which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Energy to establish an electric grid resilience grant program and an electric grid resilience research and development program. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Outages With Enhanced Resilience and Operations Nationwide Act of 2021</short-title></quote> or the <quote><short-title>POWER ON Act of 2021</short-title></quote>.</text></section><section id="id9DFCEBBB1B4A455593FD79815602C9B3"><enum>2.</enum><header>Electric grid resilience grants</header><subsection id="id4C5CB3C9AC3E4E59A6631E61EC1113EE"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idbfca7665073b4c10a94743c8c21397e8"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id60DD1CBBC8404030A5A388ACEF9A463D"><enum>(A)</enum><text>an electric grid operator;</text></subparagraph><subparagraph id="id9397936B78054745925E99B253379E11"><enum>(B)</enum><text>an electricity generator;</text></subparagraph><subparagraph id="id5D3869EA06994787A45B4CEADF1A09F4"><enum>(C)</enum><text>a transmission owner or operator;</text></subparagraph><subparagraph id="id8608F6FEC6794D8E9B2C9F49EE5953BF"><enum>(D)</enum><text>a distribution provider;</text></subparagraph><subparagraph id="id3D06759B1779493AACFC428C5D4C24CE"><enum>(E)</enum><text>a fuel supplier; and</text></subparagraph><subparagraph id="id62BFFB2E7F5A435799B2DDEBBF95ADEB"><enum>(F)</enum><text>any other relevant entity, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id109288e800b94050b3144b2db28d73fe"><enum>(2)</enum><header>Extreme weather</header><subparagraph id="idE30A945592564AE9B15BE5D3FDE5D30C"><enum>(A)</enum><header>In general</header><text>The term <term>extreme weather</term> means a weather phenomenon that—</text><clause id="idC60B20BAA3984995B6900D49056ADB17"><enum>(i)</enum><text>occurs outside of the historical frequency prior to 1990; or</text></clause><clause id="idD3A4CA231E6642449AFDF0B6921319DD"><enum>(ii)</enum><text>is unexpected, unusual, severe, or unseasonal.</text></clause></subparagraph><subparagraph id="idA9F70FAD9AD549C9808FFB1355A2D82F"><enum>(B)</enum><header>Inclusions</header><text>The term <term>extreme weather</term> includes—</text><clause id="id38162DB9681B42F28D41ABF10577A2CE"><enum>(i)</enum><text>a tornado;</text></clause><clause id="id494E34576E4041BFA633A4C4233445B3"><enum>(ii)</enum><text>a thunderstorm;</text></clause><clause id="id2215BEA8A36E4A4D984442D7F7E7D9E0"><enum>(iii)</enum><text>an ice storm;</text></clause><clause id="idE4F2238F5A334EC5932031879D581D8D"><enum>(iv)</enum><text>a heat wave;</text></clause><clause id="id0028A69D4EE745898D9CC605DDECAF20"><enum>(v)</enum><text>flooding; </text></clause><clause id="id2766737774F5489B87613AD93EBC54C2"><enum>(vi)</enum><text>drought;</text></clause><clause id="idE238DF5865054049A5847828418EB4C8"><enum>(vii)</enum><text>high winds; and</text></clause><clause id="id9703CFD945C34225B60BAB8F326DE8C2"><enum>(viii)</enum><text>mudslides.</text></clause></subparagraph></paragraph><paragraph id="ID569E39A7AE294A8BB8194A9568303F9E"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id920D00B5BD984DC09C244527EDD23EC7" commented="no"><enum>(4)</enum><header>Resilience event</header><text>The term <term>resilience event</term> means an event in which, due to extreme weather, a wildfire, or any other natural disaster, operations of the electric grid are disrupted, preventively shut off, or cannot operate safely.</text></paragraph><paragraph id="idEA750685E5EA4DD0AEEAA378A1B40C99"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="id598E1E5AE53D49B7AA1F635161456104"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="id07A9A708AD234C8CAF9DF2B3DA442628"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="id5275DBB90D0B45BD8B28AEC48BA743C5"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph id="id9681D7C601994496BBA7D55D518BFD8D"><enum>(C)</enum><text>any territory of the United States.