which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Corporation for Career Pathways to promote pathways to unfilled and emerging job markets, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Workforce Promotion to Access Training to Help Workers, Adults, and Youths Succeed Act</short-title></quote> or the <quote><short-title>Workforce PATHWAYS Act</short-title></quote>.</text></section><section id="idFA37A4CC615040578A342DB2B3CDCA53"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="idac08e15127d14ff296b7bacb3d7159e0"><enum>(1)</enum><text>to provide a coordinated process for developing a national strategy to ensure that United States’ students and workers have access to affordable, relevant, and innovative education and job training that will equip them to compete and win in the global economy;</text></paragraph><paragraph id="idf1164ed4e9f84a57bc7d65b268df71e1"><enum>(2)</enum><text>to prepare Americans for the 21st Century economy and the emerging industries of the future by—</text><subparagraph id="id6AEDC576A05C49A682795DF1BF95C2D7"><enum>(A)</enum><text>providing an environment of lifelong learning and skills-based training; and</text></subparagraph><subparagraph id="id494ADF03407A474298D138B43DDBF43A"><enum>(B)</enum><text>cultivating a demand-driven approach to the opportunities available;</text></subparagraph></paragraph><paragraph id="id78D068ED547D460E82D82956A51EE636"><enum>(3)</enum><text display-inline="yes-display-inline">to establish a promotional public-private partnership that—</text><subparagraph id="id1A72029DC9AB43A5AF534E7CDF1146FF"><enum>(A)</enum><text display-inline="yes-display-inline">analyzes economic trends;</text></subparagraph><subparagraph id="idE8EDA97BA3444F36A40E71CD0E90CFD5"><enum>(B)</enum><text display-inline="yes-display-inline">promotes pathways to unfilled and emerging job markets; and </text></subparagraph><subparagraph id="idA0994342E8D74E4F900CE7F30DFE7413"><enum>(C)</enum><text display-inline="yes-display-inline">guides current and future workers in the United States economy by providing information to empower economic mobility and security for United States workers;</text></subparagraph></paragraph><paragraph id="id18E70FE6B07E4CD280371154E8F28D99"><enum>(4)</enum><text>to use economic and labor data and a honed marketing campaign to reduce the barriers to choosing a career, or a career transition, with more effective outreach and information that is amenable and understandable for the worker and the business community;</text></paragraph><paragraph id="idca46ccabad6d4172ae317ce5993240a0"><enum>(5)</enum><text>to use information and marketing to reduce the stigma or uncertainties surrounding many quality and essential professions in the United States;</text></paragraph><paragraph id="id1952206a69104ea3be337d8cf197efff"><enum>(6)</enum><text>to work with private employers, educational institutions, labor unions, other nonprofit organizations, and State, territorial, tribal, and local governments to update and reshape the education and job training landscape in the United States; and</text></paragraph><paragraph id="idCE5A25AE590E4218AACA0B32C5D5B993"><enum>(7)</enum><text>to work to aide and strengthen United States workers in the wake of a global pandemic that has inflicted significant pain on their economic and physical well-being . </text></paragraph></section><section id="idd48a32b8b5384788855beca32a3d3240"><enum>3.</enum><header>Corporation for Career Pathways</header><subsection id="id70eccd2405764c1cac3ec3f1a4e712bf"><enum>(a)</enum><header>Establishment</header><text>There is authorized to be established a nonprofit corporation, which—</text><paragraph id="id918D6BEA3D37469894CABAAB8ACAD41C"><enum>(1)</enum><text>shall be known as the Corporation for Career Pathways (referred to in this Act as the <quote>Corporation</quote>);</text></paragraph><paragraph id="id1FE5E67291514C25AB4D316D0E21E1F4"><enum>(2)</enum><text>shall not be an agency or establishment of the United States Government; and</text></paragraph><paragraph id="idFD3301EB2EF8444287556366CAB1FBD5"><enum>(3)</enum><text>shall be subject to the provisions of the District of Columbia Nonprofit Corporation Act (<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/29/4">chapter 4</external-xref> of title 29, District of Columbia Official Code) to the extent that such provisions are consistent with this section. </text></paragraph></subsection><subsection id="id1956d50de6b747a290da5e044768681c"><enum>(b)</enum><header>Mission and vision</header><paragraph id="id2fabf8714e0342fdaa2c519a3660c872"><enum>(1)</enum><header>Mission</header><text>The mission of the Corporation is to increase awareness of career pathways for United States workers, educators, and employers by promoting workforce development initiatives, educational programs, and other opportunities that develop skills relevant to high-demand industries—</text><subparagraph id="idC54E57D63FE34935A6B1C7DF3F8FE747"><enum>(A)</enum><text>to create a healthier, more resilient, and more sustainable workforce; and </text></subparagraph><subparagraph id="idA83A1258D627478293E04048691DC556"><enum>(B)</enum><text>to increase our Nation’s global competitiveness.</text></subparagraph></paragraph><paragraph id="idcf782ac3ebb54182b6a738268107c334"><enum>(2)</enum><header>Vision</header><text>The vision of the Corporation is working through an innovative public-private partnership to use strategic data analytics, an effective public marketing campaign, and the dissemination of timely information to provide the tools workers, educators, and employers need—</text><subparagraph id="id930262E0E3054312B0556FC74719CA5F"><enum>(A)</enum><text>to create greater economic mobility;</text></subparagraph><subparagraph id="idA184C340030D4B308196B315758620F9"><enum>(B)</enum><text>to promote greater job creation or employment;</text></subparagraph><subparagraph id="idAA08F9E6A9C045CDBD77B1557FF1C518"><enum>(C)</enum><text>to reduce long-tenured displaced and dislocated workers; and</text></subparagraph><subparagraph id="id729651653E1944138D6BC93B683595E4"><enum>(D)</enum><text>to increase the Nation’s gross-domestic product, export potential, and overall economic strength. </text></subparagraph></paragraph></subsection><subsection id="idc2957a05263e4e5eae5f5c19c9b957d9"><enum>(c)</enum><header>Board of Directors</header><paragraph id="idF69D1DC08B9E46378E4ED9312C6E7B5B"><enum>(1)</enum><header>In general</header><text>The Corporation shall have a Board of Directors (referred to in this section as the <quote>Board</quote>) consisting of 21 members, who—</text><subparagraph id="idC398EAE57F68483DB6A48ED3A5852F0F"><enum>(A)</enum><text>shall be appointed by the Secretary of Labor, in consultation with the Secretary of Commerce, the Secretary of Education, the Administrator of the Small Business Administration, the Director of the National Economic Council, and the Chairman of the Council of Economic Advisors;</text></subparagraph><subparagraph id="idF12D3E7E5AD341E5B69948A09AB8A609"><enum>(B)</enum><text>shall have knowledge of the domestic job market, education opportunities, and career development;</text></subparagraph><subparagraph id="idEDADEF653A584363B94FBD629504E43B"><enum>(C)</enum><text>shall collectively represent diverse ethnicities and regions of the United States; and</text></subparagraph><subparagraph id="idC0B09524AF1946E98FC8D42F2ADE3A56"><enum>(D)</enum><text>shall be United States citizens.