<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1440</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210428">April 28, 2021</action-date><action-desc><sponsor name-id="S388">Ms. Hassan</sponsor> (for herself and <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make technical corrections to the FAFSA Simplification Act.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FAFSA Simplification Technical Corrections Act</short-title></quote>.</text></section><section id="idFE136B3A8CD540E6BFFF08DBDA7933B7"><enum>2.</enum><header>Early implementation of FAFSA simplification</header><subsection id="id229C8348ECE14513878ADF80DB69F6B9"><enum>(a)</enum><header>FAFSA Simplification Act</header><text display-inline="yes-display-inline">The FAFSA Simplification Act (title VII of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) is amended—</text><paragraph id="id32B76A59FA9C4BCAB66DD63F750C237B"><enum>(1)</enum><text display-inline="yes-display-inline">in section 702—</text><subparagraph id="id581E9B4C42A54774A7D5F2A5329BD363"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (n), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB758FDDBA8684979B679E6545CDCC5D0"><paragraph id="idC606CB0A73EF4FD1A1085876C1B8A8B4"><enum>(3)</enum><header>Implementation</header><text>In carrying out the amendments made by paragraph (1)(A)(i), and paragraph (1)(A)(iv) to add subsection (s) to section 484 of the Higher Education Act of 1965, or any regulations promulgated under such amendments, the Secretary of Education may waive the application of—</text><subparagraph id="id79908B21DCFB447E8A075203D295C45C"><enum>(A)</enum><text>subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>);</text></subparagraph><subparagraph id="idEEF5AF448C584876B8E647FA57F7A1CA"><enum>(B)</enum><text>the master calendar requirements under section 482 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1089">20 U.S.C. 1089</external-xref>);</text></subparagraph><subparagraph id="id9E4122C96B2E4171BB9C37E2959A3913"><enum>(C)</enum><text>negotiated rulemaking under section 492 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1098a">20 U.S.C. 1098a</external-xref>); and</text></subparagraph><subparagraph id="id3C21E74C81934792B830DBC9AAFE8C23"><enum>(D)</enum><text>the requirement to publish the notices related to the system of records of the agency before implementation required under paragraphs (4) and (11) of section 552a(e) of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>), except that the notices shall be published not later than 180 days after the date of implementation of the amendments, as determined in accordance with paragraph (2).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id92565747F16C47C4A14D72EF399AC87B"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3077995d532b4a58875f0787993c55df"><subsection id="idbf7b1f1f0ea94951ae62b75a8a167e18"><enum>(q)</enum><header>Early effective date; implementation</header><paragraph id="id15a7df77e09d4379907343ae4ee3d95f"><enum>(1)</enum><header>Effective date</header><text>Notwithstanding section 701(b) of this title, the Secretary of Education may implement the amendment made by subsection (l)(1) of this section, which pertains only to foster youth and unaccompanied homeless youth, before (but not later than) July 1, 2023. The Secretary shall specify in a designation on what date, under what conditions, and for which award years the Secretary will implement such amendment prior to July 1, 2023. The Secretary shall publish any designation under this paragraph in the Federal Register at least 60 days before implementation.</text></paragraph><paragraph id="idb4cd4e60390f42b78fe328bc68b51b2c"><enum>(2)</enum><header>Implementation</header><text>In carrying out the amendment made by made by subsection (l)(1) of this section, which pertains only to foster youth and unaccompanied homeless youth, or any regulations promulgated under such amendment, which pertains only to foster youth and unaccompanied homeless youth, the Secretary of Education may waive the application of—</text><subparagraph id="idF2EFACDDB9464F6B9881061587C96AB6"><enum>(A)</enum><text>subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>);</text></subparagraph><subparagraph id="idE00BAA7AF46C45F391DEC34F2CD2FDD1"><enum>(B)</enum><text>the master calendar requirements under section 482 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1089">20 U.S.C. 1089</external-xref>);</text></subparagraph><subparagraph id="id512A8303A49A40F3845D826F985919DE"><enum>(C)</enum><text>negotiated rulemaking under section 492 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1098a">20 U.S.C. 1098a</external-xref>); and</text></subparagraph><subparagraph id="id1AB1580337C14751A3658B4979E7D690"><enum>(D)</enum><text>the requirement to publish the notices related to the system of records of the agency before implementation required under paragraphs (4) and (11) of section 552a(e) of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>), except that the notices shall be published not later than 180 days after the date of implementation of the amendment, as determined in accordance with paragraph (1).</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idB2F30620A8B047D080B4A55FC13629D8"><enum>(2)</enum><text>in section 705, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id216AEB2DF5644A46876C31056DAE10C6"><subsection id="id6577DE21628D4CA4B2A40D065922DA08"><enum>(c)</enum><header>Implementation</header><text>In carrying out the repeal made by subsection (a), or any regulations promulgated under such repeal, the Secretary of Education may waive the application of—</text><paragraph id="id02A2710403C24FE6ACE881596B721E6E"><enum>(1)</enum><text>subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>);</text></paragraph><paragraph id="id71A69DD3231446DAA5F2B1B87AE07BE4"><enum>(2)</enum><text>the master calendar requirements under section 482 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1089">20 U.S.C. 1089</external-xref>);</text></paragraph><paragraph id="id9A805E1EAD934C628E6D8833820EBC0B"><enum>(3)</enum><text>negotiated rulemaking under section 492 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1098a">20 U.S.C. 1098a</external-xref>); and</text></paragraph><paragraph id="id73BA54147B8B4717A49AF67752009E27" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>the requirement to publish the notices related to the system of records of the agency before implementation required under paragraphs (4) and (11) of section 552a(e) of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>), except that the notices shall be published not later than 180 days after the date of implementation of the repeal, as determined in accordance with subsection (b).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id99192FB3DDC641899B44E266BE8A75E3"><enum>(b)</enum><header>Technical amendment to cost of attendance</header><paragraph display-inline="no-display-inline" commented="no" id="idEB27E68D0E454434891B8A460503C5E3"><enum>(1)</enum><header>In general</header><text>Section 472(a)(13) of the Higher Education Act of 1965, as amended by section 702(b) of the FAFSA Simplification Act (title VII of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), is amended by inserting <quote>, or the average cost of any such fee or premium, as applicable</quote> after <quote>on such loan</quote>. </text></paragraph><paragraph id="id6438b2c30b8c49afbe938065983fabb7"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect as if included in section 702 of the FAFSA Simplification Act (title VII of division FF of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) and subject to the effective date of section 701(b) of such Act. </text></paragraph></subsection></section></legis-body></bill>