</text></subparagraph></paragraph></subsection><subsection id="id433878a3b6da4918b69a762af1ab4e8e"><enum>(b)</enum><header>Establishment</header><paragraph id="idC2662F3C44B84482A7B6D8F90A219813"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish an electric grid resilience program under which the Secretary shall provide grants to States and Indian Tribes to award grants to eligible entities to carry out projects that enhance the physical resilience of the electric grid.</text></paragraph><paragraph id="idfabb014b6d984810bc2e4ee39ef20901"><enum>(2)</enum><header>Annual application</header><subparagraph id="id606AE092224F48F6978712A85B7A5A79"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant under this subsection for a fiscal year, a State or Indian Tribe shall submit to the Secretary an application for that fiscal year that describes the criteria and methods that will be used by the State or Indian Tribe to award electric grid resilience grants to eligible entities.</text></subparagraph><subparagraph id="id1429236F88E045AC93D148C61B82E55A"><enum>(B)</enum><header>Requirement</header><text>The Secretary shall use amounts appropriated under subsection (f) for a fiscal year to provide grants under this subsection only to States and Indian Tribes that have submitted an application under subparagraph (A) for that fiscal year. </text></subparagraph></paragraph><paragraph id="id931854C9123C42D09BC293E455C917D6"><enum>(3)</enum><header>Distribution of funds</header><subparagraph id="idE5113D97317040B08C421B68C81C1B73"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide grants to States and Indian Tribes under this subsection based on a formula determined by the Secretary, in accordance with subparagraph (B).</text></subparagraph><subparagraph id="id57E44A910D9D4BE4A7236AF295E09E3C"><enum>(B)</enum><header>Requirement</header><text>The formula referred to in subparagraph (A) shall be based on the following factors:</text><clause id="id74B673CE130F4558A1A72052DDF01D1D"><enum>(i)</enum><text>The total population of the State or Indian Tribe.</text></clause><clause id="idB6B71A3C363B4E91852F922004A572F4"><enum>(ii)</enum><text>The probability of resilience events in the State or on the land of the Indian Tribe during the previous 10 years, as determined based on the number of federally declared disasters or emergencies in the State or on the land of the Indian Tribe, as applicable, including—</text><subclause id="id1CC4887C81BF48B58EEE67BC7A11F91D"><enum>(I)</enum><text>disasters for which Fire Management Assistance Grants are provided under section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>);</text></subclause><subclause id="id1A42528E5BA0484A9BB0DBA442A5D261"><enum>(II)</enum><text>major disasters declared by the President under section 401 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>);</text></subclause><subclause id="idD82DA0CB7F9B4A0AA4F25A87C91609CC"><enum>(III)</enum><text>emergencies declared by the President under section 501 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>); and</text></subclause><subclause id="idD310BB61232649E596A18ED7CADAB93E"><enum>(IV)</enum><text>any other federally declared disaster or emergency in the State or on the land of the Indian Tribe.</text></subclause></clause><clause id="idAE079181FF3245ADA68328F55E80C00B"><enum>(iii)</enum><text>The number and severity, measured by population and economic impacts, of resilience events experienced by the State or Indian Tribe on or after January 1, 2011.</text></clause><clause id="id7F1A703C071A47068B1A2B123145B84E" commented="no"><enum>(iv)</enum><text>The total amount, on a per capita basis, of public and private expenditures during the previous 10 years to carry out mitigation efforts to reduce the likelihood and consequences of resilience events in the State or on the land of the Indian Tribe, with States or Indian Tribes with higher per capita expenditures receiving additional weight or consideration as compared to States or Indian Tribes with lower per capita expenditures.