</text></subparagraph></paragraph><paragraph id="id3d37e193c4814f11970e7ae23f2cba52"><enum>(2)</enum><header>Membership</header><text display-inline="yes-display-inline">Of the members appointed pursuant to paragraph (1)(A)—</text><subparagraph id="id84f288b39f974f28806d3453bb40a6e2"><enum>(A)</enum><text>1 member shall have appropriate expertise and experience at a 4-year institution of higher education;</text></subparagraph><subparagraph id="idBDB1DB76597D4AA4A069CB748E349E36"><enum>(B)</enum><text>1 member shall have appropriate expertise and experience at a 2-year institution of higher education;</text></subparagraph><subparagraph id="idD01C261B404B470CAFDD60E96B9252AE"><enum>(C)</enum><text>1 member shall have appropriate expertise and experience at a career and technical training institution;</text></subparagraph><subparagraph id="idCA94501E0D4F47A9866B4982EEE0DA14"><enum>(D)</enum><text>1 member shall have appropriate expertise and experience in other adult education opportunities;</text></subparagraph><subparagraph id="id7C40E10E49EE42C3A8FC7AF63972AB77"><enum>(E)</enum><text>1 member shall have appropriate expertise and experience at a primary or secondary public school, especially in preparing students in a career and technical education environment;</text></subparagraph><subparagraph id="id0E9AFA9699C448B5B0EA132099448A1B"><enum>(F)</enum><text>in selecting the members described in subparagraphs (A) through (E), the Secretary of Labor should give strong consideration to including at least 1 member with specific experience in career or academic counseling;</text></subparagraph><subparagraph id="idae8049b7fd9949e3b50c385f8b354bfd"><enum>(G)</enum><text>1 member shall have appropriate expertise and experience in State or local workforce boards;</text></subparagraph><subparagraph id="ida6a191148d5e4a86b3edeb614fd10f5a"><enum>(H)</enum><text>1 member shall have appropriate expertise and experience with economics of the labor market, including possible work in academia;</text></subparagraph><subparagraph id="idff2f2c3275464c43b0522517da9f5877"><enum>(I)</enum><text>1 member shall have appropriate expertise and experience in a labor organization representing private sector unions, including through established apprenticeship programs;</text></subparagraph><subparagraph id="id9d334b0a29da44cdab43abd790f3e1bc"><enum>(J)</enum><text>1 member shall have appropriate expertise and experience in a labor organization representing public sector unions, including through established apprenticeship programs;</text></subparagraph><subparagraph id="id6d14422fd3c243a98a632f0291de2b93"><enum>(K)</enum><text>1 member shall have appropriate expertise and experience in a private sector business trade association, such as a Chamber of Commerce;</text></subparagraph><subparagraph id="ida5cd258c74f74210a387edb0354d3e51"><enum>(L)</enum><text>1 member shall have appropriate expertise and experience in small business or entrepreneurship, or their associations; </text></subparagraph><subparagraph id="id6ec7cd6a2263451aba175c3e27e4bd06"><enum>(M)</enum><text>1 member shall have appropriate expertise and experience in state or regional economic development;</text></subparagraph><subparagraph id="id5e7fca740e544a5285ea5aa20b0eaa6b"><enum>(N)</enum><text>2 members shall have appropriate expertise and experience in a nonprofit organization that specializes in assisting workers with job placement and other needs, at least 1 of which shall specialize in assisting minority workers; </text></subparagraph><subparagraph id="idB76BA7351B0048F99A388FE867125ED3"><enum>(O)</enum><text>1 member shall have appropriate expertise and experience in a nonprofit organization that provides job and vocational education to unemployed and underemployed individuals;</text></subparagraph><subparagraph id="idf10f3a65c9ce4954b55f8238e776c2fd"><enum>(P)</enum><text>1 member shall have appropriate expertise and experience in a nonprofit organization that specializes in helping assist veterans in career development and job placement;</text></subparagraph><subparagraph id="id6c2db51e114e400994bcff1105634c21"><enum>(Q)</enum><text>1 member shall have appropriate expertise and experience in a nonprofit organization that specializes in helping assist disabled workers; </text></subparagraph><subparagraph id="id97d3891815994d9db14ea2c5cc4ed62d"><enum>(R)</enum><text>1 member shall have appropriate expertise and experience in a nonprofit organization that specializes in helping assist at-risk youth;</text></subparagraph><subparagraph id="idaace86bcbf534bbcb27654521476dacc"><enum>(S)</enum><text>1 member shall have appropriate expertise and experience in a nonprofit organization that specializes in helping assist in rehabilitating workers after incarceration; and</text></subparagraph><subparagraph id="id824ed2a9d5aa4b099fd573cf7364316d"><enum>(T)</enum><text>2 members shall have appropriate expertise and experience in areas not identified in subparagraphs (A) through (S) (such as areas within the technology, energy, and health care sectors), as determined by the Secretary of Labor, in consultation with the other officials referred to in paragraph (1)(A).</text></subparagraph></paragraph><paragraph id="idCF70882A778E488C80BCA68F6815A5D4"><enum>(3)</enum><header>Incorporation</header><text>The initial members of the Board shall serve as incorporators and shall take whatever actions are necessary to establish the Corporation under the District of Columbia Nonprofit Corporation Act (<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/29/4">chapter 4</external-xref> of title 29, District of Columbia Official Code).</text></paragraph><paragraph id="ida7e7f660819f407eb90637b1a41bfccb"><enum>(4)</enum><header>Term of office</header><subparagraph id="id29451F7BD0074DBF8DE739822E2F8AB4"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term of office of each member of the Board shall be 3 years.</text></subparagraph><subparagraph id="id66B624F4CD2C41EE96D897BB5305C7F7"><enum>(B)</enum><header>Exceptions</header><text>Of the members initially appointed to the Board under this subsection—</text><clause id="idc73e5e905c894092a48b918ae7554067"><enum>(i)</enum><text>7 members shall be appointed for an initial 4-year term; </text></clause><clause id="idFB774132AE7D4BE7A8F843879255D99F"><enum>(ii)</enum><text>7 members shall be appointed for an initial 3-year term; and</text></clause><clause id="id2dbc710f5eef4c00856948d007dd16cc"><enum>(iii)</enum><text>7 members shall be appointed for an initial 2-year term.</text></clause></subparagraph></paragraph><paragraph id="id4b25c037a4f14db3953204d0535e3954"><enum>(5)</enum><header>Removal for cause</header><text>The Secretary of Labor may remove any member from the Board for good cause.