; and</text></subparagraph><subparagraph id="id2BF4CC2668564E8FB3903E1BC438DD9D"><enum>(B)</enum><text>may be provided either in cash or in-kind, from institutional and non-institutional funds, including contributions from State entities and private sector corporations or foundations.</text></subparagraph></paragraph><paragraph id="idc31f23f60a434357af396dc432d7b711"><enum>(4)</enum><header>Special rule</header><text>Notwithstanding paragraphs (2) and (3), the Secretary may waive or reduce the required non-Federal share under this section for an eligible entity that is, or includes, an institution that—</text><subparagraph id="id166dea1ecb0d46faa9a4051287e39d84"><enum>(A)</enum><text>is a minority-serving institution or is a community college; and</text></subparagraph><subparagraph id="idb96c8519670747bf887de46edd6e7a53"><enum>(B)</enum><text>has submitted a grant application under this section that demonstrates a need for a waiver or reduction.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id088eb485f459459c91ec8e77a3c682ae"><enum>(g)</enum><header display-inline="yes-display-inline">Funding rule</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, the Secretary shall only award grants or contracts under this section for a fiscal year if the total amount of funding under this title is greater than the total of such amount for fiscal year 2020.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idE96D0440544443F59DAE54ACFF832F42"><enum>7.</enum><header>Authorization of appropriations for part B</header><text display-inline="no-display-inline">Section 614 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1130b">20 U.S.C. 1130b</external-xref>) is amended—</text><paragraph id="id6C61B1EF086B4A87A738BA933D682086"><enum>(1)</enum><text>in subsection (a), by striking <quote>2009</quote> and inserting <quote>2022</quote>; and</text></paragraph><paragraph id="id73538059FF4E4A56A8EF7833B1CA881B"><enum>(2)</enum><text>in subsection (b), by striking <quote>2009</quote> and inserting <quote>2022</quote>.</text></paragraph></section><section id="idE60384D7F3FB4A418F4B7D22C46EE3E3"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 631 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1132">20 U.S.C. 1132</external-xref>) is amended—</text><paragraph id="id7731BBB5856D4440BD4DBDB5F7F66744"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) through (4), (5) through (8), and (9) through (10), as paragraphs (3) through (5), (7) through (10), and (12) through (13), respectively;</text></paragraph><paragraph id="id54BF36036D514BD580D664E8C255E86F"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3B9990D37B8241ED8D3537A9B3DACC9F"><paragraph id="idB93FE55A65BC4FCEAA376CE7DB917F1E"><enum>(2)</enum><text>the term <term>community college</term> has the meaning given the term <term>junior or community college</term> in section 312(f);</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id1ED594EA3BBB4B0983F55D039E723E26"><enum>(3)</enum><text>by inserting after paragraph (5), as redesignated by paragraph (1), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB39A87B457A34152BAF563F0C96CE641"><paragraph id="id7B9DBCC474A94ED38960DE0010171DBC"><enum>(6)</enum><text>the term <term>heritage student</term> means a postsecondary student who—</text><subparagraph id="id53843E9D0B4149E7B5E817EE4970DCE1"><enum>(A)</enum><text>was born in the United States to immigrant parents or immigrated to the United States at an early age;</text></subparagraph><subparagraph id="id5B9D56C4E4D2405EB3E3DB61BE77C04B"><enum>(B)</enum><text>is proficient in English, but raised in a family primarily speaking 1 or more languages of the country of origin; and</text></subparagraph><subparagraph id="id4935506DFD4D4AE1A3D1F08E29B15CBB"><enum>(C)</enum><text>maintains a close affinity with the family’s culture and language of origin.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id38347B04F3D744E79B122ACF8D03184F"><enum>(4)</enum><text>by inserting after paragraph (10), as redesignated by paragraph (1), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA7322E99D000442BAA62A0B077A35196"><paragraph id="id70AC29389B204D3BA36A0944A5F0FB88"><enum>(11)</enum><text>the term <term>minority-serving institution</term> means an eligible institution under section 371(a);</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idBF4B793F45A64C178541DF156C9E15B3"><enum>9.</enum><header>Repeal of unfunded programs and duplicative requirements</header><text display-inline="no-display-inline">Title VI of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1121">20 U.S.C. 1121</external-xref> et seq.) is amended—</text><paragraph id="id77B1A104865346628BF54AFA4865CF9E"><enum>(1)</enum><text>by striking part C;</text></paragraph><paragraph id="idCCBCA2F0DB31469187260610E5F321D7"><enum>(2)</enum><text>by redesignating part D as part C; and</text></paragraph><paragraph id="idD1A9476570D7435C86D8BED2C9CB8C0B"><enum>(3)</enum><text>by striking sections 637 and 638. </text></paragraph></section></legis-body></bill>