</text></clause></subparagraph></paragraph><paragraph id="id28a67305c9134da492220148e3c85fd1"><enum>(4)</enum><header>Annual update of data used in distribution of funds</header><text>Beginning 1 year after the date of enactment of this Act, the Secretary shall annually update—</text><subparagraph id="id9C2584C3E4F94635BF0E33030AB82B76"><enum>(A)</enum><text>all data relating to the factors described in paragraph (3)(B); and </text></subparagraph><subparagraph id="id0A6C01398BDE429BAE351B398E035AE9"><enum>(B)</enum><text>all other data used in distributing grants to States and Indian Tribes under this subsection.</text></subparagraph></paragraph><paragraph id="id7547F6E1E01C40DC9ECC79A1DA19BC42"><enum>(5)</enum><header>Matching funds</header><text>A State or Indian Tribe that receives a grant under this subsection shall be required to match not less than 15 percent of the amount of the grant. </text></paragraph><paragraph id="id689120e0489340c9b08453a5391a9070"><enum>(6)</enum><header>Plan required</header><text>The Secretary shall ensure that each grant provided to a State or Indian Tribe under this subsection will—</text><subparagraph id="idf8e37eacd70d422b97c2186c1c8f8baf"><enum>(A)</enum><text>be allocated in accordance with a published State or Indian Tribe plan that—</text><clause id="idF6F30F26B5174C0DA99253A6CE75DD8D"><enum>(i)</enum><text>is adopted by the State or Indian Tribe after notice and a public hearing; and </text></clause><clause id="idF444F6A1A967460784A99278887FB69E"><enum>(ii)</enum><text>describes the proposed funding distributions and recipients of the electric grid resilience grants to be provided by the State or Indian Tribe; and</text></clause></subparagraph><subparagraph id="id7e9b7f7877254b479420d8c59daac416"><enum>(B)</enum><text>be allocated, pursuant to the applicable State or Indian Tribe plan, to eligible entities for projects within the State or on the land of the Indian Tribe, as applicable.</text></subparagraph></paragraph><paragraph id="ide8abb21f71fb48c39818390e34ab923f"><enum>(7)</enum><header>Administrative expenses</header><subparagraph id="id9a11a877b670469683e177c4c3f3f04d"><enum>(A)</enum><header>In general</header><text>Of any amounts made available to the Secretary to carry out the program established under paragraph (1) for a fiscal year, the Secretary may use not more than 10 percent for the administrative expenses of carrying out that program.</text></subparagraph><subparagraph id="id8d32a303e0dc4f829093eb700b6d44a0"><enum>(B)</enum><header>Grant amounts</header><text>Not more than 10 percent of the amount of a grant provided by the Secretary to a State or Indian Tribe under this subsection may be used for administrative expenses.</text></subparagraph></paragraph></subsection><subsection id="id5f71c4c83e1546e99d0db05d35f144c2"><enum>(c)</enum><header>Use of grants</header><paragraph id="id4915A610A79642B09FE17F7EEE3018CF"><enum>(1)</enum><header>In general</header><text>A grant awarded to an eligible entity under the electric grid resilience program established under subsection (b)(1) may be used for activities, technologies, equipment, and hardening measures to enable the electric grid to better withstand the effects of extreme weather, a wildfire, or any other natural disaster, including—</text><subparagraph id="ida8d562ec694a4f1e91b88460b24d6d10"><enum>(A)</enum><text>weatherization technologies and equipment;</text></subparagraph><subparagraph id="idb387ae5fdc26404fa7b277a4a7f144c2"><enum>(B)</enum><text>fire-resistant technologies and fire prevention systems;</text></subparagraph><subparagraph id="id81ff80487b934dbfa97b87c21424ed9b"><enum>(C)</enum><text>monitoring technologies;</text></subparagraph><subparagraph id="idb3f1770118dd4edfa3f7553734531eab"><enum>(D)</enum><text>the