</text></paragraph><paragraph id="id4d1e16f7ffbe4c7383e0a5835e9963fd"><enum>(6)</enum><header>Vacancies</header><subparagraph id="id0D553AA44DC445B1AF9E3F86827100EC"><enum>(A)</enum><header>In general</header><text>Any vacancy in the Board shall not affect the authority of the Board and shall be filled in the manner required under this subsection. </text></subparagraph><subparagraph id="idCBE3EFF0D57E46BA8A447548EBF72090"><enum>(B)</enum><header>Service after expiration of term</header><text>Any member of the Board whose term has expired may continue to serve on the Board until the earlier of—</text><clause id="id6E4294A30B3941349DE5B3381457C5F3"><enum>(i)</enum><text>the date on which the member’s successor has taken office; or </text></clause><clause id="id9E68C6E13054405ABD397B08514A7DF9"><enum>(ii)</enum><text>the last day of the calendar year in which the member’s term has expired.</text></clause></subparagraph><subparagraph id="idA73A536F9D9E43D78795DEBB2F932173"><enum>(C)</enum><header>Length of appointment</header><text>Any member of the Board appointed to fill a vacancy occurring before the expiration of the term for which that member’s predecessor was appointed shall be appointed for the remainder of such predecessor’s term. </text></subparagraph><subparagraph id="id9A8311D82F984A148CD32E0157F6818A"><enum>(D)</enum><header>Term limit</header><text>A member of the Board may not serve more than 2 consecutive terms (in addition to an initial 2-year term, if applicable).</text></subparagraph></paragraph><paragraph id="idee46968dc7d4467e977bf30bbccddd55"><enum>(7)</enum><header>Election of chair and vice chairs</header><text>Members of the Board shall—</text><subparagraph id="id1053BFEFE3614DF0A238DC8C2E586A5D"><enum>(A)</enum><text>annually elect a member to be Chair; and </text></subparagraph><subparagraph id="id944213B41E964AAF9D42663BE5C6A2DC"><enum>(B)</enum><text>elect 1 or 2 members to be Vice Chair every 2 years.</text></subparagraph></paragraph><paragraph id="id6f4fc3cfecc44138a9ab7ec1bf84353f"><enum>(8)</enum><header>Meetings</header><subparagraph id="idF2E983DB7B7847ED8B3AAA7DE80045F9"><enum>(A)</enum><header>Open to the public</header><text>Meetings of the Board, including any committee of the Board, shall be open to the public. The Board may, by majority vote, close any such meeting only for the time necessary to preserve the confidentiality of commercial or financial information that is privileged or confidential, to discuss personnel matters, or to discuss legal matters affecting the Corporation, including pending or potential litigation. </text></subparagraph><subparagraph id="idE14651BF335247DBA836B92DE4C8565F"><enum>(B)</enum><header>Frequency; locations</header><text>The Chair shall convene Board meetings not less frequently than 4 times per year in diverse locations throughout the United States. </text></subparagraph><subparagraph id="idD33F4E0F9A4A422B874A2B2FA80F7FD1"><enum>(C)</enum><header>Local input</header><text>During Board meetings, members of the Board—</text><clause id="id96367E047EA241E9B1DD4DF90ECF9542"><enum>(i)</enum><text>shall be briefed by local officials and individuals with appropriate expertise in the topic under discussion; and</text></clause><clause id="idBE483FF3D9E54ECB8DF15F0BD68419CC"><enum>(ii)</enum><text>shall review the efforts of the Board and impact of actions taken by the Board. </text></clause></subparagraph><subparagraph id="id235639A94175406494402AA3BFC5A808"><enum>(D)</enum><header>Virtual attendance</header><text>Not fewer than 1 of the Board meetings each year may be conducted virtually to reduce travel and lodging costs. Members of the Board may attend any Board meeting virtually if the member explains to the Board why his or her virtual attendance is necessary.</text></subparagraph></paragraph><paragraph id="id88e4c5c2f9214f958ea85d83b05e8acc"><enum>(9)</enum><header>Not federal employees</header><text>Notwithstanding any other provision of law, members of the Board may not be considered to be employees of the United States Government as a result of their service as members of the Board.</text></paragraph><paragraph id="idd7fba398a2c841ddbc051359e1678eb3" commented="no"><enum>(10)</enum><header>Compensation; expenses</header><text>Members of the Board may not receive any compensation from the Federal Government for their service on the Board, but shall be paid actual travel expenses and per diem in lieu of subsistence expenses when they are away from their usual place of residence, in accordance with section 5703 of title 5, United States Code.</text></paragraph><paragraph id="id17212b495a374734a6edf8cda416b558"><enum>(11)</enum><header>Annual objectives</header><text>The Board shall establish annual objectives through a workforce strategy for the Corporation for each fiscal year, subject to approval by the Secretary of Labor, in consultation with the Secretary of Commerce, the Secretary of Education, the Administrator of the Small Business Administration, the Director of the National Economic Council, and the Chairman of the Council of Economic Advisors.</text></paragraph><paragraph id="id25b5c5dcbb2a45058a63770b95894bf9"><enum>(12)</enum><header>Budget</header><text>Not later than 60 days before the beginning of each fiscal year, the Board shall—</text><subparagraph id="idA3595838348B4A378A3C5A80E33292DD"><enum>(A)</enum><text>submit a copy of the Corporation’s budget for the upcoming fiscal year to the Secretary of Labor, which budget shall include a detailed explanation of any expenditure provided for in the budget in excess of $5,000,000; and</text></subparagraph><subparagraph id="idA1AE5FF25B854A628AB2FF86BB233254"><enum>(B)</enum><text>post a copy of the budget and explanation described in subparagraph (A) on the Corporation's website. </text></subparagraph></paragraph></subsection><subsection id="idc67a60c582c74e08b02a6c039a03349f"><enum>(d)</enum><header>Officers and employees</header><paragraph id="idd77d99deb18f4dbdb46447ebafd3dca2"><enum>(1)</enum><header>In general</header><subparagraph id="id4B42E5140F484BD2A2FDA3C58B6DBE89"><enum>(A)</enum><header>Officers</header><text>The Board shall hire United States citizens to serve as the Executive Director of the Corporation and as such other officers as may be necessary to carry out the duties of the Corporation.</text></subparagraph><subparagraph id="idBE83640F80FA4BC1825E230153835CDA"><enum>(B)</enum><header>Employees</header><text>The Executive Director, under the direction of the Board, shall hire such employees of the Corporation as may be necessary, including—</text><clause id="id8E4167FCCC974236B2D355BF00AB2E00"><enum>(i)</enum><text>individuals with expertise and experience in labor market economics, </text></clause><clause id="idD20C5D2A7781463C84472FBED72919EE"><enum>(ii)</enum><text>individuals with private and public sector experience;</text></clause><clause id="id1FDEC01D072345528D944DF03509E9A5"><enum>(iii)</enum><text>individuals with expertise and experience in public relations; and</text></clause><clause id="id96E9BD78C3FB4597AD9B9AB564D08EBF"><enum>(iv)</enum><text>individuals with expertise and experience in labor relations.</text></clause></subparagraph><subparagraph id="id4D85BAD5462547A8A3D2D0F97ED5B1FF"><enum>(C)</enum><header>Length of service</header><text>Officers and employees hired pursuant to subparagraphs (A) and (B) shall serve for terms fixed by the Board and at the pleasure of the Board. </text></subparagraph><subparagraph id="idF77ED387DF6549A7A3D1C6E443CBBD94"><enum>(D)</enum><header>Compensation</header><clause id="idDDF80272C9E540208ADFDFBAEBB6530F"><enum>(i)</enum><header>In general</header><text>The Corporation may fix the compensation of officers and employees hired pursuant to subparagraphs (A) and (B). </text></clause><clause id="id5BD71E1333FE435C9E3F3F1AAB4E74BF"><enum>(ii)</enum><header>Limitation</header><text>Except as provided in clause (iii), officers and employees of the Corporation may not receive any salary or other compensation from any sources other than the Corporation for services rendered during their employment by the Corporation. </text></clause><clause id="id485028D9B002458E89D3FF0D9CFEF31A"><enum>(iii)</enum><header>Service for other organizations</header><text>Officers may receive compensation for service on the Board of Directors or a committee of an organization that does not receive funds from the Corporation if such service has been approved in advance by the Board and is subject to the provisions of the Corporation's Statement of Ethical Conduct. </text></clause></subparagraph></paragraph><paragraph id="id11ecc45330ed4e78b7ee27e1e28bf339"><enum>(2)</enum><header>Nonpolitical nature of appointment</header><text>No political test or qualification may be used in selecting, appointing, promoting, or taking other personnel actions with respect to officers or employees of the Corporation.</text></paragraph></subsection><subsection id="id0fb0c750f9c8479e9b222755dbccaeb4"><enum>(e)</enum><header>Nonprofit and nonpolitical nature of Corporation</header><paragraph id="id4ecd24798f604cd2920751e806e851fc"><enum>(1)</enum><header>Stock</header><text>The Corporation shall have no power to issue any shares of stock, or to declare or pay any dividends.</text></paragraph><paragraph id="id2835773da9b246cea7fb93eefdb359cb"><enum>(2)</enum><header>Profit</header><text>No part of the income or assets of the Corporation shall inure to the benefit of any director, officer, employee, or any other individual except as salary or reasonable compensation for services.</text></paragraph><paragraph id="id037763ed1b4a4a2a954f66633bcc54e6"><enum>(3)</enum><header>Political contributions</header><text>The Corporation may not contribute to or otherwise support any political party or candidate for elective public office. Individual members of the Board are not prohibited from such activities when acting in their personal capacity.</text></paragraph><paragraph id="id747cc481519a48ff8af93ca3a5c66cea"><enum>(4)</enum><header>Lobbying activities</header><text>It is the sense of Congress that the Corporation should not engage in lobbying activities (as defined in section 3(7) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1602">2 U.S.C. 1602(7)</external-xref>). Individual members of the Board are not prohibited from such activities in their personal capacity.</text></paragraph><paragraph id="id823f6cc41b8b46a3a83cdcdd1abb2b94"><enum>(5)</enum><header>Broad focus</header><text>In carrying out its duties under this section, the Corporation may not overtly prioritize any particular group of jobs or industries beyond what is statistically justified.</text></paragraph></subsection><subsection id="id3D9A7F6DDB8D4DD7A283CB8B9774F5E8"><enum>(f)</enum><header>Duties and powers</header><paragraph id="id10BD213089FC45399E597FDE76E43CF0"><enum>(1)</enum><header>Annual reports</header><subparagraph id="idDF190FB5574945288F036482252BE8F5"><enum>(A)</enum><header>Operations</header><text>Not later than March 1st of each year, the Corporation shall submit a report to the Secretary of Labor, which shall include, with respect to the preceding fiscal year—</text><clause id="id499bfc089f8c4107b40154e343c39325"><enum>(i)</enum><text>a comprehensive and detailed description of the Corporation’s operations, activities, financial condition, and accomplishments in promoting United States workers, the domestic job market, and career pathways, including any actions authorized under paragraph (5);</text></clause><clause id="id19f9665a2a3842e9a3ce6beac9569df6"><enum>(ii)</enum><text>a comprehensive and detailed accounting of amounts obligated or expended by the Corporation;</text></clause><clause id="idf8668eed66ab4998b8bf44a976db3341"><enum>(iii)</enum><text>a detailed description of each in-kind contribution received by the Corporation, including, for each such contribution—</text><subclause id="id6337e44082d94a43b4e384d723c1bddf"><enum>(I)</enum><text>its fair market value;</text></subclause><subclause id="id85c8928a0f6f463194ad6fc0354dd88e"><enum>(II)</enum><text>the individual or organization responsible for making the contribution;</text></subclause><subclause id="idedf5554d5cbf474babd58059b130696b"><enum>(III)</enum><text>its specific use; and</text></subclause><subclause id="id11a27efab5fe46a69f5ef39afeb99b90"><enum>(IV)</enum><text>a justification for its use within the context of the Corporation’s mission;</text></subclause></clause><clause id="id264c0d82a17a45199606f9970902fb28"><enum>(iv)</enum><text>an objective and quantifiable measurement of the progress made, on an objective-by-objective basis, in meeting the objectives established by the Board and included within the annual workforce strategy;</text></clause><clause id="idcf7ecda4436145079345eea07ac8928b"><enum>(v)</enum><text>an explanation of any challenges to achieve an objective established by the Board and any revisions or alterations to the Corporation’s objectives established by the Board pursuant to the annual workforce strategy;</text></clause><clause id="idd0a72d96acda47188625bd5875c49186"><enum>(vi)</enum><text>such recommendations as the Board considers appropriate for all workforce stakeholders, including the Executive branch, Congress, States, and local governments. </text></clause></subparagraph><subparagraph id="idABFC9896C4AF4C0598C5CD9FCAEC1F15"><enum>(B)</enum><header>Workforce strategy</header><text>Not later than January 1st of each year, the Corporation shall develop and submit to the Secretary of Labor an annual workforce strategy for engaging all labor market stakeholders about opportunities or changes to useful degrees, registered apprenticeship programs, and certifications or skill sets, which shall include—</text><clause id="id201510f1fd904374927d5b49857f5eab"><enum>(i)</enum><text>setting specific workforce performance goals to be supported by the Corporation that benefit all States, territories, and the District of Columbia;</text></clause><clause id="idDA976A7CE17C4BFF85A1B6D5539EF5B1"><enum>(ii)</enum><text>identifying opportunities and strategies to create more job and career building opportunities and mobility to rural, urban, and suburban areas;</text></clause><clause id="id6ea5dd1917e24612b64838cbb7598863"><enum>(iii)</enum><text>evaluating the current and future state of the United States workforce, including projected emerging job and skill needs across all sectors of the United States economy;</text></clause><clause id="id93B9A9BBBD95485686CF7AC9AD9DD2B6"><enum>(iv)</enum><text>identifying and addressing potential impacts of emerging technologies on the workforce;</text></clause><clause id="iddf42ff48abbf409598daaf8db0bb7654"><enum>(v)</enum><text>providing information pertaining to— </text><subclause id="id910e194e80a24ef9b85366d092380bf8"><enum>(I)</enum><text>the 25 job classifications that are currently in the highest demand in each State or region, according to the latest State and regional assessments and reports;</text></subclause><subclause id="idaf7b888e1c624644b7e42827c4dbf18e"><enum>(II)</enum><text>the 50 job classifications that are