undergrounding of electrical equipment;</text></subparagraph><subparagraph id="id45e7956e65cd44f4b689155aaf280f73"><enum>(E)</enum><text>utility pole management;</text></subparagraph><subparagraph id="id60b37c66f1f14d33b621ac5962f25ec0"><enum>(F)</enum><text>the relocation of power lines;</text></subparagraph><subparagraph id="id9fc96560f54f4d9f8c288daf0021f8fe"><enum>(G)</enum><text>vegetation and fuel-load management;</text></subparagraph><subparagraph id="ida1e64c18153849e39a0cf58534b0ea4a"><enum>(H)</enum><text>the use or construction of distributed energy resources for enhancing system adaptive capacity during extreme weather events, including—</text><clause id="id2A97C5F4D72D4993948C932A5D7D93CB"><enum>(i)</enum><text>microgrids; and </text></clause><clause id="idCEC2EA7A47544015AF57AE201D4B496D"><enum>(ii)</enum><text>battery-storage subcomponents;</text></clause></subparagraph><subparagraph id="id46B22E2390BD42CA8F43627AB01F2128"><enum>(I)</enum><text>adaptive protection technologies; and</text></subparagraph><subparagraph id="id4f22277430ba4cdaa2405c371d52dde5"><enum>(J)</enum><text>advanced modeling technologies.</text></subparagraph></paragraph><paragraph id="id90DA7B7458214C67A2864BAA7E9C8B8B"><enum>(2)</enum><header>Prohibited uses</header><subparagraph id="id7CA7B3CC7D444F6BAABE3799E8629E8A"><enum>(A)</enum><header>In general</header><text>A grant awarded to an eligible entity under the electric grid resilience program established under subsection (b)(1) may not be used for—</text><clause id="id53705de75f79489bac14c2abe5ea1e42"><enum>(i)</enum><text>construction of a new—</text><subclause id="id9AB89E4FB15D4B8EB37F329003ACAE06"><enum>(I)</enum><text>electric generating facility; or</text></subclause><subclause id="idBAAD172CB4D942C5A062D3458013A97D"><enum>(II)</enum><text>large-scale battery-storage facility that is not used for enhancing system adaptive capacity during extreme weather events; or</text></subclause></clause><clause id="idd841050b40994b4886cbfd76e33909e3"><enum>(ii)</enum><text>cybersecurity.</text></clause></subparagraph><subparagraph commented="no" id="idA74EE7B12E1647EBACFAF2E0691F45C5"><enum>(B)</enum><header>Certain investments eligible for recovery</header><clause commented="no" id="id336DFD715759471EAFE37B6E9D1FB8D6"><enum>(i)</enum><header>In general</header><text>An eligible entity may not seek cost recovery for the portion of the cost of any system, technology, or equipment that is funded through a grant awarded under the electric grid resilience program established under subsection (b)(1).</text></clause><clause id="id56694456A1A8409D98CA86B3EE27F788" commented="no"><enum>(ii)</enum><header>Savings provision</header><text>Nothing in this subparagraph prohibits an eligible entity from recovering through traditional or incentive-based ratemaking any portion of an investment in a system, technology, or equipment that is not funded by a grant awarded under the electric grid resilience program established under subsection (b)(1).</text></clause></subparagraph></paragraph></subsection><subsection id="id0c76f5e62b154a99a605da764f3b0cbb"><enum>(d)</enum><header>Evaluation of funded projects</header><text>The Secretary shall carry out periodic evaluations of—</text><paragraph id="id7A4BE8595EE14B0D9708F6BEF271199D"><enum>(1)</enum><text>the electric grid resilience program established under subsection (b)(1); and </text></paragraph><paragraph id="id10F3BF46E0B44DD0B4F59F992B3583A8"><enum>(2)</enum><text>the projects carried out by eligible entities receiving grants under that program.