currently in the highest demand nationwide; and</text></subclause><subclause id="idcdb85011c0ec48138edce68e106db5d6"><enum>(III)</enum><text>the emerging job market trends anticipated 5 years and 10 years into the future;</text></subclause></clause><clause id="idC4E28BFC8FC7480C977A2E2DD287197B"><enum>(vi)</enum><text>taking a strategic look at whether it is more accurate or effective to break the lists referred to in clause (v) into regions, rather than breaking them up exclusively along State lines;</text></clause><clause id="id3e7eb2a2195c4a829a3387006321df68"><enum>(vii)</enum><text>exploring and providing information on how to better connect the appropriate employers and workers, including by highlighting emerging industries to better link potential employees to the business and job markets that are hiring;</text></clause><clause id="id1619f2c8af994500bc4c65994f23ab54"><enum>(viii)</enum><text>identifying necessary general skill sets, such as time management, judgement and decision making, operation monitoring, coordination, speaking, critical thinking, active listening, and material resource management, that are most desired, important, and needed by employers and the most in-demand jobs and careers;</text></clause><clause id="id6c1b4a502c52441089d54e878037207a"><enum>(ix)</enum><text>identifying the necessary specific skill sets needed to match the demands of the Nation, State, or region’s in-demand job markets;</text></clause><clause id="idf22eb9eba50c42988e775a24ec0486fd"><enum>(x)</enum><text>identifying the current education and training capacity of United States educational and vocational institutions and career pathways to meet the workforce needs identified pursuant to clauses (iii) and (v), including fields for which there is a shortfall or surplus of education and training capacity;</text></clause><clause id="id70f9f10c70464db0ba9000f77768d973"><enum>(xi)</enum><text>identifying and addressing what motivates workers and promoting such motivators;</text></clause><clause id="idc772c72f55be4f7e9907daec4ebae936"><enum>(xii)</enum><text>identifying and addressing barriers to retaining individuals in careers;</text></clause><clause id="idd3a14db00a5c4f17b1477cb7a440cbb5"><enum>(xiii)</enum><text>identifying and addressing factors influencing individuals pursuing careers in in-demand fields, including barriers to attracting individuals into such fields, particularly young people and traditionally underrepresented populations, including women and minorities;</text></clause><clause id="ide21e812d88294865adfa445b3a200a8a"><enum>(xiv)</enum><text>considering how Federal agencies, businesses, industries, labor organizations, educators, and other stakeholders can coordinate efforts to support qualified individuals in pursuing careers in high-demand fields;</text></clause><clause id="ideef3315f7b4d4d8d9547ab48405345fe"><enum>(xv)</enum><text>identifying and addressing the most effective manner to transition between jobs or between geographic locations;</text></clause><clause id="id1e69ee9597484d5b96d0d28569b614df"><enum>(xvi)</enum><text>identifying and addressing any potential stigmas or misperceptions, that influence whether young individuals pursue careers associated with certain jobs or career paths in in-demand fields;</text></clause><clause id="idb1985e719fbf4a3388d7da6b89dad120"><enum>(xvii)</enum><text>facilitating and encouraging elementary, secondary, and postsecondary students in the United States to pursue careers in in-demand fields;</text></clause><clause id="idf5a813550bfb41f1bd9a4ad9500c0eba"><enum>(xviii)</enum><text>identifying and developing pathways for students and individuals to secure apprenticeships readiness, registered apprenticeships, and other work-based learning opportunities in in-demand fields;</text></clause><clause id="id1a2028b2ea5c44d498854e09341932d3"><enum>(xix)</enum><text>identifying methods of enhancing apprenticeships readiness and registered apprenticeships, job skills training, mentorship, education, and outreach programs that are exclusive to youth, veterans, disabled persons, and senior citizens in the United States;</text></clause><clause id="idede8da7ec81e4b908da7b825c452b4a8"><enum>(xx)</enum><text>identifying potential sources of funding, including grants and scholarships, that may be used to support youth, veterans, disabled persons, senior citizens, and other qualified individuals in pursuing careers in high-demand fields;</text></clause><clause id="iddea38a8441664a32976c2b657812aa0a"><enum>(xxi)</enum><text>reevaluating education and workforce training programs to meet constantly changing employer needs and engaging with business leaders, educational institutions, and community-based organizations to ensure that the needs of the workforce are being offered in education and training;</text></clause><clause id="id71d120b1864c446d897906e1c06543d1"><enum>(xxii)</enum><text>creating policies that build pathways between secondary education, post-secondary education, training institutions, and business communities;</text></clause><clause id="id5539c9af96604ab381a55a946226ae76"><enum>(xxiii)</enum><text>ensuring that secondary education, post-secondary education, workforce training, and business development programs consider equity by targeting investments in low-income neighborhoods, which often results in higher growth rates and broader equity and inclusivity; and</text></clause><clause id="id829b0bb9543b4f1fa798c59e6b127537"><enum>(xxiv)</enum><text>conducting outreach to employers to persuade the employers to adopt these options, including the registered apprenticeship model.</text></clause></subparagraph><subparagraph id="id315ba1e8744848cb825c68f0f7e33d56"><enum>(C)</enum><header>Marketing plan</header><text>In conjunction with the workforce strategy developed pursuant to subparagraph (B), the Corporation shall develop and submit an annual marketing plan to the Secretary of Labor that—</text><clause id="idCEAE7E37143342FEB584C21D77026228"><enum>(i)</enum><text>incorporates the elements described in subparagraph (B);</text></clause><clause id="id45a05001688c4145b71c97e1b6f61c06"><enum>(ii)</enum><text>helps individuals chart a career path that will place them in the middle class or higher without having to work more than 1 job;</text></clause><clause id="id3611257b48b74a3ab4fd27a141042a24"><enum>(iii)</enum><text>informs individuals of professional development opportunities, including the advantageous longitudinal outcomes associated with such opportunities;</text></clause><clause id="id4964b5fe8e5040f4b57db5eb7f2ec7d9"><enum>(iv)</enum><text>markets the options regionally to employers, nonprofit organizations, workforce boards, potential apprentices, secondary school students, counselors, school administrators, and parents;</text></clause><clause id="id19dbbad4c1254c399437e6359e65d642"><enum>(v)</enum><text>maximizes the economic benefits to the United States by promoting effective business and workforce integration in the United States through advertising, outreach to educational institutions, labor organizations, business trade shows, and other appropriate promotional activities;</text></clause><clause id="id4ccdeb74722e4f0d89016ad56b626a1f"><enum>(vi)</enum><text>addresses ways to diversify the employment and career pathways in many industries by—</text><subclause id="id53C7ED152C0243CF84C148E07931968B"><enum>(I)</enum><text>providing employment opportunities to underrepresented communities; </text></subclause><subclause id="idF08EE87FBE5D4C66ADB38654AE3529DC"><enum>(II)</enum><text>promoting diversity among these options by marketing and supporting outreach to underrepresented populations, including women and minorities; and </text></subclause><subclause id="idC2EA78DB25E84D02A301E8566D963808"><enum>(III)</enum><text>increasing access for vulnerable or underrepresented populations, especially women and minorities, to high skill and other in-demand careers;</text></subclause></clause><clause id="id4bc0e79e8e3f427390ad99b6ee5cec8c"><enum>(vii)</enum><text>more effectively coordinates veterans, seniors, and disabled populations into the job market;</text></clause><clause id="idcc983fe548bd4a979fb339758d1b4646"><enum>(viii)</enum><text>includes regional, State, or local analyses in the Corporation’s materials and marketing efforts;</text></clause><clause id="idfa84107fccdd413db0f4c2ff4ccdd63e"><enum>(ix)</enum><text>evaluates and provides awards or recognition in accordance with paragraph (4); and</text></clause><clause id="idd91597f25c13477991b2dbad22329e18"><enum>(x)</enum><text>includes a <quote>Workforce Report Card</quote> to monitor the progress made towards meeting annual workforce performance goals established pursuant to subparagraph (B)(i).</text></clause></subparagraph></paragraph><paragraph id="id46B914528C1B4164A0C95373ADFAEB48"><enum>(2)</enum><header>Annual united states career forecast and resource guide</header><text>Not later than April 1st of each year, the Corporation, using elements required in the annual workforce strategy and any other information and resources readily available from Federal, State, and local governments, consortiums, and academic institutions, shall publish an annual public United States Career Forecast and Resource Guide that provides such information in a plain, understandable way—</text><subparagraph id="id85063c4308b4418aabb63361179e038f"><enum>(A)</enum><text>to educate the American public regarding the United States job market, including—</text><clause id="id8858918062AE41AE8D57974BD946F3CF"><enum>(i)</enum><text>information regarding in-demand industries, workforce needs, and pathways for training for and obtaining available jobs; and</text></clause><clause id="idC7A038F31C424C6787E4805186A51339"><enum>(ii)</enum><text>identifying and correcting common misperceptions regarding such issues;</text></clause></subparagraph><subparagraph id="id092bc30ab2ee48ac90c81772b1441bf4"><enum>(B)</enum><text>to provide useful, understandable, and concrete information to students, workers, businesses, scholars, scientists, and others involved in the United States job market;</text></subparagraph><subparagraph id="id96571b2facc141c0a2132792b155b661"><enum>(C)</enum><text>to identify the workforce needs of the United States economy, broken down by State, or regions, as appropriate, and time period, including government employment and other public service employment;</text></subparagraph><subparagraph id="id2cc3a71fa9e74605aa143261ed1f9d0f"><enum>(D)</enum><text>to outline effective career development opportunities that include additional or complementary career pathways;</text></subparagraph><subparagraph id="id9843837b145042548a5392f9f130079b"><enum>(E)</enum><text>to promote opportunities and pathways for small businesses and entrepreneurship;</text></subparagraph><subparagraph id="id7ce55cd7bfd344d79e5ba0371be15bcf"><enum>(F)</enum><text>to provide a list of Federal and State resources to assist United States workers, educators, or career counselors to navigate relevant career pathways in fields in which more workers are needed;</text></subparagraph><subparagraph id="idb3912f0cc58e4dd59b2bc8d17ee4957b"><enum>(G)</enum><text>to advocate for the implementation of education and training systems, including registered apprenticeships, that are fully aligned with workforce needs;</text></subparagraph><subparagraph id="id7ff5efe077ba426ab3706ff8fc50bfb6"><enum>(H)</enum><text>to promote underrepresented communities in in-demand industries;</text></subparagraph><subparagraph id="id7f8ec9a27fbd4e58914891d0e48e807f"><enum>(I)</enum><text>to include rural workforce and job markets in all workforce development efforts;</text></subparagraph><subparagraph id="id4f1e6a168a6b4cecbdf0409a16234701"><enum>(J)</enum><text>to focus on in-demand industries and populations that are most likely to drive the United States economy;</text></subparagraph><subparagraph id="id5ab47c23fc5347d1881993250360ea12"><enum>(K)</enum><text>to outline the economic and other benefits of filling domestic job markets with properly trained United States workers through advertising, outreach to workforce and business associations, and other appropriate promotional activities; and</text></subparagraph><subparagraph id="idac5cba57a7904f6eb0194309d6d05501"><enum>(L)</enum><text>to identify efforts that can be made by employers, educators, and workers to provide for greater income mobility and economic stability in the future job market. </text></subparagraph></paragraph><paragraph commented="no" id="idCBE6D1BF63C54BE0911B5BCC58DF3A03"><enum>(3)</enum><header>Distribution of report and strategy</header><text>Not later than 60 days after receiving each operations report pursuant to paragraph (1)(A) and each workforce strategy pursuant to paragraph (1)(B), the Secretary of Labor shall submit a copy of such report and strategy to—</text><subparagraph commented="no" id="id31712abb4acc45a797f910162e229fd6"><enum>(A)</enum><text>the Secretary of Education;</text></subparagraph><subparagraph commented="no" id="id29660cde530d44888ce0d00631a51e20"><enum>(B)</enum><text>the Secretary of Commerce;</text></subparagraph><subparagraph commented="no" id="idfe5409f40365473f958fd9f9ca6254fe"><enum>(C)</enum><text>the Administrator of the Small Business Administration;</text></subparagraph><subparagraph commented="no" id="idf58f95e56ff542c9a17f6b73f3356e41"><enum>(D)</enum><text>the Director of the National Economic Council;</text></subparagraph><subparagraph commented="no" id="idadd22a6f2484403b9de6c6d7755c9f34"><enum>(E)</enum><text>the Chairperson of the Council of Economic Advisors;</text></subparagraph><subparagraph commented="no" id="id79D01651DB80492ABDBD5E0309FB4094"><enum>(F)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" id="id99871F13AEF04F28850DE47DBC6DCC7E"><enum>(G)</enum><text>the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" id="id36893E014432493D8375222DE9644F25"><enum>(H)</enum><text>the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" id="idBA96026DA1D64773A1402464578B9A5D"><enum>(I)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" id="id1445FB0F28BD49D79A4015B0D17F79CC"><enum>(J)</enum><text>the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>; and </text></subparagraph><subparagraph commented="no" id="id81907862DBFA48C6959D6FCD961F46D0"><enum>(K)</enum><text>the <committee-name committee-id="">Committee on Education and Labor of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="idd0694d9379d24588bf1758f706341d71"><enum>(4)</enum><header>Recognition awards</header><text>The Corporation shall establish an awards program to annually recognize—</text><subparagraph id="id11233ac43ae04abfae98da1176df46eb"><enum>(A)</enum><text>workers and students who achieve excellence in registered apprenticeships, adult education programs, career and technical education programs, or other nontraditional workforce development pathways; </text></subparagraph><subparagraph id="idEF33034E212447B2BD48CAFBCDD38708"><enum>(B)</enum><text>educational institutions that take unique or innovative approaches to developing a skilled workforce; and </text></subparagraph><subparagraph id="id9ed130b1f1294e458c7e716d217236c9"><enum>(C)</enum><text>businesses that take unique or innovative approaches to developing a skilled workforce.