</text></paragraph></subsection><subsection id="id3ed8ce76dbe9434093575e2a4179b451"><enum>(e)</enum><header>Annual report to Congress</header><paragraph id="id6B2E983C01B048CD87658DA7B21A5922"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to Congress a report describing the electric grid resilience program established under subsection (b)(1), including the results of the periodic evaluations carried out under subsection (d). </text></paragraph><paragraph id="idACE9BE637F3C43878D33CBF8C5A0AB43"><enum>(2)</enum><header>Requirements</header><text>The report under paragraph (1) shall include information and data provided by each State or Indian Tribe receiving a grant from the Secretary under subsection (b) on—</text><subparagraph id="id702b7547f91044d4af53495fc774266e"><enum>(A)</enum><text>the costs of the projects for which grants are awarded to eligible entities by States or Indian Tribes under that subsection; and</text></subparagraph><subparagraph id="id4a401bca7e78436d9db35debacec7edb"><enum>(B)</enum><text>the types of activities, technologies, equipment, and hardening measures funded by those grants. </text></subparagraph></paragraph></subsection><subsection id="id72f2a23943d54f8dab86c2aecf689626"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $100,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section><section id="iddc79ba8c682e48e4ad25444d58604ce4"><enum>3.</enum><header>Electric grid resilience research and development</header><subsection id="id00c09bbe528b46ef8cf89a2559ff4a9a"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Energy (referred to in this section as the <term>Secretary</term>) shall establish a research, development, demonstration, and commercial application program to enhance resilience and strengthen emergency response and management of the electric grid.</text></subsection><subsection id="id89593b8a34524de0b45c2b48e9e3af81"><enum>(b)</enum><header>Grants</header><text>Under the program established under subsection (a), the Secretary shall award competitive grants to eligible entities described in subsection (c) to conduct research, development, demonstration, and commercial application activities to improve the resilience of the electric grid by developing technologies and capabilities to withstand and address the current and projected impact on electric grid infrastructure of—</text><paragraph id="idA4BBA8F161C146A99F4110EEE48CD0F6"><enum>(1)</enum><text>extreme weather (as defined in section 2(a));</text></paragraph><paragraph id="idFCB06E361CE146B98E65ECA6030BC761"><enum>(2)</enum><text>wildfires; and</text></paragraph><paragraph id="id18161C5AA3D14747B05FAE717DADE76A"><enum>(3)</enum><text>other natural disasters.</text></paragraph></subsection><subsection id="ida9ad908baab34ea8abc698567359fd3a"><enum>(c)</enum><header>Eligible entities</header><text>An entity eligible to receive a grant under subsection (b) is—</text><paragraph id="id429067add23f44f08ff950afbe341a0d"><enum>(1)</enum><text>an institution of higher education, including a historically Black college or university and a minority-serving institution;</text></paragraph><paragraph id="idc186ac9b66fa4373b12db2a2207768f6"><enum>(2)</enum><text>a nonprofit organization;</text></paragraph><paragraph id="ida61087a3945b477d95787372ed7ccf14"><enum>(3)</enum><text>a National Laboratory;</text></paragraph><paragraph id="idc2d37412dd834b56aafae6f634ca7812"><enum>(4)</enum><text>a unit of State, local, or Tribal government;</text></paragraph><paragraph id="id578452d733f940d1af454a39660f1246"><enum>(5)</enum><text>an electric utility or electric cooperative;</text></paragraph><paragraph id="id6e1f0d90ac524682ada84d3a97e804c3"><enum>(6)</enum><text>a retail service provider of electricity;</text></paragraph><paragraph id="id13e3a92aa7554c5bb309a2e3c33b5c07"><enum>(7)</enum><text>a private commercial entity;</text></paragraph><paragraph id="id5ad1736bcac14d239d30b5539c582d10"><enum>(8)</enum><text>a partnership or consortium of 2 or more entities described in any of paragraphs (1) through (7); and</text></paragraph><paragraph id="id7b3a444472e84a748d0d909eb768d86b"><enum>(9)</enum><text>any other entity the Secretary determines to be appropriate.</text></paragraph></subsection></section></legis-body></bill>