</text></subparagraph></paragraph><paragraph id="idf61c99faa24140ef882ead8d02ecf838"><enum>(5)</enum><header>Powers</header><text>In order to carry out the activities required under this subsection, the Corporation may—</text><subparagraph id="id82595392b32f4df49cb94cea9187ea98"><enum>(A)</enum><text>obtain grants from, partner with, and make contracts with, Federal and State agencies, trade associations, private companies, coalitions, and other institutions with relevant expertise;</text></subparagraph><subparagraph id="idd1da70bfcbb94d10b59e3af364878235"><enum>(B)</enum><text>hire or accept the voluntary services of consultants, experts, advisory boards, and panels to aid the Corporation in carrying out such activities; and</text></subparagraph><subparagraph id="id9c99175ffd5b4ae69bd117a4eb3bd27e"><enum>(C)</enum><text>take such other actions as may be necessary to accomplish such activities.</text></subparagraph></paragraph></subsection><subsection id="id7967C25FD5B34C139009F8B7B5BC6D8C"><enum>(g)</enum><header>Website</header><text>The Corporation shall develop and maintain a publicly accessible website through which it shall—</text><paragraph id="id31A75F8915BE4F30AE93EC02278052DB"><enum>(1)</enum><text>provide information to the public, including stakeholders;</text></paragraph><paragraph id="id29518315E39743F494AC82AA81B840FB"><enum>(2)</enum><text>conduct public outreach activities; and</text></paragraph><paragraph id="id755D1C1D870D4FEFAF14EBF6463ED6D0"><enum>(3)</enum><text>distribute marketing campaign materials, including the resource guide described in subsection (f)(2).</text></paragraph></subsection><subsection id="id43ba1fe4aba847949e47ead476cdf8e0"><enum>(h)</enum><header>Use of available data and statistics</header><text>In carrying out all of the duties and activities described in this section, the Corporation shall—</text><paragraph id="id74CF2127B3FD490388F6D00B4A3941EF"><enum>(1)</enum><text>make use of all relevant and available data and statistics used by Federal and State agencies, as appropriate, including reports, data collection, surveys, and the similar efforts;</text></paragraph><paragraph id="id890F6B71D0914D11AF19F4D23B02E705"><enum>(2)</enum><text>take all necessary precautions to avoid maintaining any individual’s personal information; and</text></paragraph><paragraph id="id33c822c77ecb47659b5abbfe9e4aa393"><enum>(3)</enum><text>make available the data, information, and statistics it collects for the responsible use by Federal and State agencies, as appropriate, including reports, data collection, surveys, and similar efforts. </text></paragraph></subsection></section><section id="id76A4658D5434472EB02C097A862DA1F7"><enum>4.</enum><header>Funding</header><subsection id="idFBDF974FDE244A01879A971966054D3C"><enum>(a)</enum><header>Authorization of appropriations</header><paragraph id="id2F9B8E94CFA14DDB9E5A7148B24C95C7"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated $25,000,000 for each of the fiscal years 2022 through 2026 to carry out this Act.</text></paragraph><paragraph id="idC07C020294E146E8BC2E09D6EE65BB40"><enum>(2)</enum><header>Additional funding during periods of high unemployment</header><text>During any of the fiscal years referred to in paragraph (1) in which the United States unemployment rate exceeds 10 percent, there is authorized to be appropriated an additional $25,000,000 to carry out this Act.</text></paragraph></subsection><subsection id="id9AE6EF7AF0FA45B98951086B2CC88F9E"><enum>(b)</enum><header>Non-Federal contributions</header><text>The Corporation shall seek up to $25,000,000 annually in contributions from—</text><paragraph id="id96323A6633DC461A9A150094FC5CA796"><enum>(1)</enum><text>United States corporations;</text></paragraph><paragraph id="idB6A7A92006E847968DFF8EA665FAAEE4"><enum>(2)</enum><text>local chambers of commerce;</text></paragraph><paragraph id="id9E971CE169C448248E30D2199EECEF58"><enum>(3)</enum><text>institutions of higher education, including vocational schools;</text></paragraph><paragraph id="id2FF46801E9E0417CB101E116573AA9C5"><enum>(4)</enum><text>State and local governments;</text></paragraph><paragraph id="id6afc651615b4450bae650c8bba8618f3"><enum>(5)</enum><text>workforce boards;</text></paragraph><paragraph id="id573a5f943905475f8c0df50f8ba73974"><enum>(6)</enum><text>nonprofit organizations;</text></paragraph><paragraph id="id0790d23a43084898911ae502a476c056"><enum>(7)</enum><text>labor organizations; and</text></paragraph><paragraph id="idebdefdebb51b43d8b5cf96710671ba3e"><enum>(8)</enum><text>other interested stakeholders that the Corporation considers appropriate. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3CB65AEBA93645A2AE210864ADD7C26C"><enum>(c)</enum><header>United States Career Pathways Fund</header><paragraph commented="no" display-inline="no-display-inline" id="id7930988BF1E34EEF8534B8B0D0955163"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the general fund of the Treasury a separate account, which shall be known as the <quote>United States Career Pathways Fund</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B37A7E652AE47FDAD77E7E9E75226CB"><enum>(2)</enum><header>Deposits</header><text>There shall be deposited into the United States Career Pathways Fund—</text><subparagraph commented="no" display-inline="no-display-inline" id="idFA32079AA6024FAF96569E0B34C6745A"><enum>(A)</enum><text>amounts appropriated pursuant to subsection (a); and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id20EF10B64CE44A2BB4671F1B25C4A8F1"><enum>(B)</enum><text>amounts donated to the Corporation for Career Pathways in accordance with subsection (b).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAFCD1EA6CFC14367A201A8BCA61D15A3"><enum>(3)</enum><header>Use of fees</header><text display-inline="yes-display-inline">Amounts deposited into the United States Career Pathways Fund shall remain available until expended for grants for the Corporation or for State and local workforce boards to assist in the implementation of the annual workforce strategy described in section 3(f)(1)(B).</text></paragraph></subsection><subsection id="id2a7877d433b3410ba35c9f2ebe58f9a9"><enum>(d)</enum><header>Matching public and private funding</header><paragraph id="idd3b6017bf43d4c29bc24882d2b1a2316"><enum>(1)</enum><header>Start-up expenses</header><subparagraph id="id906ACC7A8F894E7785148667587E89AA"><enum>(A)</enum><header>In general</header><text>Subject to paragraph (3), of the amounts deposited into the United States Career Pathways Fund pursuant to subsection (c)(2), the Secretary of the Treasury shall make available to the Corporation up to $10,000,000 to cover the Corporation's initial expenses and activities under this Act. </text></subparagraph><subparagraph id="idEF2A4D049A2E4821B5784DE34E888B1D"><enum>(B)</enum><header>Quarterly transfers</header><text>Transfers from the United States Career Pathways Fund to the Corporation shall be made not less frequently than quarterly, beginning on January 1, 2022, on the basis of estimates by the Secretary of the Treasury. Proper adjustments shall be made in amounts subsequently transferred to the extent prior estimates were in excess or less than the amounts required to be transferred.</text></subparagraph></paragraph><paragraph id="idc52fdbd92d654f5a9eddda5e6a6fb3f8"><enum>(2)</enum><header>Funding for subsequent fiscal years</header><text>Subject to paragraph (3), for each of the fiscal years 2022 through 2026, the Secretary of the Treasury shall transfer make quarterly transfers from the United States Career Pathways Fund to the Corporation in an amount that is equal to the amount deposited into the United States Career Pathways Fund during the prior quarter.</text></paragraph><paragraph id="id974574c1e72f442c8a3f8bd5e29d487e"><enum>(3)</enum><header>Matching requirement</header><subparagraph id="id2b8b996f3f1d42e09d8eb1ecf1107963"><enum>(A)</enum><header>In general</header><text>Amounts may not be transferred to the Corporation under this subsection unless, for each of the fiscal years 2023 through 2026, the Corporation provides a non-Federal match equal to the amount transferred to the Fund under paragraph (2) for each such fiscal year.</text></subparagraph><subparagraph id="id2fcc6bf419fc4aafb9acb10fa828cc4c"><enum>(B)</enum><header>Goods and services</header><clause id="idD700D9EFFD7C4639BC324A4779DF149A"><enum>(i)</enum><header>In general</header><text>For the purpose of determining the value of the non-Federal match under subparagraph (A) the fair market value of goods and services (including advertising) contributed to the Corporation—</text><subclause id="id300D0A260806460EBFF8A21132B8607F"><enum>(I)</enum><text>may be included in the determination; and</text></subclause><subclause id="id6f8f5fdb8a5d41d78b9c2a8d525d5f46"><enum>(II)</enum><text>may not account for more than 80 percent of the matching requirement in any fiscal year.</text></subclause></clause><clause id="id4e36c9d6b4f4431eb8a1602e08e18140"><enum>(ii)</enum><header>Right of refusal</header><text>The Corporation may decline to accept any in-kind contribution determined to be inappropriate, not useful, or commercially worthless. </text></clause></subparagraph><subparagraph id="ide92eaa2649a54a3583b3fd8d36639a75"><enum>(C)</enum><header>Waiver</header><text>The matching requirement under subparagraph (A) shall be waived during the 12-month period beginning on the date on which the United States unemployment rate is greater than 10 percent. </text></subparagraph><subparagraph id="ide8e3752976fd4e78b7361db97c1ca398"><enum>(D)</enum><header>Limitation</header><text>The Corporation may not obligate or expend funds in excess of the total amount received by the Corporation for a fiscal year from Federal and non-Federal sources. </text></subparagraph></paragraph><paragraph id="id26dfcdd5719e47f5af3ad148e4d1f894"><enum>(4)</enum><header>Carryforward</header><subparagraph id="id02b374b1c0db463eb2126f594abb95ab"><enum>(A)</enum><header>Federal funds</header><text>Amounts transferred to the Fund under paragraph (1) or (2) shall remain available until expended.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1784fcee7e614c859d1e4686a7fe27b4"><enum>(B)</enum><header>Matching funds</header><text>Any amount received by the Corporation from non-Federal sources in any of fiscal year 2022 through 2026 that cannot be used to meet the matching requirement under paragraph (3)(A) for the fiscal year in which amount was collected may be carried forward and treated as having been received in the succeeding fiscal year for purposes of meeting such matching requirement in such succeeding fiscal year.</text></subparagraph></paragraph></subsection><subsection id="id65ea8abcd17f4352b80b3ece0e2e6812"><enum>(e)</enum><header>Limitations on use of funds</header><paragraph id="idCCF74821E3B748E584C5D91E7B4492EC"><enum>(1)</enum><header>In general</header><text>Amounts deposited into the Corporation for Career Pathways Account may not be used for any purpose other than carrying out the responsibilities of the Corporation under this subsection.</text></paragraph><paragraph id="idbb1f372649784026955fab75a4bd69b1"><enum>(2)</enum><header>Major campaigns</header><text>The Board may not authorize the Corporation to obligate or expend more than $15,000,000 on any advertising campaign, promotion, or related effort unless—</text><subparagraph id="id73b248088734459bac59b5ce39ed7434"><enum>(A)</enum><text>at least 10 members of the Board are present (including virtual presence, as authorized under paragraph 3(c)(8)(D)) at the meeting at which such obligation or expenditure is approved;</text></subparagraph><subparagraph id="id8c1301404ee74f8387c6f310344a905d"><enum>(B)</enum><text>such obligation or expenditure is approved by an affirmative vote of at least 2/3 of such members; and</text></subparagraph><subparagraph id="id2be95ca6e0c442738a1e8e27768156ff"><enum>(C)</enum><text>each member of the Board was given at least 3 days advance notice of the meeting at which the vote on the obligation or expenditure is to be taken that identifies the matters to be voted upon at such meeting.</text></subparagraph></paragraph></subsection><subsection id="idd6630863d7d044ef8ee810ba3750ae08"><enum>(f)</enum><header>Accountability</header><paragraph id="id3acd62daafad45fd8dc85e7706ec7164"><enum>(1)</enum><header>Annual financial audits</header><subparagraph id="id9DAE5BEC8B1B43ABA34D4FF2F902AEA0"><enum>(A)</enum><header>In general</header><text>The Corporation shall contract with an independent accounting firm to conduct an annual financial audit of the Corporation’s operations and shall publish the results of each audit on its public website. </text></subparagraph><subparagraph id="id9B9928B2796749859E6BB3F2991D47C0"><enum>(B)</enum><header>GAO review</header><text>The Comptroller General of the United States may—</text><clause id="id9531528652954F71BF98604043E51CB1"><enum>(i)</enum><text>review any audit of a financial statement conducted under subparagraph; and</text></clause><clause id="id2894D415B9FA40F698FA3F33A0FD1509"><enum>(ii)</enum><text>conduct periodic audits of the Corporation's operations. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f40a7e9131446c2be4a21e1b497948b"><enum>(2)</enum><header>Program review</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idAE8030BC1E264194A4FBC93903522F5F"><enum>(A)</enum><text>conduct a review of the programmatic activities of the Corporation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB1BCD428FC4A4122A46EAB6F1D16FF73"><enum>(B)</enum><text>submit a report to the appropriate congressional committees that contains the results of such review. </text></subparagraph></paragraph><paragraph id="id2190FF68F6D242A9B075306B1D274317"><enum>(3)</enum><header>Access to records</header><text>The Corporation shall provide Congress and the Comptroller General of the United States with full and complete access to the books and records of the Corporation.</text></paragraph></subsection></section></legis-body></bill>
